ZONING BOARD OF APPEALS MEETING - APPROVED
July 20, 2011
The meeting was called to order by Peter Koffler, Chairman at 8:02 pm. The Chair noted that a quorum
was present.

Announcements:

Sean McCarthy stated that the applicant has requested an adjournment to the September 2011
meeting.

2) M/M Araujo - Luigi Rogliano

The Chair read the public notice aloud for the record.
The Chair asked if the proof of public notice was received.
Sean McCarthy responded yes.
Luigi Rogliano is the contract vendee and is representing this application.
Luigi Rogliano stated that the application is for a parking variance. He stated that this
application was previously approved 2 years ago but the owners were not financially able to start

�the project. He stated that this application is only seeking to reinstate the same approval without
any deviations.
Sean McCarthy stated that this building was destroyed by a fire and the use was grandfathered.
The Chair asked the applicant to describe the proposed building.
Luigi Rogliano responded that there will be a commercial business on the 1st floor and two
residential units above as indicated in the approved plans.
M. Gorete Crowe asked if anything can be built behind the property.
Sean McCarthy stated that there can be 5 parking spaces built but the applicant has allowed the area to
be open as an easement for access to adjacent properties.
Luigi Rogliano stated that none of the other businesses on Beekman Ave have parking.
The Chair stated that nothing can be built on the property that can provide the required parking.
Luigi Rogliano stated that at a time in the future when the adjacent properties are developed,
some parking can be provided in the rear of the property.
The Chair opened the public hearing.
Angelo Guzzo stated that there was never a 3-story building on the site. He stated that his
building was totally renovated and if there is a parking area near his property, his property would
smell the automotive exhaust.
Since there were no further public comments, the Chair made a motion to close the public hearing. M.
Gorete Crowe seconded. It was unanimous (4-0).
Luigi Rogliano stated that the future parking plan is something that the Village is requesting. He
stated that there is no current plan to put parking in the rear of the property.
The Chair stated that the lot needs to be developed but the variance is substantial. He stated that
he would like to see the site plan as well as the approved minutes of the meeting when the
original application was approved. He made a motion to adjourn the application until this
information is provided. Michael Wernick seconded. It was unanimous (4-0).

3) Sean Flatley

The Chair read the public notice aloud for the record.
The Chair asked if the proof of public notice was received.
Sean McCarthy responded yes.
Sean Flatley is the owner and is representing this application.

Covered wood deck -

�The Chair stated that the Board has received the following:
1) Application dated June 13, 2011
2) survey dated June 13, 2011
Sean Flatley stated that he is the new owner of the property. He stated that the existing deck is
non-conforming. He stated that he wants to remove the 2-story deck and replace it with a more
functional deck that will extend out to the rear property line.
The Chair asked if the existing deck is usable.
Sean Flatley stated that he is a carpenter. He stated that the existing deck is unsafe. He stated
that the posts are rotted and the footings are incorrect.
The Chair asked if the new deck would have the same elevation.
Sean Flatley responded yes.
Sherry Bishko asked if there are stairs on the existing deck.
Sean Flatley responded yes.
The Chair asked what is on the rear property line.
Sean Flatley responded that there is a hedge on the rear property line.
The Chair asked if the existing decks are visible from Crane Ave.
Sean Flatley responded yes.
The Chair opened the public hearing.
Since there were no public comments, the Chair closed the public hearing.
M. Gorete Crowe stated that there is no rear yard on the property.
Sean Flatley responded that it is steep but there is about 25-feet to the rear property line. He
stated that underneath the new deck, the lawn will remain.
M. Gorete Crowe asked if the stairs will be on the outside of the deck.
Sean Flatley responded yes.
The Chair asked if ARB approval is also required.
Sean McCarthy responded yes.
The Chair asked if this is the minimal space needed to make the deck functional.
Sean Flatley responded yes.
The Chair made a motion to approve the variance as requested. He stated that the application is
for the minimal variance possible to meet the needs of the applicant. He also stated that it is not
detrimental to the neighborhood. Michael Wernick seconded. It was unanimous (4-0).

�4) Other a) Moon River Grill - Bob Ronan spoke to the Board regarding his one-year probation. He
requested that the probation be lifted.
The Chair asked when the applicant opened their doors.
Bob Ronan responded that the variance was approved in July 2010 but he opened for business on
December 14, 2010.
The Chair stated that an application needs to be filed so that the public can be noticed and can
attend. He stated that it is part of the process.

5) Minutes for June 2011 The minutes for the June 2011 meeting were reviewed.
The Chair made a motion to approve the June 2011 minutes as amended. Michael Wernick seconded. It
was unanimous (4-0).
