Construct a mixed-use building-

The Chair read the public notice aloud for the record.
The Chair asked if the proof of mailings was submitted.
Sean McCarthy responded yes.
The Chair stated that if an application is denied, the applicant cannot be heard again for a 6month period if the application is substantially similar.
William Simeonfrides is the project architect and is representing this application on behalf of the
owner. He stated that the previous application required more variances. He stated that the
residential portion was reduced by 1000sf. He stated that the building was redesigned.
The Chair checked the zoning code to verify that the application can be presented to the Board
within a 6-month period. He asked the applicant to highlight the differences in the applications.
William Simeonfrides stated that the commercial area remained the same size at 1000sf. He
stated that the residential portion of the building was shifted over 2-feet. He stated that the area
near Chestnut Street is now open and undeveloped. He stated that the residential units were
reduced to only 1-bedroom units from the original 2-bedroom layouts. He stated that the parking

�requirements were also reduced.
The Chair stated that the new application shows that the application was altered. He stated that
although the application has been modified, the new application does not appear to be
substantially different from the previously rejected application. He noted that the substantial
wall fronting the street. He stated that the public is being inconvenienced because they have to
keep coming out every time the applicant makes a change.
Timothy Judge stated that the application does not have enough information to make a decision.
Jennifer Lobato-Church stated that she does not want to open the public hearing because the application
does not seem to be substantially different from the previously rejected application.
William Simeonfrides stated that the new application does not resemble the previous application.
Michael Wernick stated that the public should have the enough time to review the application again. He
stated that the 6-month timeframe should stand.
The Chair stated that pursuant to §62-47 of the Village Zoning code, the application is
substantially similar to the previously denied application. He asked the Village Attorney if the
Boards refusal to hear the application restarts the 6-month timeframe.
Janet Gandolfo responded no. She said that the applicant was denied in January 2011 and can
reapply in July 2011.
The Chair made a motion to determine that the application is substantially similar to the
previously denied application. Jennifer Lobato-Church seconded. It was unanimous (5-0).

2) Minutes for June 2010, February 2011 and March 2011 The minutes for the June 2010 meeting will be reviewed at the next meeting.

The February 2011 minutes were reviewed.
The Chair made a motion to approve the February 2011 minutes as amended. Timothy Judge seconded.
It was unanimous (5-0).

The March 2011 minutes were reviewed.
The Chair made a motion to approve the March 2011 minutes as submitted. Timothy Judge seconded.
It was unanimous (5-0).
