April 19, 1982 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor Stephen J. Maceyak Janet Gandolfo Peter Soriano Joseph D. Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee Maceyak that the minutes of the meetings held on March 22nd, April 5th and April 12th be approved as written. Carried, Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time, Mr. Thomas Cavalieri, 151 Webber Avenue, stated that he heard that the Board was going to discuss the possibility of buying dogs for the police department. As a former member of the Board and now as a citizen, he said that he protests any monies being used to train or pu?:chase dogs. He stated that they are of no use in our Village. The last time we had a dog, it destroyed the inside of the police car, said Mr. Cavalieri and he does not see why we need another dog. Mr. Seymour Stein, a member of the Directors of C.O.C. read letters from the Rev. John Sykes of the Shiloh Baptist Church, Rev. Leroy Perry of the Foster Memorial Church and John Keels, Director of the C.O.C. strongly opposing the use of dogs for law enforcement. Mayor Zegarelli stated that no firm decision has been reached on the part of the Board. This was an item recommended in the police budget which was being studied. REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION Trustee Soriano stated that a meeting was held on March 25th with the Technical Service Review Board, Ronald Turnquist and Board members to discuss the utilization of space in the building. We are now waiting for recommendations. Johnson Controls are presently working on the heating system, said Trustee Soriano. �-2Trustee Soriano stated that the Colonial Lifts Co. has been notified that the Village is not prepared to install an elevator in th< building, however, if funds are available in the future, we would so notify them. Trustee Soriano read the first progress report from Ronald Turnqui on the Village Garage construction. It is 127n completed, he said. Trustee Soriano stated that he investigated the work of Mr. Thaler with whom the Village has a contract for cleaning of firehouses and in questioning some of the firemen, found that he is doing a satisfactory job and he does not recommend the hiring of a new custodian at this tinw FINANCE & REAL ESTATE Trustee Gandolfo reported a cash balance of $288,570.96 in the General Fund as of April 19, 1982. In Trustee A1990.4 Trustee order to govern the cost of the increases for the police, Gandolfo moved that $36,000 be transferred from Contingency to A3120.1 Police Salaries as per police contract, seconded by DiFelice. Carried. Trustee Gandolfo moved, seconded by Trustee DiFelice that action of the Treasurer in re-investing $400,000 for 30 days at 1170 interest with the First National Bank of North Tarrytown be confirmed. Carried. Trustee Gandolfo stated that a letter has been received from HUD regarding the N.Y.S. Closeout Audit in connection with the Urban Renewal Project. The amount due the State is $18,817 which has to be paid withi thirty days. Following a discussion, the matter was referred to counsel to request an extension. Trustee Gandolfo stated that there are two bills submitted for payment tonight that she would like to discuss in committee before approving them. One bill is from the Village of Tarrytown regarding the Tarrytown Lakes and the other is for the mini-bus for senior citiz i Trustee Gandolfo stated that there is also a bill from Johnson Control in the amount of $8900 which she would like to discuss with the building inspector before approval. She stated that most people are not pleased with the system. Trustee Gandolfo stated that several members of the Philipse Manor * Improvement Association met with John Biros regarding Fremont Pond. The contractor has proceeded in digging out a hole for the spoil area and some members who live on Hunter Avenue are concerned about the drainage problem. All involved reviewed the layout of the plans Everything is going along well, she said. FIRE Trustee Lofaro reported that he received estimates for equipment needed for the fire inspectors, as well as estimates for fire alarm wires into the hospital and submitted them to Trustee Gandolfo for the budget. i �-3- 33, Mayor Zegarelli stated that the budget will be adopted on April 29th. GOVERNMENTAL RELATIONS-SENIOR CITIZENS Trustee Soriano stated that he is in receipt of a communication from a private company who will make a study of all phone bills for a 12 month period, free of charge, to ascertain errors in our phone bills. If any errors are found, the company will receive 50?o of the amount reimbursed to the Village, he said. Following a short discussion, Trustee Soriano moved, seconded by Trustee DiFelice that the company be requested to review the phone bills. Carried. Trustee Soriano stated that he had called the Town of New Castle that he would attend the meeting regarding McClean Cable TV if he is available. He stated that he also called the County and signed up for the tour which will be held on April 24th sponsored by Urban Development to get some ideas for the beautification along Beekman Avenue. Trustee Soriano stated that at the Village Officials meeting held last week, the Association went on record requesting Villages to write their legislators to support an override of Governor Carey's veto of the $7 9.9 million in special aid to municipalities for the fiscal year 1982-83 and moved that our State Legislators be contacted to this effect, seconded by Trustee Gandolfo. Carried. Trustee Soriano moved, seconded by Trustee Lofaro that our State legislators be contacted to support bills S3264 and A4185 which limits group homes (under the Mental Hygiene Law) to a ratio of one facility per each 15,000 population. Carried. Trustee Soriano stated that an invitation is extended by the Blythedale Home to anyone interested to celebrate National Volunteer Week on May 6th. Community leaders will be there to greet the public, he said. Trustee Soriano stated that the cheese program will be available again tomorrow. Trustee Soriano stated that 100 people attended the citizens meeting. The happy hour was paid for by the Cardinal's Catholic Charities campaign, he said. Trustee Soriano stated that the next meeting of the Town of Mt. Pleasant Senior Citizens Council will be held on May 6th. Housing for Senior Citizens, with help from the County, is still being reviewed, he said. LABOR RELATIONS & CONTRACTS Trustee Lobato stated that the CSEA contract is due to expire soon and in preparation of same, he has obtained a copy of the present contract, as well as copies of contracts from neighboring Villages. He stated that a report and recommendations will be presented to the Board for consideration. �-4POLICE Trustee DiFelice reported that a demonstration of K9 police dogs was given on April 14th requested by the Chief. Letters have been received from retirees on the old police pension fund requesting increases, said Trustee DiFelice. He stated that the last increase (a cost of living) given them was in 1977. There are seven people remaining in the old pension fund, he said, and it is the recommendation of the committee to give a $500 cost of living payment to the members. Trustee DiFelice moved, seconded by Trustee Gandolfo that on recommendation of the police committee, $3500 be transferred 'from Contingency A1990.4 to Deficiency appropriation, for cost of living in the amount of $500 per retiree in the local police pension fund. Carried. Trustee DiFelice gave the following report for March: I I I * (In official minutes) Trustee DiFelice read letters from B. Nicol, 95 Beekman Avenue, Mrs. J. Gallinger, Maple St f , A. Fleischman and H, Peller, thanking officers in the police department for their aid, lectures and house survellience and moved that copies be placed in their respective folders, seconded by Trustee Lofaro. Carried, A letter was received from the hospital thanking the police department for their assistance during the last snow storm, said Trustei DiFelice. PUBLIC WORKS Trustee Maceyak moved that specifications be prepared and bids be returned on May 17th for a 3/4 ton, 4 wheel drive pickup truck with snow plow, seconded by Trustee Soriano. Carried. i Trustee Maceyak moved, seconded by Trustee Soriano that a new I position of skilled laborer be posted to take effect June 1st. Carried. Trustee Maceyak stated that a man has been assigned to clean Beekman Avenue during morning hours, He stated that a letter is being drafted to all businessmen on the Avenue asking for their cooperation i: cleaning their property. Following a short discussion, Trustee Maceyak moved, seconded by Trustee Soriano that the Supt. of Public Works and himself affix their signatures to the letter, Carried. Trustee Maceyak reported that the water department assisted the highway department in plowing and clearing snow around fire hydrants. Trustee Maceyak reported a balance of $22,689.34 in the water and sewer account as of April 19th. The highway department sanded and removed snow during the last snow storm,reported Trustee Maceyak. The gates at the Village yard have been repaired and are now closed during non-working days, said Trustee Maceyak. r �^3r^ -5RECREATION & PARKS Trustee Gandolfo gave the following report: The North Tarrytown Dads' Club baseball season opens this Saturday and the girls' softball league opens on April 26th. The AYSO Soccer League will start its season on Sunday. teams, with 160 boy's and girls will be participating. Fifteen An additional class of aerobics was added to the winter/spring schedule with 15 residents participating. This year's Easter Egg Hunt, co-sponsored with the Tarrytown Recreation Department and the Knights of Columbus was a success. 350 children joined in the hunt on April 10th, Trustee Gandolfo moved, seconded by Trustee Maceyak that Edward Fahey be appointed part-time seasonal laborer at $4 per hour, effective immediately. Carried. Trustee Gandolfo stated that the softball game between the officials and department heads of North Tarrytown and Tarrytown was cancelled last year. She stated that she is arranging for a game with Tarrytown, some time in August and will so notify the Board of the date. Trustee Gandolfo stated that the Board met to discuss the bid for the utility building at Memorial Field and moved that action of the Board in awarding the bid to Malacarne Construction Company (low bidder) in the amount of $14,704, according to specifications, be confirmed by the Board, seconded by Trustee Soriano. Carried. TAX EXEMPT & ASSESSMENT Trustee Lobato reported "progress". MAYOR'S REPORT Mayor Zegarelli stated that he was in receipt of two energy audits of the buildings which outlined procedures to be implemented to reduce energy bills. Mayor Zegarelli read a letter from County Executive A. DelBello thanking the Board for their help in the referendum concerning refuse disposal district. Mayor Zegarelli read a letter from Frank Mancuso acting Executive Director of the Phelps Memorial Hospital, stating that he has instructed his staff that the Village of North Tarrytown has the sole use of the dumping area at the hospital and if there are any violations to the agreement to inform him of same. Mayor Zegarelli stated that he is in receipt of a letter from John Carroll that the Loyalty Day Parade will be held in White Plains, instead of in the Tarrytowns and asked the Board's pleasure as to whether or not the $500 which was appropriated to the Veterans still stands. "» �-6Following a short discussion, Trustee Soriano moved, seconded by Trustee Gandolfo that the appropriation remains as is and that the $500 be earmarked solely for the North Tarrytown contingent. Carried. Mayor Zegarelli stated that he is in receipt of a memo from CDA Director Bill Doorley regarding hearings required in connection with the Small Cities Program. Trustee DiFelice moved, seconded by Trustee Maceyak that hearings be held on May 17th and June 14th on changing the goals of the housing plan of the Small Cities program. Carried. COMMUNICATIONS . I Communication from Willis Moon, Sec'y. of Fire Patrol, regardingyB repairs to their kitchen was read and referred to the fire and ^ administration committees for study. Communication from William Anzovino, President of the VFW Drum Corps requesting permission to hold a parade to celebrate its 50th Anniversary on August 22nd was read and on motion of Trustee DiFelice, seconded by Trustee Lofaro, permission was granted and the the police and fire departments be notified of same. Carried. Communication from Mrs. Mary Petcoff, 27 College Avenue, requestinj sidewalk repairs, as well as donating two dogwood trees was read and referred to the public works committee. Communication from Mariano Meneses, 29 Barnhart Avenue, on behalf of the Cuban Club of the Tarrytowns, requesting permission to hold dances on May 15th and June 20th was read and on motion of Trustee Gandolfo, seconded by Trustee Lobato permission be granted provided that the hours comply with the local ordinances. Carried. Communication from Salvatore Firrincieli, 67 Howard Street, requesting a sidewalk in front of his property was read and referred tol the public works committee. H Communication from Ellen McDonough, 23 Kendall Avenue, thanking I the police and fire departments and Sgt. Hayward for their aid to her mother was read and on motion of Trustee DiFelice, seconded by Trustee Lobato that copies be placed in their files. Carried. Communication from Arthur Ceconi, 36 Amos Street, stating that the curb in front of his property was damaged by the snow plow and requestii repairs was read. Mr. Ceconi also stated that for the past four weeks, his garbage was missed for two collections. The matter was referred to the public works committee. The Clerk informed the Board that Joseph Lofaro submitted his resignation as a member of the Recreation Commission on March 24th and on motion of Trustee Gandolfo, seconded by Trustee Lobato his resignati< was accepted, effective March 24, 1982. Carried. i •» • �The Clerk informed the Board of delinquent water accounts totalling $8428.95 to be entered on the 1982 Assessment roll after which Trustee DiFelice moved, seconded by Trustee Lobato, that they be entered on the 1982 roll. Carried. UNFINISHED BUSINESS Mayor Zegarelli stated that with the organization of the new Board and committees, a series of informational type meetings will be held with department heads and different civic and taxpayers organizations to familiarize residents with the activities of the Board and in turn to explain various policies that may have an impact within their own areas. Trustee DiFelice inquired as to the status of various reports that have not been received during the term of a former Fire Chief. After a short discussion, it was decided that Trustee Lofaro would attend the Fire Council meeting to discuss the matter. NEW BUSINESS Trustee Lobato stated that the Board held a series of meetings towards the preparation of the new budget and after the hearing held work sessions during which many issues were discussed; one of which was the authority of the Board to influence the operation of the police department in order to effectuate policies. The police function is a public function, said Trustee Lobato, and there is legislation covering it. No one can really say where our authority stops and the Chief's begins. It was his thinking that the Village Attorney make a study of this problem, however, other people thought it would be better handled by the Village Prosecutor, said Trustee Lobato. Trustee Lobato moved that the Board authorize and direct the Village Prosecutor to study the problem of the jurisdiction of the Board of Trustees relative to the operation of the police department to the extent of covering the police department's operation to effectuate the policy set by the Board of Trustees with special attention to the authority of the Board of Trustees to establish regulations for the police department which govern the operation of the police department, seconded by Trustee Gandolfo. Mayor Zegarelli stated- that there is an amount of research involved and there should be a determination for funding. A ceiling on the number of hours should be set. Trustee Lobato suggested a ceiling of ten hours after which a report should be submitted. During the discussion, Counsel stated that he would write a letter to the Municipal Resource Center for some guidelines and the Board can then proceed from there. Motion carried. *% �-8Trustee DiFelice stated that Con Edison is seeking an increase in rates and moved that a letter of protest be sent to the Public Service Commission, seconded by Trustee Gandolfo. Carried. Trustee Maceyak offered the following resolution, seconded by Trustee DiFelice: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Stephen J. Damin, and WHEREAS the said Stephen J. Damin was a School Crossing Guard and a resident of the Village for many years having been held in the highest esteem by all those who knew him, now, therefore, be it m RESOLVED that this Board of Trustees take official notice of I Stephen J. Damin's death and a copy sent to the family of the deceased! Carried. 1 Trustee Gandolfo stated that she is holding the Johnson Control Bill, ice skating bill from the Village of Tarrytown and the bill for the minibus for senior citizens from the Village of Tarrytown for further study. Trustee Soriano moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated April 19, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attachec to the warrants. Carried. There being no further business to come before the meeting, Trustee DiFelice moved, seconded by Trustee Gandolfo that the same be duly adjourned, Carried.
