                  <text>The Board of Trustees of the Village of Sleepy Hollow held a meeting on Tuesday, March 8,
2022 at Village Hall, 28 Beekman Avenue, Sleepy Hollow, New York.
Present:

At 7:00 p.m. Mayor Wray called the meeting to order with a pledge to the flag and a moment
of silence for residents; Lenora DeCamp, 94 years old of Kendal Way, Willie Solomon, 85
years old of Tarrytown and beloved father of our Crossing Guard Judy Solomon, Michelle
Warren 61 years old of Valley Street. Our thoughts are with his family and friends.
Mayor Wray called the Board of Assessment Review to order at 7:02 p.m. The Board
acknowledge the tax grievances that were received. At 7:03 p.m., Mayor Wray adjourned
the Board of Assessment Review and thanked Assessor Edye McCarthy for all her hard work.
Public Hearings
Clerk McCarthy read the following public hearing announcements:
1) Lighthouse Landing Affordable Housing
2) Zoning Amendment Changes to Local Law #3, 2021
Mayor Wray opened the both Public Hearings.
Frank Occhipinti addressed the Mayor and the Board of Trustees and stated that
the adoption of the previous Zoning adoption was a bad error.
Brad Schwartz, attorney representing Maria Martins of 11 Kendal Ave, addressed the Mayor
and the Board of Trustees regarding the current Zoning hearing. (See attached)
Anne White of Kendal Way, addressed the Mayor and the Board of Trustees and disagrees
with the proposed repeal of Local Law #3, 2021.

�Pat Munroe of New Broadway, addressed the Mayor and the Board of Trustees and
disagrees with the proposed repeal of Local Law #3, 2021.
Kimbra Denny of Tuckahoe, NY, addressed the Mayor and the Board of Trustees and
stated that she is interested in applying for the affordable housing being built at Edge on
Hudson, and wants to know what the guidelines will be and stated she’s been waiting for a
while.
A resident of Howard St. addressed the Mayor and the Board of Trustee and asked about
housing for other than village employees or volunteers.
Mayor Wray stated that the 61 housing units would be filled with people who qualify, before
others can apply, such as volunteers, those who work in the village and seniors citizens.
Discussion ensued regarding guidelines for the Affordable Housing applicants.
Maria Martins of Kendall Avenue, addressed the Mayor and the Board of Trustees and
asked to not repeal Local Law#3, 2021.
Lauren Connell, a current candidate for Trustee, addressed the Mayor and the Board of
Trustees and stated the potential procedural defect of repealing the current Local Law
recently adopted, and replacing it with the old Local Law is inefficient, a waste of everyone’s
time and work and suggested moving forward instead.
Mayor Wray stated that Section 450-94 of the Village Code outlines procedures that must be
followed. Mayor Wray stated that this procedural error might become a potential problem in
the future if it is not corrected now.
Trustee Gonzalez agrees with Lauren’s suggestion and stated he disagrees with repealing of
Local Law #3, 2021.
Discussion ensued with Village Attorney, Josh Subin.
Kimbra Denny of Tuckahoe, NY, addressed the Mayor and the Board of Trustees again and
asked if working in the Village would qualify an individual to apply for the Affordable Housing.
Mayor stated that an individual working in the Village would qualify.
Trustee Andruss moved to close the public hearing on the Affordable Housing, Trustee Spiro
seconded. Motion carried.
Mayor Wray adjourned the Zoning Amendment public hearing until Tuesday, March 15th for
additional comments.

�Trustee Rodriguez asked to address the Mayor and the Board of Trustees and made the
following statement: He stated that he was asked by Trustee Spiro and Mayor Wray to join
the Committee for the Zoning Amendments, which included Trustee Spiro, Building
Department Inspector Sean McCarthy, a member of the Planning Board and members of the
Community. He joined in February 2021 before the amendments were adopted in August
2021 and at the time, he joined the Committee he was not yet elected to his position of
Trustee.
He stated that the downtown amendments from August 2021 were specifically requested by
the community and these requests are indicated in the Sleepy Hollow Comprehensive Plan,
and a letter from Norma Drummond of the County’s Planning Board, suggested not to repeal
Local Law #3, 2021 and to preserve the best practice elements of the code. In summer
2021, the Village’s Planning Board also provided redlines and additions and much discussion
prior to the adoption of Local Law #3, 2021 (the "August Amendments"). He stated the
Board of Trustees and the public were enthusiastic about these amendments, and stated the
intent of the sky exposure plane rules contained in the zoning was to ensure equitable air
and light and to maintain architectural consistency and preservation of historic character
along Beekman Avenue. The rules are consistent with zoning best practices and have
precedent throughout the country - for example, NYC has a sky exposure plane rule, which
has existed since the 1920s. Should the rule be struck from the code, which seems to be the
intent of some members of the Planning Board, the original intent of the code and the
requests made by the community, and by extension the Comprehensive Plan would be
undermined.
Trustee Rodriguez asked to put a pause on all Planning and Zoning Boards approvals on
areas affected by the zoning amendments until the final amendments are made.
There were no further comments at this time.
Mayor Wray welcomed the Village auditors, Chris Kopf and Coleen Harris of PKF O’Connor
Davies who presented the audit report to the Mayor and the Board of Trustees.

Mayor Wray thanked Treasurer DiGiacomo for all her hard work.
Approval of Warrants:
On a motion made by Deputy Mayor Scaglione, seconded by Trustee Andruss the warrant
was approved and Treasurer DiGiacomo was authorized to pay bills in the amount of
$358,512.77.

Approval of Minutes:
On a motion by Deputy Mayor Scaglione, seconded by Trustee Andruss the minutes of the
February 8, 2022 meeting were approved. Motion carried.

�On a motion by Deputy Mayor Scaglione, seconded by Trustee Andruss the minutes of the
February 15, 2022 meeting were approved. Motion carried. Trustee Spiro abstained.
Mayor’s Announcement:
Mayor Wray made the following announcements/comments:
- St. Patrick’s Day Parade is Sunday, March 13th starting at 1:30 pm in Tarrytown,
heading north on Route 9, ending on Beekman Avenue.
- Village Election is on Tuesday, March 15th 6 am-9 am, and encouraged everyone to
vote!
- Reminder Daylight Savings starts this Sunday, March 13th
Public Comments:
Mayor Wray opened the meeting to the public for comments and invoked the 3 minute rule.
Patrick Munroe, addressed the Mayor and the Board of Trustees regarding a letter he sent
regarding the intersection of Route 9 and New Broadway, he demanded a response to his
letter. (Attached)
Mayor Wray stated that signs requested by Mr. Munroe have been installed and the Village is
continuing ongoing efforts to work with the DOT regarding this matter; such as doing a
traffic study at this intersection.
Patrick Munroe responded irately by asking about previous recommendations he has made
to the Board, such as hiring a crossing guard for that intersection.
Frank Occhinpinti, addressed the Mayor and the Board of Trustees and slated the Mayor
for not allowing attendees to talk for more than 3 minutes during public comments, but
allowing them to speak longer than 3 minutes during public hearings. He also stated
residents getting parking tickets in certain parts of the Village is unfair.
Patrick Munroe addressed the Mayor and the Board of Trustees again and ferociously
stated that the Mayor and Board of Trustees are not doing enough to protect pedestrians at
that intersection. He stated the DOT does not have temporary solutions.

�Old Business:
Mayor Wray mentioned that the Board has made a consensus on the request from Edge on
Hudson regarding Blocks O &amp; P.
Trustee Gonzalez stated he is not in favor and strongly objects to the recent proposal by
Edge for blocks O &amp; P. He stated they are asking for additional homes in this development
and it will eliminate the green space. Trustee Gonzalez stated going from 103 to 110 units is
not accommodating, including lack of parking, and urged the public to attend the March 17th
Planning Board meeting and to object to this proposal. He also stated the Fire Department
should weigh in on this requested proposal, in addition, Trustee Gonzalez stated that when
people live on top of each other they behave poorly, and the Board has an obligation to the
community to make sure everyone are safe.
Trustee Rodriguez stated he does not believe the current design follows the original design
intent.
Mayor Wray agreed with Trustee Rodriguez and stated it was important to address the Fire
Department safety requirements.
Trustee Spiro stated that the Planning Board should be able to assess what the
recommendations are and work with Sean McCarthy and Margie Rudick to enforce what is
necessary, once due diligence is done.
Trustee Gonzalez iterated that previous recommendations by the Fire Department were
modified but still feels that it is not a safe situation going from 103 to 110 units, and also
suggested having a third party expert, such as an urban designer advise the Board. He
believes the Board of Trustees should weigh in on the Planning Board’s decision, regarding
this matter.
Additional discussion ensued.
Mayor Wray stated for the record that parking requirements have been presented to the
Board of Trustees more than once, and that Mr. McCarthy may send it to Trustee Gonzalez
for review.
The Mayor directed the Village Clerk to advise the Planning Board that the Board of Trustees
have no objections to the revision of Block O &amp; P proposed site plan by the Planning Board.
There was no further discussion regarding Block O &amp; P at this time.
Trustee Andruss discussed a request for funding the beautification of the triangles islands
along Route 9. A sketch with types of plants to be planted was given to the Board. The
garden club will be doing most of the work. Trustee Andruss moved to fund, up to $5,000
for the purchase of plants and supplies for this project. Deputy Mayor Scaglione seconded it.
Motion carried.

�New Business:
Trustee Rodriguez thanked Mayor Wray for installing the signs at the intersections of Rt. 9
and asked to consider installing steal bollards and concrete blocks.
Trustee Rodriguez requested to put a pause on all Planning and Zoning Boards approvals on
areas affected by the zoning amendments until the final amendments are made.
Village Attorney, Josh Subin, stated that a moratorium would be required to proceed with this
request. He will send this information to the Mayor and Board of Trustees.
Treasurer DiGiacomo has a new retainer, with Harries Beach, which must be signed by the
Mayor at a future meeting.
Mayor Wray mentioned that a previous resolution was approved to hire an employee for the
building department but the candidate declined at the last minute. Building Inspector Sean
McCarthy has offered the position to another candidate and, Mayor Wray asked to have a
resolution prepared for the next work session.
Communications:
Clerk McCarthy stated she received communications from Hudson Anchor Restaurant, Wendy
Yancey, Laura Lopes, Charlene Rider, Patrick Munroe, and Norma Drummond of Westchester
County Planning Dept. All communications have been shared with the Board of Trustees.

Mayor Wray opened the meeting to the public and invoked the 3 minute rule.

Mayor Wray thanked Mr. Munroe for his concerns and stated he will discuss it with Police
Chief Bueti.
At 9:32 pm on a motion by Deputy Mayor Scaglione, seconded by Trustee Andruss the
meeting was adjourned.
