September 21, 1981 t TT ^*n * ? fffJl A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present James J. Timmings, Deputy Mayor Janet Gandolfo Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trus tees / Robert J. Ponzini, Counsel Absent Philip E, Zegarelli, Mayor Deputy Mayor Timmings called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee White moved, seconded by Trustee Gandolfo that the minutes of the meeting held on September 8, 1981 be approved with minor correction on page 3. Carried, Deputy Mayor Timmings called for bids on the dredging of Fremont Pond Treasurer Amato opened the following bid; Aqua Dredge, Inc, Armonk, N.Y. $61,300. Security bond in the amount of $3065 enclosed, Trustee Gandolfo moved, seconded by Trustee White that the bid be discussed after the business meeting, together with representatives of Philipse and Sleepy Hollow Manor Associations. Carried. Deputy Mayor Timmings asked if there was anyone present who would like to address the Board. Mr. John Harbour, Director of the Restoration, stated that he wanted to express personally to the Board and to the fire and police departments his great appreciation and valiant efforts the men made to save the barn and further investigation work since the fire. He stated that it was a terrible loss, Deputy Mayor Timmings thanked Mr. Harbour for coming this evening. Trustee Cavalieri moved, seconded by Trustee DiFelice that Mr. Harbour's comments be made known to the police and fire departments. Carried, REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that Mr. Monks is repairing the tower on the Municipal Building and is changing the direction of the water Ik • l« i i -. - �-2- IT* flow to bypass a leak on the tower. The floor of Union and Rescue Hose Companies have been washed and waxed and Central Headquarters will be done this week in time for the inspection. The faucet on the outside of Central Headquarters has been repaire said Trustee Cavalieri. Trustee Cavalieri moved, seconded by Trustee Soriano that upon completion of contract documents, bids be received on October 30th on t proposed Village garage at 2 P.M. Carried, FINANCE & DEVELOPMENT Trustee Gandolfo reported a cash balance of $87,063.13 in the General Fund as of September 21st, Trustee Gandolfo moved that action of the Treasurer in depositing with the First National Bank of North Tarrytown a c.d. note in the amount of $150,000 at 13%%, maturing on October 12th, be confirmed, seconded by Trustee White. Carried, Trustee Gandolfo moved that the salary of Gary Thomas be adjusted from $10,000 to $12,000, effective September 9, 1981, seconded by Trustee Soriano. Deputy Mayor Timmings stated that it is his feeling that this increase be put off on the professional employees of the Village until late October so that we will have the time and chance to review all . these jobs on a professional basis. Action of this sort could leaw-^ problems, he said. Following a short discussion, Deputy Mayor Timmings polled the Board as follows; Trustee Gandolfo Soriano - Yes Yes Trustee Cavalieri - Yes " DiFelice - Yes White - Yes Deputy Mayor Timmings voted "No". Motion carried. Trustee Gandolfo moved to transfer the amount of $2,000 from j Contingency Fund to A7140.1, Personal Services Maintenance Laborer, I seconded by Trustee Soriano. Carried. ! Trustee Gandolfo called for a meeting of the Finance and Public Safety Committee to discuss the police budget expended for October 1st« 8 P.M. GOVERNMENTAL RELATIONS Trustee White reported "progress". LABOR RELATIONS Trustee Timmings reported one grievance from an ex-member of Nortl Tarrytown Police Department which was referred by the Tri-County Federa �Y< IT***^ -3- ^ 9 Vffjz. of Police to American Arbitration Association. Counsel stated that he is answering the grievance. PUBLIC SAFETY Trustee DiFelice stated that the Board is invited to attend the annual fire inspection on September 26th. The parade will commence at 7 P.M. at General Motors. The annual clambake will be held on Sunday at Kingsland Point Park, he said. Trustee DiFelice stated that Columbia Hose truck is being repaired by Quirk Motors as per agreement made by the Village attorney. / Trustee DiFelice stated that the Fire Chief received a letter from the Westchester County Fire Inspectors Association that an exit drill • will be conducted on October 6th at 7 P.M. The purpose of it is to teach people two ways out of rooms in homes, he said. • i Trustee DiFelice reported that Ptl. John Cappello will attend the Municipal Training Institute at SUNY in Purchase from Sept. 12-Dec. 17th Trustee DiFelice reported that the Youth Bureau Officers will be conducting traffic and safety programs at the local schools. Trustee DiFelice stated that the Dog Warden, Town of Mt. Pleasant, will be covering North Tarrytown for two days and moved that he be authorized to issue summonses in North Tarrytown during those two days, seconded by Trustee Cavalieri, Carried. Trustee DiFelice moved that action of the Public Safety Committee in awarding the 1974 and 1977 highway and police cars to Liberty Motors in the amount of $7 9.99 and $529.99 respectively, be confirmed by the Board, seconded by Trustee White. Carried. <i Trustee DiFelice read a letter written by Tappan Motors to D.O.T. regarding a hole in the sidewalk left by the contractor who installed the traffic lights. He stated that he contacted DOT who informed him that the contractor will complete the work as soon as possible. Trustee DiFelice stated that Chief Spota received a letter from Arthur Freed, Executive Director of the Traffic Safety Board, County of Westchester regarding the Village's eligibility for $32,654 for each of the' next four years for work to be performed under the Highway Improvement Program DWI, He stated that in 1979 we applied for these funds, but there were non<available. Since then, we have re-applied. The project has been instituted again and we will receive a grant for the next four years, said Trustee DiFelice. Chief Spota is working on the required information, he said. , t Trustee DiFelice stated that we received a letter from Mrs. Sally Isler who was interested in the position of the animal control officer and in talking to her, he stated that she preferred to use her own vehicle, instead of the Village vehicle. Counsel stated that there is liability involved and the matter should be clarified before any arrangements are made for the use of her car. Following a discussion, it was agreed that the public safety committee meet after the Board meeting to prepare an agreement outlining the terms for use of her vehicle, etc. ,•41! • M* >.i it �-4Trustee DiFelice moved, seconded by Trustee White that Mrs, Sally Isler be appointed Animal Control Officer at $3,50 per hour, not to wor] more than 20 hours per week, Carried. Trustee DiFelice stated that the two petitions received signed by tenants of the V.T. apartments and residents of Elm Street were referrei to the Chief of Police for action. Trustee Timmings stated that he has received complaints about the timing on the signals at the intersection of 448-Broadway and Beekman Avenue regarding north and southbound traffic. He suggested that the Chief survey the area and give us an idea of how severe the problem is at the intersection. Trustee DiFelice stated that he was talking to the engineer today and was told that the green arrows were eliminated and Bedford Road an Beekman Avenue traffic does not coincide anymore, The matter will be reviewed again, said Trustee DiFelice. *2ufiu«~<i -jM*- tXJL put, f-^_ yu , fo*~eUiAM.i , Trustees Sc^an^and i^v^l^eri-commented on the traffic signal .at Hudson Terrace'yTheOepSr of Transportation will provide the necessary signs, posts, etc,, however, it is the responsibility of the community to make the installation. To do this, a public hearing setting forth bus stops would be required, said Trustee DiFelice. Following a short discussion, the matter was referred back to committee. PUBLIC WORKS Trustee Soriano gave the following report; The Water & Sewer Department removed the siphons used as dump manholes for flushing dead ends of sanitary sewers on Beekman Avenue at Teresa Street, and excavated and shut off abandoned service at the car wash on Valley Street. i Balance in the water and sewer account as of Sept. 21st is $28,23 The highway department repaired the catch basin on Evergreen Way Hemlock Drive and placed concrete around catch basins and adjacent strei slab that was undermined. A concrete base was also placed for a catch basin at our disposal site at Phelps Memorial Hospital. Concrete was also placed in post holes on Dell Street. The sidewalk on the west side of Pocantico Street from Elm Street to Howard Street was replaced. Driveways and crosswalks will be replao next week. A guide rail was constructed along the Pocantico River on Dell Street to protect the gabion wall recently constructed. The new schedule of paper pickup every Wednesday has commenced and the response is good. RECREATION & PARKS Trustee Gandolfo gave the following report: �-s- /7/ The fall and winter brochure is out. The programs include; Aerobics, Calligraphy, Ceramics, Knitting, volleyball, ice skating, etc, Trustee Gandolfo stated that the lavatories in Douglas Park were broken into during which the screen door was damaged. She stated that the chains on the swing set in the Clinton Street playground were cut and removed. Trustee Gandolfo stated that she is in receipt of a report from James Cropper, District Conservationist, regarding a study he made of the erosion problem in Douglas Park and his recommendations. Trustee Gandolfo stated that she has been informed by the recreation supervisor that marijuana was found in Douglas Park and hypodermic needles were found in the Clinton Street playground. It is also known that adults are drinking in the playground. Equipment has been stolen from the Barnhart Park shed, said Trustee Gandolfo. Trustee Gandolfo moved that Christine Chalmers be appointed part-time secretary in the recreation department at $3.50 per hour, seconded by Trustee White. Carried, SENIOR CITIZENS Trustee White read a letter from the N.Y.S. Office of Aging that State Aid approved our application for the Elderly Programs and Services for the period July 1, 1981-June 30, 1932 in the amount of $2,000. Trustee White stated that the seniors will be wearing buttons depicting the North Tarrytown Headless Horseman whenever they go on trips. TAX EXEMPT & ASSESSMENT Trustee Timmings reported "progress". MAYOR'S REPORT: Deputy Mayor Timmings read a memo from the building inspector that the court order of September 11th regarding the prohibiting of burning in the incinerator at 100 College Avenue has been lifted by his office as per agreement with the Justice Court and the prosecuting attorney of the Village. In his personal inspection, Mr. Page stated that the unit shows it to have been repaired properly and in good working order. Trustee White moved, seconded by Trustee Gandolfo that action of officials be confirmed by the Board. Carried. Deputy Mayor Timmings read the letter from Mr, John Harbour, Sleepy Hollow Restorations, commending the police and fire department for their action during the fire at the Restoration and a copy was ordered sent to the departments. Deputy Mayor Timmings noted the official copy of the demand for arbitration from the American Arbitration Association in the matter of John Quartucio, former patrolman. Trustee DiFelice moved to confirm receipt of the document, seconded by Trustee White. Carried. �-6Deputy Mayor Timmings read a letter from the Program Manager, Community Development Department of the State, regarding a new tax law designed to restore historic preservation of buildings. Trustee Cavalieri moved, seconded by Trustee White that the matter be referred to Mr. Doorley. Carried. Deputy Mayor Timmings noted a letter from Dr. MacNaughton, member of the Mt. Pleasant Senior Citizens Committee, regarding smoke alarms for citizens. • Trustee Gandolfo moved, seconded by Trustee White that the matter be referred to the Senior Citizens Committee. Carried. Deputy Mayor Timmings read his answer to a letter ty Mr. O'Connor] CSEA, regarding to grievances. Trustee Cavalieri moved, seconded by Trustee Gandolfo that action of Trustee Timmings be confirmed. Carried. Deputy Mayor Timmings read a letter from the Public Service Commis acknowledging receipt of Mayor Zegarelli's letter protesting the increa in gas rates on behalf of the Board. COMMUNICATIONS Communication from Mrs, Christine Chebetar, 38 Pine Street, regarding the removal of a tree in front of her property was read and referred to the Environmental Conservation Committee. Communication from Mr. & Mrs. James Timmings, 119 Rice Avenue, requesting attention to a tree on the northeast corner of Rice and Van Tassel Avenues was read and referred to the Environmental Conservation Committee. Communication from Mr. & Mrs. Peter Galocky, Continental Street, requesting attention to a tree in front of their property was read and| referred to the Environmental Conservation Committee. Communication from Robert Kargoll, 95 Beekman Avenue, in answer to a petition signed by residents of 95 Beekman Avenue, about noise and loud radios on Beekman Avenue was noted. Mr, Kargoll stated that he has been informed by residents that any time they had a complaint, the police would respond quickly. Communication from Mrs. Joseph Diaz, 19 Andrews Lane, requesting sidewalk repairs as well as the replacement of two trees was read and referred to the public works committee. Communication from Sec'y. of Fire Council, Glenn Amesbury, regardii changes in personnel in Fire Patrol, Union Hose and Columbia Hose Compai was read and on motion of Trustee DiFelice, seconded by Trustee White action of Fire Council was confirmed by the Board, Carried. �\ \ ifihftiite^^ /73> -7- f?yji UNFINISHED BUSINESS Trustee DiFelice inquired about the status of 21 Beekman Avenue. Counsel stated that plans have been filed for its restoration. Following a short discussion, Trustee DiFelice moved, seconded by Trustee Gandolfo that Counsel be authorized to send a letter to the owner of 21 Beekman Avenue setting forth a deadline of his proposal for restoration of his property. Carried. • With regard to the former Strand Theater, Trustee Gandolfo moved that a citizens committee be formed to prepare a study as to how the Strand Theater can be used. Carried. / Trustee White inquired if there was anything further on McLean Cable TV. Counsel stated that he is waiting for an answer from Assemblyman Peter Sullivan after which action will be taken against the company. Trustee Gandolfo noted a communication from Curtis Heath regarding a tree damaged by a Village truck. Mr. Biros stated that there was no impairment to the tree. Trustee Gandolfo stated that it is the opinion of the Council that the tree was in good health and does not have to be replaced. Trustee Gandolfo moved, seconded by Trustee White that the Board confirm action of the Conservation Committee and their opinion be adopted Carried. Trustee Gandolfo moved that a letter be sent to the owner advising her that an employee looked at the tree and it will not be replaced, seconded by Trustee DiFelice. Carried. Trustee Gandolfo stated that she is in receipt of a letter from Frank Savage, Depeyster Street, requesting a tree in front of his property. His name will be placed on the list. Trustee Soriano moved, seconded by Trustee White that the bills submitted on the General Fund and Water & Sewer Department warrants dated September 21st, 1981 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee DiFelice moved, seconded by Trustee White that the same be duly ad j ourned.
