Zoning Board of Appeals Meeting
April 19, 2023
Chairman Timothy Church called the meeting to order at 7:07 pm.
Present:

Timothy Church, Chairman
Craig Lis

1. Lindsay Krakauer, 40 Hudson Street, Proposed second-floor addition- Public hearing
Chairman Church read the public notice, listed the documents submitted with the application,
and asked Sean McCarthy to confirm that the Building Department received the mailing receipts.
Sean McCarthy stated that the Building Department received proof of the mailing.
Chairman Church stated that the since there are only four members of the Board present, the vote
must be unanimous. The applicant has the option of deferring the decision to the next meeting.
Chairman Church invited the applicant to present the application.
Amanda Linhart stated that she is the architect representing the applicant. Ms. Linhart stated that
the application proposes removing the sloped shed room and constructing an open second-floor
deck and railings over the front porch. The proposed balcony would not extend further into the
front or the sides of the house. Ms. Linhart stated that second-floor balconies are common on
Hudson Street and that there are four houses with second-floor street-facing balconies.
Chairman Church asked Ms. Linhart if the building south of 40 Hudson Street is set closer to the
street curb and if the proposed deck would appear recessed from the street.
Ms. Linhart stated that 40 Hudson Street is set back further than the houses on either side.

�Sandra Tripp stated that it appears the neighbor to the south constructed a full second story
where there may have been a porch.
Chairman Church stated that the application does not propose to increase the footprint of the
house or increase the height of the house.
Chairman Church solicited questions from the Board.
There were no questions from the Board.
A motion was made to open the public hearing.

Chairman Church solicited comments from the public.
There were no comments from the public.
A motion was made to close the public hearing.

Vote 4-0

Chairman Church made a motion to approve the requested variances based on the following
criteria:
1. The requested variances are due to an existing non-conforming lot.
2. The requested variances will not produce an undesirable change in the neighborhood’s
character, as second-floor porches are consistent with other houses on the street. The
proposed second-floor porch will not extend closer to the sidewalk or at the north or
south facades, and the footprint of the house will remain the same.
3. There is no other way to achieve the benefit sought by the Applicant to have a secondfloor porch.
4. The requested variances are not substantial, as the applicant is not proposing to increase
the house’s footprint.
5. Granting of the area variances will not cause an impact on the physical or environmental
conditions of the neighborhood.
6. Although the requested variances are self-created, it is not the only factor the Board
considers when granting a variance
