December 21, 1981 / A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Janet Gandolfo Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trustees Robert J. Ponzini, Counsel. Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Mayor Zegarelli noted the Village's 107th anniversary and asked the audience present to help us celebrate the occasion. Mayor Zegarelli stated that a meeting will be held on December 28th when the Board will formally approve the bids on the Village garage-and Strand Theater. Mayor Zegarelli opened the following bids on the former Strand Theater: Fiorno Ferrera 91 Wildey St., Tarrytown, N.Y. $28,000.00 Xaurentino Rodrigues 56 Clinton Street, N. Tarrytown, N,Y. $45,000.00 Trustee Timmings moved, seconded by Trustee White that the bids be referred to the Board as a committee of the whole. Carried. Mayor Zegarelli opened the following bids on the proposed Village Garage: (In detail official minutes) Mayor Zegarelli moved that the bids be referred to the Board as a committee of the whole, seconded by Trustee White. Carried. Mayor Zegarelli stated that the Village Attorney is in receipt of a letter from the U.S. Department of Justice in response to his inquiry concerning the status of the complaint of Thomas A. Gleason that he has been deprived of his civil rights. In the letter, Mr. Reynolds stated that after carefully reviewing the investigative report submitted by the FBI, they have concluded that there is no prosecutable violation of Federal criminal civil rights statutes and they have closed their files. �Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. No one appearing before the Board, the regular order of business was taken up. REPORTS OF COMMITTEES BUILDINGS & GROUNDS TrusteevCavalieri moved, seconded by Trustee Soriano that action of the ^fcutfty^Lri awarding the heat control bid to Johnson Controls in the amount of $23,950 be confirmed by the Board> Carried, Trustee Cavalieri moved, seconded by Trustee Gandolfo that his committee be authorized to travel, with expenses, to the old Danbury Fair grounds to look over the Headless Horseman statue which will be for sale. Carried. | I \M I FINANCE & REAL ESTATE Trustee €andolfo reported a cash balance of $117,272.73 in the General Fund as of December 21, 1981. Trustee Gandolfo moved, seconded by Trustee Timmings that action of the Treasurer in investing a certificate of deposit in the amount of $100,000 in the First National Bank of North Tarrytown at a rate of 127. be confirmed. Carried. In connection with Fremont Pond, Trustee Gandolfo reported that sb received a copy of a letter that Charles Pound sent to Mr. Cropper, Soi Conservation Service, which he enclosed the proposed location and construction details for the dredged materials spoil area to be used for the deposition of materials. Trustee Gandolfo moved, seconded by Trustee DiFelice that the Village Clerk be authorized to send the necessary copy of the written consent and copy of title search to the school board. Carried. Trustee Gandolfo moved, seconded by Trustee White that a copy of I the plans and specifications of Fremont Pond be sent to the President I of the school board. Carried. ^ Trustee Gandolfo stated that Mr. Pound was supposed to supply us with evidence of a performance bond and appropriate liability insurance Mr. Gorman has received a copy of the liability insurance which was don incorrectly. Mr. Pound was supposed to indemnify the school board befo: the Village and Mr. Gorman has written to him advising him that the liability insurance is not acceptable and appropriate and moved that action of Mr. Gorman be confirmed, seconded by Trustee Cavalieri. Carri GOVERNMENTAL RELATIONS Trustee White moved r seconded by Trustee Gandolfo that the Village offices be closed Christmas Eve and New Year's Eve at 12 noon. Carried.| Trustee White reported that cable TV was installed today at Collegi Arms. i •» �-3- ^h 7 LABOR RELATIONS Trustee Timmings reported that as a result of mediation, a tentative agreement was reached with the police department. '\ Trustee Timmings moved, seconded by Trustee Gandolfo that the draft outlining the basic agreement between the police and Village be approved. Carr ied. Trustee Timmings moved that Counsel be authorized to draft the final version of the contract in conjunction with the police attorney, seconded by Trustee White. Carried. Mayor Zegarelli thanked Trustee Timmings and Counsel Ponzini for the long hours they worked reaching this agreement. In connection with the policy of paying employees who have been injured on the job, Trustee Timmings moved, seconded by Trustee Soriano that employees be paid as follows, effective January 1, 1982: ,: If an employee calls in claiming inability to /come to work^due to a prior injury, he will be paid for his absence, but the time will be charged to his sick leave benefits. The employee will be required to report this to the Workmen's Compensation and when compensation accepts his* case, his sick leave benefits will be restored. If the employee does not have any sick leave benefits, he will not be paid, but must seek redress from Workmen's Compensation. When the employee receives payment from compensation, the Village will make up the difference between his compensation and his salary. If an employee is injured on the job and must absent himself from the job, he will be paid his full salary for\the first week. Subsequent payment will have to be made by Workmen's Compensation and the Village will make up the difference between what compensation pays and the employee's salary. On the question, Trustee DiFelice inquired if this includes all Village employees and was answered by Trustee Timmings that it included members of the public works department. A question was raised whether or not employees in the public works department were on an hourly or salary basis. Trustee Soriano stated that employees not considered in administration are computed on an annual basis, but are considered .hourly. , ,, , Trustee.Cavalieri moved to table until more information is obtained, seconded by s e 8ayor Zegarelli polled the Board on the motion to table as follows: Trustee Timmings " Gandolfo " Soriano - No - No - No Motion to table not carried Trustee Cavalieri - Yes DiFelice - Yes White - No ! Trustee Timmings stated that the IRS has circulated a new regulatic whereby lunch money should be reported as additional income when employ! attend seminars, conferences, etc. and employers are demanded to report this reimbursement. i Trustee Timmings moved, seconded by Trustee DiFelice that Counsel be instructed to review the regulation to ascertain whether or not thi new regulation applies to the Village. Carried. PUBLIC SAFETY Trustee DiFelice stated that he is in receipt of a letter from DOT inquiring if the new construction work, traffic^ light signals on route 9, 448 intersection, etc. are satisfactory to the Board. Trustee DiFelice stated that no complaints have been received regarding the intersection and moved that a letter be sent to DOT that the traffic light signals, etc. are working satisfactorily, seconded byj Trustee Gandolfo. Carried. | Trustee DiFelice stated that the Youth Bureau gave a lecture on fingerprinting to the Boy Scouts on December 15th. Trustee DiFelice moved that Ptl. Ferguson be authorized to attend the Maxwell Institute School with members of ADAPT at a cost of $250 foi tuition, said money to be taken from the Youth Bureau budget, seconded by Trustee Timmings. Carried, Trustee DiFelice reported that Ptl, John Cappello graduated from the Municipal Police Training School on December 17th. i Trustee DiFelice reported that the amount of $1347.29 has been received from the County for the aid of our police department when rioti occurred at the County jail several months' ago. Trustee DiFelice moved that parking meter regulations be suspended during this week and on Christmas and New Year's Eve, seconded by Trustee Timmings. Carried. i PUBLIC WORKS Trustee Soriano gave the following report; Excavated and repaired cave-in over sanitary sewer on Harwood Ave. Placed permanent black top on various excavations. Bank balance in water department as of 12/21/81 is $34,838.14. Re-arranged and consolidated catch basins and pipe at pine storage at treatment plant greenhouse area. i �-5- *?9y Removed branches at Pine Street and Continental Street. Trimmed trees in the Anderson and Van Tassel Avenue areas. Sealed joints in the Elm Street and Pocantico Street area. T.V. by the New England Pipe Co. - the storm sewer from Beekman Avenue down Valley Street to Frank Chevrolet. ! Sanded and plowed during the three storms. Road repair program is now complete at final cost of $89,960. Hopper from Brockway fell away from body at the Croton dump. The hopper was brought back to garage on a flat bed and the unit is now back in service. Because of the Christmas and New Year's holidays, there will be no bulk or paper pickup this week or next. On both weeks, the Thursday pickup will be made on Wednesday and Fridays on Thursday. Trustee ^Soriano read a letter from Gus Paese, consulting engineer, that the road work has been satisfactorily completed. The Village saved $8595 und er the bid. f < Mr. Paese recommended that the balance of the cost of the work be paid. Mr. Paese also thanked the police, highway and water departments for their cooperation. Trustee Soriano moved, seconded by Trustee Timmings that the balance of payment be made to County Asphalt, Inc. in the amount of $10,378.00. Carried. Trustee Soriano stated that John Biros attended a meeting called by County Executive, Alfred DelBello, regarding the solid waste program. At the meeting, Mr. DelBello stated that the program is in jeopardy because of a petition submitted requiring a referendum on the information of the district. Mayor Zegarelli stated that the IMA agreement states that a certain number of people can petition the governmental agency (County) to have a permissive referendum concerning the whole proposal on solid waste. If this goes through, the question would be on the ballot, such as Con Edison's proposal. RECREATION Trustee Gandolfo gave the following report: A majority of the Fall and Winter programs ended last week with about 310 residents participating, Out of 17 programs and events, 11 of them went for a 71%. ' Programs still in session are ice-skating, ice hockey, ski trips and ice skating Olympics. The Winter-Spring brochure will be in the mail by January. Classes will commence the first week of February. Some programs scheduled are Aerobics, gymnastics, box lacrosse, Softball warm-ups, floor hockey, racquetball and many more. ! �Trustee Gandolfo moved, seconded by Trustee Soriano that Pat Lofaro be authorized to attend the ADAPT Program at the Maxwell Institu in White Plains, cost of $250, to be taken out of the recreation budget Carried. Trustee Gandolfo stated that Tarrytown has. sent us a proposal for ice skating at the Tarrytown Lakes which is not acceptable. She stated that she will contact Mrs, Slavin to see if we can work on an alternate proposal regarding ice skating. Trustee Gandolfo stated that the Mayor and she met with representa ta tives from the County regarding Kingsland Point Park whereby a discuss] was held on an agreement. The Town of Mt, Pleasant will be contacted ascertain whether or not they would be interested in a joint agreemen In a discussion with Supervisor Rovello, he has requested a written proposal on the matter. She stated that she has requested Pat Lofar) to submit suggestions as to what type of activities would be most successful. Mayor Zegarelli stated that he talked to Supervisor Rovello and he will be drafting a formal proposal and stated that in a memo to Trustee! he had asked for any suggestions. ' Trustee Cavalieri stated that he had talked to County authorities a couple of years' ago regarding Kingsland Point Park and had suggested that we would maintain the park, cutting grass, etc. and they would collect the fees and pay for the lifeguardsj however, the matter had to go through several departments. He stated that he never heard from the County again. Trustee Gandolfo stated that her committee will be formulating proposals. The draft will be made after a hearing. SENIOR CITIZENS Trustee White reported that the citizens held a Christmas Party today with a sizable attendance, Basil Soriano provided the music. TAX EXEMPT & ASSESSMENT I Trustee Timmings stated that we have been notified by the Dept. of Equalization and Assessment that the final equalization rate for 1981 is 24.19%. MAYOR'S REPORT Mayor Zegarelli stated that he is in receipt of a letter from Roger Pellaton, architect, for 21 Beekman Avenue, requesting a 30 day extension for review of Mr. Kowalczk's application for a building permi for the restoration of his property. Mr. Pellaton stated that revised plans have been submitted. Following a discussion, Trustee Cavalieri moved to accept the reques for an extension, seconded by Trustee DiFelice. Mayor Zegarelli polled the Board as follows: Trustee Timmings - Yes " Gandolfo - No " Soriano - Yes Trustee Cavalieri - No DiFelice - No White (absent) �-7- . =^0" Mayor Zegarelli voted "Yes". Motion failed - extension denied. COMMUNICATIONS Communication from Cuban Club requesting permission to hold a dance on December 31st was read. Trustee Timmings moved, seconded by Trustee Cavalieri that permission be granted. Carried. Communication from Sec'y. of Fire Council, Glenn Amesbury, regarding changes in personnel in Fire Patrol and Rescue Hose Companies, and exempt certificates for Daniel Hogan, James Kenyon, John Lombardi was read. One member was elected an out-of-town active member of Fire Patrol. Counsel stated that out-of-town members would not be eligible for membership in' the Fire Department unless the person works in the Village. Since this is not known, Trustee Timmings move&, seconded by Trustee DiFelice that action of Council regarding the changes be approved, except for the out-of-town member. Exempt certificates were granted to the above, Carried. Communication from Jose Figueirede, 148 Depeyster Street, requesting a new sidewalk was read and referred to the public works committee. Communication from Secly. of Fire Council, Glenn Amesbury, requesting on behalf of the Council, a meeting with the Board to discuss janitorial services was read and referred to the Buildings & Grounds Committee. Communication from Joseph Piedimonte resigning from the Mt. Pleasant Senior Citizens Commission was read. Trustee Timmings moved, seconded by Trustee DiFelice that his resignation be accepted with regret. Carried. Trustee Timmings moved, seconded by Trustee DiFelice that the Board approach a member of the Clergy to replace Mr. Piedimonte. Carried. UNFINISHED BUSINESS Trustee Soriano moved, seconded by Trustee'Timmings that the minutes of the meeting held on December 7th, 1981 be approved as written. Carried. Trustee Cavalieri stated that at the last meeting of the Board, a discussion was held regarding the reclassification of the easterly side of Clinton Street, He stated that he received a response from the Planning Board and it was their recommendation that the area be reclassified from an R2 District to a C2 District, �-8Following a discussion, it was the consensus of the Board to request the Planning Board to review the possibility of a new classifi. cation to include whatever defines industrial and its subdivisions, and also their feelings for the east side, in line with the west side. Trustee DiFelice suggested that a letter of commendation be sent to the police and fire departments for their aid to a call for Ralph Cellante. NEW BUSINESS Trustee Gandolfo stated that when Pat Lofaro saved a man's life several months1 ago, he was awarded a watch from his fire company and moved that he be allowed to accept the watch, seconded by Trustee Timmings. Carried. Trustee Timmings moved, seconded by Trustee Soriano that the bil submitted on the General Fund and Water & Sewer Department warrants dated December 21, 1981 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants, Carriedy There being no further business to come before the meeting, Trustee DiFelice moved, seconded by Trustee Soriano that the same be duly adjourned.
