Ponzini, Counsel Absent Mario DiFelice, Trustee Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Timmings moved, seconded by Trustee White that the minutes of the August 17, 1981 meeting be approved as written. Carried. ii. Mayor Zegarelli called for bids on the 1974 Chevrolet Highway Car and 1977 Chevrolet Police Car with an upset price of $200. <\ Treasurer Amato opened the following bid: Liberty Motors Jersey, City, New Jersey 1977 Chevrolet Police 1974 Chevrolet Highway $529.99 $ 79.99 Trustee Timmings moved, seconded by Trustee White that the bid be referred to the public safety committee for report and award at the next meeting, after which, Trustee Timmings amended the motion that the committee be empowered to act if the bid is in order, seconded by Trustee Soriano. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mrs. L. Kosilla, Howard Street, inquired if anything was being done about the traffic problem on Howard Street during hours when General Motors shifts change. Mayor Zegarelli stated that he is meeting with a representative of General Motors and will bring this to his attention. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri stated that there will be a meeting with the Presidents of fire companies on September 14th. Trustee Cavalieri reported on the schedule of dates as to when specifications will be prepared and bids returnable in connection withi the proposed Village garage. FINANCE & REAL ESTATE Trustee Gandolfo reported a cash balance of $217,118.01 in the General Fund as of September 8, 1981. Trustee Gandolfo moved, seconded by Trustee Timmings that action of the Treasurer in depositing the amount of $400,000 in a certificate of deposit for thirty days at 13%7D be confirmed. Carried. Trustee Gandolfo moved, seconded by Trustee Timmings that $500 be transferred from A1990 Contingency to A5182, Street Lighting Expenses. Carried. Trustee Gandolfo stated that we had budgeted $5500 for Street Light Maintenance and the bid was $6,000. Trustee Gandolfo moved to increase A510-Estimated Revenues A2680 insurance recoveries $10,134 and increase A960-Appropriations A3120.2 Police Equipment $10,134, seconded by Trustee Timmings. Carried. Trustee Gandolfo stated that this covers the cost of the new polici car which replaces the car that was totaled. Trustee Gandolfo offered the following resolution, seconded by Trustee Timmings: BOND RESOLUTION, DATED SEPTEMBER 8, 1981, AUTHORIZING THE ISSUANCE OF $104,500 SERIAL BONDS AND $5,500 CAPTIAL NOTES OF THE VILLAGE OF NORTH TARRYTOWN, NEW YORK PURSUANT TO THE LOCAL FINANCE LAW OF NEW YORK, TO FINANCE THE PAVING OF STREETS IN THE VILLAGE OF NORTH TARRYTOWN. (OFFICIAL MINUTES) Trustee Gandolfo moved, seconded by Trustee Timmings that the following resolution be adopted; BOND RESOLUTION, DATED SEPTEMBER 8, 1981, AUTHORIZING THE ISSUANCE OF $110,000 SERIAL BONDS OF THE VILLAGE OF NORTH TARRYTOWN, PURSUA TO THE LOCAL FINANCE LAW, TO FINANCE THE ACQUISITION OF TWO MOTOR VEHICLES FOR THE VILLAGE, (OFFICIAL MINUTES) �iiiiii^iiiiii^^ . -3- /ve Trustee Gandolfo moved, seconded by Trustee Cavalieri that the firemen who were on a special fire watch at the Restoration on August 24th be paid at the prevailing rate of $3.60 per hour. On the question, Trustee Timmings stated that we have a letter from the Superintendent of Public Works that he was unable to operate the Village Public Works Department satisfactorily the next day because of the number of -people who were on fire watch. He stated that the Village is not paying the same people twice. Trustee Gandolfo, stated that these firemen were working on their off hours. Since they could not report for work, they were given a personal day. Motion carried. Trustee Gandolfo stated that Chief Spota is having difficulty in hiring school guards. She stated that it was her understanding that as long as it averages out 17 hours per week they could continue to work. Trustee Cavalieri suggested moving the shift back an hour. Trustee Timmings stated that there was legislation introduced in Albany placing the responsibility of school crossing guards on the School Board of Education. Trustee Timmings moved that the Chief of Policebe authorized to hire school crossing guards with £h& s^^i^aj^onthat the yearly number of hours worked should not exceed^l^^ nc^fspe^weelr; seconded by Trustee Gandolfo. A discussion was held regarding the changing of the schedule for the police department, after which Trustee Cavalieri moved that in accordance with the contract it was deemed an emergency for the welfare of the Village children, that the shifts in the police department tours be changed as follows: From 7:00 A,M. - 3:00 P.M.; 3:00 P.M. - 11:00 P.M. and 11:00 P.M. - 7:00 A.M., seconded by Trustee Soriano, as soon as implementation can be effective. Mayor Zegarelli polled the Board as follows; Trustee Timmings - Yes Gandolfo - Yes " Soriano - Yes Trustee Cavalieri " White - Yes - Yes Motion carried. Carried. GOVERNMENTAL RELATIONS Trustee White stated that she attended meetings held by ADAPT. The committee is comprised of concerned citizens of the Tarrytowns to provide help to persons seeking treatment. Trustee White stated that in the Community Development Block Gran authorization has been made of 4.16 billion dollars, 70% for entitleme communities, 30% for metro and non-metro discretionary grants. UDAG is retained as a separate category with a $500 million authorization. Economic distress will be the primary selection factor. LABOR RELATIONS Trustee Timmings stated that the committee is starting to go undei with grievances. He stated that he is in receipt of a letter from Mr. O'Connor of CSEA who filed several grievances. Trustee Timmings stated that we have a second stage grievance frot Richard Maccabee pertaining to sick time and moved to reject the grievance, seconded by Trustee White. Carried. Trustee Timmings commented that there is a timeliness provision in the contract that is not being followed religiously. , Trustee Timmings moved, seconded by Trustee White that Robeart ' "# Smutek's grievance on out-of-title pay be referred to the Labor Relatio Committee and John Biros. Carried. Trustee Timmings moved, seconded by Trustee White that Hercules Shubrick's grievance, overtime pay, be referred to the Labor Relations Committee. Carried. Trustee Timmings stated that George Helwig has submitted the secoi stage of his grievance regarding vacation time and we have a letter fr< John Biros stating that vacation time was granted.. Mr. Helwig filed another grievance. Trustee Timmings moved to reject the second stage grievance of George Helwig and refer the first stage grievance back to John Biros fo| determination, seconded by Trustee Cavalieri, Carried. Trustee Timmings stated that the first stage grievance has been received from Henry Ludwig as a result of his being sent home for refusj to do a job and was docked four hours pay. Trustee Timmings moved, seconded by Trustee Cavalieri that the grievance be referred to John Biros for a recommendation. Carried. Trustee Timmings commented that there have been many grievances have unnecessarily taken up valuable time. Trustee Timmings moved that John Biros be commissioned to make a study for the Board as to alternatives to accomplish public works depat] functions, said report to be submitted by October 5th, seconded by Trustee Gandolfo. Carried. �/JTO -5- Trustee Timmings read a letter received by the Mayor from Joseph O'Connor, CSEA representative responding to work-days and breaks for employees in the Public Works department. Trustee Timmings moved that John Biros obtain, in writing, from the CSEA, a letter agreeing to the changes in the current contract hours, etc. so that there would be no reprecussions later, seconded by Trustee White. On the question, Trustee Cavalieri stated that as a member of the Public Works Committee, he did not know about the 7 A.M. - 3:30 P.M. workday. He stated £hat he objects to the entire proposals in the letter because of the fact that he did not know about them. Mayor Zegarelli polled the Board as follows: Trustee Timmings " Gandolfo " Soriano - Yes - Yes - Yes Trustee Cavalieri - No " White - Yes Motion carried. PUBLIC SAFETY Trustee Gandolfo, in the absence of Trustee DiFelice, moved that the meter maintenance contract be awarded to Edward Simnowski in the amount of $2995 for the period Sept. 1, 1981 - May 31, 1982, according • to specifications, seconded by Trustee Cavalieri. Carried. Trustee Gandolfo stated that two bids were submitted and his bid was accompanied by a check which was called for in the specifications. In the absence of Trustee DiFelice, Trustee Gandolfo reported that conditions around the Morse School and avenue improved slightly. New traffic signals should be ready for school opening on 448- North Broadway she said. The D.P.W. will have crosswalks painted in time for school opening, said Trustee Gandolfo. Trustee Gandolfo stated' that Rescue Hose apparatus committee met with all sales representatives and will now begin phase II by seeing the actual fire apparatus. Specifications for a new fire chief's car have been referred to committee, said Trustee Gandolfo, Trustee Gandolfo stated that there is still a problem with cars being parked around Robertson Park, as well as cars blocking the mailbox in front of the Post Office. On behalf of Trustee DiFelice, Trustee Gandolfo congratulated the fire department for/the good job they performed in extinguishing the fire at the Restoration. �-6Trustee Gandolfo stated that the meter maids are still not giving people a chance to obtain change. Some of the merchants feel that thej are being unfair. The matter was referred to the Police Chief. Trustee Gandolfo read a letter from Det.-Sgt. DeFalco to Chief Spota commending Ptlmen. Kiggins (on two separate actions) and Whalen for their interest in apprehending suspects leading to their arrest and moved that copies be placed in their folders, seconded by Trustee Soriano. Carried. Trustee Gandolfo submitted the following police report for the month of August: (in detail official minutes) PUBLIC WORKS Trustee Soriano reported that permanent blacktop on excavations has been placed on Harwood, Palmer, Kelbourne Avenues and Valley Street The hydrant on County House Road has been repaired. Water conserv tion efforts have been fruitful and for the first eight months, there was a 21% reduction in consumption as compared to a comparable period last year. The bank balance in the water account as of September 8th is $22,814.98. The highway department placed new sidewalks at 70, 74, 78 and 80 Clinton Street. This represents the final sidewalk program for this ye said Trustee Soriano, Blacktop has been placed on various depressions and potholes on Holland and Katrina Avenues and Old Broadway, The 12" storm drain has been extended to its juncture with 20" storm drain at our disposal site at the Phelps Memorial Hospital. I Trustee Soriano reported that the probationary period of John I Johnson, Mechanic, ended on September 3, 1981 and moved that he be I placed on permanent basis and that the $500 which was withheld be inclu in his present salary, effective September 3, 1981, seconded by Trustee Timmings. Carried, Trustee Soriano moved to confirm the action of John Biros in charging personal days to those employees who were absent from work because of the Restoration fire, seconded by Trustee Timmings. Carried. Trustee Soriano moved to confirm the action of John Biros in sendi an employee home during which he was docked because of his refusal to work, seconded by Trustee White. Carried, Trustee Soriano moved, seconded by Trustee White that John Biros be granted permission to attend the fall meeting of the N.Y. Section Water Works Association at Niagara Falls from September 22-25 with expenses. Carried. �I II l i i w t e JffitlllliiTi V /fc*L -7RECREATION & PARKS 'ffj^ Trustee Gandolfo stated that a letter has been received from the recreation chairman recommending Gary Thomas for the maintenance laborer position which was formerly held by Robert Lugrezia. Trustee Gandolfo moved that Gary Thomas be appointed Maintenance Laborer, at the salary of $10,000,less $500, per annum, on six months probationary period, effective September % , 1981, seconded by Trustee White. #During the discussion of the appointment, Trustee Soriano stated that he was opposed to someone being appointed from out-of-town. He stated that he knew of a local person who was interested in the job. / Trustee Gandolfo stated that Trustee DiFelice left a note against • the appointment of an out-of-towner. Trustee Gandolfo stated that everyone was given a full interview. This appointment was recommended by the Commission and Committee. Mayor Zegarelli polled the Board as follows: Trustee Timmings - Yes Gandolfo •- Yes " Soriano - No Trustee Cavalieri - Yes " White - Yes Motion carried. Trustee Gandolfo reported that the women's softball league, Bert's Auto Body won the league championship and the Assembly Line won the playoff championship. The Men's softball league, Michael's are both league and playoff champions for the fourth year in a row. The fall and winter brochure will be out in September. Some of the programs include: Typing, Basketball, Volleyball, Ski trips, Ice Skating, etc. Regarding the status of the Recreation Commission, Trustee Gandolfo moved, seconded by Trustee Cavalieri that a public hearing be held on September 30th in the Board room of the Municipal Building, to discuss any proposed changes, modifications of the Recreation Commission. Carried Trustee Gandolfo stated that Pat Lofaro wrote to Mr. Caton at the Administration Building that the recreation department will not be running any recreation programs at Peabody until April, 1982, and that we will not maintain the field until April when we resume our programs. Trustee Gandolfo moved that Pat Lofaro's action be confirmed by the Board, seconded by Trustee Timmings. ,i. On the question, Trustee Cavalieri stated that he did not think our Director- should take reservations on private property. The Dad's Club is in the North Tarrytown Recreation Program and we make reservations for them. Motion carried. SENIOR CITIZENS Trustee White reported that citizens1 meetings have resumed for tt winter. Today's attendance was 100. She stated that Mayor Zegarelli issued a proclamation celebrating Senior Citizens Day on their 6th Anniversary. Trustee White moved to confirm action of the Mayor, seconded by Trustee Soriano. Carried, Trustee White stated that the citizens have planned trips to Atlantic City on September 24th, Florida, October 12th and Pamona on October 13th (Octoberfest). TAX EXEMPT & ASSESSMENT Trustee Timmings reported "progress". MAYOR'S REPORT Mayor Zegarelli stated that letters have been sent out to tenants of 79 College Avenue to get rid of their personal materials, as well as letters informing tenants of a rent increase of $13 per room, effective November 1st. Mayor Zegarelli stated that he is in receipt of a letter from HUD of subject satisfaction of conditional approval for public service activities for Title I funds. Mayor Zegarelli stated that as per resolution of the Board, he wrote a letter to the Public Service Commission opposing the increase in gas rates. He also wrote to Mr. Peter Eschweiler, Dept. of Plannin for a traffic study of North Tarrytown. I Mayor Zegarelli read a letter written by Trustee Timmings to Mr. O'Connor in answer to his letter, regarding various items concerning hi memo. Mayor Zegarelli stated that a letter from Chief Oliva, Town of Mt. Pleasant, requesting information of services we require in connections the animal warden has been referred to the public safety committee. Mayor Zegarelli stated that an information clinic for fire inspect and building inspectors will be held at the Westchester County Fire Training facility on September 28th. Mayor Zegarelli stated that an answer was received to his letter from Peter Stengel regarding repairs to the overhead bridge on Palmer Avenue and that the bridge will be closed for two weeks commencing Sept 21st in order to perform the necessary repairs. Carried. Mayor Zegarelli stated that he sent a mailgram to Ms. Myerson, Acting Area Manager of HUD, voicing our concern and opposition to State funds being appropriated for Search for Change project. Mayor Zegarelli stated that he wrote a letter to HUD voicing our concern and opposition to the Search for Change Project. Not liking the answer he received, he sent Ms. Myerson the mailgram as well as copies to Cong. Peyser and Samuel Pierce, Sec'y. of HUD. / Trustee Timmings moved, seconded by Trustee White that action of the Mayor be confirmed. Carried. Mayor Zegarelli read a letter from the Automobile Club of New York that North Tarrytown has received the Pedestrian Safety Award for Achieving no pedestrian fatalities in the last seven years. The award will be given on October 6th at the Westchester Country Club in Rye. 4I ,. I Mayor Zegarelli stated that he received a petition from residents of the Van Tassel apartments complaining about various incidents on Beekman Avenue when General Motors dismisses its employees on the night shift and has referred it to the police chief and public safety committee. Mayor Zegarelli stated that he is in receipt of a request to proclaim September 17-23 as Daughters of the American Revolution and so moved, seconded by Trsutee Timmings. Carried. COMMUNICATIONS Communication from Mr. & Mrs. C. Weldon, 499 Bellwood Avenue, requesting the removal of a tree in front of their property was read and referred to the public works committee. Communication from John Joyce, 67 Pocantico Street, requesting the removal of a tree at the corner of Howard Street was read and referred to the public works committee, Communication from Mrs, C. Guarneri, owner of properties at 19, 21 and 26 Elm Street requesting sidewalk repairs at those addresses was read and referred to the public works committee. Communication from James Weaver, 26 Crane Avenue, requesting two trees to be planted in front of his property was read and referred to the public works committee. Communication from Curtis Heath, Chairman of the Conservation Council, regarding damage to a dogwood tree by a Village truck on Palmer Avenue was read and referred to the public works committee. He stated th one of the reasons in having Village Elections in March allows local services to be properly discussed. Trustee Timmings moved that a letter be sent to the County Board of Legislators requesting them to consider holding this referendum at any other time other than during the month of March, seconded by Trustee White, Carried. Copies to NYCOM and WCVOA, Trustee White moved that the bills submitted on the General Fund and Water & Sewer warrants dated September 8th be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants.
