ZONING BOARD OF APPEALS MEETING -APPROVED
June 20, 2007
The meeting was called to order by Robert Anello, Chairman at 8:00 pm. The Chair noted that a
quorum was present.

Fence -

This is an application for an area variance from the Village Zoning Code to construct a
front yard fence at a single-family residence where the following variance is required:
Fence Height
Proposed fence height = 5.0 ft
Maximum fence height = 3.0-ft
Kathleen and Clifton Steurer are the owners and are representing this application
The Chair asked if the proof of mailings had been received.
Sean McCarthy responded yes.
The Chair stated that the Board had received the following:
1) application dated May 14, 2007
2) survey
3) photos of property and neighborhood
4) letter dated May 14, 2007 from applicant
5) short EAF

�Clifton Steurer stated that he wants to replace existing 5’-foot hedge with a fence that would be
of the same height. He stated that when the hedges need to be trimmed, it is dangerous with cars
passing by.
Kathleen Steurer also stated that a handicapped neighbor passes by the hedges everyday. She
stated that by removing the hedge and installing the fence, it would allow a wider path for him to
travel on.
The Chair questioned the need for the height of the fence.
Clifton Steurer stated that the existing hedge does not provide any privacy. He is also concerned
about the safety of his children.
The Chair asked for the photos of the proposed fence.
Clifton Steurer presented photos of a solid fence.
Gordon Swartz asked if other housed in the neighborhood have similar fences.
Clifton Steurer stated that many of the houses on Route 9 have similar fences.
Eliot Martone stated that this fence would be covering the front of the house. He stated that
other houses on Route 9 have similar fences but they are used for the side and rear yards.
The Chair stated that a recent application for a similar variance was denied.
The Chair reviewed the reasons for an area variance. He asked the applicant to further explain
why this variance is needed.
Kathleen Steurer stated that they have 2 small children at home. She stated that a 5-foot fence
would help keep her kids toys in the yard.
The Chair opened the public hearing.
Since there was nobody present, the Chair closed the public hearing.
The Chair asked about the fence on other parts of the property.
Kathleen Steurer stated that the side yard will have a lower fence in order for traffic to properly
maneuver around the turn.
The Chair stated that the Board would like to see what the ARB approves before granting the
requested variance. He stated that the argument for a variance is not strong.
Eliot Martone asked if the applicant would be willing to add the fence as well as keeping the
hedge.
Clifton Steurer stated that it is dangerous to maintain the existing hedges.
Eliot Martone stated that the hedge should be replaced with a hedge that grows more upward
than outward.

�Clifton Steurer stated that installing new hedges and the fence would not be financially feasible.
The Chair asked if the Board had any questions.
Gordon Swartz stated that he is not opposed to the fence. He stated that the style of the fence
should keep with the nature of other properties in the neighborhood. He stated that he would like
to see the ARB’s response before acting.
Timothy Judge stated that he added some lattice on the top of his fence to give a more
aesthetically pleasing appearance. He stated that the applicant should have a few design patterns
available for review.
The applicant requested an adjournment so that the ARB can review the application.
The Chair stated that the ARB can act on the application if they want but the Zoning Board
wants to receive feedback on this application from the ARB before deciding on the variance.

Eliot Martone made a motion to adjourn this application to the next meeting. Linda Moiron
seconded. It was unanimous (7-0).

2) Minutes from the May 2007 meeting The minutes from the May 2007 meeting were reviewed.
Diane Martello made a motion to approve the minutes as amended. Linda Moiron seconded. It
was unanimous (5-0) (Martone and Koffler abstained).
