After reading the n o t i c e of public hearing to d i s c u s s any proposed c h a n g e s , modifications or d i s s o l u t i o n of the N o r t h T a r r y t o w n R e c r e a t i o n C o m m i s s i o n pursuant to S e c t i o n 243 of the G e n e r a l M u n i c i p a l L a w , M a y o r Z e g a r e l l i asked if there w a s a n y o n e w h o would like to a d d r e s s the Board. M r . Frank R e y , 37 H o l l a n d A v e . , commented that there seems to b e a communication gap b e t w e e n the C o m m i s s i o n and Board. H e stated that h e does not see the r e a s o n i n g w h e r e interested p e o p l e w h o h a v e v o l u n t e e r e d their time and p u t together programs for the c h i l d r e n are n o w being told that they are n o t n e e d e d a n y m o r e . H e commented that M r . L o f a r o ' s assistant resigned and another p e r s o n w a s hired at $2,000 m o r e . H e reiterated a comifounication g a p e x i s t s , I' Trustee Soriano stated that it w a s n o t t h e intent to g i v e P a t r i c k ' s assistant a r a i s e - - t h i s w a s an a d j u s t m e n t . T h e m a n did n o t g e t a r a i s e , the position d i d , said T r u s t e e S o r i a n o , . - >. , _1 . . --" ^-U. ^<*\' i-ane*-. /A Mayor Zegarelli stated that it is his feeling to change the body or type of functioning of the commission to a form of committee. There never was any debate as to the removal of individuals. They would operate under different rules, he said. Mayor Zegarelli stated that the difference is not in personalities, but what is now State Law and how it pertains to the Mayor & Board of Trustees in this Village, On a question of Mr, Rey as to what the advantage would be to the community and children, Mayor Zegarelli stated that there is a lack of communication between one or the other, however, it can be eliminated with a good amount of understanding. The question is should this be a commissio as set up in the '30's or a committee of similar form that does not have the same type of obligations and responsibilities. Trustee Gandolfo stated that subsequent to 1933, new laws were enacted and now have caused the laws to clash. She stated that we have not been able to settle exactly what the commission means as opposed to a committee. There is no intention to remove anyone. The problem would be resolved if we say it is a committee, instead of a commission, said Trustee Gandolfo. 'I �-2Trustee Gandolfo stated that we have a director who puts in many hours and no credit is given to him for implementing programs. She stated that he is being overlooked entirely as far as implementing programs in this Village. One of the members of the commission had asked Mr. Doorley to order an $8,000 piece of equip without the authority of the Board, said Trustee Cavalieri. This equipment, in his opinion, was not needed at that time of the year. Mr. Steve Maceyak, 13 Elm St., member of the Recreation Commissior stated that the piece of equipment was his idea and that he presented the Trustees with all pictures, etc. of the equipment, after which he told Mr. Doorley-not to order the equipment because it would cost too much money. In the interim, the information was somehow lost, said Mr. Maceyak. He stated that he understands that he cannot spend monej and understands the Trustees' point of view. The problem is a communication gap, he said. Most commissioners do understand they cannot sp« money, said Mr. Maceyak. Mrs. Meade, member of the Commission, read from the General Munici Law, Article 243, whereby any expenditures have to/^>proved by the Towi Board. Mr. Cullen, 95 Beekman Ave., stated that if there is a proposal f< discussion of funds, it should be brought back to the Board, after whii Trustee Gandolfo replied that it is. Trustee Timmings stated that there should be harmony between the Board and Commission, committee and Superintendent. Over the last tw years, the recreation department has adhered very closely to its alloc expenditures, he said. He stated that Patrick Lofaro found an organi tion in the community willing to contribute towards the summer concert! This was added to the amount of money recreation spent. The budget hai a way of balancing itself out, he said. There is an ability for the Board, committee, commission and Superintendent to work together and provide a good recreation program, Miss Eva Piedemonte, 304 Gordon Avenue, Chairman of the Commissio stated that members understand that they do not have the power to spen the money. They make recommendations to the Board and the Board act] on their recommendations. The commission has been under the guidance of the N.Y.S, law, she said, and now it clashes with the new laws. Sfo stated that the Board had preconceived ideas about abolishing the commission. Mr. Mario Belanich, 153 No. Washington St., commented that this issue is politically motivated. He stated that the children will sui s �-3- <">£ Trustee Soriano stated that the main point that is being brought out is that the commission is to recommend. Whatever criticism will be ironed out, he said. We want them called a committee. Trustee Gandolfo stated that the commission would be set up as a citizens' committee such as we already have for Traffic, Environmental, etc. This committee would go over programs and obtain input from various sectors of the community. A meeting would be held once a month to discuss programs with Board members and Patrick and make specific recommendations or proposals. The Board members would act on the recommendations. Tl^is is how it is done with other citizens committees, she said. As a commission, the Board feels that they have the power to spend money, said Trustee Gandolfo. Where a recommendation is made, the Board has to follow their recommendation, she said. To tie the hands of the. Board where we cannot reject a proposal or part of a proposal would be illegal. Just changing the name would eliminate the problem, she said. On an inquiry of Mr. Belanich as to the advantage of this change, Trustee Gandolfo stated that it might eliminate this ongoing problem. Mrs. E. Beclc, Hunter Avenue, stated that she is very much annoyed at the statement that the issue is political and did not think it was at all. If they do not overspend the money, it should go back into the General Fund, she said, Trustee White commented about the closing of the Clinton Street playground because of vandalism. She stated that there was vandalism in all the parks and they all should have been closed. She questioned as to why should children have to go to Barnhart Park when they have a park right in their own neighborhood. Miss Piedemonte stated that the commission did not close the Clinton Street playground. They recommended that it be closed because of the condition of the park, i.e. new equipment was damaged, broken glass, overgrown weeds, etc. When it came time to open, recommendations were submitted to the Board and the park was opened, she said. Mr. Patrick Lofaro stated that he closed the park because a property owner's building was being damaged. He stated that the lot was cleaned up before the opening. Trustee White stated that the condition of the Clinton Street park did not develop just this year. The park has l been neglected for years, she said. She stated that damage to the man s building could have been done by children out of the neighborhood. Trustee Cavalieri stated that there is vandalism in all the parks. They were punching holes in this particular person's wall and playing on his roof, he said, Mayor Zegarelli noted that there is a notice of claim against the recreation commission, He noted the notice of claim as an example of why the law should be changed to reflect where the responsibility should rest on matters such as a lawsuit. The Mayor stated that the Village would defend the suit because under present Village law it is our obligation and not the recreation commission. �-4- Mr, Waldman stated that he is confused between the commission and committee after which Mayor Zegarelli explained that because of the way1 commission is defined in the present law it directs the commission to di certain things such as financing, public safety, etc. The thoughts behind a committee should be advisory, he said. He stated that he personally feels that he would like to have the same people on this committee and would take their points of view in an advisory capacity. Trustee DiFelice stated that he would be in favor of changing the commission to a committee. We will be able to have more people on this committee whereby on .a commission, there is a limit. Following a discussion, Mayor Zegarelli stated that he would . write letters to our legislators to have the body of the laws establisl in 1933 to coincide with the present Village Law. I No other comments, Trustee DiFelice moved to adjourn, seconded by Trustee Soriano.
