Resolution of the Board of Trustees of the Village of
Sleepy Hollow to Adopt of Home Rule Request
WHEREAS, the Board of Trustees of the Village of Sleepy Hollow adopted a resolution
on April 11, 2011 supporting the concept of the adoption of state legislation to impose a
room "occupancy tax" on persons occupying any hotel or motel for hire in the Village;
and
WHEREAS, the April 11, 2011 resolution supported such a room "occupancy tax" in all
Villages in the Town of Greenburgh as well as the unincorporated portion of the Town
of Greenburgh and the Village of Sleepy Hollow; and
WHEREAS, the Board of Trustees adopted a second Home Rule Request on June 14,
2013 in response to proposed legislation to permit, at local option, the imposition of a
room "occupancy tax" for hotels and motels in the Town of Greenburgh, the six Villages
in the Town and the Village of Sleepy Hollow
WHEREAS, the Board of Trustees adopted a third Home Rule Request on April 12,
2016 in response to proposed legislation to permit, at local option, the imposition of a
room "occupancy tax" for hotels and motels in the Town of Greenburgh, the six Villages
in the Town and the Village of Sleepy Hollow
WHEREAS, the Village has been made aware that there is new Hotel Occupancy Tax
legislation that will be coming to the floor of the Assembly (A9469) and Senate (S8413)
for consideration; and
WHEREAS, the Village of Sleepy Hollow is supportive of the adoption of Hotel
Occupancy Tax legislation entitled, "An Act to amend the tax law, in relation to
authorizing the town of Greenburgh to adopt a local law to impose a hotel/motel
occupancy tax for hotels not located in a village; authorizing specified villages in the
towns of Greenburgh and Mount Pleasant to adopt local laws to impose a hotel/motel
occupancy tax in such villages; and providing for the repeal of such provisions upon
expiration thereof"; and
WHEREAS, since the Village does not have the authority to enact such legislation by
local law, the Village must request that the State act on the matter through the
adoption of a Home Rule Request; and

�WHEREAS, the Home Rule Request states in the portion of the document marked
"Explanation" the following:
During these difficult economic times, municipalities need additional non-property tax
sources of revenue to fund basic services to keep their communities safe and properly
serviced. This legislation will assist the Town of Greenburgh and its Villages and the
Village of Sleepy Hollow in the Town of Mount Pleasant to fund necessary services.
NOW THEREFORE, BE IT RESOLVED that the Board of Trustees of the Village of
Sleepy Hollow does hereby adopt a Home Rule Request asking the state legislature to
adopt Assembly Bill No. A9469 and Senate Bill No. S8413 entitled "AN ACT to amend
chapter 504 of the laws of 2016, amending the tax law relating to authorizing the town
of Greenburgh to adopt a local law to impose a hotel/motel occupancy tax for hotels
not located in a village; authorizing specified villages in the towns of Greenburgh and
Mount Pleasant to adopt local laws to impose a hotel/motel occupancy tax in such
villages, in relation to extending the effectiveness thereof

Approving the Annual Memorial Day Parade
Be It Resolved that the Mayor and Board of Trustees of the Village3 of Sleepy Hollow
hereby allows the Central Veterans Committee of the Tarrytown's to hold its Annual
Memorial Day Parade on Monday, May 30, 2022 beginning promptly at 9:00 AM on Main
Street in Tarrytown.
The route will head north on Broadway to Beekman Ave, West to South Washington St,
then South on South Washington St. to Patriot's Park, where services will be conducted
at the WW II Monuments.
Be It Further Resolved the Board of Trustees directs the Chief of Police to coordinate
the public safety issues with the applicant(s), if necessary.

Authorizing Mayor to sign IMA with the Villages of Elmsford,
Dobbs Ferry, and Irvington for Pot Hole Killer Machine
Be it Resolved, that the Board of Trustees of the Village of Sleepy Hollow hereby
authorizes the Mayor to execute the attached Inter-Municipal Agreement with the villages
of Elmsford, Dobbs Ferry, Irvington to lease a Pot Hole Killer Machine from Patch
Management Inc. at a cost not to exceed $10,000.

Proposal for 2021 Snrav Patching
Dear Mr. Mills,
Below is the quote you requested for spray patching services at the villages of Sleepy Hollow,
Irvington, Dobbs Ferry and Elmsford.
Scope of services:
PMI will supply one PK2000 specialized spray injection patcher truck(s) with skilled operators and
the specified materials to perform spray injection repairs as directed by your designated
representatives from the villages. The work schedule will begin at the time you specify and will
consist of our providing and placing a total of 6 tons of aggregate per day with corresponding
emulsion on consecutive weekdays, weather permitting. Weekend work is an option only at the
mutual agreement between Patch Management, Inc. and the villages.
The effective billable rate for this job is $5,000.00 per 6-ton truck day. A , "6-ton truck day" is
defined as 6 tons of material placed, or 8 hours, whichever comes first
Our rates have increased due to federal and state regulations that require us to have an apprentice
program and pay prevailing wage, as well as insurance costs which have skyrocketed, increasing
fuel prices, material prices and the need to be competitive in the CDL field, causing driver pay to
increase.
Equipment:
One PK2000 Pothole Killer truck. (Due to scheduling logistics PMI may offer additional truck(s)
to complete this placement in a more efficient manner at mutual consent between the Villages and
Patch Management, Inc.)
The patcher will be equipped with patch on the fly, providing the capability to perform linear
patching while moving in a forward direction, the patcher will be equipped with a directional arrow
board mounted on the rear of the patcher capable of providing a visual warning to pedestrians and
approaching vehicles.

Warranty
Patch Management Inc. will warranty our work against failure for a period of ninety (90) days from
the date of the application. When PMI has been notified of a possible failure the repair will be
reviewed by a PMI representative to confirm the repair has failed or if the issue is the surrounding
area adjacent to the repair which has failed. When PMI has evaluated and determined that the
threshold 10% of the work performed has failed, PMI will schedule to return and perform the
necessary repairs at no additional cost to the State.
Customer Responsibilities:
Your responsibilities will be to provide all traffic control that is required beyond our arrow board
if needed, a hard and clean surface to place a stone supply of approximately 25 tons per delivery
and a loader on site to load the materials as required for restocking the patcher. Furthermore, you
agree to provide a secure location for the patcher to be parked at the end of the day's operation
which has available for use each evening a 120-volt electrical access necessary to heat the emulsion
tank. Patch Management may request the space be allotted to store a small emulsion trailer on site
to support the operation if necessary.
Cost structure: Contract services:
Our cost to mobilize the equipment, with a skilled operator with the identified materials to support
the stated work period will be charged at a flat rate of $35,000.00 for 42 tons of patching in the
Villages. This provides 2 days (12 tons) of patching per village at $10,000 per village for Sleepy
Hollow, Dobbs Ferry, and Irvington. It also provides 1 day (6 tons) o f patching for Elmsford at
$5,000.00. for the day.
If you agree with this proposal and our approach, please have an authorized representative execute
and fax this page back to Patch Management, Inc. at 215 949-3166 and we will prepare a delivery
schedule for your review and approval. This proposal is valid for thirty (30) days from the date of
this proposal.
Prevailing Wage:
This job is subject to prevailing wage and the proposal amount was calculated based on the wage
rate for Teamster - Heavy Highway Group A A for Westchester County. When the N Y Department
of Labor notifies you of the actual amount to be paid per hour to our operators, please inform me
of that rate and title.
