Present Philip E. Zegarelli, Mayor James J. Timmings Janet Gandolfo Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trustees / Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee White that the minutes of the meetings held on May 26, 1981 and June 1, 1981 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. Sol Shapiro, merchant on Beekman Avenue, inquired as to what the Village is going to do about the Strand Theater. He stated that a petition containing 500 signatures was presented to the Board requesting a parking lot. He stated that the property is an eyesore. i. ^ Mayor Zegarelli stated that we have not physically received title to the property yet. It should occur shortly, he said. He stated that a meeting was held to discuss what the Board intends to do with the property; i.e. whether it be put up for sale or make it into a parking lot F •i'i! Mr. Shapiro offered help from the merchants. Trustee Gandolfo suggested that the merchants follow the example of Dr. Leroy and Frank 0 Brien who are renovating their properties on B e ekman Av enu e . Trustee Cavalieri stated that he was on Beekman Avenue today and suggested that the sidewalks be swept. He stated that he does his every day. Mayor Zegarelli stated that an announcement will be made as to when a work session will be held during which representation of merchants will be called upon to discuss proposals for the Strand Theater. r Mrs. Roseann Bell, Elm Street, inquired as to what decision did the County Board of Legislators rescind and where do we go from here regarding the Search for Change project contemplated for Pocantico St. •\l\ . ill' l , ; •'• I'M I •' �_9_ Mayor Zegarelli stated that the decision was" initiated by Edward Brady, County Legislator representing our area, who repealed the Board action of April 1981 which established the County sponsorship and pub a "Search for Change" under the support umbrella of the County. What done in April was repealed, said the Mayor. This does not mean that til Agency has been stopped or prevented from locating in this Village, takes away Westchester County's support for future funding. Mayor Zegarelli stated that a Ruth Stern of CRISP has requested al meeting to discuss the situation. Mayor Zegarelli stated that he will appoint a committee of three from the Board to meet with them, as well] as representation from the neighboring area to sit in on the meeting, Mayor Zegarelli suggested that residents write their State Legisl He stated that they determine the course of action for Search for Char] Decision making and funding emanates from the State, he said. Trustee Timmings suggested enlisting the aid of the PTA and school board also. People in State government will listen to a school boardj he said. Trustee Cavalieri stated that he volunteered his place of businesj to have petitions signed by people in both Villages. Mrs. Louise Klupacs, Pocantico Street, stated that she lives nextl door to the property in question and stated that it has become a junglj Trustee DiFelice stated that a notice was sent to the owner by thj building inspector who advised that the property would be cleaned up, Mr. Lester Clark, Birch Close, stated that regarding the parking the Philipse Manor station, the Village has issued permits to residents! and non-residents, but has sharply reduced the number of available par} spaces. He stated that the parking was changed on Palmer Avenue to 1 Parking at any time. There is parking only at 1 Riverside Drive for tenants. This action is taking away from permit holders, he said. He| presented a petition signed by 50 people, most of whom are residents asking for reconsideration of the set-up of parking permits. Trustee DiFelice stated that he was in receipt of calls regarding! the parking situation and has talked to both presidents of the Philipse, Manor and Sleepy Hollow Manor Associations. A joint meeting will be held, said Trustee DiFelice. Mayor Zegarelli stated that we are aware of the problem specificaj on Palmer Avenue. The owner of property on Palmer Avenue approached t Board recently and requested that the parking prohibited sign be resto which was done. The Mayor stated that the no parking signs were instal on Palmer Avenue when a new trunk line was installed for the County se line, but were never removed. Following a discussion, the matter was referred to the public safj committee. Trustee Cavalieri stated that the buildings and grounds committee| met with the Planning Board and discussed the possibility of making provisions for 70 parking spaces on the side of the railroad station. �-3REPORTS OF COMMITTEES I ?! 1 BUILDINGS & GROUNDS Trustee Cavalieri reported that a new slop sink was installed in .Central Headquarters and a grease trap was being installed in Rescue Hose Company. The flushometer in the women's cell was faulty causing damage to Pocantico H & L Company's social room. It will be repaired, he said. 1 I' j'-*. « Trustee Cavalieri stated that Telequip Company has reviewed our telephone system with Trustee DiFelice and will report back on the cost for the installation of a new telephone system to improve efficiency. Trustee Cavalieri read a letter from John Cellante, part-time custodian who has resigned. / GOVERNMENTAL RELATIONS Trustee White called for a meeting with Mr. Sally, UDAG, for July 2nd. At this time, Mr. Jack Gorman, attorney for Fremont Pond project, reviewed the progress of the project. He stated that he met with the Professional Engineer representing the Village and they reviewed the specifications which were last used and made some modifications. The specifications will now include that the excavated materials will be deposited on the Peabody property. There is an agreement existing between the Village and School District as to what is to be done about the seepage, odors, etc. The specifications should be available in final form on Thursday of this week, he said. He stated that both the school and Village have authorized execution of the agreement. He stated that we are very close to going out for bid. Trustee Cavalieri raised the question of the school board submitting a hold harmless clause. Mr. Gorman stated that we are giving them a hold harmless clause. They are not in a position of damaging any of our property, he said. Following a discussion, Mayor Zegarelli thanked Mr. Gorman for his appearance this evening. FINANCE & DEVELOPMENT Trustee Gandolfo reported a balance of $26,599.86 in the General Fund as of June 22, 1981". Trustee Gandolfo moved the following resolution be adopted, seconded by Trustee Timmings: "Bond Resolution, Dated June 22, 1981, Authorizing the Issuance of $80,750 Serial Bonds and $4,250. Capital Notes of the Village of North Tarrytown, pursuant to the Local Finance Law, to Finance the Reconstruction of a Building for Use as an Office for the Village Highway Department" (in official minutes) ,-!». ' !f �-4Trustee Gandolfo moved that the following resolution be adopted, seconded by Trustee T:minings : "Bond Resolution, dated June 22, 1981, Authorizing the Issuance of $441,750. Serial Bonds and $23,250. Capital Notes of the Village o North Tarrytown, Pursuant to the Local Finance Law, to Finance the Construction of a Multi-Purpose Building for use by various Villag Departments" (in official minutes) Trustee Gandolfo moved, seconded by Trustee White that the following resolution be adopted: (Capital Note in the amount of $20,000 for two police cars in detail official minutes) Trustee Gandolfo moved, seconded by Trustee Cavalieri that the Treasurer be authorized to transfer $2,009.21 from Contingency FundA1990.4 to Al900-Purchase of Land-Special Items, to cover the balance due on the bid price of the Strand Theater. Carried. Trustee Gandolfo stated that she spoke to Supervisor Rovello who informed her that the Town was purchasing a computer for their payrolls, etc. and she inquired if North Tarrytown could be keyed into the computer. He told her that as soon as they work out their system, they will be in contact with us, said Trustee Gandolfo. Trustee Gandolfo stated that she is in receipt of inventories fro departments and moved that they be incorporated as part of the minutes, seconded by Trustee DiFelice. Carried, Trustee Gandolfo stated that at the last meeting, $250 was donated to the Tarrytowners and Proud Of It Club and moved that they be given an increase of $250, the same as last year, said amount to be transferr from Contingency Fund. The total donated is $500. Trustee Cavalieri seconded the motion On the question, Trustee Timmings stated that he will vote agains it. People who organize the fireworks program know the constraint of operating within a budget. He reviewed several items that were unforcwhich now have to be paid for from the Contingency Fund. Trustee Gandolfo stated that the same circumstances happened last year. Trustee Cavalieri stated that this was for the benefit of the peo Mayor Zegarelli polled the Board as follows: Trustee Timmings - No Gandolfo - Yes " Soriano - No Trustee Cavalieri " DiFelice " White - Yes - No - Yes Mayor Zegarelli voted "Yes" and declared the motion carried. �-5- Trustee Timmings stated that he received a notice from the Village Attorney regarding out-of-title pay grievance with Civil Service being settled. He had directed the Village Treasurer to forward a check in the amount of $418 to the arbitrator and so moved that the amount be taken from the Contingency Fund and payment be made as agreed upon in Counsel's memo to the Mayor & Board, seconded by Trustee Cavalieri. Carried Trustee Timmings moved, seconded by Trustee Gandolfo that the decision as to from what account the money is to be taken be referred to the public works committee. On the question, Trustee Soriano stated that he did not oppose the payment of the money, but did oppose the method that the arbitrator used in justifying his claim. He stated that the sweeper was never a heavy piece of equipment, it was only a budget item. Following a short decision, Mayor Zegarelli polled the Board as follows: Trustee Timmings Gandolfo Soriano - Yes Yes Yes Trustee Cavalieri " DiFelice " White - Yes Yes Yes Motion carried. PUBLIC SAFETY Trustee DiFelice stated that Columbia Hose truck was returned to the Village after approximately four months for repairs and moved that a letter be sent to the Fire Council, Fire Chief and President of Columbia Hose to ascertain if they are satisfied with the repairs before payment is made and that they be informed that in the future, should any major repairs have to be made, that they meet with the Board to discuss them, seconded by Trustee White. Carried. Trustee DiFelice stated that the annual inspection of the auxiliary police was held this evening at the high school. Trustee DiFelice stated that he is in receipt of the street lighting report from Edward McCarthy indicating the locations of the new street lights and the location of the lights which were removed. Trustee DiFelice stated that he is in receipt of a report from Chief Spota of awards given by the PBA for outstanding police work for 1980 to members of the police department. Of the 17 awards given, North Tarrytown received ten. Trustee DiFelice moved that a letter of commendation be sent to the Chief and the department for their outstanding work and that copies be placed in their personal folders, seconded by Trustee Gandolfo. Carried. Trustee DiFelice reported that several persons were charged with violation of the noise ordinance and the department is holding the radios. He also stated that several persons have been charged with marijuana violations in the rear of College Arms and for trespassing in College Arms and violations of consumption of alcoholic beverages in public. �-6Trustee DiFelice stated that the Chief received a letter from A.V Camilli, Public Sjchools of the Tarry towns, in appreciation forithe assistance of Ptlmen. Ciffone and Ferguson on a field trip to N.Y.C. Trustee DiFelice read a letter from Victor Albanese, 62 Devries Av< commending the police department, and in particular, Sgt. Hayward and Ptl. Cappello for the medical treatment administered to him on May 31si Trustee DiFelice stated that he is in receipt of an application foi taxicab station from Stephen Serina and M. Landry and moved that it be referred to the Chief for further investigation and report back to the Board of his findings, seconded by Trustee White. Carried. Trustee DiFelice stated that we are still in need of a dog warden and moved that a letter be sent to the Town of Mt. Pleasant requesting the use of their warden for two non-consecutive days per week, seconde by Trustee Gandolfo. Trustee DiFelice stated that the Mayor make mem also of the street signs which the Town was making for us, as well as the painting of the line on County House Road. Carried. Trustee DiFelice stated that he is in receipt of a letter from the County of Westchester, Dept. of Transportation, regarding proposed bus stops that it was the responsibility of the local municipality to insti and erect the signs. Bus stop ordinances will also have to be establii through public hearing, said trustee DiFelice. The matter was referred back to committee. Trustee DiFelice stated that he was approached by Mrs. Nancy Dyer, Secretary of the N.Y.S. Association of Therapists requesting permission to use the headless horseman emblem for their convention to be held in October in the Tarrytown Hilton. Following a short discussion, Trustee DiFelice moved, seconded by Trustee Gandolfo that permission be granted to the N.Y.S. Association a Therapists for the use of the official Village of North Tarrytown emblt as a non-profit use, for its Annual Convention to be held at the Tarn! Hilton in October, 1981. Trustee Tirnmings questioned if we had the authority to allow the emblem to be used and was answered by Trustee Cavalieri that Edward Simnowski has in his possession a letter from Walt Disney Productions granting us permission to use the emblem. Motion carried. Trustee DiFelice stated that work is progressing on Route 9-448. signal lights are being installed, he said. Trustee DiFelice stated that a letter has been received from the N DOT regarding our request for a traffic light at Broadway and Depeyster and that counters have been placed in the roadway and a report will be forthcoming from the State. Trustee DiFelice stated that a letter has been received from Mr. A Marasco, Director of the Office of Disaster and Emergency Westchester i regarding new mandates from the State that auxiliary police must be tra in the use of firearms and Criminal Law Procedure. A training school« be held from July 16-23, he said. Chief Spota has volunteered Lt. Bro and ammunition. �>'#*. -7- j^&^h. Carey, copies to our State Legislators, VJCVOA and N.Y.S.C.O.M. requesting funding for this mandate which was passed along to the Village, seconded by Trustee Gandolfo. ??JL On the question, Trustee Timmings stated that there is money for police education and auxiliary police to be spent at the discretion of the Chief. Trustee Cavalieri stated that the State knows when Village budgets are prepared. Trustee DiFelice stated that the County will report back to the State if no one attends the school. / Motion carried. Trustee White moved, seconded by Trustee Timmings that letters be sent to Senator Goodhue and Assemblyman Sullivan of our support of Senator Pisani's Bill concerning Child Pornography. Carried. With regard to widows receiving an increase in pension, Trustee DiFelice quoted article 7-194 of the Village law whereby the Board may not establish an annual pension in excess of $600. Any increase to widows is prohibited under the State. The only alternative is a cost of living adjustment, said Trustee DiFelice. The matter was referred back to committee. Trustee DiFelice proceeded to move that the reprimand concerning Ptl. Edward Ciffone be removed from his record, seconded by Trustee Cavalieri. On the question, Trustee Timmings stated that we had a couple of cases where we had people who fouled up for a long period of time and never had a reprimand in their personal folder and it would be difficult to prove a point to the State arbitrator. Counsel Ponzini stated that you have to know what the subject is and vote to go into executive session. Trustee Gandolfo stated that there have been no problems for a long time and did not think this would be starting a precedent, however, after a discussion, Trustee Gandolfo moved that to table the motion and refer back to the Board as a committee of the whole, seconded by Trustee Timmings. Trustee Soriano reported a balance of $41,792.23 in the Water & Sewer account. RECREATION Trustee Gandolfo gave the following report: Someone stole the rope bridge out of the old sewage plant. Registr] tion deadline for the summer program is June 30th. Included in the program will be Youth tennis lessons, weight lifting, teen softball, wrestling, aerobic dancing, racquetball, first aid, T.V. workshop, lacrosse, adult tennis lessons. Special events include concert series] roller skate to music, dog show and battle of the bands. Trustee Gandolfo stated that no one was using the Teen Center and moved that the center be closed and that the insurance be cancelled immediately, seconded by Trustee White. Carried. Trustee Gandolfo stated that she will write a letter to the VFW thanking them for their help. Trustee White stated that the Teen Center was tried, but was not successful. Trustee Gandolfo moved that the Mayor and Board of Trustees, depart] heads, Village Attorney, challenge the Tarrytown Village Board to a softball game on August 8th at 7:30 P.M. at Memorial Field, seconded bj Trustee Cavalieri. Trustee Cavalieri amended the resolution that those department heads as of the date of the letter be allowed to participate. Motion carried. SENIOR CITIZENS Trustee White stated that the citizens took trips to Wildwood andi boat ride. A letter of condolence and resolution was ordered sent to Mrs. Schwer' S family. ' t ' * Trustee White moved, seconded by Trustee Timmings that Dr. Jacquelin MacNaughton be appointed on the Senior Citizens Town of Mt. Pleasant Commission to fill the vacancy created by the resignation of Mrs. Sbezzi, seconded by Trustee Timmings. Carried. Trustee White stated that the Board was invited to attend the Senior Citizens picnic at Kingsland Point on July 15th. The Albany representative considers the school district aid is based on true value. When Albany proposes its aid to the Tarrytown School District, they see a different amount of value We are losing out on State aid, said Trustee Timmings. Trustee Cavalieri inquired as to what happened to the Secession Committee's tax exempt group who looked into this months' ago. Following a short discussion, the matter was referred to Trustee Timming's committee. MAYOR'S REPORT Trustee Timmings moved, seconded by Trustee White that a public hearing be held on July 20th, 1981 to adopt local legislation on National Flood Insurance program. Carried. Mayor Zegarelli stated that he is in receipt of a letter from the Commissioner, Dept. of Environmental Facilities, Westchester County, that the County is purchasing a sophisticated water leak detecting piece of equipment for $40,000 and are asking municipalities to share with them in the purchase of this equipment and North Tarrytown's share would be $616. This would permit us to use the equipment with their manpover when the need arises at no further charge. ffi Trustee White moved, seconded by Trustee Timmings that North Tarrytown share the amount of $616 for this purpose. Carried. Mayor Zegarelli stated that he is in receipt of a letter from the Dept. of Selective Service System asking us to appoint two people who could be considered to serve on the Selective Service System Board. The matter was referred to Labor Relations Committee. COMMUNICATIONS Communication from D. Walter Luberger, 139 Millard Avenue, reques sidewalk repairs at 281-283 No. Broadway was read and referred to the public works committee. Communication from Chief Glenn Amesbury, Sec'y. of Fire Council regarding changes in personnel in Union Hose and Rescue Hose Companies request for exempt certificates for R. Biro, R. Maccabee and N. Kosill request for permission of Rescue Hose Company to take its apparatus to Haverstraw on August 29th, Union Hose to Thornwood on July 15th and Columbia Hose to Montrose on August 12; and Chief Hennessey's request take the Chief's car to the parades was read. Trustee DiFelice moved, seconded by Trustee White that action of Council be confirmed in all respects. Carried. Communication from D. Lopano, 155 No. Washington Street, requestin the removal of a tree in front of his residence was read and referred the public works committee. Communication from M. Baird, Sec'y. Sleepy Hollow Cemetery Board o Directors, that Mayor Zegarelli's letter was referred to their legal Counsel was read and filed. Communication from John Flynn, Executive Director of 126 Valley Street, noting conditions of the parking lot and playground was read and referred to the recreation committee. UNFINISHED BUSINESS Trustee Cavalieri moved that Wally Buxton be appointed Village Historian, for the remainder of the year, to fill the vacancy created by the resignation of Mrs. Alice Runyon, seconded by Trustee DiFelice, Carried. Mayor Zegarelli was authorized to sign the agreement between the school board and Village regarding Fremont Pond. Trustee DiFelice stated that Rescue Hose fire apparatus committee has been meeting on a regular basis with apparatus companies. Trustee DiFelice stated that he spoke to Mr. Steve Sombor of Cabl at the Conference of Mayors in Grossingers last week about 100 Colleg Avenue and was told that a letter should be sent to him outlining wha \ �Mi\• TfW"*»T-, 11Cable TV has not done so far and why. Trustee Cavalieri stated that a meeting should be held with the Traffic & Transportation Committee and Board to discuss Strand Theater, 21 Beekman Avenue, Elm St., etc. The matter was referred to Governmental Relations Committee. NEW BUSINESS / Trustee Timmings moved, seconded by Trustee Soriano that the Board go on record as protesting the State's attempts to put a limit on aid. Carried. i i . " Trustee Gandolfo moved, seconded by Trustee Soriano that the bills submitted on the General Fund and Water & Sewer warrants dated June 1st, 1981 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Prohibit the sprinkling of lawns except with hand held hose. Sanitation Dept. 1. Cleaned Morse, Clinton St. and I^rgotta Courts playgrounds, installed trash receptacles and placed these parks on a regular (2) day a week pick up schedule. 2. Placed John Paulding School Day Camp on a regular pick-up schedule during the Day Canp Program. 3. Cleaned up the alleyways on both sides of the former Strand Theatre and will install locks on the exit gates. 4. STarted a program of encouraging the "Breaking down" or flattening of cardboard boxes and tying them in bundles for neater appearance and more efficient pick-up. The program is in (3) steps (1) persuasion by the Sanitation Dent. (2) warning by the Police Dept. and (3) if still no cooperation, the Police Dept. will issue a summons. 1. Replaced sidewalk and separate curb on Lawrence Ave. (west side) from BeerJTian to REscue Hose Fire Headquarters and on the east side from Beekman to Rescue. 2. Rebuilt catch basin on Sleepy Hollow Road near North Street. 3. Repaired catch basin on Lakeshore Close. �/ 4. Excavated "cave-in" over storm drain in Birch Close and backfilled. '5. Continue with regular branch pick-up >bndays and Thursdays and paper for recycling on the 2nd and 4th Mondays.
