November 2, 1981 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor • •> * James J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Timmings moved, seconded by Trustee Soriano that the minutes of the meeting held on October 19, 1981 be approved as written.* Carried. Trustee DiFelice moved, seconded by Trustee White that we suspend normal procedure to hear a presentation and see a film on tree preservation Mayor Zegarelli welcomed Mr. Robert Herberger, Forester, Dept. of Environmental Conservation, who showed a film on tree preservation, as well as giving a report on his inspection of trees in North Tarrytown. Mr. Herberger stated that existing monies should continue to be spent in the maintenance of trees, pruning, planting, etc. At this time, Mr. Herberger presented Trustee DiFelice with a certificate from the Westchester County Youth Conservation Corps for his efforts in the tree preservation program. Mr. Herberger recommended a shade tree commission who would take care of the maintenance and removal of trees and also recommended a public relations committee. He recommended the Village not to plant anymore maple trees, and urged the Village to establish a maintenance program which would consist of general pruning, water fertilization of the trees, etc. He urged the Village to enter the Tree Safety Program USA which would give the Village national recognition from the National Arbor Day Foundation organization. In order to be recognized, the Village must meet the following criteria: 1. 2. 3. 4. $1 per person expenditure. Legalized tree body commission. Tree ordinance Arbor Day celebration. Letter of intent that the Village will have one next spring would be accepted. \ �-2Mr. Herberger suggested the planting of 25-30 trees per year and encouraged planting on the property owner's side of the sidewalk if possible. He presented his report to Trustee Gandolfo. Mayor Zegarelli thanked Mr. Herberger for his excellent presentati and for his time and efforts and that the Village will follow up on his suggestions and recommendations, Trustee DiFelice moved, seconded by Trustee White that a letter of thanks be sent to Mr. Herberger and his staff for a job well-done. Carrii Trustee Gandolfo moved for a f^ve minute recess, seconded by Trustee -"GandftLi^. • Carried. Mayor Zegarelli'read the notice of hearing on a proposal to adopt a resolution pursuant to the provisions of Section 467 of the Real Pro Tax Law, to exempt from Village taxes within the control of the said Board of Trustees to the extent of 50% of its assessed value properties! owned by one or more persons 65 years of age or over who comply with thj provisions of said Section 467 as to occupancy, income, length of ownership and otherwise, and asked if there was anyone presentwho would like to comment on the proposed resolution. ^ No one appearing for or against, Trustee Gandolfo moved that the hearing be closed, seconded by Trustee DiFelice. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter. Mrs. R. Bucci, 189 Union Avenue, Tarrytown, inquired as to the procedure that is followed when a child (age 17) is arrested. She stat that her son wanted to notify his mother, but was told that he could no She stated that she did not know of the arrest until 10:30 that morning Trustee DiFelice stated that he will meet with the Chief tomorrow and obtain a report, after which a meeting will be held with the police committee and Mrs. Bucci will be notified of the results. Mayor Zegarelli stated that an inquiry has already been made regaj the matter. Mr. Larry Kosilla, Howard Street, inquired as to what progress is being made as per their request about the traffic problem on his street Mayor Zegarelli stated that he will be meeting with General Motor officials tomorrow. He stated that he asked Counsel about speed bumps and was informed that we cannot legally put them in. Mayor Zegarelli stated that he wrote to the Westchester County Department of Planning and asked for a traffic survey, but has received no response, as yet. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri stated that maintenance of the Village buildings is continuing and the repairs at Union Hose should be completed within ten days, �-3- ^y . Trustee Cavalieri stated that the Board reviewed the bids for the Village garage and the contractors selection will be made at the next meeting. Trustee Cavalieri stated that the Board has selected to sell the former Strand Theater and moved that bids be accepted at the meeting to be held on December 21, 1981, at 8 P.M. with an upset price of $55,000.00, seconded by Trustee DiFelice. Carried, Trustee Cavalieri moved that specifications be prepared for updating the heating system and bids be returned at the meeting of December 7, 1981 seconded by Trustee DiFelice. Carried. FINANCE & REAL ESTATE Trustee Gandolfo reported a cash balance of $239,067.75 in the General Fund as of November 2, 1981. Trustee Gandolfo moved, seconded by Trustee Timmings that action of the Treasurer in investing $200,000 for thirty days at the First National Bank of North Tarrytown be confirmed. Carried. Trustee Gandolfo moved, seconded by Trustee Timmings that the Treasurer be authorized to transfer the following: From A1900.00 Contingency to A1321.0 Auditor - $1,000.00 From A1900.00 Contingency to A1950.4 Taxes & Assessments $2,595.78 (to cover taxes on Strand Theater) From A1900.00 Contingency to A5110.1 Personal Serv.-M.E.O. $3,096.00. (Court Order effective July 1, 1981.) Trustee Gandolfo stated that the twenty days for filing suit or contesting the validity of the Fremont's Pond bonding will expire on November 12, 1981. Trustee Gandolfo stated that an article appeared in the October 26th edition of the N.Y. Times whereby the Rockefeller Family has donated some of their property for a park. She stated that she does not know what the effect will be on the Village, We should make inquiries, she said, and that North Tarrytown be considered in their donation of land. Following a short discussion, Trustee Gandolfo moved that the Mayor be authorized, on behalf of the Village, to make further inquiries and report back to the Board, after which the finance committee should take the necessary steps along these lines, seconded by Trustee Soriano.Carried. Mayor Zegarelli stated that he has already made an inquiry. will be held regarding the matter, said the Mayor. Meetings GOVERNMENTAL RELATIONS In connection with the forthcoming Village Election in March, Trustee White offered the following resolution, seconded by Trustee DiFelice WHEREAS the next general Village on March 16, 1982, and election for officers will be held WHEREAS the Board of Trustees must designate by resolution and publish the offices which are to be filled in such election and the terms thereof, % �^^W^^j^^^j^^ ^^^k£|tajfe^^£a&&|^ -4NOW, THEREFORE, BE IT RESOLVED: Section 1. That the Board of Trustees designates the following offices as vacant at the end of the current official year, to be filled at the Village election to be held on March 16, 1982 for the following terms: Trustee - two years; Trustee - two years; Trustee - two years. Section 2. The Village Clerk is hereby directed to publish the resolution in full in the Tarrytown Daily News, a newspaper of general circulation with the Village. s Section 3. This resolution shafcl take effect immediately. Carried. • Trustee White stated that Cable TV work has commenced at College I Arms. I Trustee Timmings noted the letter on Trustees1 desks signed by a Mrs. Maria Diaz of Beekman Avenue, that the Cable Company told her that lower Beekman Avenue is without cable because the lines must be placed j underground and that the Village is holding them up. Mayor Zegarelli stated that it will be referred to Counsel-. ; i LABOR RELATIONS ' Trustee Timmings stated that he was notified by the Chairman of th( Police Bargaining Committee that the police did not want to accept the last offer. PERB has suggested a Mr. Paul Kell as mediator and a hearii will be held on December 4th. There is a provision in the law which encourages continued efforts to establish a contract, said Trustee Timmings. Because of the pending situation, he did not want to comment on details, said Trustee Timmings. Trustee Timmings stated that job evaluation of employees has been completed, with the exception of two people. A meeting will be held wil the finance committee, he said. . Trustee Timmings stated that he met with John Biros and members oJ the CSEA and heard the presentation concerning four grievances. After" studying all available data, he has prepared an answer to CSEA and movet that after review of Counsel, the letter be sent to CSEA, seconded by Trustee White. Carried. PUBLIC SAFETY Trustee DiFelice stated that Rescue Hose apparatus committee will review a demonstration in Mamaroneck on November 7th by the Pierce Mfg. Company. Columbia Hose Company is celebrating its 82nd Anniversary, said Trustee ^DiFelice. Trustee DiFelice gave the following police report for the month of October: (In detail official minutes) �-*7 Trustee DiFelice read a letter from Mrs. Florence Brown, 11 Maple St., commending Ptl. Hrotko for his help when she fell from a ladder and moved that a copy be placed in his folder, seconded by Trustee Timmings. Carried. Trustee DiFelice read a letter from Mr. Stephen Dennis, Principal of Morse School, thanking the police department, especially Ptl. Ferguson, for their help and assistance in helping the students and moved that a copy be placed in their folders. Carried. Trustee DiFelice read a report from Chief Spota commending Ptlmen. Biro, Caixeiro and Whalen for their meritorious work in connection with an investigation of an accident which resulted in the indictment of a person for homicide and moved that copies be placed in their folders, seconded by Trustee White. Carried. Trustee DiFelice stated that Chief Spota reviewed the request for a school crossing guard at Cortlandt-Cedar Streets-College Avenue and it was observed that school buses stop to pick up children for school. He stated in his report that there are numerous parents present during the arrival and departure of the children and very few have to cross the street. The bus drivers have commented that they did not believe that a crossing guard was needed at either crossing. The Chief stated that numerous persons received summonses for violating the stop signs during the surveillance, said Trustee DiFelice. Trustee White stated that parents are with their children around 8:15-8:30 in the morning, however, it is before that time that there are other children leaving for school and stated that there is a need for a school crossing guard. Trustee Cavalieri suggested that a patrolman should direct traffic at that hour. The matter was referred to the public safety committee. Trustee Cavalieri stated that people are parking in the area marked off by yellow lines and was told by Trustee DiFelice that the area is for the handicapped. The matter was referred to the public safety committee. Trustee DiFelice stated that he received a memo from Chief Spota stating that Ptl, Patten and Hayes would like interviews with the Public Safety Committee and the Police Chief regarding their eligibility on the Civil Service list for sergeant. During a short discussion, Trustees commented that there are no vacancies on the force at the present time. Trustee DiFelice moved, seconded by Trustee Cavalieri that a meeting of his committee be held with the patrolmen. Carried. Trustee DiFelice stated that under the CDA program, the police committee made a survey as to where street lights should be placed in the census tract 116. The survey showed 211 lights. We now have 11 lights to complete the project. N �I^^^^i^iyj ^^^M^^fa^fi^^ -6Mayor Zegarelli suggested that if possible, more than 11 lights be purchased so that they could be used for future use. Trustee DiFelice stated that Sally Isler signed the dog contract and moved that action of the Mayor in signing the contract be confirms seconded by Trustee Timmings. Carried. Trustee DiFelice stated that he is in receipt of a letter from Brian Sadlow of Chappaqua who would like to donate, as a gift, a top for the Auxiliary Police jeep. v Counsel Ponzini stated that it*would be permissible to accept the top. PUBLIC WORKS Trustee Soriano gave the following report; Blacktopping of pipe storage area in the greenhouse section on River Street has been completed. The department replaced the catch basin frame /£nd grate at the northeast corner of Kingsland Road and Evergreen Way. Rebuilt two catch basins and placed two new frames and grates on the storm sewer line from Birch Close through an easement on the proper of Anthonv Fiorella. Fifteen holes have been excavated for the planting of trees as par of the CDA program. Road repair program is continuing on Gesner Place, Fremont Road and Hemlock Drive. Preparatory work has been completed on Pleasant Str and Dell Street. Winterizing fire hydrants throughout the Village proper. Completed the painting of exposed 18" pipeline crossing the Pocantico River at various locations. I I Balance in water account as of November 2nd, $26,663.97. Tuesday being a holiday, there will be no bulk or newspaper pickup this week, said Trustee Soriano. Trustee Soriano reported that the new Mack refuse truck has been delivered and moved that payment in the amount of $83,395 be made to Mineola Mack, seconded by Trustee Cavalieri. Carried. Trustee Soriano moved that the Christmas lights be turned on December 4th and hours for illumination 5 P.M. - 12 midnight, except on Christinas and New Year's Eve, they will be illuminated all night, secow by Trustee Cavalieri. Carried. Trustee Soriano stated that a letter of thanks was received for wo performed on Depeyster Street by the street department and moved, secon by Trustee DiFelice that the letter be placed in folders. Carried. N �-7Trustee Gandolfo gave the following report; Youth basketball will commence this week, Nov. 3rd at the SHHS gym. Reservations are still being taken for this week's bowling trip to White Plains Bowling alleys. Cost will be $3 . Trustee Gandolfo stated that Mr. Labienc of the Miracle Recreation Equipment will be here to add the final touches to the playground equipment at Barnhart Park. Trustee Gandolfo reported that the section of the fence by the gate at Clinton Street park has been broken again. It was repaired twice before, she said. * . > . SENIOR CITIZENS Trustee White reported that a Halloween Party was held by the citizens with a turnout of 135 people. She stated that applications for smoke detectors have been completed by citizens and will be turned over to the Town of Mt. Pleasant. Trustee White stated that Miss Anne Nixon of Tarrytown had submitted a proposal to the Tarrytown Trustees and is requesting moral support from North Tarrytown in a project to obtain store fronts for the sale of wares made by the citizens. The sale of these items would aid citizens in supplementing their income, said Trustee White, and moved that the North Tarrytown Board of Trustees endorse Miss Nixon's proposal. Carried. TAX EXEMPT & ASSESSMENT Trustee Timmings reported "progress". MAYOR'S REPORT Mayor Zegarelli stated that a memo and proposed ordinance is on each Trustee's desk for their review and moved that .a :public hearing be held on December 7th on the proposed local law/^ficowSH-iSy18rrustee Sor iano. Carr ied. Mayor Zegarelli moved that William Doorley be granted a month's leave of absence, without payf seconded by Trustee Cavalieri. Carried. Mayor Zegarelli stated that a meeting has been scheduled with Mr. Brownstein, ETPA, who will speak to the Board about rent guidelines. Mayor Zegarelli stated that department heads traveling on business trips, conferences, should place their request through their committee chairmen and approved by the Board and so moved that a memo be sent to department heads, seconded by Trustee Cavalieri. Communication from Glenn Amesbury, Sec\y. Fire Council, regarding a change in personnel in Columbia Hose Company was read and on motion of Trustee DiFelice, seconded by Trustee Cavalieri that action of Fire Council be confirmed by the Board, Carried. The Clerk informed the Board of a claim of Stella Benchat against the Village as a result of a fall sustained to her on July 26, 1981 cmg Beekman Avenue and that the insurance carrier and Counsel have been 1 notified of same. I Trustee Timmings moved, seconded by Trustee Soriano that action of the Clerk be confirmed. Carried. Communication from Tom Maynard, Acting Director, Federal Emergency Management Agency, that they are in receipt of the Village's ordinance on Flood Insurance and that it meets the Flood Plan^Management regulati was read and entered into the minutes. . . . UNFINISHED BUSINESS In connection with the hearing this evening, Trustee Timmings moved, seconded by Trustee Gandolfo that the following resolution be adopted: RESOLVED: 1. Any real property located in the Village of North Tarrytown sha be exempt from taxation by the Village to the extent of fifty (50%) per cent of the assessed valuation thereof, pursuant to Section 467 of the Real Property Tax Law, provided that: a. In the case of joint ownership of said real property, either tl husband or the wife must be sixty-five (65) years of age or over. I b. The income of the owner or the combined income of all the owner of the property does not exceed the sum of eight thousand ($8,000.00) dollars forjthe twelve (12) consecutive months immediately preceding the date of the application for exemption. Where title to the property is vested in either the husband or the wife, their combined income may not exceed such sum . Such income shall include Social Security and retiri benefits, interest, dividends, rental income, salary ox earnings and income from self-employment, but shall not include gifts or inheritance In connection with any application for exemption, applicant shall furni the Board of Assessors such evidence of the income or combined income a the Board of Assessors may require, , j c. The title to the property shall have been vested in the owner or all of the owners of the property for at least twenty-four (24) consecutive months prior to the date of making application for exemptioi N �rpy^ -9d. The property is used exclusively for residential purposes. e. The real property is the legal residence of and is occupied in whole or in part by the owner or by all of the owners of said property. 2. Application of such exemption must be made by the owner, or all of the owners of the property on forms to be furnished by the Board of Assessors of the Village. Said application shall furnish all the information and shall be executed in the manner required or described in such forms, and shall be filed veach year with the Board of Assessors, not later than December 31st. This resolution shall apply only to Village real estate taxes for the fiscal year commencing June 1st, 1982. Carried Unanimously. Trustee Timmings stated that during negotiations, he would like to have the authority of the Board to ask people in the Village office to obtain data from various sources in the County and so moved, seconded by Trustee Gandolfo. Carried, Trustee Gandolfo stated that the group home committee is being activated again. She stated that members are trying to keep lines of communication open. All of the residents of the group home on Farrington Avenue have been replaced and there is a vast improvement in the area, said Trustee Gandolfo The residents are operating at a much higher level than the older ones, she said. Trustee Cavalieri noted that landscapers working at private homes are placing branches, leaves, etc. in the street and the Village has to remove them. He suggested some type of licensing. The matter was referred to Counsel for study, Trustee White moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer Department warrants dated November 2nd, 1981 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. Trustee Gandolfo stated that she objected to one of the bills, Thomas Smith's bill, and she indicated same on the voucher. No other business to come before the meeting, Trustee DiFelice moved, seconded by Trustee Gandolfo that the same be duly adjourned. Carried.
