Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Gandolfo moved, seconded by Soriano that the minutes of the meeting held on August 3, 1981 be approved as written. Carried. Mayor Zegarelli called for bids for the repair and maintenance of meters for the period 9/1/81-5/31/82. Edward Simnowski No. Tarrytown, N.Y. $2,925.00 Certified check in the amount of $292.50 enclosed. Roger Manco Tarrytown, N.Y. No check enclosed $2,830.00 Trustee Timmings moved, seconded by Trustee Gandolfo that the bids be referred to the public safety committee for evaluation and report back to the Board on Sept. 8th. Carried, Mayor Zegarelli called for bids on a 1981 20 yard garbage truck and a 1981 25 yard garbage truck. Treasurer Amato opened the following bids: (see attached) Trustee DiFelice moved that the bids be referred to the public works committee and Supt. of Public Works for report back to the Board, seconded by Trustee Soriano. Trustee Timmings amended the resolution that as soon as the committee has met that the deposit checks be returned to the non-successful bidders no later than Sept, 1st, seconded by Trustee Soriano. Treasurer Amato opened the following bid: Frank Chevrolet, North Tarrytown, N.Y. Check in the amount of $1,206.65 enclosed. $12,164.05 Trustee Soriano moved that the bid be referred to the public works committee and Supt. of Public Works for analysis and report back to the Board with their recommendation by Sept. 8th, seconded by Trustee White. Carried. Mayor Zegarelli read the notice of hearing on a proposed amendment to amend Chapter 57, V & T, Sec. 57-14A and 57-38 One Hour Parking 9:00 A.M. - 5-00 P.M. instead of 9:00 A.M. - 6:00 P.M. and asked if there was anyone present who would like to address the Board on the proposed amendment. / No one present speaking for or against the proposed amendment, Trustee Timmings moved, seconded by Trustee White that the hearing be closed. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter. il. Mr. Sal Donzella, owner of Donzella's garage, stated that several years' ago he presented a letter to the Board requesting sidewalk repairs. He stated that the foreman had inspected the sidewalk and agreed that it should be replaced, however, nothing has been done as yet. He noted other sidewalk requests were completed after his request was made. Following a short discussion, the matter was referred to the public works committee. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that the new part-time man started today and maintenance work is continuing satisfactorily. Trustee Cavalieri requested permission to explore the idea of a mechanical engineer to check out the heating system in the building. He stated that the thermostat is located in the Clerk's office and when the office is closed the thermostat is turned down, however, it is being raised during the night by an unknown person. The interest earned on certificate of depo invested during the month of July amounted to $9875.00. Trustee Gandolfo moved that the following resolution be adopted. CAPITAL NOTE RESOLUTION DATED AUGUST 17, 1981, AUTHORIZING THE ISSUANCE OF $27,500 CAPITAL NOTES OF THE VILLAGE OF NORTH TARRYTOWN. Section 1. (a) Pursuant to a Bond Resolution dated June 22, 1981 authorizing the issuance of $80,750 Serial Bonds and $4,250 Capital No of the Village of North Tarrytown to finance the reconstruction of a building for use as an office for the Village Highway Department (the "Highway Department Building Resolution"), the Trustees hereby determ to issue capital notes in the aggregate principal amount of $4,250; ail (b) Pursuant to a Bond Resolution dated June 22, 1981, authorizin the issuance of $441,750 Serial Bonds and $23,250 Capital Notes of the Village of North Tarrytown to finance the construction of a Multipurpose Building for various Village departments (the "Multi-Purpose Building Resolution"), the Trustees hereby determine to issue capital notes in the aggregate principal amount of $23,250. Section 2(a) The capital notes issued under the Highway Departmen Building Resolution shall be issued as two notes, numbered 1 and 2, sh be in the denominations of $2,125 each, shall be dated August 18, 1981 shall be payable August 1982, and August 18, 1983, respectively, shall bear interest at the rates of 5%7o and 5%70 per annum respectively, and shall be sold to First National Bank of North Tarrytown. Section 3. This resolution shall take effect immediately upon adoption. Trustee Timmings seconded the motion and the motion was adopted. Trustees Timmings, Gandolfo, Soriano, Cavalieri, DiFelice and White voting for the affirmative and no trustee voting for the negative. Car Trustee Gandolfo stated that at a previous meeting, a resolution was passed to accept bids on Fremont Pond on September 8th. To date, the specifications have not been received. She stated that she called Mr. Gorman, but has not received any response at all. j i Following a discussion, Trustee Gandolfo moved that a letter be sent to Jack Gorman from the Board inquiring as to the status of the specifications on Fremont Pond, seconded by Trustee White, said specif cations to be presented to the Board by August 24th. Carried. Trustee Cavalieri stated that at the work session of the Board it was discussed that a time limit be placed on the whole project, and mo that the previous date for the return of bids on Fremont Pond be postponed to Sept _ember 21st, instead of September 8th in order to enable the proper advertisement and preparation of specs, seconded by Trustee Timmings. Carried. Trustee Gandolfo stated that commencing September 1st, all depart heads will employ part-timers no more than 20 hours per week. ) I1 if ; ) i -4 �I i l mmmm IMfflmm rmmmmmmt Tfto^'n -4- \\T\ % GOVERNMENTAL RELATIONS ?f^ Trustee White maed, seconded by Trustee Cavalieri that the following resolution be adopted and that the Mayor be authorized to sign the necessary agreement with the County of Westchester for the purpose of undertaking a Community Development Program pursuant to the Housing & Community Development Act of 1980: WHEREAS, the Secretary of Housing and Urban Development of the United States is authorized, under Title I of the Housing and Community Development Act of 1980, to make grants to states and other units of general local government to help finance Community Development Programs, and WHEREAS, Section 99-h of the General Municipal Law of the State of New York grants to any municipal corporation the power, either individually or jointly with one or more other municipal corporations, to apply for, accept and expend funds made available by the Federal government, either directly or through the state, pursuant to the provisions of any Federal law which is not inconsistent with the statutes or consticution of this state, in order to administer, conduct or participate with the Federal government in programs relating to the general welfare of the inhabitants of such municipal corporation, and / il. WHEREAS, the Community Development Act of 1980 and any "Eligible Activities" thereunder are not inconsistent with the statutes or Constitution of the State, and WHEREAS, a number of municipalities have requested Westchester's participation, and the County of Westchester has determined that it is desirable in the public interest that it make application for Community Development Block Grant funds as an Urban County, and WHEREAS, participation by the County of Westchester as an Urban County in the Community Development Program requires that the Village of North Tarrytown and the County of Westchester cooperate in undertaking, or assisting in undertaking, essential community development and housing activities, specifically those activities authorized by statutes enacted pursuant to Article 18 of the New York State Constitution. WHEREAS, this Board deems it to be in the public interest for the Village of North Tarrytown to enter into a Cooperation Agreement with the County of Westchester for the aforesaid purposes, NOW, THEREFORE, BE IT RESOLVED, that Philip E. Carried, Trustee White read over balances in CDA funds pertaining to public works, recreation, fire, etc. LABOR RELATIONS Trustee Timmings stated that he received salary data from the Dept. of Labor for 1980 which also determines the clarification of jobs He stated that the committee will be reviewing the professional staff as soon as negotiations are completed with the police. Trustee Soriano inquired if steps in salaries could be taken when a new person is hired. He stated that it is not fair to start a new person at the same salary that a person who has been working for ten years receives. Trustee Timmings stated that there is an anti-discrimination law which states equal time and equal pay. This is also in the contract, he said. PUBLIC SAFETY Trustee DiFelice stated that there was a small problem with the radio which we are purchasing for Fire Patrol truck which occurred in the G.E. factory. It is under the State contract and as soon as the problem has been straightened out, another radio will be shipped to us, said Trustee DiFelice. Trustee DiFelice reported that during the past seven months, members of our police department conducted a narcotics investigation and moved that a letter of congratulations be sent to Daniel Guido, Commissioner, Westchester County Dept. of Public Safety, and to Det.Sgt Carmen DeFalco and Det. Vincent Butkovich thanking them for their excellent work and to Ptlinen. Ferguson and Caixiero for their work during the raid, seconded by Trustee Gandolfo. Carried. J Trustee DiFelice reported that two taxi operators were issued summonses for operating a taxi without a license. I i Trustee DiFelice reported that the Auxiliary Police have completed the required training and are now in the process of completing their firearms training under the new State law. Trustee DiFelice stated that a letter was received from Richard Carbone, Assistant Director of the Westchester County Youth Conservatio Corps, notifying us of certificates presented to Susan Quinn, 61 Chestn Street and John Koszelius, 95 Beekman Ave., for the work they have done in the recreation areas of the County and moved that the Village preset them with a certificate of achievement;, seconded by Trustee Soriano. Carr Trustee DiFelice moved that the old 1973 Chevrolet police van #501 be transferred to the Department of Public Works, seconded by Trustee Cavalieri. �-6- /C/^ Trustee Timmings amended the motion that it be placed on a three months trial period to ascertain whether or not the Village is getting enough out of it to justify the gas and insurance, seconded by Trustee DiFelice. Carried. Trustee DiFelice moved that the 1977 police car (Nova) be sold "as is" bids returnable on September 8th, and if there are no bids that the car be scrapped, seconded by Trustee Gandolfo. Trustee Timmings amended the resolution that an upset price of $200 be placed on the car, seconded by Trustee Gandolfo. Carried. Trustee DiFelice moved that the 1970 Ford station wagon #503 be transferred to the public works department to be utilized by the recreation department and building inspector on a 90 day trial basis for local Village use only, seconded by Trustee White. Carried. Trustee DiFelice moved that police car #511 be transferred to the public works department and that the present car used by the foreman, 1974 Chevrolet be placed out for bids, "as is" returnable on Sept. 8th, and if there are no bids that the car be scrapped, seconded by Trustee Gandolfo. Carried. Trustee DiFelice stated that the new police car was involved in an accident the other night and has been totaled. Due car when proceeds seconded to the emergency, Trustee DiFelice moved that we replace the we receive the proceeds from the insurance company and if the are higher, we will come back to the Board for recommendation, by Trustee Gandolfo. Trustee DiFelice stated that if we get the money to cover the new car arrangements will be worked out, if not, we will rediscuss the issue. Motion carried, Trustee DiFelice moved that the Traffic Bureau be notified on behalf of the Board to commence issuing warrants to scofflaws, said warrants to be processed by the police department under the scofflaw program, seconded by Trustee Timmings. Carried. Trustee DiFelice stated that if the Court is in need of help, the Chief will have a Lieutenant aid in preparing the warrants. PUBLIC WORKS Trustee Soriano reported that a leaking hydrant was repaired at Beekman Avenue and Broadway and that the department disconnected the abandoned service from the main on Valley Street and backfilled same. Meter readings are being taken throughout the Village. Bank balance in the water account as of Aug. 17th is-$14,141.24. Trustee Soriano reported that the department installed new sidewalks on Valley Street and No. Washington Street', Hedges have been trimmed along Riverside Drive. �-7Trustee Soriano moved that David Freyler be appointed sanitati on man at a salary of $15,581, less $500, subject to 'six months probat period effective August 21, 1981, seconded by Trustee Gandolfo. Carrie RECREATION Trustee Gandolfo called for a meeting of the recreation committee and commission and Pat Lofaro for August 26th at 7:30 P.M. Trustee Gandolfo reported that the Day Camp ended with a picnic attended by 150-175 people. Our thanks to Mr. Nardullo who directed the Camp. She stated that a battle of the bands was attended by 300 teenagers. Trustee Gandolfo reported that Victor Page and Paul LaBianco (Mfg. representative) inspected the equipment at Barnhart Park and fou; it to be safe and installed very well. The vandalism in Clinton St. park has been reduced and there are not many problems there now, said Trustee Gandolfo. The closing of the park for a trial period was very effective, she said. Attendance is up also. The August 8th softball game between the officials of both Village will be rescheduled some time in September, said Trustee Gandolfo. Trustee Gandolfo stated that letters have been received commending Pat Lofaro about the Day Camp and moved that they be placed in his folder, seconded by Trustee White. Carried. SENIOR CITIZENS Trustee White reported that no meetings are held during the summer TAX EXEMPT & ASSESSMENT Trustee Timmings stated that a storage shed in the cemetery was improperly listed as exempt and moved that Section 17, Block 1, Lot 1 be added to the assessment roll (1981) and a bill for taxes be issued, with no penalty, to the cemetery for payment, seconded by Trustee Whiti Carried. MAYOR'S REPORT: Mayor Zegarelli stated that he received a memo from Bill Doorley that the Director of 126 Valley St., John Flynn, has requested that rents for 79 College Avenue be paid at 28 Beekman Avenue. Following a short discussion, Mayor Zegarelli stated that a letter! will be sent to Mr, Flynn, as President of the Board of Directors, that] we shall continue to avail ourselves of the courtesies and kindness given by the North Tarrytown Housing Authority and that the rent of 79 College Avenue will be collected at 126 Valley St. Mayor Zegarelli stated that he is in receipt of a communication frj Mr. Bohlander, County Planning Dept., stating that additional highway funds will be allocated directly to the Village government. �li m i^J mtmBfflmm mmmmmmmti ^ -8- 11 '<T!**T"» /?y Mayor Zegarelli stated that he is in receipt of a copy of the Certificate of Incorporation regarding Search for Change from Assemblyman Peter Sullivan. W Mayor Zegarelli read the copy of a letter signed by Trustee Timmings to Mr. O'Connor, Field Representative, CSEA, in answer to grievances and statements made by him. Trustee Soriano moved, seconded by Trustee Cavalieri that action of Trustee Timmings be confirmed by the Board. Carried. Trustee White moved, seconded by Trustee Cavalieri that Trustee Timmings be authorized to write a letter to CSEA inquiring as to when their election would be held. \ / Motion carried. Mayor Zegarelli stated that Con Edison will hold hearings on their gas rate proposals in Elmsford on September 10th. Trustee Cavalieri moved that a letter be sent to the Public Service Commission opposing the gas rate increase, seconded by Trustee White. Carried. Mayor Zegarelli stated that a letter has been received from the Speaker of the Assembly, Stanley Fink, that payment for State's local assistance will be distributed on or before February 1, 1982. We have received official notification that we will receive $200,000, said the Mayor . COMMUNICATIONS Communication from Mrs, Mary Adams, 159 Webber Avenue, regarding the noisy manhole cover in front of her house was read. It was stated that-measures were taken to reduce the noise, however, Mr. Biros was asked to investigate the cover again. Communication from Town Clerk, Beatrice Connolly, requesting permission to use Central Fire Headquarters, Union Hose and Rescue Hose quarters for the November 3rd election from 6 - 9 P.M. was read. Trustee Timmings moved, seconded by Trustee White that permission be granted. Carried. Communication from Margaret Siegelstein, 30 New Broadway, requesting the removal of a tree in front of her residence which is causing plumbing problems was read and referred to the public works committee. UNFINISHED BUSINESS With regard to the hearing to amend Chapter 57 regarding one hour parking limit from 9 A.M. - 5 P.M., Trustee DiFelice moved, seconded by Trustee Cavalieri that the following Local Law #6 of 1981 be adopted: The Board of Trustees of the Village of North Tarrytown at a regular meeting assembled and after published notice and public hearing do hereby ordain and enact Local Law #6 of 1981 of the Village of North ! »' ' i' J i •> i l! Article IV - Section 57-14A, One hour limit parking. A between the hours of 9:00 A.M. and 5:00 P.M. b. Article VIII, Section 57-38, Schedule of Parking Meter Zone. A. One Hour Limit: Between 9:00 A.M. and 5:00 P.M., etc. This Local Law shall take effect in the time provided for by law CARRIED UNANIMOUSLY. Mayor Zegarelli stated that he received a call from Mr. Margoshes Chairman, Buildings & Grounds of the Board of Education, who has requ a meeting with the Board after Labor Day. Trustee DiFelice stated that with regard to the Mayor's inquiry about the height of street lights at route 9 and 448 he contacted the State engineer and was told that they should be 16 ft. from the ground. We may have difficulty in replacing the burnt out bulbs in the future, said Trustee DiFelice, Mayor Zegarelli stated that the Traffic & Transportation Committe has requested a small amount of funds to hire an engineer to present plans and proposals for parking alternatives in the Village. He stated that he will ascertain whether or not funds are available through CDA. Trustee DiFelice inquired as to in whose authority the Strand Theater lies. He stated that if possible purchasers want to look over the building, who has the key for the premises. Mayor Zegarelli stated that the key is being held by the police department. Following a discussion, the Building Inspector was authorized to maintain the key for availability to any interested parties who want t reivew the Strand Theater, and that visits be fixed at his convenience Mayor Zegarelli appointed Trustee White United Nations Coordinator Trustee White moved, seconded by Trustee DiFelice that the bills submitted on the General Fund and Water & Sewer warrants dated August 1 1981 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attache to the warrants.
