May £, 1981 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Janet Gandolfo .„ Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag, Trusteee Timmings moved, seconded by Trustee White that the minutes of the meeting held on April 20th, 1981 be approved as written. Carried. Trustee Timmings moved to suspend the regular order of business to present awards to members of the North Tarrytown Ambulance Corps who responded to over 100 calls or more, seconded by Trustee White, Carried. I T Mayor Zegarelli, together with Trustee DiFelice, presented the awards after which he thanked the members on behalf of the Village and Board for their services. Mayor Zegarelli called for bids on the street lighting contract for the year commencing June 1, 1981-May 31, 1982, Treasurer Amato opened the following bid: Edward McCarthy, Andrews Lane, No. Tarrytown, N.Y, Check in the amount of $600 enclosed. $6,000. Trustee Gandolfo moved, seconded by Trustee White that the bid be referred to the public safety committee. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. Charles Biebush, 250 Palmer Avenue, inquired if his request to have the parking signs on Palmer Avenue removed has been resolved. Mayor Zegarelli stated that a resolution will be entertained to remove the"Parking by Permit" signs and replacing them with "No Parking" signs, after which Trustee Gandolfo so moved, seconded by^Trustee DiFelice Carried. Debra Lovecky, 1 Riverside Drive, inquired if anything has been done regarding parking signs foryesidents of that address H �-2Mayor Zegarelli stated that the signs have .been ordered. The matter was referred to the public safety committee. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that a new panic bar was installed at! Central Firehouse. Union Hose Company is being painted. He stated , that the schematic phase of the project is now being done on the Vil] garage. When completed, the Board will meet with the architect to finalize his work, said Trustee Cavalieri. FINANCE Sc DEVELOPMENT , Trustee Gandolfo stated that the school board approved and signe, the agreement with the Village as to where the materials removed from Fremont Pond will be deposited. She stated that the school board asfe certain requirements which were done in connection with the dredging of Fremont Pond. Trustee Gandolfo moved that the Mayor be authorized to sign the , agreement with the school district of the Tarrytown, subject to the *! approval of the whole harmless clause by property owners and financia consideration between the various parties, seconded by Trustee Soriani Carried. Trustee Gandolfo stated that a meeting has been scheduled for May 21st with people who live around the pond. Mr, Gorman is updatin the specs on the project, she said. Trustee Gandolfo reported a balance of $172,807.31 in the Genera Fund account as of May 4th. As per resolution of November 24, 1980 which allowed Ptl. Patten to change from one retirement system to another, Trustee Gandolfo mov to transfer $2,756 from Police A3120 to Employee Benefits A9010.8 to cover the cost of the bill from the N.Y.S. Policemen's Retirement Sysi seconded by Trustee DiFelice, Trustee Gandolfo noted Howard Lampert*s bill on the warrant in til amount of $2799,80 and moved that as per previous resolution of the Board that he be paid 2/3 of this bill or $1866,54, seconded by \ Trustee DiFelice, Carried. \ In a discussion with John Biros during the budget hearing, Trustj Timmings stated that in the year ending 1980, the Village cut into tinCatskill Aqueduct and took more than half of our water from the systa^ which resulted in additional extra charge causing us to pay $169 per million gallons. He suggested that the public works committee should^ investigate our purchase of 32% more water and we billed for 67„. GOVERNMENTAL RELATIONS Trustee White reported "progress". �mtmm ZL -3LABOR RELATIONS Trustee Timmings stated that a committee meeting will be held on May 6th during which a review will be made of any and all suggestions made to the Village bargaining position, after which a meeting has been scheduled with the police bargaining committee on May 13th to start negotiations. PUBLIC SAFETY Wi| Trustee DiFelice reported that the street lights which were damaged at Beekman Avenue and Pocantico St. and on Riverside Drive, opposite the railroad station were repaired and placed in service. The police department, together with Tarrytown Police Department, held a Bike Rodeo on Sunday at the Tarrytown Police parking lot. The annual Cystic Fibrosis Bike-a-thon was held in Philipse Manor. Trustee DiFelice moved, seconded by Trustee White that the Mayor be authorized to sign the contract with the SPCA in the amount of $1980 for the year 6/1/81-5/31/82. Carried, Trustee DiFelice stated that the traffic court is in receipt of a letter from the Computer Service Company regarding the processing of traffic tickets that there would be a charge for extra material sent. •'X Trustee DiFelice moved, seconded by Trustee White that the Municipal Computer Service be notified that the court is in need of one copy of the outstanding monthly report and not two, Carried. Trustee DiFelice moved, seconded by Trustee Timmings that the court be authorized to issue arrest warrants to scofflaws who received their last notice. Carried. 1*3 t. Trustee DiFelice stated that the committee is looking into a new fee schedule for alternate side parking, meters, etc. He also stated that the Village is in need of a new dog control officer, on a part-time ¥* basis, three hours per day. Trustee DiFelice reported that the committee has worked out a parking system with representatives of Con Edison's substation on Cortlandt Street on a trial basis. Trustee DiFelice stated that we are in receipt of a letter from the County of Westchester for bus stop areas and the police have been requested to review the Village for same. There will be a meeting of the Traffic and Transportation Committee to review off-street parking problems, said Trustee DiFelice. Trustee DiFelice submitted the chief's report forlthe month of April. (In detail, official minutes,) Trustee DiFelice stated that Sgt. Booth attended the mandatory Police Supervisors School at Harrison and that Ptl, Patten received his Master of Science degree in Criminal Justice from Long Island University. •r* .«>?-? - « fcfc �-4Trustee DiFelice reported that Ptlmen, Ciffone & Ferguson attend; a seminar on Juvenile Crime at Mercy College on 'April 10th. Several officers attended a Symposium on combating organized crime at Communis College on April 4th and an in-service class was given to members of police department on handling domestic violence situations. Ptl. Caij attended the N.Y.C.Police Auto Crimes School from 4/27-30. Trustee DiFelice stated that the first hand gun course for 1981J been completed. | Trustee DiFelice stated that he met with the apparatus committeej of Rescue Hose Company to discuss a new apparatus and moved that the 1 apparatus committee be authorized to look into the matter of purchasil a new fire apparatus and that firemen making the field trips be cover! under our insurance policy and that the Village Clerk notify the I insurance company of same, seconded by Trustee DiFelice. Carried. I Trustee DiFelice moved, seconded by Trustee Cavalieri that the 1 firemen traveling to Pennsylvania to pick up Fire Patrol's apparatus 1 be covered under our insurance policy. Carried. 1 Trustee DiFelice stated that a request has been received from ttii Fire Chief for a new car. 1 Trustee Gandolfo moved, seconded by Trustee White that the requel be referred to the finance and public safety committees for study. 1 Carried. 1 Trustee DiFelice stated that he received a request from Chief J Spota to charge a fee for a pistol permit because of all the paper wojj involved and moved that the North Tarrytown Police Department be 1 authorized to charge a fee of $50 for pistol permits, maximum of $100 J seconded by Trustee White. Carried, j PUBLIC WORKS Trustee Soriano gave the following report: I m Sand barrels have been removed. Two men have been painting curb! and traffic lines in the Village. Bags and loose brush in the Villa! and both manors are being removed. The pipeline at the hospital lan<fl is almost complete. Two men are cutting grass at triangles and islan^ ? throughout the Village, Due to part-time help being curtailed to 17 hours per week, ther < is a need for at least two more part-time laborers. Sidewalk repairs will commence on May 5th. Trustee Soriano stated that the County Board of Legislators havej sent a letter that the Croton Landfill will end in December and that J should find an alternate place to dump. Some Villages have requested J that Croton keep the dump open and that an additional fee of $2 per t be p4id. Another alternative would be to bring the refuse to the tra station at the Yonkers toll barrier at $25 per ton, said Trustee Sori We are paying now $15 per ton, he said. �-5- -*fi Trustee Soriano moved that the Mayor send a.letter to the tillage of Croton to ascertain whether or not they would permit North Tarrytown to dump in their landfill and that we would be willing to pay an additional $2 per ton, seconded by Trustee White. Carried. Trustee Soriano took issue with an article appearing in the Award Winning Union News bulletin showing the deterioration of the Village garage. He stated that many boards have attempted to alleviate this condition. More than once a bond was floated and for various reasons did not phase out, said Trustee Soriano. He stated that he was terribly disappointed. The Board acted in good faith in correcting the conditions, said Trustee Soriano. Trustee Soriano moved that the Mayor send a formal letter of protest on behalf of the Board outlining the discrepancies in the article, seconded by Trustee Gandolfo. Trustee Cavalieri questioned the right of an employee using Village time to show the writer of the article around the garage. Motion carried. Trustee Soriano stated that the Village is in need of a chassis for our sanitation Mack truck (25 yd,) as well as a pickup truck to answer complaints. - He stated that White Front Market has asked to change their garbage collection days which Mr. Shubrick has refused to do so. They have also requested a third pickup, but according to our rules and regulations, any business requiring an extra pickup will have to contract with another company, said Trustee Soriano, Trustee Soriano reported that a new method of treating root infiltration into sanitary sewers was inaugurated. Water meter reading is now in progress. Water conservation efforts for the month of April show a reduction in consumption of 2470 over a comparable period last year, said Trustee Soriano. Cash balance in the water and sewer fund is $54,864.18, reported Trustee Soriano. RECREATION & PARKS Trustee Gandolfo gave the following report: The new equipment for Barnhart Park will be completed by this week. The mason should complete the walkway and wall very soon. Yabo fence company will be installing a new fence at the park also. The lock and chain at Devries Field has been cut and taken for the third time. Tiny Tot baseball started May 2nd. Some 30 youngsters from pre-kindergarten, kindergarten and first grade have attended. The summer brochure should be out in about two weeks. Trustee Gandolfo moved that the Village sponsor two handicapped children to a handicap camp, seconded by Trustee DiFelice. Carried. Trustee Gandolfo stated that the committee is in need of an Arts and Crafts instructor for the Day Camp. < j �-6SENIOR CITIZENS — . . — . 4 — Trustee VThite reported that the club will attend Radio City on May 14th and will also take a trip to New Jersey on June 7th. Trustee Soriano clarified projects 16B2 and 16B1 for the minibus and recommended that a meeting be held by the Board, together with the Commission and Chairman of the Citizens club to discuss this matter further. \ TAX EXEMPT PROPERTY & ASSESSMENT • '——* »•*** i Trustee Timmings referred to an article in the newspaper regardin the adoption of the Village budget where it was reported that the deer of 25c per thousand in the tax rate would have a benefit to the needy senior citizens in the Village. He stated that the Village has gone along with the program that allows 50% assessment reduction to citizen who meet the income limits. Needy senior citizens assessed for less than $5,000 and at the $1.25 they would save per thousand would amount \ to less than 3c per week, he said. \ MAYOR'S REPORT Mayor Zegarelli stated that he is in receipt of a proposal from J. Michael Divney to provide professional services in connection with preparation of the third year application for the small cities program | The total fee for preparation and processing the application will not J exceed $7 500, he said. Trustee Timmings moved, seconded by Trustee Gandolfo that the Mayi| be authorized to sign the proposal. Carried. \ Mayor Zegarelli stated that he had signed the preliminary papers 1 over the weekend for the small cities program and Trustee Soriano movec' seconded by Trustee Cavalieri that action of the Mayor be confirmed by the Board, Carried. Mayor Zegarelli stated that the Board is in receipt of the buildil inspector's report regarding 21 Beekman Avenue and that it be approved) and he be formally notified to inform the owner to file the necessary plans and forms to rehabilitate his property in accordance with all conditions of the Village if he intends to do anything with the buildi^ He so moved, seconded by Trustee White, Carried, '• Mayor Zegarelli stated that a meeting will be held on May 12th wit Cable TV and North Tarrytown Realty Associates (100 College Ave.) to discuss cable TV at College Arms, Mayor Zegarelli stated that the Board is in receipt of a letter from the County Drought Emergency Task Force. It stated that North Tarrytown is one of the few communities to achie/e and exceed the goalt 15% reduction in water usage for the month of February, Mayor Zegarelli stated that he designated John Biros to act as Building Inspector when Victor Page enters the hospital. 4 Trustee Timmings moved to confirm the action of the Mayor, second^ by Trustee White. A letter will be sent to the State. Mayor Zegarelli stated that letters have been received from Senators Moynihan and D'Amato that the Italian Consulate will relocate in Yonkers when suitable accommodations are found. Mayor Zegarelli moved, seconded by Trustee Timmings that the Village request Mr, Bohlander, County of Westchester, to send us their determination as to who owns County House Road. . COMMUNICATIONS Communication from John Fogel, 130 Depeyster Street, requesting a tree and having his sidewalk filled in with blacktop was read and referred to the public works committee. Communication from Roberto Gabarro, 150 Depeyster St., requesting a new sidewalk was read and referred to the public works committee. Communication from Laurentino Rodrigues, 56 Clinton Street, requesting a no parking sign, loading zone in front of his property was read and referred to the public safety committee. Communication from Marcia Arcate, Chairman, Sleepy Hollow Manor Taxpayers Assoc, requesting the removal of several trees at the north and south end gates of the manor was read and referred to the public works committee. Communication from Sec'y. of Fire Council, Glenn Amesbury, regarding changes in personnel in Fire Patrol; Columbia Hose requesting permission to take its apparatus to Lake George and Hudson Falls on June 18-20; Elmsford on Sept. 13th; Chief Hennessey requesting permission to take the Chief's car to Lake George and Hudson Falls 6/17-20 and an exempt certificate for Bruce Parnell was read. The Council also went on record in support of Rescue Hose Company's request to obtain a new apparatus. Trustee Timmings moved that all actions of the Council be confirmed by the Board, seconded by Trustee Cavalieri. Carried. Communication from Ann McClurken, Recording Sec'y. of NJ.F.D. Ambulance Corps, opposing the proposed move of the ambulance building to River Street was read and acknowledged. Trustee Cavalieri stated that on January 5th, the Board passed a resolution regarding Victor Page and moved that the motion be amended to read as follows, seconded by Trustee Soriano: "Victor R, Page be appointed on a full time basis as Code Enforcement Officer and Building Inspector. Salary of $7500 annually will be paid by Community Development Funds for Code Enforcement Officer, Salary of y2 500 annually will be paid by the Village for the position of Building Inspector, �I J -8Mayor Zegarelli polled the Board as follows: Trustee Timmings " Gandolfo " Soriano No Yes Yes Trustee Cavalieri " DiFelice " White Yes Yes Yes Motion carried. UNFINISHED BUSINESS Trustee Gandolfo reported that Tarrytown co-sponsored a Conservatj Water Contest with the schools and on behalf of North Tarrytown, pres| awards to D. Losier and J. Ho at the school meeting. County Asphalt1 the First National Bank of No. Tarrytown donated checks, she said. Trustee Gandolfo moved, seconded by Trustee Soriano that departing heads submit an inventory of their supplies and office equipment to tj finance committee by June 1st, Carried, Trustee Cavalieri stated that the State has suggested that the Village look into a better flow of traffic, especially with Pine Str< now that the right hand turn on Bedford Road has been instituted. The matter was referred to the traffic and transportation commits Trustee Cavalieri stated that a discussion was held in a work session of the Board about employees not assigned in the Municipal Bu:i as well as copying of records on the xerox machine. Following a discussion, Trustee Cavalieri moved, seconded by Trustee DiFelice that employees not assigned to the Municipal Building be instructed to check in and sign the document on the counter in Village Hall upon their arrival evidencing the reason why they are herj etc., and all departments using the xerox machine to record the numbs' of copies of same. Carried, NEW BUSINESS Trustee Soriano stated that the committee will consider going baq to Wednesday paper pickup, instead of the second and fourth Mondays. The committee is also considering recycling glass and aluminum, he sas Mayor Zegarelli read a letter of resignation from Mrs. Nellie Sbf. from the Senior Citizens Town of Mt, Pleasant Committee because of il! health. Trustee Cavalieri moved, seconded by Trustee Timmings that her resignation be accepted with regret. Carried. Counsel Ponzini stated that the contract for snow and ice removal] on State highways was reviewed and is the same as last year. Trustee White moved, seconded by Trustee Timmings that the Mayor be authorized to sign same, Carried. ~± Counsel Ponzini stated that he reviewed the SPCA contract which approved as to form and content, the same as last year. Carried. that th« Counsel Ponzini stated that we are in receipt of an application for assessment review on the New Rochelle Water Co. Counsel Ponzini stated that in connection with the proposed Village garage, a letter was received from the bonding attorney that the Village would require a new financing plan if the proposed new garage facility financed under the existing bond resolution is abandoned, He is investigating the matter further, Trustee Cavalieri moved, seconded by Trustee White that the bills submitted on the General Fund and Water & Sewer warrants dated May 4th be referred to committee chairmen and if found correct paid and that a copy of the resolution be attached to said warrants. Carried, No further business to come before the meeting, Trustee Cavalieri moved, seconded by Trustee White that the same be duly adjourned. Carried.
