August 3rd, 1981 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date, in the Court Room of the Village Hall. PRESENT Philip E. Zegarelli, Mayor James J. Tirrmings, Peter Soriano Thomas Cavalieri Mario DiFelice Margaret VJhite Janet Gandolfo . TRUSTEES Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8 P.M. with a prayer and salute to the flag. Trustee Tiimuhgs moved, seconded by Trustee White that the minutes of the July 17th, 1981 meeting be approved with a few minor corrections. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Miss Eva Piedmonte, Gordon Avenue, North Tarrytown stated that she had several items she would like to discuss with the Board. She asked if the curb cuts that had been promised for the handicapped has been done, and whether the parking space in front of the Strand Theatre which overlapped into the crosswalk was going to be corrected and that the matting and hand rail on the ramp in front of the municipal building was in a dangerous condition. Trustee Soriano stated that curb cuts have been made where new sidewalks have been installed and would be continued to be done as more new sidewalks are installed. Trustee Cavalieri stated that the ramp would be repaired and inquired if the Chief of Police had reconmended a handicap parking space elsewhere as the telephone company had installed a telephone booth in the area of the parking space in front of the Strand Theatre. REPORTS OF COMMITTEES BUILDING & GROUNDS Trustee Cavalieri reported that the full time caretaker will be assigned to work at the Central Fixeheadquarters and the Village Hall and the part-time caretaker will be assigned to clean Rescue Hose and Union Hose. Trustee Cavalieri asked that Chief Spota direct the people in the lobby of the building on Thursday to go into the courtroom or leave. They have been congregating in the lobby, smokint and littering and creating a nuisance. Our CETA worker, Paul Powell will be leaving on August 14th. After a discussion, Trustee Cavalieri moved, seconded by Trustee Tinmings that action of the *feyor in signing the contract with Architect Ronald lurnquist be confirmed. Trustee Gandolfo reported that the Treasurer has invested with the First Nation Bank of North Tarrytown $ 600,000.00 for 30 days at 13%7o and moved, seconded by Trustee Soriano that the action of the Treasurer be confirmed. Carried. Trustee Gandolfo moved that $745.97 be transferred from A1990. 'Contingency Fund to A1930. Judgments and Claims to cover cost of CourtOrder reimbusring taxes for year 1979 and 1980 as agreed, seconded by Trustee Soriano motion was carried. GOVERNMENTAL RELATIONS Trustee "White reported that she has contacted Michael Divney's office regarding CD.A. funds and is awaiting his return call. Trustee White stated that a meeting of the Transportation Committee will be held on August 11th, 1981 at 8 P.M. LABOR RELATIONS Trustee Timmings reported that another grievance was filed with the Superintendent of Public Worl£. He has inspected two other grievances in a timely fashion. PUBLIC SAFETY Trustee DiPelice reported that the Village of North Tarrytown Police Department in its Annual softball game with Tarrytown Police Department has won the game 13-4 and also the trophy. Patrolman Gordon Ferguson was voted most valuable player and proceeds of the game are donated to Rosary Hill. He reported that he had received an estimate of the cost of 2 and 3 hour meter timers and dial plates. Cost per timer would be $12.81 each with a ininimum purchase of 12. He reported they would discuss it at the work session on Thursday. Trustee DiPelice reported that he had recieved notice of promotional exams for Lieut., Captain and Chief and moved, seconded by Trustee Timmings that the Village of North Tarrytown not participate. Carried. Trustee DiPelice stated that the Immaculate Conception Church will hold its annual bazaar the weekend of August 14th and August 21st and that the Police Dept. will notify all residents in the area so that they can make other arrangements for parking of their cars. Trustee DiFelice reported that after investigating the matter it was decided that the P.M.I.A. be notified that the "stop sign* at the corner of Hunter Avenue and Munroe Avenue will be removed. He reported that the N.Y.S. Department of Environmental Conservation has stated surveying the trees in the Village of North Tarrytown and report should be available sometime in November, The survey is being conducted with the assistance of the County Youth Bureau. Trustee DiPelice stated that a Court decision was handed down whereby applicant �-3- over age 29 years will not be removed and must be accepted for appointment as partolman. He reported that a letter had been received from Daniel Guido, Ccnmissioner of Public Safety for the County thanking the village for their prompt response during the riot at Westchester County jail, and moved, seconded by Trustee White, that letters be sent to the Police and Fire Department for thier action during this special callout. Carried. He reported that he -was in receipt of Police Report, Overtime and Sick Times reports for the month of July and ordered them placed o file. Trustee DUelice reported that 13 Auxiliary Police had completed their special training in the use of deadly physical force and are in the process of completing required range training. Trustee DiFelice moved, seconded by Trustee Gandolfo that a letter be sent to the P.M.I. A. regarding the littering on the west side of the railroad tracks. Carried. He reported that the Rescue Hose apparatus committee has met with Pierce Co. PUBLIC WORKS Trustee Sora*no gave the following report: The water and sewer excavated and repaired sanitary sewer on Kelbourne Ave., east of Monroe, repaired floor of sanitary sewer manhole on Fremont Circle, worked sewer jet on Lawrence Avenue, painting of fire hydrants within the village. Cash balance in the water department as of 8/3/81 is $26,098.08. Trustee Soriano reported that the highway department is sealing all joints on 24" storm sewer running across New Broadway north of Pine Street, replacing concrete cum at the corner of Pine Street, Chestnut Street and Valley Street. Replaced sidewalk with sepflirate curb on Chestnut Street from Valley Street west approximately sixty feet. Also replaced gutter on Birch Close with black top binder and the gutter on the west side of County House Road. Painted lines to indicate proper parking areas on Irving Place. There is a position still open in the Sanitation Department and we are still interviewing for the position. Trustee Soriano moved, seconded by Trustee Gandolfo that Gus Paese be authorized to proceed with detailed specifications for the repaving of Gesner Place, Pleasant Street portions of Beekman Avenue, Dell Street, Hemlock Drive and Fremont Road, with bids returnable at the Special Meeting to be held on September 14th, 1981. Carried. Trustee Soriano moved, seconded by Trustee Gandolfo that the village treasurer be authorized to contact the Bonding Attorney to prepare the necessary documents for the bonding of the 1981 Road Paving Program in an amount not to exceed $110,000. Carried. Mayor Zegarelli read letter from Senator Mary Goodhue regarding the litter along Route 9. Trustee Soriano stated that bids for sanitation trucks and cherry picker will be opened on August 17th. �RECREATION & PARKS Trustee Gandolfo gave the following report: North Tarrytown all-stars defeated the Irvinggon all-stars in the annual Prank Rigotty Women's Ail-Star game 19-9. Donations amounting to $125.00 was forwarded to Rosary Hill in the name of Frank Rigotty. Village officials softball game -will be held on August 8th at 7:30 P.M. at Memorial Field. Roller Skating to music at Mbrse School blacktop area on Thursday, August 6th at 7 P.M. Misic by D.J. Fred Madona. On August 12th the 1st Annual Battle of the Bands will be held at Morse School. Among the groups will be Velvet Horse, Ventrics Domination and Midnight Sun. Hie day camps are into the fifth week and still planned is a fishing trip, the movie''Godzflla vs. the Bionic Monster". The annual Olympics and cookout are scheduled for the last day of camp on August 14th. The keys for Clinton Street Playground will be held by the Police who have agreed to lock up the playground each night. Trustee Gandolfo reported that a letter of resignation has been received from Robert Lugrezia effective August 17th 1981. Trustee Gandolfo moved, seconded by Trustee White that Mr. Lugrezia's resignation be accpeted with regret and that a letter be sent to him wishing him "good luck". Carried. Trustee Gandolfo moved, seconded by Trustee DiFelice that an advertisement be placed in The Daily News for a recreation and parks lab*sr@:, to replace Mr. Lugrezia. Carried. Trustee Gandolfo moved, seconded by Trustee Cavalieri that John Nicol, who is employed by the recreation department, take over the duties of Mr. lugrezia at the same rate of pay until a replacement is hired. Carried. Trustee Gandolfo stated that a Recreation Committee meeting and a Finance Committee meeting will be held on Wednesday, August 5th at 7:30 P.M. Trustee Tinmings stated that a Police Bargaining Meeting will be held on Wednesday, August 5th at 8:15 P.M. SENIOR CITIZENS Trustee White reported that there would be no meetings held during the month of August. The Senior Citizens are going on a trip to Pomona on August 4thT Trustee White stated that she had asked Mr. Doorley to see that all department heads were given copies of reports to show the balances in their accounts under C.D.A. I TAX EXEMPT PROPTERY & ASSESSMENTS r* Trustee Tiimrings reported "Progress", Mayor Zegarelli reported t h a t an additional $54,838. w i l l be coming from the State in the form of additional revenue sharing to be received sometime in the early Spring. Trustee Tirnmings moved, seconded by Trustee White t h a t a l e t t e r of thanks be sent to Senator Warren Anderson for h i s aid in getting additional s t a t e aid for the villages in N.Y.S., with a copy sent to the N.Y.S. Conference of Mayors. Carried. / Mayor Zegarelli stated t h a t Counsel Ponzini should contact the Westchester County Attorneys Office regarding mutual aid by volunteer firemen and policemen in such situations as the recent j a i l r i o t . Counsel Ponzini was a l s o d i r e c t e d to contact the S t a t e regarding the Special Franchise given t o McClean Cable T.V. 'Mayor Zegarelli stated that the Treasurer had received a memo from the Federal National Mortgage Company regarding tax l i e n #22 in the amount of $6,082.29 for 1978-1979 taxes on 100 College Avenue also known as Section 16 Block 16 Lot 1. He moved, seconded by Trustee Tirnmings t h a t the l i e n be cancelled. Carried. Mayor Zegarelli reported that Counsel Ponzini has sent out l e t t e r s t o various people who own the v i l l a g e money because they had damaged v i l l a g e property. Mayor Zegarelli stated t h a t he had received a l e t t e r from CETA with reference to projects for 1982 f i s c a l year and anyone wishing further information could go to their office in White Plains to review proposed plans for CETA funding. Mayor Zegarelli stated t h a t he had received 1981 Volunteer Firemen L e g i s l a t i o n recently passed and directed t h a t copies be sent t o a l l F i r e Chiefs, F i r e Wardens and Fire Companies for t h e i r perusal. Mayor Zegarelli stated t h a t he has sent a l e t t e r t o Mayor P i l l a of Tarrytown regarding the frequent c a l l s received by the North Tarrytown Ambulance Corps t o answer c a l l s in Tarrytown. t V- i. Mayor .Zegarelli reported t h a t plans had been recieved for r e h a b i l i t a t i o n of the building a t 21 Beekman Avenue sometime ago, but a building permit was not requested. Ihe v i l l a g e had requested Ron Turnquist t h e Architect t o make an i n spection with the Building Inspector and the consensus i s t h a t the owner could r e build but must conform t o a l l s t a t e and local building codes and c o n d i t i o n s . After a discussion Trustee Tirnmings moved, seconded by Trustee DiFelice that notification be sent t o the owner t h a t based on t h e a r c h i t e c t ' s r e p o r t the building i s unsafe and i f he intends to r e p a i r and renovate t h a t a p l o t plan and a request of a building permit be submitted with an estimate of construction schedule by September 1st, 1981 or t h e v i l l a g e w i l l take a l l necessary steps t o p r o t e c t the area, demolish the building with costs t o be assessed a g a i n s t the property. Carried. The Building Inspector was directed to confer -with Counsel Ponzini regarding the matter. i" - * H i I ! Mayor Zegarelli stated that he had received a l e t t e r from the M.T.A. regarding the repair of the railroad bridge over Palmer Avenue. , >t 4* �Mayor Zegarelli stated that he had written to Mr. Pearce of HID, Congressman Peyser, Senator Goodhue and Assemblyman Sullivan regarding Search for Change. Trustee Gandolfo stated that she and Trustee DiFelice will attend with Mayor Zegarelli a meeting to be held by CRISP at the.at Warner Library on August 4th, at 7:00 PM regarding the home for the mentally retarded, on Pocantico Street. Mayor Zegarelli stated that a meeting be set up with the merchants regarding parking and the changing of the times on the meter heads and dials. 'It appeared that merchants want two and three hour meters but not in front of their businesses. After a discussion Trustee Cavalieri moved the following resolution: WHEREAS, there is a continued concern to increase the available parking for the irmer Village of North Tarrytown; and WHEREAS, there is a vacant lot on Pocantico Street within such Village; and WHEREAS, it may be beneficial for the Village of North Tarrytown to use its powers of Eminent Domain to acquire said lot for municipal parking purposes. NCW, THEREFORE, be it resolved that the Village Attorney, Building Inspector and such other department heads as they may request be authorized to investigate the possible use of said lot for municipal parking and the feasibility for obtaining the said lot through Eminent Domain, any and all recommendations to be subject to the review, further study and approval of the Mayor and Board of Trustees. Seconded by Trustee Tiimiings. Carried CCMMUNICATIQNS: Ccmnunication from Richard C. Sweet, 309 North Washington Street, N. Tarrytown, regarding the dredging of Fremont's Pond and the village's liability on private property was read and upon motion duly made and seconded was referred to the Board as a whole and Mr. Jack Gorman, Special Counsel regarding Fremont's Pond. Carried. Conmunications from the Van Tassel Tarrytown Company was read regarding repairs to sidwealk in front of their property on Beekman Avenue and upon motion duly made and seconded was referred to Department of Public Works. Carried. Communication from Robert Lugrezia, Center Street, Irvington, New York, resigning effective August 17th, 1981 was read and upon motion duly made and seconded was accepted with regret. Carried. OLD BUSINESS: Trustee Gandolfo reported that all property owners surrounding Fremont's Pond have signed the "save harmless clause" except for one and that the specifications for the dredging would be completed shortly. After a discussion regarding installation of cable T.V. at College Arms, Trustee White moved, seconded by Trustee DiFelice that a letter be sent to McClean Cable T.V. informing them that the state was being notified that they were not cc^orming to the conditions of the Special Franchise. Carried. Trustee Timnings reported that he had received complaints that during the winter months litter was being placed in the sand barrels and thought that more \ �-7- ^ /3 litter barrels could be placed in various parts of the village. Trustee Soriano stated that litter barrels were $129.00 each and that the littering ordinances should be enforced. ' * NEW BUSINESS: Trustee Gandolfo stated that she had received numerous complaints about the group home on Farrington Avenue and moved that the Board request the Citizens Advisory Committee of the home to meet with the Board and advise than of the various problems and complaints received by Board members, such meeting to be held on Thursday August 20th, at 8:00 EM. Carried After a discussion Trustee Timmings moved seconded by Trustee Cavalieri that the towing of cars from accidents, when called by Police Department be clarified and a new agreement drawn. Carried. / Counsel Ponsini reported that a memo had been received from the Appelate Div., Second Department rendering a decision that a village cannot be sued for punitive damages, but only for ordinary and compensatory damages. Trustee White moved, seconded by Trustee Timmings that Mr. Door ley be authorized to complete the application for Urban County, in draft, and submit to the Board of Trustee for approval before submission on September 9th, 1981. Carried. Trustee Cavalieri stated that he was informed that North Tarrytown could receive substantially more money under UDAG as North Tarrytown is in Mt. Pleasant which'is considered a "target area". Trustee Timmings moved, seconded by Trustee White that the bills submitted on the General Fund and Water & Sewer Department warrants dated July 3rd, 1981 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee White moved, seconded by Trustee DiFelice that the same be duly adjourned. Carried.
