https://sleepyhollow.localarchives.org/files/original/1affc1d97e4f5a2b6b3790ab46ca03da.pdf ecba446d0c17a8562aceb9a638edccd9 PDF Text Text Meeting Date: 02/14/2023 Resolution #: 02/24/2023 Resolution of the Board of Trustees of the Village of Sleepy Hollow Accepting Offer of Dedication from Edge-on-Hudson WHEREAS, over the years, the Village of Sleepy Hollow (“Village”) has occasionally accepted donations and dedications of various parcels of land for public use be it as streets, parks, easements, or reservations of land; and WHEREAS, on February 1, 2023 DelBello, Donnellan, Weingarten, Wise and Wiederkehr, on behalf of Lighthouse Landing Communities LLC ("Developer") the Residences at Edge on Hudson Homeowners Association, Inc. (“HOA”), and Apartments, did make and “Irrevocable Offer of Dedication” to the Village of Streets, Public Utilities, Public Spaces and related easements, collectively, the “Dedication Property”; and WHEREAS, the Developer has therefore provided related deeds; and WHEREAS, the Developer has also provided a Sanitary Sewer, Water Main and Stormwater Drainage Easement and Maintenance Agreement between the Developer and the Village; and WHEREAS, the Developer has also provided an Access Easement Agreement between the HOA and the Village; and WHEREAS, the Developer has also provided a Maintenance and Environmental Management Agreement; and WHEREAS, the Village Board of Trustees has reviewed the same; and WHEREAS, compliance with the State Environmental Quality Review Act (SEQR) was completed by the Village Board for the Special Permit and Riverfront Development Concept Plan on January 25, 2022; WHEREAS, the Dedication Property has been, or will be, suitably improved, and any required improvements not yet completed will be bonded to the satisfaction of the Village; and WHEREAS, The Village wishes to accept the Offer of Dedication and deeds, and enter into the aforementioned agreements: Now therefore be it resolved that: 1. The Board of Trustees for the Village authorizes the acceptance of the aforementioned agreements and related documents, and authorizes the Village Administrator, or the Mayor, to execute all documents necessary to accept the Offer of Dedication and effectuate transfer �to the Village of ownership of the Dedication Property described therein and to make any non-substantive revisions as they may deem necessary; and 2. All documents and agreements shall be in a form acceptable to the Village Attorney and Village Architect. 3. Bonded funds will be held by the Village Architect and released per his reasonable discretion as outstanding, or punch list items are completed by the developer.
