March 1, 1982 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor James J, Timmings Janet Gandolfo Peter Soriano Thomas J. Cavalieri Mario DiFelice Margaret White, Trustees ,, Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee White that the minutes of the meeting held on February 16, 19o2 be approved with a minor correction. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Mr. John Carroll, 140 Hunter Avenue, inquired if there was any progress report on the research of Kingsland Point Park. Mayor Zegarelli stated that he, together with Trustee Gandolfo, have been in discussion with County representatives on a series of matters. To the best of our knowledge and records, he said, the park is designated as park lands by the State and would not revert back to anyone. It would not change back its status, he said. Mr. Carroll suggested that the Board employ Mr. Leonard Frasca on a consultant basis to investigate all the deeds. Mayor Zegarelli stated that if current negotiations continue, we would want to have a determination as to a clear title to the property. In our discussion with the head of the Park Department, we have been told that they have the deed, said the Mayor. Mr. Mario Belanich, North Washington Street, inquired about an article which appeared in the local newspaper regarding street cleaning work on a Saturday. Trustee Soriano explained that one of the employee's works 4% days per week because he comes in on a Saturday morning. There is no extra money involved-the man was transferring from one piece of equipment to another. » 1 \ P �-2REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that Joseph Thaler began work today cleaning apparatus rooms, etc. in Union Hose, Rescue Hose and Central Fire Headquarters on a weekly basis and will wax on a quarterly basis. Counsel will work on an agreement with him, said Trustee Cavalieri. The sliding divider between Fire Patrol and Columbia Hose meeting rooms has been placed back on its track and is in operating order, said Trustee Cavalieri. m The ramp for the handicapped will have self-adhesive strips of non-skid material added when the weather is warmer. I | Ground breaking ceremonies will be held at 11 A.M. on March 6th at the site of the new garage on River Street. Trustee Cavalieri stated that Ronald Turnquist reviewed the construction phase procedures in connection with the new Village garage He stated that Mr. Turnquist will oversee the project and will be the liaison between the contractor and Board, FINANCE 6c DEVELOPMENT Trustee Gandolfo reported a cash balance of $121,535.75 in the General Fund as of March 1, 1982. Trustee Gandolfo stated that she is in receipt of a copy of a letter sent to Supt. of Schools, Mr. Blueglass, from James Cropper, District Conservationist that the dredging site is acceptable. A locat sketch was submitted by the contractor to Mr. Cropper and it showed sufficient elevational information that the dredge spoil area should in no way block any existing drainage paths. Hopefully in the spring we will be able to commence work, said Trustee Gandolfo. Trustee Gandolfo moved, seconded by Trustee White that a public I hearing be held on March 22nd on the proposed use of Federal revenue I sharing funds. Carried. Trustee Gandolfo called for a meeting on March 3rd to discuss the tentative budget. GOVERNMENTAL RELATIONS Trustee White stated that a meeting will be held on Thursday with Mr. Brownstein to discuss ETPA. All Board members are asked to attend. Trustee White reported that 240 lbs, of cheese was given to Tarryt and North Tarrytown residents and was distributed at the COC. Another meeting will be scheduled, he said. Trustee DiFelice reported that the amount of $6,460 was received from warrants issued as of March 1, 1982 in connection with scofflaws. PUBLIC WORKS Trustee Soriano gave the following report: Repaired water meters which were found defective. i Preventative maintenance flushing of sanitary sewers with sewer j is in progress in Philipse Manor area. Trustee Soriano moved, seconded by Trustee White that John Biros be granted permission to attend the spring meeting of the N.Y. Section American Water Works Association in Rochester April 5-7. Carried. Bank balance in water account as of March 1st is $14,982.72. Catch basins are being cleaned out in the Sleepy Hollow Manor area The undermined section of Kingsland Road between Evergreen and Hem* was excavated, filled and backfilled. Catch basins^have been repaired in the Village garage and Barnhart 1 Old picnic tables have been removed from Douglas Park. The new aerial ladder truck was received from Frank Chevrolet as per bid of August 17th. The next holiday will be April 9th, Good Friday. bulk pickup the week of April 5th. There will be no SENIOR CITIZENS Trustee White reported that Mr. Blueglass, Supt. of Schools, spoke to the citizens today on different curriculums offered, taxes and plans for the institution of Grandma and Grandpa Days. The citizens will take a trip to Atlantic City on March 10th and ii April, An Evening Dinner Theater. TAX EXEMPT & ASSESSMENT Trustee Timmings reported "progress", RECREATION &. .PARKS Trustee Gandolfo gave the following report: Vandalism: In Barnhart Park, one hemlock tree was destroyed, graff: was reported in Clinton Street. The second handrail was stolen off the Jack & Jill equipment in Clinton Street park. The glass in Margotti Park was removed by Gary Thomas. �-5" 3ey The electric box at Barnhart Park was destroyed and Mr. McCarthy was investigating. Beginners Lacrosse clinic will commence on March 1st at the Sleepy Hollow High School gym. Youth basketball regularly scheduled for Tuesday nights has been changed to Monday nights March 8 and 15th. ;\ h i The following ski trips are scheduled for the next two weeks: Jiminy Peak on March 6th; Whiteface Mt. March 12-14 and Hunter Mt. on March 13th. Dad's Club baseball kickoff night will be held on March 12th at Morse School. Movies and prizes will be awarded. Indoor tennis lessons have commenced. - .-j.il Men's and women's softball meetings will take place in the Village Court room. Men's will be on March 4th and the women's on March 2nd. We will have a report from Pat Lofaro regarding Kingsland Point Park within the next week. MAYOR'S REPORT Mayor Zegarelli stated that a letter was received from the Supervisor of the Town of New Castle regarding problems they are experiencing with Cable TV and referred the matter to Counsel. Mayor Zegarelli reported that the bills in connection with our request for a Board of Assessment Review legislation have been signed and sent to Assemblyman Sullivan. COMMUNICATIONS Communication from Wally Buxton resigning as Village Historian effective immediately was read. Trustee Timmings moved, seconded by Trustee Gandolfo that his resignation be accepted with regret and a letter of thanks be sent to him as well as a certificate of appreciation, Carried. i s- h "' si1' LM it, it Communication from Michael Galella, 40 Depeyster Street, Manager, requesting permission to use Memorial Field for a softball tournament in May was read and referred to the recreation committee and Counsel for legality. Communication from Mr. John Carroll requesting permission on behalf of the VFW of Foreign Wars, to hold a Loyalty Day Parade on April 25th and that a contribution be made was read. Trustee Cavalieri moved, seconded by Trustee Timmings that permission be granted and that the police department be notified of same and the request for contribution be referred to the finance committee. Carried. \ !!, -fi �-6Communication from the County Department of Public Works that in lieu of the cash deposit for work done on County roads that the Board should adopt a resolution which shall guarantee that the work will be done in accordance with the conditions as set forth in the permit was read. Trustee Timmings moved, seconded by Trustee Gandolfo that the following resolution be adopted: WHEREAS, pursuant to the provisions of Chapter 605 of the Laws of 1941, revised as of June 5, 1961, the Commissioner of Public Works of Westchester County with the approval of the Board of Supervisors and thh County Executive of Westchester, has prescribed rules, regulations, sa guards, specifications and conditions for the protection, reconstruct! maintenance, or restoration of any County Road or portion thereof, and for the protection and safety of the traveling public thereon during a^ operations of reconstruction, maintenance or/restoration of such County road or portion thereof, and / i WHEREAS, the said rules and regulations require any person, firm, corporation, improvement district, or municipality doing any work upon any County road to obtain a written permit from the Commissioner of Public Works and to deposit a certified check made payable to the order of the County of Westchester in an amount computed by the extent of the proposed work, and WHEREAS, the said rules and regulations provide that any city, village, town public improvement district, or other municipality may, j in lieu of making the said mentioned deposit, file with the Commissioneij of Public Works a certified copy of a resolution duly adopted by the ] Governing Board of such municipality guaranteeing faithful performance ] by the said municipality of all the terms, covenants and conditions as set forth in the permit, which resolution shall be effective for permit^ issued during the remainder of the calendar year after adoption, and j WHEREAS, the Village of North Tarrytown, from time to time, is required to do work within the County road area for which a written permit from the Commissioner of Public Works of Westchester County is required, and for which a certified check deposit is required, NOW, THEREFORE, BE IT i RESOLVED, that the Village of North Tarrytown does hereby guarantee faithful performance of all the terms, agreements, covenants and conditions of each and every written permit as referred to herein issued by the Commissioner of Public Works of Westchester County and that this guarantee of faithful performance shall be applicable to all such written permits issued during the current calendar year January 1, 1982December 31, 1982. Carried. .s �-7- .,**£ UNFINISHED BUSINESS Trustee Soriano stated that as a result of legal advertisements for the sale of 79 College Avenue, the bill came to $429.66, of which 79 College Avenue Development Fund, Inc. cannot pay because of lack of funds and the corporation is asking the Village to pay the bill. Following a short discussion, Trustee Soriano moved, seconded by Trustee Timmings that payment be made from Village funds. Trustee DiFelice moved to table the motion, seconded by Trustee Gandolfo. On the motion to table, Mayor Zegarelli polled the Board as follows: Trustee Timmings - Yes Gandolfo •- Yes " Soriano - No Trustee Cavalieri " DiFelice " White - Yes Yes No y Motion carried. - Trustee DiFelice moved, seconded by Trustee Cavalieri that a public hearing be held on May 3rd on a proposed Local Law on Street. Trees. Carried. Mayor Zegarelli stated that he is in receipt of material regarding the gypsy moth program and referred the matter to public works committee. NEW BUSINESS A this time, Trustee DiFelice moved that the Board met in executive session to discuss a personnel matter, seconded by Trustee Soriano. Carried. Reconvening the meeting, Trustee Gandolfo moved, seconded by Trustee Soriano that the Chief of Police be given the same percentage increase pursuant to the police contract as the second highest man received (1st Lieut.), retroactive to June 1, 1981, said amount to be transferred from Contingency Fund. Motion carried while Trustee DiFelice abstained. Trustee Gandolfo moved, seconded by Trustee DiFelice that based on discussions with Civil Service office, the Mayor be directed to outline to all department heads that part-timers will be paid on the basis of 17 hours per week, seasonal workers excluded, and that the Treasurer be ordered to adhere to this order. Carried. Trustee Soriano moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer Department warrants dated March 1, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants.
