March 22, 1982 y A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Ponzini, Counsel Absent Janet Gandolfo, Trustee Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Mayor Zegarelli called for bids on a recreation utility garage. The following bids were opened: J.C. Perri, Inc., Tarrytown, N.Y. He stated that the funds received by the Village will be incorporated in the new budget. No one appearing on the hearing, Trustee Timmings moved, seconded by Trustee White that the hearing be closed. Carried. Trustee Soriano moved, seconded by Trustee White that the minutes of the meeting held on March 1, 1982 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. No one appearing before the Board, the regular order of business was resumed. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Cavalieri reported that another meeting will be held of the Buildings & Grounds Committee and the Technical Service Review Board on Thursday, at 8 P.M. as well as the newly elected Trustees to discuss the utilization of space in Village Hall. Trustee Cavalieri moved, seconded by Trustee DiFelice that the Mayor be authorized to sign an agreement with the architect for space utilization in Village Hall and the Municipal Building at a cost of not more than $1600. Carried. Trustee Cavalieri moved, seconded by Trustee DiFelice that the Mayor be authorized to sign the contract with John Thaler for the mainten-* ance of floors, etc. in Central, Rescue and Union Hose Companies on an on-going basis, money to be taken from General Fund, seconded by Trustee DiFelice. Trustee Cavalieri stated that the Village Attorney has approved the contract. Carried. FINANCE & DEVELOPMENT In the absence of Trustee Gandolfo, Trustee Timmings reported a balance of $259,134.55 in the General Fund as of March 22, 1982. GOVERNMENTAL RELATIONS Trustee White reported that she attended a swim-a-thon sponsored by the YMCA on Saturday. LABOR RELATIONS Trustee Timmings stated that as a reminder to the new committee that the CSEA contract will be the first major item of business to be undertaken The committee may want to consider the 1981-82 granted salary increase of 8.27o to CSEA and the police contract had an increase of 7%. The committee should start negotiating on the CSEA contract, he said. Trustee Timmings stated that John Biros has responded to all first stage grievances and several have been forwarded to the second stage. �\p -A- PUBLIC SAFETY Trustee DiFelice stated that the street light maintenance contract expires May 31st and moved that specifications be prepared and bids returned on May 3rd for the year commencing June 1, 1982-May 31, 1983, seconded by Trustee Soriano. Carried. Trustee DiFelice stated that the meter maintenance contract expires May 31st and moved that specifications be prepared and bids be received on May 3, 1982 for meter maintenance contract for the year June 1, 1982May 31, 1983, seconded by Trustee Soriano. Carried. Trustee DiFelice proceeded to move that bids be received on a polica car on April 5th, however, during a discussion, Trustee Timmings stated! that any purchases made at this time would be taken from this year's I budget, after which the matter was held in abeyance until such time as | the 1983 models are made. Trustee Cavalieri reiterated that the car should have no air conditioning and also recommended a small car. Trustee DiFelice stated that Ptl. Ferguson attended the Maxwell Institute in Bronxville from March 1-5, which dealt with the use and abuse of drugs and alcohol by school age children. Trustee DiFelice stated that he is in receipt of a letter from Fred Fukuchi thanking Ptl. Ferguson for the aid given to his wife and moved that the letter be placed in his folder, seconded by Trustee White, Carried. Trustee DiFelice stated that Frank Mangieri, Chairman of the Drug Guidance Council, has taken a drug course sponsored by the N.Y. ArchdiocJ at the JFK high school. j Trustee DiFelice moved, seconded by Trustee Timmings that Mr. Mangi^ be reimbursed the registration fee. Carried. ! i Trustee DiFelice moved, seconded by Trustee Timmings that the I attendance of the Court Clerk at a seminar in New Paltz on March 19th bJ confirmed and that expenses incurred be paid by the Village. Carried. I Trustee DiFelice stated that the tentative date for the ambulance Cc dinner is April 24th. Trustee DiFelice stated that the Police Chief is still investigating the taxi company's violations and final disposition will be made by the next meeting. PUBLIC WORKS Trustee Soriano gave the following report: Preventative measures of sanitary sewer lines in Sleepy Hollow Manor is in progress. Excavated and repaired a broken section of sanitary sewer on Kelbourne Avenue. Balance in water account as of March 22, 1982 is $29,377.48. •» �-5- J/7 Cleaning out catch basins in Sleepy Hollow Manor and reconstructed catch basins on Kingsland Road and Sleepy Hollow Road. Sealing joints on New Broadway and filling potholes with cold patch throughout the Village The department removed 68 tons of paper with a dollar return of $1088 on bulk pickup days for the nine months ending February 28th and salvaged approximately 75 tons of iron for a return of $1500 plus a saving of $1162 for not hauling to Croton. In connection with the referendum on solid waste to be held on March 30th, Trustee Soriano read an opinion from John Biros recommending that we continue to support the creation of the solid waste disposal district. Trustee Soriano reported that in connection with the agreement the Village has with Phelps Memorial Hospital for the use of their dumping area, the Town of Mt. Pleasant has indicated an interest in using it also. Since the agreement that the Village has with the hospital is not assignabl the Town would have to enter into its own agreement. The Town needs a dumping area, said Trustee Soriano, and he saw no objection to their using it provided that they share expenses in the event that additional piping is necessary and that an agreement is made with the hospital. He recommended that a meeting be held with the Town. Following a discussion, Trustee DiFelice moved, seconded by Trustee Soriano that a letter be sent to the hospital outlining the Village's position concerning the contract and the fact that even though the contract states that we have exclusive use, other governmental agencies have been utilizing it for a dump site and we have been criticized for it and we had nothing to do with it. RECREATION & PARKS In the absence of Trustee Gandolfo, Trustee Cavalieri gave the following report: Vandalism at Clinton Street park. A vehicle or truck was stuck in Douglas Park and made huge holes in the mud. Margotta Courts playground was also struck by vandalism. The North Tarrytown Recreation Department, together with the Tarrytown Recreation Department and the PTA of Washington Irving Jr. High School and Morse Schoo are making plans for an after school program for children which will be self-sustaining. Scheduled starting date is the second week of April. Trustee Cavalieri stated that Gary Thomas completed his six months probationary period and moved that he be placed on permanent basis effective immediately, and that the $500 withheld from his salary be adjusted accordingly, seconded by Trustee Soriano. Carried. The ski trip program, sponsored with the Westchester Ski Teens, ended this week. The Easter Egg hunt, co-sponsored with the Knights of Columbus and the Tarrytown Recreation Department will be held on April 3rd at 10 A.M| in Patriots Park. Trustee Cavalieri stated that the Recreation Department is pleased to announce that the sum of $22,000 has been collected in revenues (Stateaid, fees and charges). He stated that the figure is $9,000 over the anticipated income of $13,000. �-6At this time, Frank Quinn inquired if he could place his bid for the recreation utility shed. He stated that he just came off a job and arrived late. Mayor Zegarelli stated that bids were opened at the beginning of the meeting and it would not be appropriate to open his bid at this tin SENIOR CITIZENS Trustee White stated that Bingo was held last Monday by the club. A trip has been planned to An Evening Dinner Theater on April 22nd. A social hour will be held on April 13th for Easter and a tentative trip has been scheduled to West Point on May 1st. Trustee Soriano stated that he is in receipt of a report from Dr. McNaughton, North Tarrytown's representative on the Town of Mt. Pleasan Senior Citizens Council that the public corporation under the auspices of the Town of Mt. Pleasant has no plans for Senior Citizen housing in North Tarrytown, however, if it branches out, North Tarrytown will be considered. TAX EXEMPT & ASSESSMENT Trustee Timmings stated that the requested decrease in assessment at the Van Tassel would result in a Village Tax collection of $1 per month per apartments and the committee recommends that the Village take aggressive action to fight this certiorari. MAYOR'S REPORT Mayor Zegarelli stated that a letter has been received from Edith Nelson, President of the Philipstown Community Council at Cold Spring asking our support for the proposed legislation, Assembly Bill #8670. The proposal being re-introduced by Willis Stephens will delete part of the present law's confidentiality and secrecy requirement and make mandatory the availability of the accusatory instruments and the names against whom they are filed as public record subject to inspection and review. I Mayor Zegarelli stated that he would have the Bill on the desk fori the Board's perusal. Mayor Zegarelli noted communication from Mayor DeFazio of Sylvan Beach, N.Y. whereby he inserted a copy of Assembly Bill #3009 introduce! by Assemblyman Levy to amend Section 277 of the Highway Law which would exempt Village taxpayers from paying town highway budget items 3 & 4 and which has been introduced before the Assembly Transportation Commitl Mayor Zegarelli read a letter from the D.O.T. in answer to the Village's letter regarding our request to reduce the speed limit on Route 9. Mr. Mignogna stated that a formal investigation has been initiated and a study will be conducted at the location. Mayor Zegarelli read a letter from Senator Goodhue regarding her support for revenue sharing and opposing the cap on it. �.7. ^ / ; Mayor Zegarelli noted a letter from Lawrence Sally, Dty Commissioner, Division of Housing & Community Development Westchester County, requesting that the Village take part in housing ies. Homebuying classes are being organized by the Westchester Restitial Opportunities. April is Housing Month. The letter was referred to the building inspector andlliam Doorley. Mayor Zegarelli stated that all contracts in connectiwith the Village garage have been received. Trustee DiFelice moved, seconded by Trustee Soriano t the Mayor be authorized to sign all contracts, papers, etc. in conneon with the Village Garage. Carried. COMMUNICATIONS Communication from Sec'y. of Fire Council regarding oges in personnel in Fire Patrol, Rescue Hose, Pocantico H & L anciion Hose Companies, request for exempt certificates, permission forscue Hose and Columbia Hose to take its apparatus to parades and a nest for Chief Bozelli to take the Fire Chief's car to the parades; read. Trustee Timmings moved, seconded by Trustee DiFelice it action of Council be confirmed. Carried. The Clerk informed the Board of a notice of claim ofraldine Smith against the Village and the Town of Mt. Pleasant anaat the same was referred to the insurance carrier and Village Attorne; Trustee Timmings moved, seconded by Trustee White thaction of the Clerk be confirmed. Carried. The Clerk informed the Board that the Mayor filed th982-83 tentative budget with her on March 9, 1982 and in connect with this, Trustee Timmings moved, seconded by Trustee White that a lie hearing be held on the tentative budget on April 12, 1982. Carr. Trustee Soriano moved, seconded by Trustee White thahe 1982 Assessment Roll setting forth a total subject to taxation the amount of $40,103,874.00 be accepted and that the reductions in assments as approved and disapproved by the Assessor be granted and/oenied. Carried. Trustee Timmings read a letter he received from Mrs.izabeth Meller, Highland Ave., urging the permanent extension of the WarnLibrary hours on Sundays.
