P*v>, , \ A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Janet Gandolfo Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trustees Robert J. Ponzini, Counsel , Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee White that the minutes of the meeting held on May 18, 1981 be approved with two minor corrections' Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mrs. Catherine Cappello, Pocantico Street, inquired if the Mayor received an answer from Mr. Edward Brady, County Legislator, and was answered in the negative. mg Counsel Ponzini stated that he reviewed the resolution passed by the County Legislators and that he had the opportunity to discuss the matter with one of them. The County passed the resolution on May 13th by a vote of 15-1, with Legislator Messina voting against it, said Counsel. He stated that the County feels that since they are concerned with local communities, they would want the opportunity to scrutinize the funding of any monies. They are not going to maintain any legislative control over the project, he said^v They are only going to monitor it. Any effort would have to be made by/local municipality through whatever regulations :e in the local zoning code, said Counsel. The resolution was read by Mayor Zegarelli, copy attached, on the Board received any communications, said the Mayor. No one Trustee Timmings encouraged people in the audience to write to the County Legislators. To get action is to organize with friends and neighbors and letters be written to County Executive Alfred De,lBello and County Legislator Edward Brady, he said. _ Trustee Soriano stated that he was opposed to this particular structure in the Village. They do it without our sanction, he said. m :l ii �Trustee DiFelice stated that people of Pocantico Street were invited to attend a meeting in Port Chester about group homes and he attended with them. What is happening in North Tarrytown would possib come under the same group, said Trustee DiFelice. Following a discussion, Trustee Soriano moved, seconded by Truste DiFelice that the Mayor and Village Board of Trustees be recorded as opposed to the construction and location of any facility as outlined i the proposal as Search for Change; that a copy of this resolution be sent to the County Board of Legislators, County Executive in order to adequately outline the Village's position and opposition to the locatit of said facility, and further amended to include that Village Counsel' authorized to represent the Village in any proceedings in opposition t the proposal and that copies be sent to the Public Schools of the Tarr asking for their support in opposition to the facility. Carried Unaniir Mr. Eugene Buonanno, Gordon Avenue, inquired about the problems still existing on the Frandsen property on Gordon Avenue even though to was sent a letter to comply. Mayor Zegarelli stated that the Village Prosecutor will be here this evening and he could review the items with him, Counsel and Actiri| Building Inspector, John Biros. Mr. Buonanno stated that Mr. Frandsen was given a thirty ft. curb cut for cars entering and exiting the lot which gave him a 120 ft. length which he no longer is using. He is using the entire stretch instead, said Mr. Buonanno. Three trees were damaged by his employees and have not been replaced, he said, and that there are 26 cars parked in the lot, instead of the required 10. Alternate side parking means nothing to the owner, said Mr. Buonanno, and inquired as to what the Board is going to do about the area. Mr. Richard Schafranski, 18 Gordon Avenue, stated that Mr. Frands is utilizing the spaces which have been designated for the animal hospi The fence around the lot is virtually going to fall, he said. Mayor Zegarelli stated that Counsel is outlining all the points bei made here this evening. Trustee DiFelice stated that he is in receipt of a police report showing the number of cars being parked in the lot which is a zoning violation. Mayor Zegarelli stated that if the zoning ordinance is in violati the building inspector is empowered to issue a summons and if the cars are in violation, the police or meter maid will issue tickets. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that the painting of Union Hose Co. has been completed, as well as the washroom of Rescue Hose Co. Minor paint work will be completed in the Municipal Building, he said. �|W**n -3^ Trustee Cavalieri moved, seconded by Trustee DiFelice, upon approval of committee members, that we advertise for bids for the sale of Strand Theater and 79 College Avenue, as soon as we obtain the deed for Strand Theater and that we investigate the matter of an appraisal. Carried. FINANCE & DEVELOPMENT Trustee Gandolfo reported a balance of $53,985.83 in the General Fund as of June 1st. Trustee Gandolfo stated that Jack Gorman is still working on new specifications for Fremont Pond. She stated that she is in receipt of inventories from department heads and called for a committee meeting on June 11th. GOVERNMENTAL RELATIONS Trustee White stated that she is in receipt of a report from Mr. Doorley, CDA Director, showing balances in each department of CDA funds so that the department head would not over spend, LABOR RELATIONS Trustee Timmings stated that the committee met with CSEA regarding out-of-title pay grievance and the next step will be a hearing on June 4th. PUBLIC SAFETY Trustee DiFelice stated that he has a survey from the Chief regarding , ' the Frandsen parking lot on Gordon Avenue which will be turned over to the Village Prosecutor. i Trustee DiFelice gave the following report for the month of May: (in detail official minutes) •'$£•' Trustee DiFelice stated that the Youth Bureau commences today and is located in the First Reformed Church. All calls will be monitored, he said. M$ Trustee DiFelice stated that the CDA Director is attempting to / locate the 150 lights which were replaced by the street light maintenance ?': contractor and moved that his check be held up pending his report, jf. seconded by Trustee Cavalieri. r Mayor Zegarelli amended the resolution to warn the contractor that i ,-&s it is our intention to withhold payment pending a written report status of the lights paid for from CDA funds and that the report be made within s two weeks. Motion carried. ;' Trustee DiFelice moved, seconded by Trustee Soriano that a police car be purchased through the Ccamty purchasing program in an amount not to exceed $9000 to be paid for through a capital note. Carried. This car will replace car 502, he said. 1 �-4During the month of May, there were four general alarms and the ambulance Corps responded to 32 calls, reported Trustee DiFelice. Trustee DiFelice moved, seconded by Trustee Gandolfo that a radio be purchased in the amount of $1298.40 for Fire Patrol apparatus in order to keep contact with Phelps Memorial Hospital, said amount to be t] from part of the overall bond for the renovation work on Fire Patrol apparatus. Carried. Trustee DiFelice stated that the cost of this radio is purchased from State contract prices and the make is a G.E. PUBLIC WORKS Trustee Soriano reported a balance of $25,598.82 in the Water & Sewer account. The department is repairing water meters also. Trustee Soriano read a report from John Biros regarding recycling of bottles and cans, after which he stated that he did not think it was financially feasible. Trustee Soriano reviewed the restructuring of the Public Works Department, after which he moved the abolishment of the General Foreman position as stipulated by the Personnel Office, seconded by Trustee DiFelice. Carried. Trustee Soriano proceeded to move that John Biros be appointed Superintendent of Public Works on provisional basis pending the canvass of the Civil Service list, to include parks and playgrounds and Village owned buildings, as well as authorization to take action in the service of issuing summonses now vested in two other people at a salary of $24,629, plus $5,000 for Supt. of Public Works, $2,000 as purchasing agent, said money to come from Water Dept. funds, seconded by Trustee DiFelice. Trustee Timmings stated that the amount of $2,000 should not come from the Water Department funds. This was always kept separate, he ~ Motion not acted upon. Following a lenghthy discussion, Trustee Soriano moved that John,'} Biros be appointed Superintendent of Public Works on provisional basis, for three months, pending the canvassing of the Civil Service list, effective immediately, at a base salary of $29,129, plus longevity, pluj $2,000 for purchasing agent, seconded by Trustee DiFelice. Carried. Trustee Soriano moved that John Biros be authorized to issue summonses pertaining to the health and welfare of the Village as outlin in the courts relating to his new position as Supt. of Public Works, seconded by Trustee DiFelice. Carried. Trustee Soriano moved that the $5,000 for John Biros' position of Supt. of Public Works be taken from the water fund and $2,000 as purchasing agent be taken from the General Fund, seconded by Trustee . Trustee Soriano moved to create the title of Working Road Maintenance Foreman, seconded by Trustee DiFelice. Carried. Trustee Soriano moved that Michael Apollonio be appointed Working Road Maintenance Foreman at a salary of $22,000 per annum, plus longevity effective immediately, seconded by Trustee DiFelice. Carried. Trustee Soriano stated that an agreement had been worked out between John Biros and Steve Vincek regarding his title of working assistant road maintenance foreman. The primary function of this job is Class I M.E.O., said Trustee Soriano and the administrative requirements of Assistant Foreman will only come into being in the absence of the foreman and so moved, seconded by Trustee DiFelice, effective immediately. Carried Trustee Soriano moved to create the title of Working Sanitation Foreman, seconded by Trustee DiFelice. On the question, Trustee Cavalieri stated that the working sanitation foreman should be on the truck working. He stated that he had a difference of opinion. On the question, Trustee Cavalieri stated description of a working sanitation foreman. that he opposed the Mayor Zegarelli polled the Board as follows: Trustee Timmings Gandolfo " Soriano - Yes - Yes - Yes Trustee Cavalieri " DiFelice White No Yes Yes Motion carried. Trustee Soriano moved, seconded by Trustee Gandolfo that the nominal refunding on all increases be transferred from Contingency Fund, seconded by Tiaistee Gandolfo. Carried. Trustee Soriano stated that this restructuring will be on a trial basis for one year. He stated that no one was ever meant to be punished financially or lose a job. He stated that we are trying to eliminate complaints by trying a new chain of command. i , �-6Trustee Soriano moved to endorse all the concepts of the proposal] as outlined with the backing of the Board of John Biros to carry on the job, seconded by Trustee Gandolfo. Carried. RECREATION & PARKS Trustee Gandolfo stated that the summer brochure is out. Trustee Gandolfo moved that the lowest estimate for the replaceute of lights at the Devries field be awarded to Nick Morabito in the amon of $600-$650, seconded by Trustee White. On the question, Trustee DiFelice stated that there is only one light pole and three lights in question. Mr. Lofaro, Recreation Supervisor, stated that we can purchase tl lights at a discount and all we would have to do is hire someone with a truck to replace the lights. Following a short discussion, Trustee Gandolfo withdrew her motio and Trustee White withdrew her second. Matter referred back to committee. Trustee Gandolfo stated that she is in receipt of the contract form prepared by Counsel for umpires in recreation and moved that thej Board adopt this system of payment and that the Mayor be authorized to; sign said contracts, seconded by Trustee Soriano. Carried. An opinion was received from the Dept. of Audit & Control and this contract allows umpires to be paid by voucher, said Trustee Gandol Trustee Gand olfo stated that during the past two weeks, we have received complain ts regarding the condition of Peabody Field. She staj that the Village is not responsible for the maintenance of the field' A letter was sent to the school board regarding the condition and an answer was receiv ed from Mr. H. Pordy that North Tarrytown could solvej the problem with the help of the police department, better supervisioi or cleaning by th e Village and the problem of bleacher restoration cai be solved by repa ir by our department. Following a discussion, Trustee Gandolfo moved that the Mayor be authorized to write a letter on behalf of the Village Board for a meet] with the school board to discuss responsibility and care and maintenanj of the field, as well as the Morse School playground, seconded by Trustee DiFelice. On the question, Trustee Cavalieri stated that he drives by Peabo and Sleepy Hollow High School field and notices people having picnics. Motion carried. Trustee Gandolfo stated that Pat Lofaro has taken pictures of all] the parks showing vandalism that has occurr-ed in the Village parks, stated that we should declare a moratorium A n all parks. These acts will have to be stopped and if the people cannot stop it, we have to s] the parks down for awhile. This will be discussed in committee, she sj She stated that the Clinton Street playground is still locked and will be closed until the next meeting. A lock cannot be placed on Barnhartj and Douglas Parks, she said. �-7- J3?V\ Trustee White stated that a lot of out-of-towners come into the parks and North Tarrytown people are being blamed. Mayor Zegarelli suggested that the Recreation Commission prepare possible remedies to solve the problem. Trustee White stated that she attended a meeting at C.O.C. and they would be willing to maintain the Clinton Street playground. SENIOR CITIZENS Trustee White reported that the citizens held a meeting today. On June 9th, they are taking a boat ride up the Hudson and on June 30th a bus ride to Graymoor. A picnic will be held on July 13th at Kingsland Point. The citizens are scheduling a trip to Florida in October, said Trustee White. The citizens have scheduled three meetings for the month of June, she said. TAX EXEMPT AND ASSESSMENT Trustee Timmings reported ''progress". MAYOR'S REPORT Mayor Zegarelli stated that the Cuban Club rescheduled their dance which was to be held on June 13th to June 21st from 1 - 7 P.M. and moved to confirm, seconded by Trustee White. Carried. Mayor Zegarelli stated that Counsel has prepared a report concerning the tax foreclosure of Strand Theater on May 28th and it was necessary fo Counsel to conclude the necessary legal procedure to transfer title and so moved that actions of Counsel be confirmed and authorized, seconded by Trustee Soriano. Carried. ( s e e a t t a c h e d ) Mayor Zegarelli moved that upon receipt of the deed of the property that the same be insured, seconded by Trustee Soriano. Carried. Mayor Zegarelli stated that we are in receipt of a notice of violations on the Village garage from the State Labor Department. A meeting will be held to discuss the violations with Counsel and how properly to answer the notice, said the Mayor. Mayor Zegarelli stated that a letter was received from Mr. McGovern, D.O.T., in answer to our letter regarding the condition of route 9. Mr. McGovern stated that the State's responsibility is from curb to curb and would be a matter for the Village. Their maintenance help has been reduced, however, if they receive some relief, they will assist the Village in cleaning the area. Trustee Cavalieri moved that two additional signs indicating that thi road is maintained by the N.Y.S. D.O.T. be placed on route 9, one near th< Sleepy Hollow Cemetery and the other near the hospital entrance, seconded by Trustee Timmings. Carried. Mayor Zegarelli moved to confirm his action in offering our share of $7852 to the Village of Tarrytown for the Senior Citizens minibus services during 1980-81, seconded by Trustee White. Carried. �-8Mayor Zegarelli stated that he is in receipt of a letter from t\\\ American Red Cross thanking the Village for displaying the Red Cross Mayor Zegarelli stated that he is in receipt of a letter from thi Chief of Police, Town of Mt. Pleasant, regarding the extension of thefl animal warden services to the Village. Mayor Zegarelli stated that he is in receipt of a letter from thJ Director of Mercy College for a course in continuing education concerj National Safety Council Driving Program and referred the matter to Trustee DiFelice. Mayor Zegarelli stated that he is in receipt of a letter from the Westchester-Putnam Council of Boy Scouts that various troops are running short of volunteers and referred the matter to Trustee DiFeli Mayor Zegarelli noted a new determination on UDAG grants and aftj discussion, it was suggested that our position on UDAG programs be reviewed in view of the changes in eligibility requirements for commu such as North Tarrytown. COMMUNICATIONS Communication from Anthony Millow, 25 Cedar Street, requesting tj removal of a tree in front of his property was read and referred to tj public works committee. Communication from Mr. & Mrs. L. Thompson, 151 Valley Street, requesting sidewalk repairs was read and referred to the public works] committee. A petition signed by nine residents of Gordon Avenue and Katrimj Avenue regarding the Frandsen parking lot, as well as other matters, was read and referred to the Village Prosecutor. Communication from the Rev. Christian Santiago, Pastor of the Christian Church, Rock of Salvation, Inc., requesting permission to h| an open-air service on College Ave. from 5 - 7 P.M. was read. Trustee Soriano moved, seconded by Trustee White that permission] be granted and that the police be notified of same. Carried. Communication from Mrs. Alice Runyon, resigning as Village Histoj was read and on motion of Trustee Cavalieri, seconded by Trustee Whitl was accepted with regret and a letter of appreciation sent to her. CaJ Communication from Russell DiBlasi, Tarrytowners and Proud Of It] requesting a donation for fireworks display on July 4th was read. It was brought to the Board's attention that last year, the Villi did not receive any recognition for the donation of $500. ' �s<r -9- Trustee Timmings stated that people should have some idea when these events will take place and should place their requests before our budget is adopted. to Following a discussion, Trustee Gandolfo moved that $250 be donated towards the fireworks display, said amount to be transferred from the Contingency Fund, Celebrations, and that an appropriate letter be sent to the group, seconded by Trustee Cavalieri. UNFINISHED BUSINESS Trustee Gandolfo stated that John Gasko, Coffin Tree Co., looked at all the trees which were planted and some of them cannot be salvaged. The trees on Katrina Avenue were not planted by him, but by the contractor doing the road work in the area, she said. The tree were damaged by employees of Mr. Frandsen. the Village take Trustee Gandolfo moved that/whatever action is necessary in order to have these trees replaced by Mr, Frandsen, seconded by Trustee White. Carried. Mayor Zegarelli asked the pleasure of the Board to hold one meeting during July and August. h 1 Trustee Cavalieri stated that he was in favor of having two meetings per month. Trustee Cavalieri stated that he made a motion that people not assigned to the building are not signing in when they enter the office The matter was referred to Governmental Relations committee. Trustee DiFelice stated that he is being questioned about water restrictions being imposed and was given a review by John Biros. Following, a short discussion, Mr. Biros was instructed to make available the rules and regulations concerning water restrictions. " « :& �-10Trustee DiFelice moved that a public hearing be held on July 6th increasing fines in the V & T laws, as well as in some of the other ordinances and/or local laws, seconded by Trustee Cavalieri. Carried Trustee DiFelice moved to confirm the fees for the following it under Village jurisdiction, seconded by Trustee Cavalieri, effective immediately: Zoning Ordinance-$4.00; Zoning Map-$1.00; Plumbing Code Electrical Code-$3.00; Street Opening-$3.00; Noise Code-$3.00' Proper Maintenance-$3.00; Housing Code-$3.00; Certificate of Occupancy-$5.00 No violation certificate-$5.00; Court transcripts-$l.00 per page; Ace reports-$5.00 per page; Insurance co. complaints-$5.00 per page; Pist Permits-$50-$100; Towing-$25.00; police reports-$5.00 per page; Margo Courts Parking permits-$60.00 per year; Letter of Good Conduct-$5.00; Police Impound Lot-$15.00. Carried. Trustee Cavalieri brought up the matter of increasing Mrs. Murp pension and following a discussion, the matter was referred to the pu safety committee. NEW BUSINESS A discussion was held that property owners are not conforming to the rules and regulations concerning brush clippings, etc. and folio a discussion, John Biros was authorized in his capacity as Supt. of Public Works, to redesign the card listing rules and regulations and that residents be notified of same. Trustee White stated that there has been a great deal of noise throughout the Village and people are not adhering to the noise ordin After discussion, the matter was referred to the public safety committee. Trustee White moved, seconded by Trustee Soriano that the bills submitted on the General Fund and Water & Sewer warrants dated June 1 1981 be paid after approval by department heads and that the Treasure be authorized to pay same and that a copy of this resolution be attac to the warrants. 'M Search for Change, Inc. in the County's State Aid application for operating assistance and accompanying comprehensive Mental -, Health Services Plan. The County Executive explained that Search for Change, Inc. has applied to the New York State Office of Mental Health i ! fill for a grant to construct a mental health care facility in North Tarrytown, New York. The County Executive further ex- plained that pursuant to the State Mental Hygiene Law, Search for Change, Inc. as a grant applicant must demonstrate that the construction of the facility will fulfill a local public need in a manner consistent with the County's comprehensive • ' . mental health planning and development plan. The proposed contract does not require any expenditure i !$•$ of County funds. Any future commitment to fund the facility will, of course, be subject to County approval and appropriations. , !,j i; i '! ? �ACT NO. &1* m 198| AN ACT authorizing the County of| Westchester to enter into an Agreement with the Search for Change, Inc.*. for the term of twenty (20) years for the purpose of stating its intention to use a mental health care facility to| be constructed by Search for Change, Inc. BE IT ENACTED by the County Board of the County of Westchester as follows: Section 1. The County of Westchester is hereby author- ized to enter into a cooperative agreement with Search for Change,| Inc., whereby the County will agree to include in its application for New York State operating assistance and as part of its prograa| for community mental health and retardation services and facilities for a period of twenty (20) years the mental health services to be provided by Search for Change, Inc. and which agreement shall further provide that the County shall not be obligated to appropriate any funds to Search for Change, Inc. Section 2. The County Executive, or his duly authorized designee, is authorized and empowered to execute and deliver all instruments and take all action necessary or appropriate to accomplish the purposes of this Act. Section 3.
