May 18, 1981 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor James J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute tofche flag. *, Trustee Soriano moved, seconded by Trustee White that the minutes of the meetings held on April 13, 1981 and May 4, 1981 be approved as written. Carried. t Mayor Zegarelli stated that he will suspend the normal course of the meeting for award certificates to life members of the North Tarrytown Fire Department Ambulance Corps. Mayor Zegarelli and President of the Ambulance Corps, John Cellante, presented awards to eleven life members of the Corps. ing Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. Curtis Heath, member of the Environmental Beautification Committee •' stated that he has a letter to the Board urging the Board to endorse the bottle bill which is Senate Bill 2831 and Assembly Bill 3692. : (Letter read under communications.) Mr. Cyr of Cyr' s Auto Parts on Cortlandt Street, stated that he is still waiting forfthe No Parking sign in front of his store. Mrs. M. Cappello, Pocantico St., referring to an article in Sunday's newspaper, spoke on behalf of residents of Pocantico Street, Elm Street and Howard Street, requesting information about a home for emotionally disturbed people contemplated for building at 48 Pocantico Street. ! :e Mayor Zegarelli stated that all he knew was what was said in the local newspaper. He stated that several years' ago, it was contemplated that senior citizens housing would be built on the lot, however, the site was too small for what they wanted to do. The reporter (G. Fiordalisi) explained that another reporter had read over the actions of the County Board of Legislators who passed a resolution which meant that it is in the County Health Plan for providing those services. The site was recognized as a community mental health site. 1 �-2Mayor Zegarelli stated that the Board does not know what the resolution or any kind of determination was made on the property with the group. He stated that a series of public hearings and meetings werij held when we were to get the group home and everything was discussed publicly. He assured Mrs. Cappello that nothing would go by this Board' without a public hearing. Trustee Timmings stated that no Village in Westchester County has the burden of tax exempt property that we have in North Tarrytown. The County Board of Legislators chose to act without consulting this Board and is an injustice to the taxpayers of the Village to take another parcel off the tax rolls. Mayor Zegarelli stated that the Board will take an active stand on this matter. Trustee Cavalieri stated that he never heard anything about this and this was never discussed in committee. Trustee Gandolfo stated that she understands that the reporter is going to meet with representatives from the "Search for Change" Company which would give us some background information. Mayor Zegarelli stated that Counsel will investigate the matter and report back to the Board. Mr. Fred Seminara questioned as to why the County Legislator representing our district did not inform the Village of this. Trustee Soriano stated that he had proposed the idea of housing for senior citizens on the property with Federal funds, however, it did not work out. Mrs. Christine Fiala, Pocantico St., stated as in the other case, we put up a big fight, but we lost anyway. She questioned why the person who wanted to build a housing project on the lot was turned down. Mayor Zegarelli stated that the Village Attorney will obtain all the legal ramifications regarding this matter. Mr. Albert Martin, No. Washington St., inquired as to why this could be instituted without the approval of the Board. Mayor Zegarelli stated that the first case was as a result of a court decree and superceded zoning regulations, however, in this case, this does not include the mandate and they have to follow the zoning and building codes. Mayor Zegarelli stated that we will make all information that we obtain available to the public. Mrs. Louise Klupacs, 50 Pocantico St., stated that she was approached by the owner of the lot and asked if she would sell her property. She was told that the building would be for senior citizens and the handicapped. �Following a discussion, Trustee DiFelice moved, seconded by Trustee White that a letter be sent to County Legislator Edward Brady notifying him what has happened here this evening and inquiring of him as to why the Village was not notified of the County Legislators' actions. Carried. Mayor Zegarelli stated that there were a series of articles about a petition circulating around attempting to ask for a cutback in the sentence given to an individual in the Sleepy Hollow Cemetery incident. He stated that he sent a mailgram to Judge Martin urging him to hold fast his position concerning the individuals involved in the crime. Trustee Gandolfo moved, seconded by Trustee White that action of the Mayor be confirmed. Carried. Mr. Ruscigno, No. Washington St., requested that a patrol car be sent periodically to check in the back of Morse School property where people have been gathering and causing disturbances. The matter was referred to the public safety committee. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that painting of Union Hose Company is continuing. Painting of the bathroom and kitchen is completed. The down spout on Cedar St. has been repaired and the window screens will be installed in Union Hose this week, said Trustee Cavalieri. Trustee Cavalieri moved that a new bond be authorized in the amount of $500,000, with the approval of the Village Treasurer and Counsel and bonding attorney, for the construction of a Village garage, including the rehabilitation of the former sewage treatment plant for offices on River Street y lAj2~*^n«Jl4^ Jty V^^-Ztlc $?**~*^K . C^yty^^C FINANCE & DEVELOPMENT Trustee Gandolfo reported a cash balance of $157,546.62 in the General Fund as of May 18, 1981. Trustee Gandolfo moved, seconded by Trustee Timmings that the Treasurer be authorized to borrow the amount of $15,5>00 from the First National Bank of North Tarrytown for repairs to the two fire trucks.as follows1; (Capital Note in detail official minutes.) Trustee Gandolfo stated that the purchase of police cars, fire chief's car and pickup truck will be referred to the public safety and finance committes for recommendation. Trustee Gandolfo moved that the Treasurer be authorized to cancel the following tax sale certificatesf seconded by Trustee White: #2, N.Y.S, Dept. of Mental Retardation in the amount of $1555.15, Section 14, Block 6, Lot 1G; #26, Village of North Tarrytown (former Rosenblatt property) in the amount of $86.17, Section 16, Block 16, Lot 14. Carried, �-4GOVERNMENTAL RELATIONS Trustee White stated that a committee meeting will be held when she returns from vacation. LABOR RELATIONS Trustee Timmings reported that a committee meeting was held two weeks' ago and finalized our request for changes in the police contract. The first meeting with the PBA was held last Wednesday, he said. Anothd session will be held this coming Wednesday, and tjie following week we will move to Tuesday night. We will keep it moving on a weekly basis, said Trustee Timmings and that he hopes to come up with a mutual agreement. Trustee Timmings requested that members keep the results of the bargaining session among their committee members and urged that other members of the Board be discreet in our upcoming negotiations. PUBLIC SAFETY Trustee DiFelice stated that a committee meeting was held on May 12th, together with Frank Mangieri and Counsel. The new youth counselling program will commence on June 1st, he said. Trustee DiFelice stated that letters are being sent out to all scoff laws. If they fail to show up within a week or no reply is receiv^ a warrant will be issued by the police, said Trustee DiFelice. Trustee DiFelice stated that the road work on Route 9-448 is progressing on time. We are in need of school guards and a dog warden, he said. Trustee DiFelice stated that Mr. Edward McCarthy's bid was the only one received for street light maintenance for the year 6/1/815/31/82 and moved that the bid be awarded to him in the amount of $6,000., seconded by Trustee Gandolfo. Carried. The amount of $5500 was allocated in the new budget and $500 will] transferred from the Contingency Fund. Trustee DiFelice stated that he accompanied other members of Fire Patrol Company to Pennsylvania to pick up the fire apparatus and on May 12th the truck was inspected by the Board. Trustee DiFelice stated that the County has requested that bus stop signs be posted and sites were designated as follows: In front of 128 Cortlandt St., Sleepy Hollow Restaurant, Beekman Ave.; area adjacent! to Central Fire Headquarters, Headless Horseman Bridge, North Washington] St., southbound, west side (Sleepy Hollow Rest.); and 126 Valley St. (Margotta Courts-yellow zone.) Trustee Cavalieri moved, seconded by Trustee White that a letter bej sent to the County granting permission for them to post bus stop signs at no cost to the Village. Carried. �-5PUBLIC WORKS Trustee Soriano stated that he has not received a report from the street department. Trustee Soriano reported that the Catskill Aqueduct, south of Kensico was shut down last night for general inspection and will continue all week. During this shutdown, we will be using Croton Supply, he said. Trustee Soriano reported a balance of $47,958.71 in the Water & Sewer account as of May 18th. ^ Trustee Soriano reported that the committee will restructure the public works department to consist of a Supt. of Public Works, a foreman in charge of sanitation; a foreman in charge of highway and a foreman in charge of the water and sewer department; a head mechanic in charge of his assistant. Each person will be responsible to the Supt. of Public Works for the performance of his particular department. Trustee Soriano stated that the personnel office is conducting a reclassification study of all positions in the department. He stated that regardless who becomes the road maintenance foreman.under the new s true ture^mrgrecL that the salary be fixed at $22,000, effective June 1, 1981, to -2*Sitt<5^any increments to which the person is entitled by law, seconded by Trustee White. Carried. Mayor Zegarelli called for a meeting on May 26th to discuss a police car, transfer of accounts and to determine and select a Supt. of Public Works. Trustee Soriano stated that the personnel office representatives were here on Friday to have several of the street department meft'complete an evaluation report, however, they refused to do so and said they would go over to the personnel office on Monday. Trustee Soriano stated that he did not know if the men went over. The men are to go over on their own time, and not on Village time, said Trustee Soriano. He stated that according to personnel office, they could be given a reprimand. At this time, Steve Vincek, assistant highway foreman, stated that Trustee Soriano would have to start with him, since he was one of the employees who went over to personnel office today. He stated that the reason why they refused to complete the questionnaire was because the representatives were late in arrival and the men had to take equipment back. After an exchange of words, Trustee Soriano stated that he did not call for this meeting to evaluate services, the County personnel office did. RECREATION Trustee Gandolfo reported that the equipment at Bamhart Park is being installed and should be completed by next week. Trustee Gandolfo moved, seconded by Trustee Timmings that the counselors appointed by the recreation commission for the summer day camp be confirmed by the Board. Carried, �The department is in need of an Arts & Crafts Instructor for the Day Camp, said Trustee Gandolfo. Anyone with experience should contact the recreation department, she said. Trustee Gandolfo stated that our parks, especially the Clinton Str playground, has been struck with vandalism. The recreation commission has recommended to close the Clinton St. park and transfer any usable equipment to Friendship Park where it can be easily patrolled by the police. She stated that Mr. Lofaro has locked the park until a decisi is made and moved to confirm his actions, seconded by Trustee DiFelice. Carried. -* Trustee Gandolfo stated that the owner of A & S Machine has . requested to purchase the property. Following a discussion, Trustee Gandolfo moved, seconded by Trustee DiFelice that the matter be referred to committee. Carried. t Trustee White stated that there is vandalism in the other parks and these should be closed also. Mayor Zegarelli stated that the parks will be discussed in a work session. Trustee Gandolfo stated that the summer brochure is cut. Three estimates were received for the maintenance of lights at Devries Avenue field as follows: Storm Electric - $895; Ed McCarthy-$750; Steve Maceyak-$695. The contract would include lights, material and labor. Following a discussion, the matter was referred to committee for further study, SENIOR CITIZENS Trustee White stated that a meeting was held and 100 citizens attended. Tomorrow is Senior Citizens day and free bus service will be provided, she said, Trustee White stated that she attended a Senior Citizens meeting at the Town of Mt. Pleasant during which discussions were held on taxes, housing for senior citizens and 100% full assessment. Each Senior Citizen center will be given a smoke alarm detector, The citizens will attend Radio City on May 20th and a trip to Florida is being planned, said Trustee White. Trustee Soriano stated that he is in receipt of a letter from the Fraternal Order of Eagles that they would sponsor the Senior Citizens minibus project. He stated that an application has to be completed to determine the feasibility of the project, after which a meeting will be held with a representative from the State, the Board of Trustees, Senior Citizens Commission and representatives from the Eagles Club. TAX EXEMPT & ASSESSMENT Trustee Timmings reported "progress". - �-7- ^# f MAYOR'S REPORT Mayor Zegarelli stated that it will be necessary for Counsel to represent the Village regarding the Strand Theater. Following a discussion Trustee White moved, seconded by Trustee DiFelice that Counsel be authorized to appear as the Village's representative to bid for the purchase of Strand Theater on May 28, 1981 and that he be further authorized to bid on an amount equalling the Town and School tax lien plus the Village tax lien and that the work session of July 31, 1980 indicating the Village's intention to purchase the property be confirmed by the Board. Carried. ^ Mayor Zegarelli moved, seconded by Trustee White that the week of October 11-18 be designated "Week of Celebration for the Disabled". Carried. Mayor Zegarelli stated that he is in receipt of a letter from Senator Ralph Marino who stated that . he will support the MRD program. Mayor Zegarelli stated that he is in receipt of a letter from Sandy Galef to Edward Davies, Deputy Commissioner of Solid Waste who is suggesting a tour of the transfer station in Yonkers. Mayor Zegarelli stated that he is in receipt of a letter from County Legislator O'Rourke regarding changes in County districts. Mayor Zegarelli stated that he is in receipt of a request from Rabbi Shmuel Butman, Director of the Lubavitch Youth Organization proclaiming 80 days of education in recognition of the accomplishments in education of Rabbi M. Schneerson, and Trustee Gandolfo so moved, seconded by Trustee DiFelice, Carried. COMMUNICATIONS Communication from Curtis Heath, 9 Evergreen Way, requesting that the Board adopt a resolution supporting the bottle bills in the State Legislature was read. Trustee Cavalieri stated that he will not support this bill, claiming that it is discriminatory. Following a short discussion, the letter was referred to the board as a committee of the whole. Communication from Willis Moon, Recording Sec'y. of Fire Patrol, regarding incorrect time of the clocks in Central Headquarters was read and referred to the buildings and grounds committee. Communication from Mr. & Mrs. Wilbur South, 153 Valley Street, requesting the filling in of holes in front of his property when meters were removed was read and referred to the public works committee. Communication from Sec'y. of Fire Council, Glenn Amesbury, regarding the following was read: recommending that the Board accept the work completed on Fire Patrol apparatus; advising the Board that the department will no longer respond to calls to pump water because of sewage problems; active membership in personnel in Columbia Hose Company; Fire Patrol requesting permission to take its apparatus to Mt, Kisco on July 17th, �-8Ossining on August 5th; Rescue Hose to Mamaroneck pn June 30th and Brews on July 24th; Chief requesting permission to take the car to the parades Trustee Timmings moved that actions of Council be confirmed by the Board, seconded by Trustee White. Carried. Trustee Timmings moved that a letter be sent to the owner of College Arms - (North Tarrytown Realty Associates) notifying them of this directive and that they be instructed to correct the condition that exists at this project, seconded by Trustee Gandolfo. Carried. • » * Communication from Joanne Addotta, Coordinator of the SIA stating that a group of students from Spain will be living in the Tarrytowns during the summer and that they plan to attend a meeting of the Board was read and filed. Communication from Ms. Anne Nixon, President of the Tarrytowns NAACP regarding employment practices concerning Kim Berry and Robert Jefferson was read and on motion of the Mayor, seconded by Trustee Cavalieri was referred to Counsel. Carried. Communication from E.W. Frandsen, North Broadway, regarding the condition of several trees which were planted in front of his property was read. Trustee Gandolfo stated that two of the trees were damaged by his employees and Counsel had written to him for reimbursement. He stated at the time when he was first approached that he would replace the tree if in the spring it was found that the tree had died. He did not live up to his bargain, she said, and requested that Counsel write him another letter. Communication from John Flynn, Director, N.T. Housing Authority, regarding the condition of the Margotta Parking lot was read and referred to public safety and public works committees. Communication from Glenn Amesbury, Sec'y. of Fire Council, on behalf of Fire Council opposing the moving of the ambulance Corps to an location was read and referred to public safety committee. Communication from Glenn-Amesbury, Sec'y of Fire Council, bringing to the attention of the Board a serious problem with College Arms was read. He stated that during the year April 1980-March 1981, the department responded to 43 calls to College Arms and only three of them could be considered to be justified. He stated that the majority of the alarms are due to the incinerator backing up and filling the hallways with smoke and that the Council is recommending that this incinerator be closed down and replaced with a compactor, Following a discussion, Trustee Soriano moved, seconded by Trustee DiFelice that a letter be sent to the North Tarrytown Realty Associates endorsing this recommendation and that a copy be sent to the building inspector. Carried, ^_ �UNFINISHED BUSINESS . f Trustee Gandolfo stated that a meeting is being held with property owners surrounding Fremont Pond and the Sleepy Hollow Manor Taxpayers Association on May 21st. Trustee Timmings stated that he has received many complaints with regard to the removal of parking on Palmer Avenue. He stated that people involved have paid their fees for parking, but are not getting a space and questioned why signs have been placed in front of 1 Riverside Drive. Mayor Zegarelli stated that it is contemplated that parking stalls be designated in front of 1 Riverside Drive or have diagonal parking. Trustee DiFelice stated that he has been trying to get parking on Riverside Drive between Harwood and Hunter Avenue where there is space available for 55 cars. NEW BUSINESS Trustee Timmings stated that at the Village Officials Association meeting, it was stated that a member of our Board is well-qualified to fill the opening in the N.Y.S. Conference of Mayors' Association and moved that a letter be sent to the Conference of Mayors endorsing Mayor Zegarelli for the position, seconded by Trustee Soriano. Carried. Trustee Gandolfo stated that Mr. Curtis Heath and Mrs. Ann DeLuca attended a seminar on gypsy moths. Trustee DiFelice moved, seconded by Trustee White that the bills submitted on the General Fund and Water & Sewer warrants dated May 18th be referred to committee chairmen and if found correct approved and that a copy of this resolution be attached to same, and that the Treas. be authorized to pay same.
