ZONING BOARD OF APPEALS MEETING
November 16, 2011
The meeting was called to order by Timothy Judge , Acting Chairman at 8:15 pm. The Chair noted that
a quorum was present.

This is a continuation from previous meetings.
William Simeonfrides is the project architect and is representing this application on behalf of the

William Simeonfrides reviewed the recent revisions to the plans. He stated that the commercial
office space was reduced by 280sf. He stated that the reduction in commercial space will result
in a reduction in one parking space. He stated that the turret was reduced in height by 3 feet. He
also stated that the laundry area was eliminated and the residential apartment entrance was also
changed. Lastly, he stated that the size of the covered parking area was also increased.
Sean McCarthy stated that it would not be feasible to have trucks on Valley Street back into the
property.

�William Simeonfrides also stated that there is another parking space on Valley Street that is not
being used.
Sean McCarthy responded that it is used for a pick-up/drop-off for the daycare. He stated that it
could be used for both the daycare and the loading space for the commercial space.
The Chair asked if any action by the Board of Trustees is required to make the parking space
used for both the daycare and loading zone.
Janet Gandolfo responded that the Board of Trustees would have to review and approve of the
loading space use change.
The Chair stated that the Board could make the variance conditional on the commercial uses that
can occupy the commercial space in order to limit the use of the loading zone area.
Jennifer Lobato-Church asked for clarification regarding the possibility that the owner will not occupy
the commercial space.
William Simeonfrides responded that the owner will probably move into the space. He stated that the
property must be a mixed-use building so if the building is only a residential building, the applicant
would need a variance for lot size instead of as a mixed-use property only needing a loading zone

The Chair opened the public hearing.
Jose Chevere (70 Depeyster St.) stated that the architect has worked hard making a lot of
changes but he is still opposed to the turret. He stated that the turret would be an eyesore in front
of his home. He also stated that this will impact the ability to sell his home.
Since there were no further public comments, the Chair closed the public hearing.
Michael Wernick stated that he likes the changes that the architect has made.
M. Gorete Crowe responded that the architect has made many improvements. She stated that the
application looks more like a home instead of just a building.
Jennifer Lobato-Church stated that the concerns of the Board are not being heard. She stated that
many suggestions were made but most of them were ignored.
The Chair stated that the application would not be an undesirable change to the neighborhood.
He stated that it is a commercial zone and the property is a mixed-use building. He stated that
this is not a self-created hardship. He stated that the requested variances are not substantial. He
made a motion to approve the application as submitted with the condition that the commercial
use be limited to a low traffic office use so that the traffic impacts for the commercial tenant is
very limited. There will be no service orientated tenants, retail tenants or high traffic uses.
Janet Gandolfo stated that she will research the correct verbiage to insert into the approval.
