January 17, 2024
Chairman Timothy Church called the meeting to order at 7:04 pm.
Present:

Chairman Church read the public notice, listed the documents submitted with the application,
and asked Pamela Kroll to confirm that the Building Department received the mailing receipts.
Pamela Kroll stated that the Building Department received proof of the mailing.
Chairman Church invited the applicant to present the application.
Christopher Barbagli stated that he is the architect representing the applicants. Mr. Barbagli
stated they are seeking a variance to reduce the front yard setback by 3 1/2 feet. Mr. Barbagli
stated that the existing house does not have a front entrance. There are side entrances on the
house's driveway and living room sides. The application proposes constructing a
mudroom/vestibule addition and a covered front porch addition to enhance the house's aesthetics
and provide outdoor living space. Only 4 1/2 feet from the property setback line is currently
available to construct a porch.
Chairman Church asked Mr. Barbagli to present and describe the drawings.

�Mr. Barbagli presented the proposed elevation drawing and stated that the proposed mudroom
addition would replace the living side entrance, limit the weather elements from coming into the
house, and provide a front entrance facing the street.
Chairman Church asked Mr. Barbagli if the proposed porch is open and accessible from the
vestibule. Chairman Church asked if the proposed vestibule would be in the setback.
Mr. Barbagli stated that the porch would be open and accessible from the double doors of the
vestibule. The proposed vestibule is not in the setback.
Craig Lis asked Mr. Barbagli for the proposed depth of the front porch.
Mr. Barbagli stated that the proposed porch would have a depth of 8 feet, with 3 1/2 feet
encroaching into the required front yard setback.
Chairman Church asked Mr. Barbagli if the porch stairs would encroach into the front yard
setback.
Mr. Barbagli stated that only the porch would encroach into the front yard setback.
Chairman Church stated that the applicants are requesting a variance to construct a front porch
that encroaches 3 1/2 feet into the required 30-foot front yard setback. The proposed vestibule
addition does not require a variance for the side yard setback.
Chairman Church moved to open the public hearing.

Chairman Church stated that when only four Board members are present, the vote must be
unanimous to grant the variance. The applicants can request the Board to vote on the application
or postpone the vote to the next meeting. If the vote is not unanimous, the applicants may
resubmit the application in six months or revise the application for the next meeting.
Chairman Church stated that the pictures submitted show that the applicant’s house is behind the
plane of the neighboring property. Although the proposed one-story open porch will extend over
the plane of the neighboring property, it would not be a noticeable encroachment in the required
30-foot setback. The proposed front porch and vestibule addition will improve the aesthetics of
the house.

�Craig Lis stated that the open porch differs from constructing a solid wall, and the requested
variance is minor compared to the required front yard setback.
Gorete Crowe stated that the open porch would not create a visual obstruction from either side of
the applicant’s property.
Lauren Sullivan is the owner of the property and requested that the Board take a vote on the
application.
Chairman Church proposed granting the requested variance based on the following criteria:
1. The requested variance from the front porch addition will not be a detriment to the nearby
properties, as the proposed additions will enhance the aesthetics of the neighborhood.
2. There is no other feasible method to obtain the benefit sought by the applicants to have a
front entrance and usable front porch.
3. The requested area variance is not substantial in relation to the 30-foot required front yard
setback.
4. Granting the area variance will not cause an impact on the physical or environmental
conditions of the neighborhood.
5. Although the requested variance is a self-created difficulty, there are other factors the
Board considers when granting a variance.
