January 15, 2020
Chairman Timothy Judge called the meeting to order at 8:04 pm.

Chairman Judge stated that the application submitted by Carlos Rodrigues for 54 Pocantico
Street will not be heard because the public notices were not mailed to the neighboring property
owners. The application will be heard at the February meeting.

Chairman Judge read the public notice and listed the documents submitted by the applicant.
Chairman Judge asked Pamela Kroll to confirm that all of the mailing receipts have been
received.
Pamela Kroll stated that all of the mailing receipts have been received.
Chairman Judge invited the applicant to present the application.
Vladimir Levin, RA is the architect representing the applicant. Mr. Levin stated that they are
requesting approval for front and side yard variances to construct a second story addition over
the existing first floor and construct a new gable roof over the existing second floor. The
purpose of the proposed addition is to create additional bedrooms for the family. The purpose of
the new roof over the existing second floor is to create additional attic space for mechanical
equipment and the minimal standing height. Mr. Levin stated that the proposed addition is not

�out of character with the neighborhood and the scale and footprint of the property is proportional
to surrounding houses that also have existing non-conforming front and side yards. Mr. Levin
stated that although the massing of the house will increase, the perceived height from the street
elevation does not increase since the proposed roof will maintain the same ridge height of the
existing roof. The proposed gable roof will increase the height by five inches. Mr. Levin stated
that there is no other feasible way to accomplish the benefit sought by the applicant. Mr. Levin
stated that the requested variances are numerically substantial due to the existing nonconforming conditions of the building. The proposed addition will not increase the footprint of
the building and will not increase the existing side or front yard set-backs. There will not be any
environmental impacts to the neighborhood because the proposed addition will not create
additional impervious surfaces or additional stormwater discharge. The owner did not create the
existing conditions.
Craig Lis asked how many bedrooms currently exist.
Vladimir Levin stated that there are four existing bedrooms. The existing house configuration is
set up as two separate dwelling units and not code compliant for bedroom accessibility. A
renovation is proposed to correct the existing dwelling configuration.
Craig Lis requested an explanation of the existing front yard set-back and the proposed front
yard set-back.
Vladimir Levin stated that the survey shows that the existing front porch is slightly over the
property line. The only proposed change to the porch is to add a new metal panel standing seam
roof above it. The proposed front yard set-back of 4.1 feet refers to the set-back from the
property line to the existing first floor of the house where the second story addition is proposed
to be constructed directly above it.
Chairman Judge solicited additional comments from the Board.
There were no additional comments from the Board.

Motion was made by Chairman Judge to approve the area variances as requested based on the
following criteria:
1. The alleged difficulty is not a self-created hardship due to the existing non-conformities
of the building.

Granting of the area variances will not produce an undesirable change in the character of
the neighborhood or a detriment to the nearby properties as most of the neighboring
properties are non-conforming to the Zoning Code and are very close to the street.

3. Granting of the area variances is the most reasonable way for the Applicant to achieve the
benefits sought and the feasible way to expand the number of bedrooms.
4. The proposed variances are not substantial due to the pre-existing non-conformities of the
building.
5. The proposed variances will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood as the stormwater discharge will be handled
on site.
Chairman Judge stated that the application meets the requirements for a Type II action under
SEQRA 617.5.
