October 5, 1981 i j* >!i \ A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Is Philip E. Zegarelli, Mayor James J. Timmings,Dep. Mayor Janet Gandolfo Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trustees Robert J. Ponzini, Counsel Deputy Mayor Timmings called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. He stated that Mayor Zegarelli is attending a public hearing at the County Legislators Hall in regard to our opposition to the placing of Con Edison's takeover question by the County on the Village ballot. Deputy Mayor Timmings stated that the Westchester County Village Officials Association and the N.Y.S Conference of Mayors support our position. He stated that the Village Board is the only body who can approve any question to be placed on a ballot. Trustee Soriano moved, seconded by Trustee White that the minutes of the meeting held on September 21, 1981 be approved as written with the necessary minor corrections (pg. 3), and that the minutes of September 14, 1981 be approved also. Carried. Deputy Mayor Timmings asked if there was anyone present who would like to address the Board may do so at this time. No one present, the regular order of business was resumed. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that the committee met with officers of Rescue and Union Hose Companies regarding the cleaning of their quarters. After their company meeting, a report will be made back to the Board, said Trustee Cavalieri. Trustee Cavalieri stated that Mr. Morabito from Peekskill is removing the abondoned equipment from the treatment plant at no cost to the Village. Trustee Cavalieri stated that the plans and specifications of the Village garage have been received and moved that they are not to leave the building, seconded by Trustee DiFelice. Carried. FINANCE & DEVELOPMENT Trustee Gandolfo reported a balance of $85,274.93 in the General Fund as of October 5, 1981. Carried. Trustee Gandolfo stated that the Board met last Thursday with representatives of the Sleepy Hollow Taxpayers' Association and surrounding property owners of Fremont Pond. She stated that Dr. Ippolito, President of the Association, has agreed to attempt to raise more funds for the project and during the next two weeks will be canvassing property owners in Sleepy Hollow Manor for a donation of $100 per family which it is estimated will bring in part of the donatio of $18,000. She stated that the Village has $20,000 in the bond. Thi would not bring the total amount up to the bid of $61,300, for dredgi of the pond, she said. Trustee Gandolfo moved that the Treasurer be authorized to contact the bonding attorney for an additional $20,000, seconded by Trustee Soriano. Carried. Trustee Gandolfo called for a meeting of department heads to discuss their budget to date for October 14th. GOVERNMENTAL RELATIONS O Trustee White read a letter from George Cincotta, Chairman of the N.Y.S. Commission on Cable TV which was sent to Assemblyman Sullivan that an agreement had been reached by the McLean Cable and owner of College Arms and that service to residents is expected to be available within sixty days. She thanked Counsel Ponzini and all those who helpe in resolving this matter. At this time, Mayor Zegarelli presided over the meeting. LABOR RELATIONS Trustee Timmings stated that he received a call from the represe^ tive of CSEA that he would be available to discuss the recent grievan The committee will set a date after the meeting, he said. \ PUBLIC SAFETY Trustee DiFelice stated that this is Fire Prevention Week and the Fire Chiefs and firemen will be out during the week and at night visiti schools, plants and other establishments. On Tuesday, Alarm 22 will sound and in a program set up by the Westchester County Fire Inspection Association, residents are asked to have fire drills in their own home. Trustee DiFelice moved that the amount of $1008.00 be transferred from Contingency Fund to Celebrations Account, seconded by Trustee Cavalieri. Carried. Trustee Timmings moved, seconded by Trustee White that the week of October 5th be declared Fire Prevention Week. Carried. Trustee DiFelice moved that the Mayor be authorized to sign the Youth Grant Application for funds, seconded by Trustee Timmings. Carrie 4 :•• S �-3Trustee DiFelice submitted the following police report for the month of September: (in detail official minutes) Trustee DiFelice reported that Frank Hrotko has satisfactorily completed 52 weeks probationary period and moved that he be placed on permanent basis, effective immediately, to continue at his present salary, seconded by Trustee White. Carried. Trustee DiFelice reported that results* of the Sergeant's exam have been received lifting the names of Ptlmen. Patten and Hayes who passed the exam and moved that the list be placed on file, seconded by Trustee Timmings. Carried. Trustee DiFelice stated that he contacted DOT regarding the intersection of 448, Bedford Road, New Broadway, etc. and was told that Beekman Avenue, Bedford Road and Hudson Terrace are on separate signals which is the reason for the delay on Route 9. He stated that they will pla£ej,more green on Route 9, however, it will affect Beekman Avenue and ~" :raffic. He stated that they will try to give Route 9 more green for the morning and evening rush hour, said Trustee DiFelice. With regard to the bus stops, if we were to designate these stops, we would have to eliminate several parking meters, said Trustee DiFelice. Following a short discussion, the matter was held in abeyance. With regard to the pavement marking program, Trustee DiFelice stated that the cold pLasj^c crosswalks and stop bars were ordered, however, the bars were^freceivea? the last week of August. We installed them as the opportunity arose, said Trustee DiFelice. The crosswalks have not yet arrived, he said. The crosswalks are being painted in the meantime, he said. Trustee DiFelice reported that scofflaw warrants have been issued today. This is in a first of series of warrants being issued for scofflaws, he said. PUBLIC WORKS Trustee Soriano reported that the with copper at the deadend of Highland the Pocantico River at Dell Street was placed in the excavation on Washington department replaced the service Avenue and the water line crossing painted. Permanent blacktop was Street. The balance in the water account as of October 5, 1981 is $43,723.98 The catch basin on New Broadway was lowered and the catch basin on Gordon Avenue at Katrina Ave. was replaced. A new catch basin was built on our disposal site at Phelps Memorial Hospital. Blacktop was placed around the storm drain where a section of roadway at New Broadway was undermined. Trustee Soriano moved, seconded by Trustee DiFelice that the bid for a pickup truck with compartment body and aerial ladder be awarded to Frank Chevrolet in the amount of $21,760, according to specifications. Carried. Carried. Trustee Soriano moved that the bid for a 25 yd. Mack unit with Leach Packer be awarded to Mineola Mack in the amount of $83,395 accorc to specifications, seconded by Trustee DiFelice. Carried. t Noting two more medical reports on employee injuries, Trustee Soriano inquired as to whether or not we should have a Doctor examine' th people to ascertain whether or not these are a ligitimate claim against the Village. The Village should have some recourse, he said. Following a discussion, Trustee Soriano moved that the Labor I Relations committee and Counsel be authorized to set up a procedure I for the Doctor to follow to include expenses, seconded by Trustee I Timmings. Carried. Trustee Timmings moved that John Biros be authorized to report to • the Board the number of lost time accidents and, if possible, make a comparison to private industry, seconded by Trustee White. Carried. Trustee Soriano stated that Monday is Columbus Day and there will be no bulk or newspaper pickup for the week. RECREATION & PARKS Trustee Gandolfo moved, seconded by Trustee White that the Mayor be authorized to sign an application for reimbursement funds for the Youth Service Program. Carried. Trustee Gandolfo stated that the rest rooms at Douglas Park have been broken into. Glass is becoming a problem at the Clinton Street playground and Margotta Courts. Today is the last day for registration for fall and winter programs, said Trustee Gandolfo. Registration will still be taken for several other programs, she said. Applications will still be accepted for the Pilgrim Run. Trustee Gandolfo stated that the AYSO and Pop Warner Football Programs have started. I I Trustee Gandolfo stated that several children volunteered to clean the Clinton Street playground and moved that a letter of thanks be sent to them, seconded by Trustee White. Carried. SENIOR CITIZENS Trustee White reported that the citizens took a trip to Atlantic City on September 30th and are now on a trip to Florida. Flu shots wer administered to the citizens today at the Neighborhood House. Senior citizens are reminded not to purchase anything without going through th purchasing agent, said Trustee White. TAX EXEMPT & ASSESSMENT ! Trustee Timmings reported "progress." N �.5- ^ COMMUNICATIONS Communication from the Central Veterans Committee inviting the Board to the Veterans Day Services on November 11th at Patriots Park at 10 A.M. was read and accepted with the thanks of the Board. f Communication from Bessie Levy, North Broadway, requesting sidewalk repairs to 30-34 Kendall Avenue, 186 Cortlandt Street and 225 North Broadway was read and referred to the Public Works Committee. Communication from J. R. Flynn, Director of the N.T. Housing Authority, forwarding employee salary schedules for 1982 for review and approval was read and referred to the Board as a committee. Communication from Mariano Meneses, President of the Cuban Club, requesting permission to hold a dance at 45 Beekman Avenue on October 24th from 9 - 1 A.M was read. Trustee White moved, seconded by Trustee Timmings that permission be granted, however, in accordance with the ordinance, the hours be from 9 P.M. - 12 midnight. Carried. Communication from the Village Clerk of Tarrytown, notifying the Board of a proposed amendment to the Zoning Ordinance of Tarrytown which would affect property bordering the Village of North Tarrytown was read. Mayor Zegarelli stated that the Building Inspector is in attendance at the hearing. The Clerk informed the Board that a notice of claim was served on the Recreation Commission by the mother of Peter Ware, Joan Amoruso, regarding an injury sustained to her son on June 7, 1981, at the Sleepy Hollow High School, and that the claim was referred to the insurance company and Village Attorney. Trustee Timmings moved, seconded by Trustee White that action of the Clerk be confirmed. Carried. MAYOR'S REPORT: Mayor Zegarelli read a communication from the Tarrytowns' Committee on the Disabled that 1981 has been designated the International Year of the Disabled Persons and that a celebration has been planned on October 24 at the Warner Library and Patriots Park. The matter was referred to the Senior Citizens Committee. Mayor Zegarelli stated that Columbia Hose apparatus was repaired and in order to obtain the truck, a check was given to Quirk Motors in the amount of $3,856.19. Trustee Timmings moved to confirm action of the Mayor and Treasurer and action of the fire committee for testing and approving the apparatus, seconded by Trustee White. Carried, Mayor Zegarelli stated that he is in receipt of a letter from County Executive A. DelBello requesting the appointment of an official representative to serve as liaison between County and Village for the Tricentennial Celebration of the County of Westchester in 1983. �mm » <b I« m H N ii Iammmumm*** -6Mayor Zegarelli appointed Trustee Gandolfo and the Village Histori Wally Buxton C&B&f* Gross) as North Tarrytown's representatives. Mayor Zegarelli read a letter from Sec'y. of Fire Council, Glenn Amesbury, that the North Tarrytown Ambulance Corps will respond to the Village of Tarrytown to answer emergency calls whenever needed, but wil not respond to transports. During a discussion, Trustee Timmings stated that there are variou legal questions that have to be answered, after which he moved that the Board authorize Counsel to investigate this matter as quickly as possib seconded by Trustee Soriano. Carried. A discussion was held regarding the Recreation Commission during which Mayor Zegarelli stated that he was in contact with a legislator that a resolution would be necessary from the Board of Trustees to petition the State Legislature to have the laws of the 30's to coincide with the present laws regarding the regulations concerning the recreati commission. Trustee Gandolfo moved, seconded by Trustee White that we petition Assemblyman Sullivan to have this special legislation passed. Carried, UNFINISHED BUSINESS Trustee Gandolfo stated that she, together with the Mayor and Trustee Timmings ,: met with members of the school board regarding the respective responsibilities on the Morse playground and Peabody field. They came to agreeable terms, she said. Scheduling will be handled by Pat Lofaro and the school will maintain the fields, said Trustee Gandol. Regarding the lights for Morse School, Trustee Gandolfo stated that if we purchase the lights for the playground, the school will prov the electricity. Trustee Cavalieri commented that recreation given by the school has decreased and opposed the purchase of lights. I Mayor Zegarelli stated that several years' ago, the Board went on| record that the Village will purchase lights and we waited for them to turn down the proposal. Trustee Gandolfo stated that the committee will discuss whether or not Morse playground equipment should be removed entirely. Trustee Gandolfo stated that she, together with John Biros, will review various areas where trees will be planted and anyone with reques for trees should let her know. With regard to a petiton from tenants of the Van Tassel, Trustee DiFelice suggested that a meeting be held with a representative from ETPA and the Board to discuss pros and cons of the rent law. " •> Trustee Soriano moved, seconded by Trustee White that the Mayor be authorized to sign the snow removal contract on County roads within the Village for the 1981-82 season. Carried. �/ff -7Counsel stated that the attorneys did not agree with the list of arbitrators in the matter of ex-Ptlman. John Quartucio and we are waiting for another list. NEW BUSINESS i Trustee Timmings stated that the Lions Club is sponsoring a Stay Healthy Day and moved that November 10th be proclaimed as "Stay Healthy Day" seconded by Trustee White. Carried. Trustee Cavalieri stated that he saw a program on drug abuse on Channel 7 the other night and wrote to Mr. Fife requesting if the program would be available for viewing to certain groups. He stated that he received an answer that it could be for a fee of $30, and so he has referred this matter to the Recreation Supervisor. Trustee White stated that many complaints have been received from people living in high rise apartments regarding lack of heat and inquired if some type of ordinance could be passed requiring landlords to provide heat. Counsel stated that he will obtain model laws for the Board's review. Mayor Zegarelli reported on his attendance at the meeting of the County Board of Legislators this evening with regard to their proposal to have the Con Edison question on the Village ballot. He stated that the County Board passed a resolution and the State Association of Mayors came out with a legal opinion against it--that only those items approved by Villages can be placed on the Village election ballot. Formal decision of passing the resolution has been deferred pending a meeting of elected officers of Villages in particular to see what the prospects are in getting a unanimous agreement to place the question on the local ballot, said the Mayor. Mayor Zegarelli stated that he told them the he did not think that all Villages would subscribe to that. Trustee Soriano moved, seconded by Trustee White that submitted on the General Fund and Water & Sewer Department dated October 5, 1981 be paid after approval by department the Treasurer be authorized to pay same and that a copy of be attached to the warrants.
