A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Janet Gandolfo Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee White moved, seconded by Trustee Cavalieri that the minutes of the meetings held on March 23, 1981, March 26, 1981 and April 6, 1981 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. Fred Gross, Chairman of the new apparatus committee of Rescue Hose Company, spoke on behalf of other members present, requested permission authorizing the committee to seek out bids and demonstrations for the replacement of their Mack apparatus. He stated that the apparatus gave good service to the Village since I960, however, during the past several months, it has begun to show the effects of its age. He stated that a letter has been submitted to the Board with supporting documents as to why it is necessary to replace the truck. Mayor Zegarelli acknowledged receipt of a copy of the letter to the Mayor and Trustees. The matter was referred to the public safety committee. Mr. Charles Biebush, 250 Palmer Avenue, requested that the Board look into the matter of commuter parking at the west end of Palmer Avenue. He stated that he wrote a letter to the Mayor about the situation and said that something should be done about it. Mr. Biebush stated that there was no ordinance permitting parking along Palmer Avenue or any other street in Philipse Manor, Signs are posted on Palmer Avenue allowing parking by Village permit, he said, however there is no ordinance. He stated that he has to sell his property, but if the parking is allowed on the street, the property will not be able to be sold. Counsel-Ponzini stated that the resolution passed was clone so with the understanding that parking would be allowed to the end of Riverside Drive into Palmer Avenue. Whether the Board wishes to keep it as a commuter parking is up to the Board, he said, The broad language allows , you to use discretion, said Counsel. The matter was referred to committee. �-2Miss Eva. Piedemonte, Chairman of the Recreation Commission, stated that the commission met Tuesday and discu'ssed the Teen Center. Since the Center has not been utilized during the last four months, itj was the recommendation of the four members present that the Center be closed, she said. Miss Piedemonte stated that the Center had two teenagers per week. On a question of Trustee Soriano as to how much the Center is^ costing us, Miss Piedemonte answered $3.50 per hour for the supervisor or $14 per week. Trustee Gandolfo stated that when the program was instituted, games, a pool table, ping pong and a TV were installed. Trustee DiFelice suggested that the Center be given a year's trij Trustee Gandolfo stated chat it would not be fair to close the Center to the people who appear at the door. She stated that she and Pat Lofaro went up to the high school to obtain the views of students and learned that they are not interested in any type of organized activity. Following a discussion, Mayor Zegarelli stated that the recommen of the commission to close the teen center will be taken under advisen REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that lights have been replaced in Cent! Headquarters meeting rooms through CDA funds. Log books for the maintenance department will be documented by the custodians. Cell bid are being painted also, said Trustee Cavalieri. The panic bar and loi for the front door has been ordered. Trustee Cavalieri stated that tile repairs or replacement is necessary in Union Hose Company and a slop sink is needed for Central Fire Headquarters. He stated that William Haggerty will no longer collect meter money and this responsibility will be transferred to the police department as was suggested in the State audit report. The ste windows at Union Hose have been installed through CDA funds and the tin broken windows at Union Hose Company have been repaired. Trustee Cavalieri stated that a meeting will be held to discuss possible expansion or alteration work of rooms for the police departmi Mayor Zegarelli stated that he is in receipt of a contract from R. Turnquist, architect; for the proposed garage and asked the Villagi Attorney to review it. It was found approved, subject to several itei Counsel Ponzini stated that the contract met all requirements um the State and local law, subject to Board approval -and bonding attorm He stated that the Treasurer will contact the bonding attorney to see there is enough money left in the bond and also to see if the bond was; okay for construction of a garage at River Street, �Trustee Cavalieri moved, seconded by Trustee White that the Mayor be authorized to sign the contract with Mr. Turnquist for the architectura construction of the Village garage. Carried. FINANCE & DEVELOPMENT Trustee Gandolfo reported a balance of $240,845.19 in the General Fund as of April 20, 1981. GOVERNMENTAL RELATIONS Trustee White reported "progress". LABOR RELATIONS Trustee Timmings stated that he has been in touch with the Chairman of the police bargaining committee and will meet with his committee. He stated that he would like to start negotiating next week. Trustee Timmings stated that the first hearing on a CSEA grievance claim for out-of-title pay against the Village was held in White Plains. Counsel Ponzini, Mike Apollonio and Trustee Soriano represented the Village. There will be follow-ups to the meeting, he said. Trustee Timmings stated that at the Village officials' meeting held in Briarcliff several weeks' ago, it was stated that consideration should be given to early retirement to people in Tier I pension system. There is a long range benefit to the taxpayers to get Tier I employees to retire and replace them with new employees in Tier III. Tier III employees would pay a portion of their pension, said Trustee Timmings. Mayor Zegarelli stated that if Trustees have any suggestions or items for inclusion in the negotiations to submit them to Trustee Timmings. PUBLIC SAFETY Trustee DiFelice moved, seconded by Trustee Gandolfo that specifications be prepared and bids be received on May 4, 1981 for the repair and maintenance of meters for the year June 1, 1981-May 31, 1982. Carried. Trustee DiFelice moved, seconded by Trustee White that specifications be prepared and bids be received on May 4, 1981 for the maintenance and repair of street lighting equipment for the year June 1, 1981 - May 31, 82. Carried. Trustee DiFelice moved, seconded by Trustee Timmings that the bid for 50 - 70 watt lucalox street light fixtures in the amount of $5679 be awarded to Garfield-Wolar, according to specifications, to be paid for through CDA funds. Trustee Gandolfo amended the resolution that the amount of money left over be placed towards the purchase of three police radios. Carried. Trustee DiFelice stated that Gus Paese sent a letter that improvements to the Pocantico River embankment have been completed in full accordance 1 with the plans and specifications. One problem is that the cemetery dam ' gave way causing a blockage in the Pocantico River which the Village / > ' • �-4had to clean at a cost of $2,000. • i Trustee DiFelice moved, seconded by Trustee Gandolfo that a bill be sent to the cemetery in the amount of $2,000 for labor and equipment I used for the cleaning of the channel in the Pocantico River. Carried. I Trustee DiFelice stated that Mr. Paese recommended the installation! of a chain link fence on top of the wall. He stated that there is a II 10-12 ft. drop. Brophy for their assistaJ on March 26th and moved that copies be placed in their folders, seconded by Trustee White. Carried. I Trustee DiFelice read a letter from James Marx, 39 Hemlock Drive, 1 complimenting Ptl. Ferguson for the efficiency in which he handled a 1 traffic jam when his car was temporarily disabled and moved that a copyl be placed in his folder, seconded by Trustee Cavalieri. Carried. Trustee DiFelice stated that the Board is in receipt of a letter from the COC complaining about the bus service of the taxi company. He stated that Chief Spota has informed him that drivers have been issued tickets for violations and some drivers had had their permits revoked. Trustee DiFelice stated that the Chief has suggested that a local law be adopted to charge a fee for pistol permit applications. Trustee DiFelice stated that construction work at route 9-448 is progressing on schedule. ^ PUBLIC WORKS Trustee Soriano reported that the department is performing its routine services to the Village. Trustee Soriano moved, seconded by Trustee Cavalieri that action ol the committee in appointing Michael Smutek Motor Equipment Operator at 1 salary of $14,712 per annum, less $500, subject to six months probation! period retroactive to April 14, 1981 be confirmed. Carried. " j ' Trustee Soriano stated that he received a letter from the Town of Mt. Pleasant that his letter for street signs was referred to Rocco Berrilli of the police and traffic committee. Trustee Soriano stated that a letter was received from Gus Paese, consulting engineer, that County Asphalt has completed the work on the gabion wall on Dell Street satisfactorily and has recommended that payment be made and so moved, seconded by Trustee Cavalieri that County Asphalt be paid the amount of $42,780 as per his bid. Carried. Trustee Soriano reported that the County Executive has asked that continued voluntary conservation of water be observed and an attempt be made to reduce consumption to 207o below that of last year. Water restrictions from the County are still in effect. The Water Department has excavated and backfilled the sanitary sewer line on Kendall Avenue, reported Trustee Soriano, The water department excavated and sealed off a drain line from the greenhouse to the wet-well of the treatment plant. I RECREATION & PARKS Trustee Gandolfo reported that Bob Lugrezia took two different age groups of boys to participate in the 51st Annual Westchester Parks and Recreation Basketball Tournament. 100 children participated in the easter egg hunt. Trustee Gandolfo reported that the department with the help of the highway department, are in the process of building the playground equipment at Barnhart Avenue park. / ( j ' j i New tennis nets ac Devries Avenue have been erected and adult tennis lessons have started, said Trustee Gandolfo. Trustee Gandolfo moved, seconded by Trustee White that the bid for grills, metal bench, etc. be awarded to Suprina's Sportsland in the amount of $3656.63. Carried. J 1 This money will be taken out of next year's budget, said Trustee Gandolfo. _!_ SENIOR CITIZENS Trustee White reported that various plans have been made by the seniors, one of which is a trip to Radio City. Senior Citizens Day will be held on May 19th at the County Center, she said. Some have already stipulated that they would donate. Mayor Zegarelli stated that the proper procedure in order to remei any misconception of your actions thus far of what you have done shouli be confirmed by the Board and letters of approach or explanation of what we want to do should go out under the Mayor's signature from the Village as a whole. He stated that he received a few calls regarding this. Mayor Zegarelli suggested that the senior citizens committee and commission draft some kind of program outlining what is required so th a letter can be sent from the board. TAX EXEMPT & ASSESSMENT Trustee Timmings - no report. MAYOR'S REPORT: Mayor Zegarelli acknowledged receipt of letters from Assemblyman P. Sullivan regarding the Taylor Law; Senator M. Goodhue regarding utility rates and Mr. Swik, Conservation Department regarding the geesi at Fremont's Pond, and a letter from Mr. Galef regarding the Croton landfill. Mayor Zegarelli stated that the meetings in June will be held on June 1st and 22nd because of the Conference of Mayors meeting. COMMUNICATIONS Communication from Frank Nichols, Sec'y. Central Veterans Committ requesting permission to hold the annual Memorial Day Parade on May 25 as well as inviting members of the Board to participate was read and Trustee Timmings moved, seconded by Trustee Gandolfo that permission bi granted and police notified of same. Communication from Sal. Cappuzzello, President of the ItalianAmerican Ind. Club, requesting permission to hold a dance on April 25tl at the Holy Cross Hall from 9 - 1 A.M. was read. Trustee Timmings moved, seconded by Trustee Gandolfo that permiss be granted, however, that they be notified of the 12 midnight deadline Carried. Communication from Mrs. M. Martello, 158-160 Cortlandt Street, requesting sidewalk repairs at her property was read and referred to t public works committee. Communication from Osvaldo Alvarez, 12 Lawrence Avenue, permission to tape the Memorial Day Parade on the balcony of Building, as well as using the electric current was read and Trustee Timmings, seconded by Trustee Gandolfo, was referred Buildings & Grounds and Public Safety Committee. Communication from Shirley Marmo, 219 Gordon Avenue, requesting repairs to her driveway when it was torn up as a result of road repaving work was read and referred to the public works committee. Communication from Daniel Matarasso, 54 Fremont Road, submitting a bill in the amount of $1200 for reimbursement for work he contracted to do to remove muck from the back of his home was read. Mr, Matarasso claims in his letter that the condition of his property was caused by the Village. The matter was referred to Counsel. Communication from Marjorie Remick, 3 Lake Shore Close, requesting the Village to investigate a violation of the building code and covenant by Mr. Matarasso as a result of his dredging work in Fremont Pond was read and referred to Counsel, The Clerk informed the Board tha^ she is in receipt of the list of delinquent water accounts totaling^«365,10 to be entered on the 1981 assessment roll. UNFINISHED BUSINESS It' Mayor Zegarelli called for a meeting on April 27th for the purpose of adopting the 1981 final budget. 'U i1 it A meeting was called for April 29th with McClean TV Cable Co. and the owner of College Arms. <v % Trustee Gandolfo suggested that the line on County House Road be repainted. • i > . i" Trustee DiFelice stated that it will be as soon as the original line is removed. The matter was referred to the public safety committee. Trustee Gandolfo stated that she would like an opinion from Counsel regarding Senior Citizens acting as Code Enforcement Officers. Trustee Cavalieri suggested that school crossing guards be utilized for this purpose. A discussion was held regarding the teen center and it was the general consensus of the Board that the center continue for a full year. Counsel Ponzini noted tax petitions from Con Edison, N.Y. Telephone Co. , and New Rochelle "Water. He stated that he is in receipt of a letter from Mr. Dempsey regarding the Strand Theater and suggested that provisions be made in the new budget towards the purchase of it pursuant to the terms of his earlier memo in a resolution of the Board on the purchase of the theater.
