Caroline Hargeaves represented herself. The Project is to install an open deck. Ms. Hargeaves said that the deck will improve use of the back yard and create better access. The project is in keeping with the neighborhood and drainage has been addressed. Sean McCarthy said that the reason a variance is required is because the house is nonconforming and that the deck would normally not need a variance. �Motion to open the public comments: Moved: Judge Seconded: Brown Absent: Peter Koffler, Michael Wernick, Sherry Bishko Vote: 4-0 There were no comments Motion to close the public comments: Moved: Judge Seconded: Church Absent: Peter Koffler, Michael Wernick, Sherry Bishko Vote: 4-0 Acting Chairman Judge said that the project is in keeping with the neighborhood, that the variance would otherwise not be required if not for the non-conforming house, that it is a Type II action under SEQRA and that it will have no adverse affect on the neighborhood. For these reasons, Mr. Judge recommended approving the variance. Motion to approve the variance: Moved: Judge Seconded: Church Absent: Peter Koffler, Michael Wernick, Sherry Bishko Vote: 4-0 APPROVED 2) James Thornton, 54 Hudson Street, Public Hearing for a New Two-Family Residence Acting Chairman Judge read the public hearing notice into the record and stated that the Board had received the following documents: • Variance Application • Zoning Compliance Application • EAF Short Form • Site Plan • Floor/Area Ratio Calculation • Drawings Acting Chairman Judge confirmed with Mr. McCarthy that the returns were received. James Thornton represented himself. A previous variance was approved for this project, but there are additional modifications. The neighbor's comments were taken into consideration. The new design is similar to other houses in the neighborhood, but the floor /area ratio is too large requiring a variance. Mr. Thornton said that the house requires only a small variance. Mr. Judge asked if the footprint had changed. The applicant responded no. He said that the parking solution is a good one and that the design will enhance the neighborhood. The variance is diminutive and the project is a type II action under SEQRA.
