June 14, 1982 A regular meeting was held before the Board of Trustees -of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor Stephen J. Maceyak Janet Gandolfo Peter Soriano Joseph D. Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Maceyak moved, seconded by Trustee Lofaro that the minutes of the May 17, 1982 meeting be approved as written. Carried, Mayor Zegarelli stated that the availability of meeting in the court room was pro-offered because of a request, however, the person did not appear and it was the unanimous consensus of the Board to meet here in the board room. If in the interim anyone should request us to meet in the court room, the Board will so oblige, said the Mayor. Trustee Lobato moved, seconded by Trustee Maceyak that this action be confirmed. Carried. Mayor Zegarelli read the notice of hearing in accordance with Section 570.312 of HUD Community Development Block Grant Program to hear views of citizens on the proposed revisions to the housing goals as shown in its Housing Assistance Plan for Small Cities Program and asked if there was anyone present who would like to address the Board may do so. Mr. William Doorley, Director, stated that at the previous hearing held on May 17th, he presented the goals which were going to be submitted to HUD. The original goal was exaggerated and we had to lower them, he said. Mr. Vincent Chebetar, Pine Street, inquired as to why is there a divided line for these programs. He stated that there are many homeowners in the Webber Park area who could use the Federal grants. Mayor Zegarelli stated that we have requested a change. This tract was established as per census figures compiled over the years. This is a guideline established by the Federal government, said the Mayor. We have had many requests from people «in Webber Park, said the Mayor, however we cannot make it available because the Federal government has determined where the money can be allocated. Mr. Doorley stated that he has been given permission to allow funds for some owners outside the tract area if the people requesting the funds are within the income set by the guidelines. They may come in to his office for infx>rma tion. �y^Sb No other comments, Trustee Soriano moved, seconded by Trustee ^ Lobato that the hearing be closed. Carried. • * Mayor Zegarelli read the notice of hearing to consider a'proposed amendment to the Fire Prevention Code to add Section 22-6A -"Smoke and Heat Detection Devices" and asked if there was anyone present who would like to address the Board on the proposed amendment. Mr. Vincent Chebetar inquired as to how the smoke detector would apply to an individual taxpayer. Counsel read Section "C" - Single Family and two family dwellings which states that all one and two family dwellings where construction commenced after June 30, 1982 shall have at the entrances to all bedro< at least one smoke detection device, etc. Mr. Page, Building Inspector, stated that he had suggested that instead of amending the N.Y.S. Fire Prevention Code, that the Village adopt a resolution stating that where the N.Y.S. Fire Prevention Code does not explicitly detail a requirement, that the National Board of Fire Underwriters current edition take precedent. No other comments, Trustee Gandolfo moved, seconded by Trustee Soriano that the hearing be closed. Carried. The proposed amendment was referred to the Board as a whole for further review. Mayor Zegarelli called for suspension of regular order of business in order to deal with Van Tassel tenants' request to adopt legislation in connection with ETPA and Trustee Lobato so moved, seconded by Trustei Gandolfo. Carried. Mayor Zegarelli stated that Counsel drafted the proper legislation to adopt ETPA measures in the Village of North Tarrytown. Trustee Soriano moved the following resolution, seconded by Trustee Gandolfo: I WHEREAS a notice of hearing was published in the Tarrytown Daily News on May 14, 1982 inviting all residents and taxpayers of the Villagi of North Tarrytown to attend a public hearing on a proposed Local Law to adopt the provisions of the Emergency Tenants Protection Act of 1974 and ^ WHEREAS a public hearing was conducted at the Municipal Building, Village of North Tarrytown, on May 24, 1982 and residents and taxpayers the Village of North Tarrytown and all other concerned citizens did comment and testify on that public emergency requiring the regulation of housing did exist, NOW, THEREFORE, BE IT RESOLVED, That the Village of North Tarrytown finds that a vacancy rate for housing accommodations within its municipal boundaries is not in excess of 57o, and i �-3- J/Jl It is further resolved that a public emergency exists requiring the regulation of residential rents of all multiple buildings with six or more dwelling units pursuant to the Emergency Tenant's Protection Act of 1974, And it is further resolved that a certified copy of this resolution be forwarded to the New York State Department of Housing and Economic Development and the Westchester County Rent Guidelines Board requesting their assistance pursuant to all ETPA regulations. Mr. George Warhead, attorney representing the Van Tassel Tarrytown Company, stated that he is familiar with the statutory framework of this legislation. He stated that he was not at the hearing because he did not know about it. To adopt this resolution would be a bad idea for the Village and tenants, he said. He stated that he did not see where it would help the tenants. It would cause a decrease in property value and cause a tax certiorari case which would also lead to deterioration. The owners are attempting to increase the level of services, he said, and a limitation in rent will create a decrease in services. Mr. Warhead stated that ETPA is administered by the government and requires numerous forms and methods. He stated that the owner has increased the rent in accordance with the guidelines. The Board should consider entering into a fair rent agreement with the landlord, said Mr. Warhead. been Mayor Zegarelli stated that we have/requested repeatedly to have the building inspector inspect the building and what in particular angered the tenants, was a statement that was made that there were no building violations, said the Mayor. Mr, Warhead stated that the building inspector inspected the building after the tenants applied for ETPA. Trustee Soriano stated that this matter has been expressed openly on the street. When only one side shows up constantly, we have to accept the will of the people, he said. The people could not accept the raises in between the leasing period, he said. The Board had to make a decision. People came in with documentary evidence and pictures. The matter was looked into from both sides, he said. As chairman of the Governmental Relations .committee, he stated that he called Mr. Brownstein to a meeting to discuss ETPA, said Trustee Soriano. Mr. Warhead stated that violations are supposed to be handled by the building department and not the State rental office. Trustee Soriano stated that according to ETPA, there is a situation whereas if violations have not been corrected, rents are supposed to be equally reduced. Mr. Warhead stated that under rent control, under section 38, all increase^ have been approved 1% which is an indication that there were no violations. Mr. Joseph Schwer, 95 Beekman Avenue, stated that previous Presidents met with the owners and have gone over different violations and increases were held up because of apartments not being taken care of. The tenants were told that violations would be corrected. He also stated that >y �-4- WV 'JPD « electrical and plumbing contractors have to be licensed and obtain permits. ' Trustee Lobato inquired of Mr. Warhead if the V.T. has been follow! the Westchester County Guidelines and was answered in the affirmative. He inquired as to how services would be reduced if they were following the guidelines. Trustee Maceyak also questioned the fact that if the V.T. is following the 1% in the guidelines where any problems would exist in deterioration of the building. Mayor Zegarelli stated that the tenants had gone door-to-door to find out how many places have deteriorated. He stated that it was not easy for the tenants to file complaints. The matter was looked in quite thoroughly, said the Mayor. i Trustee Gandolfo stated that with a fair rental agreement, it would be easier for the landlord to get away with violations than under ETPA. Mrs. Teresa Volpe, 95 Beekman Avenue, stated that at the hearing on this subject, a woman stated that when her lease expired, her rent was raised $190. The landlord has driven the people to take action. Mr. Warhead stated that in consideration of how many times this was done, he did not think it justified going into ETPA. This is not fair, he said. You have to have more statistics, he said. He does not know the size of the apartment and what rent she was paying, said Mr .= Warhead Trustee Lobato stated that the V.T, is not the only landlord in North Tarrytown. It is the largest. Landlords were not we11-represents at the hearing and that he had hoped that they would have submitted data and present their case to the Board. Whether or not it is ETPA, the owner would still come in with a tax certiorari. Trustee Soriano recommended that ETPA pertain to four apartments and up. dwellings of i Mr. Ray Avellino, 2 Ridge St., stated that landlords should come back later and ask for some protection through taxes. Not every buildid has violations, said Mr. Avellino, and everyone is being punished. ; At this time, Trustee Soriano moved to amend his previous motion to include in the guidelines all dwellings, six apartments and above. Mayor Zegarelli polled the Board on the entire resolution as follow Trustee Maceyak - Yes Trustee Gandolfo - Yes " 11 Soriano - Yes " Mayor Zegarelli voted "Yes" and declared the Lofaro - Yes DiFelice - Yes Lobato - Yes motion carried. Trustee Lofaro moved for a five minute recess, seconded by Trustee DiFelice. Carried. i �-5- 3f/ -r, At this time, Mayor Zegarelli presented plaques to members#of the Fire Department Fire Ambulance Corps who answered 100 arid 200 calls. * REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION Trustee-Soriano moved, seconded by Trustee Lofaro that Johnson Control bertme balance of $6,566 for the heat control work in the Municipal Building, seconded by Trustee Lofaro, Carried. Trustee Soriano reported that A. C. Pearce made the final inspection on the utility garage at Devries Field and moved that Malacarne be paid the final amount of $14,704, seconded by Trustee Gandolfo, said money to come from CDA funds. Carried. Trustee Soriano stated that he is in receipt of a call from Frank's Fuel that they will deliver a minimal amount of oil until such time as the bill is paid on 79 College Avenue. Money should be in some time in June, he said. We are experiencing a problem with the tenants, said Trustee Soriano. Counsel Ponzini stated that it has been several weeks since he has heard from the attorney for the potential buyer. Mayor Zegarelli stated that another letter will be sent for an answer, setting a time limit of July 12th, after which we will try to sell the building if the answer is in the negative. Trustee Soriano stated that he is in receipt of an estimate from Herlihy & Donovan for the installation of a new gas burner in Pocantico H & L Company in the amount of $960 and moved that they perform the necessary work for the installation of the burner, seconded by Trustee Gandolfo. Carried. Trustee Soriano stated that the River Street Village garage is progressing. FINANCE & REAL ESTATE Trustee Gandolfo reported the amount of $235,594.34 in the General Fund as of June 14, 1982. Trustee Gandolfo moved, seconded by Trustee Soriano that action of the Treasurer in investing $100,000 in C D . notes at 11% with the First National Bank of North Tarrytown be confirmed. Carried. Trustee Gandolfo offered the following resolution, seconded by Trustee Maceyak: BOND RESOLUTION, DATED JUNE 14, 1982, AUTHORIZING THE ISSUANCE OF $100,000 SERIAL BONDS OF THE VILLAGE OF NORTH TARRYTOWN, PURSUANT TO THE LOCAL FINANCE LAW, TO FINANCE THE COST OF THE RECONSTRUCTION AND REPLACEMENT OF STORM DRAINS IN THREE RESIDENTIAL AREAS QF THE VILLAGE AND APPROPRIATING THE PROCEEDS TO SUCH PURPOSE, (In detail official minutes.) �-6« Trustee Gandolfo moved, seconded by Trustee Soriano that the Chief of Police be given an increase of $2,051 on his base salary, retroactive to June 1, 1982. Trustee Gandolfo moved that the rate of pay for the police matron be fixed at $15 for a call up to three hours and each hour thereafter, she would receive $4.00 per hour, seconded by Trustee Soriano. Carried. Trustee Gandolfo stated that at the Village Officials' Conference held at Grossinger's last week, she attended a seminar whereby a Mr. Gary Shadsky spoke on municipal investments. He stated that he would come to each municipality and speak to the Board on investments, said Trustee Gandolfo, and moved that she be granted permission to contact • Mr. Shadsky to speak before the Board at no cost to the Village, secon<B by Trustee Maceyak, Carried. I FIRE Trustee Lofaro moved, seconded by Trustee Soriano that the followin be appointed members of the Fire Board of Appeals for the following term Orazio Celtruda Stanley Pulaski William Kenyon Emil Initio f Thomas Square Carried. 5 years - 4 - 3 2 1 Trustee Lofaro stated that the firemen are all ex-Chiefs of the department. ' Trustee Lofaro stated that Rescue Hose apparatus is back in service Columbia Hose apparatus has a leak in the tank and is being repaired. Repair work on the doors of the ambulance will be completed also, said Trustee Lofaro. GOVERNMENTAL RELATIONS & SENIOR CITIZENS Trustee Soriano stated that he has been pursuing the matter of I obtaining grants for an elevator in the building for the handicapped, m Mr. Doorley has written to the Dept. of State inquiring if there are any grants for this purpose. We were told at the Conference that grants have been cut by the government. TrusteaSoriano stated that different grants are still available for job programs and we are pursuing these. Trustee Soriano stated that a Mr. Joseph Sadry from the Mental Retardation Association will talk about mental health. Trustee Soriano stated that 91 citizens were present at the meeting held on June 7th. A picnic has been scheduled at Kingsland Point Park Trustee Soriano stated that the Town Senior Citizens Council is still pursuing the matter of housing for senior citizens. i �-7- . 3 < ^ LABOR RELATIONS Trustee Lobato stated that the committee will commence negotiations with the CSEA on June 24th. POLICE & LIGHT Trustee DiFelice reported that the annual inspection of Auxiliary Police members was held this evening. Trustee DiFelice moved, seconded by Trustee Maceyak that specifications be prepared and bids returned on July 12th for a 1982 police car, said month to come from Revenue Sharing. This is in accordance with Counsel's memo, said Trustee DiFelice. Carried. Trustee DiFelice stated that the highway department completed the installation of plastic stop bars at crosswalks. He stated that the Town of Mt. Pleasant aided us in painting the double line on County House Road and Riverside Drive extension. Trustee DiFelice gave the following police report for the month of May: (Copy in official minutes) Trustee DiFelice read a memo from Chief Spota commending Dets. DeFalco and Butkovich for their follow-up investigation in the robbery case of the N.Y. Daily News Brooklyn plant which enabled the Brooklyn robbery squad to arrest suspects in connection with this case. Trustee DiFelice moved, seconded by Trustee Lofaro that a copy of the commendation be placed in their personal folders. Carried. Trustee DiFelice stated that the Chief of Police received a certificate from the National Medic Alert Foundation International for their efforts in making the public and health professionals more knowledgeable about the system of emergency medical identification. Trustee DiFelice moved, seconded by Trustee Soriano that the certificate be placed in Chief Spota's file. Carried. PUBLIC WORKS Trustee Maceyak reported that the water department replaced the defective hydrants on Barnhart, Palmer and Lakeshore Close. Permanent blacktop has been placed in excavations on Beekman Avenue and Depeyster Street, Balance in the water and sewer account as of June 14th is $18,468.74. As per a letter of resignation of Robert Nevelus as Water & Sewer Main. Man Gr. II, submitted this evening, Trustee Maceyak moved to accept his resignation, effective June 18, 1982 and that he be paid one week of unused vacation, seconded by Trustee Lofaro. Carried. \ �-8The highway department replaced defective sidewalk slabs on Beekman Avenue and Hudson Street with CDA funds, said Trustee Maceyak. Trustee Maceyak stated that the department opened the fence at the parking area on Elm Street and also placed fill in some of the areas. Fill was also placed in the Devries parking area to improve the drainage Dead trees were removed from various streets in the Village, reported Trustee Maceyak. Trustee Maceyak moved, seconded by Trustee Soriano that specifications be prepared and bids be returned on July 12, 1982 for the reconstruction and repair of approximately 140 catch basins in the Sleepy J Hollow, Philipse Manor and Webber Park area. Carried. • Trustee Maceyak stated that the committee met with John Biros andB it was his opinion that a man was not needed in the water department. I A man is needed in the highway department. Interviews will be held shortly, said Trustee Maceyak. RECREATION & PARKS Trustee Gandolfo gave the following report: The lock was removed from the Douglas Park gate and over the Memorial Day weekend, the light on the utility shed was broken, two vent were damaged and the glass electric meter was cracked. The utility building is completed, reported Trustee Gandolfo, and meets with the approval of the architect and recreation supervisor. The recreation department and Michael's Tavern will sponsor a Women's softball tournament on July 31st and August 1st. A sholarship fund will be set up through Michael's Tavern, she said. The Day Camp registration is going well. Ninety-one children are registered in the day camp and 22 in the Tot camp. Trustee Gandolfo stated that at a previous meeting, she made a • motion to charge non-residents a higher fee for the Day and Tot Camp, • however, she was informed by Mr. Blueglass that since we were using thfl school grounds this would not be possible. The matter will be discussed further at the meeting with the school board, she said. Trustee for the work for the July front of the Gandolfo thanked John Vincek, Floyd Rhein and Mike Apolloni they performed at Barnhart Park. The park should be ready 10th Olympics. The bulletin board has been installed in Municipal Building, she said. Trustee Gandolfo moved, seconded by Trustee Lofaro that the followii coordinators and counselors be appointed in the Day Camp program: (see official minutes) i �3 W m Trustee Gandolfo moved, seconded by Trustee Lofaro that the following laborers be appointed in the parks: (In detail official minutes) Trustee Gandolfo moved, seconded by Trustee Maceyak that the following instructors be appointed in the recreation programs: (in detail official minutes) Trustee Gandolfo stated that the committee has been reviewing the erosion problem at Douglas Park and moved that Gus Paese be hired to prepare specifications for the improvement of the park at $750 through to the completion of the project, bids returnable on July 12, 1982, seconded by Trustee Soriano. Carried. Trustee Gandolfo stated that the softball game between Tarrytown and North Tarrytown will be held on August 15th, rain date August 22nd at Memorial Field at 7:30 P.M. Trustee Soriano stated that he has received a call from Tarrytown Trustee Jerry Blood regarding Friendship Park. He is asking if either Village would take title over the park or have one Village maintain it for a year. He stated that Trustee Blood informed him that when North Tarrytown cleaned the park, it stayed clean. This is one of the most heavily used parks in the Village, said Trustee Soriano. It is well-used. A meeting is being scheduled with Tarrytown to discuss the matter further, he said. TAX EXEMPT & ASSESSMENT Trustee Lobato reported "progress". MAYOR'S REPORT Mayor Zegarelli stated that in connection with ETPA, it is necessary to appoint representatives to assist the County Guidelines Board, one for the tenants and the other for the landlords. With the approval of the Board, Mayor Zegarelli appointed Ray Avellino to represent the landlords and Joseph Schwer to represent the tenants. Mayor Zegarelli stated that a seminar is being held on June 17th in New Rochelle on Coastal Zone Management and if anyone is interested in going may do so. Mayor Zegarelli stated that he is in receipt of a communication from the Dept. of Transportation that in accordance with the CHIPS program, $32,604 has been appropriated for the Village of North Tarrytown for local street and highway improvement. With regard to our request for legislation for an Assessment Review Board, Mayor Zegarelli stated that the law did not pass because the Committee wanted it for all municipalities and the Governor did not. Mayor Zegarelli read a letter from Assemblyman Peter Sullivan acknowledging our letter regarding his aid in over-riding Carey's veto on State aid. �Mayor Zegarelli stated that he is in receipt of proposed legislate from Senator John Flynn which would establish a procedure for the incorporation of an entire Town as a Village and referred it to the Gov't. Relations Committee and Tax Exempt Committees. Mayor Zegarelli reminded the Board of a meeting with the school board on June 17th. Mayor Zegarelli read letters from Senator Goodhue and Assemblyman Sullivan acknowledging our letters regarding Tier 3. Mayor Zegarelli read a letter from Sunohio who has been granted permission by U.S. EPA Region II to install a mobile polychlorinated m biphenyl disposal unit as an alternative method to high temperature I incinerator for the disposal of polychlorinated byphenyls at the Con I Ed substation on Cortlandt Street, that the work which was scheduled ' the week of June 14th and 21st has been postponed indefinitely. Mayor Zegarelli noted a letter dated May 17th from Lawrence Salley, Deputy Commissioner, Div. of Housing & Community Dev. Westchester County that North Tarrytown will receive from Westchester Urban County Community Development Block Grant in the fiscal year 1982; $80,00 in '83 and $100,000 in '84. The municipality cannot incur any costs associated with this grant prior to execution of a contract and notification of authorization to incur the cost. Mayor Zegarelli noted a second letter dated May 27th from Lawrence Salley that our application for funding of Day Care scholarships, senior citizens program of recreation, fire protection projects and boat basin and park will not be included under the 1982-85 funds of Urban County C D . Program. Trustee Maceyak moved that the Mayor send a letter to the County of Westchester requesting reimbursement for our services in transporting prisoners from the County jail to the local jail, retroactive to the last six years, seconded by Trustee Lobato, This is a County responsibility, said Trustee Maceyak. Carried. m COMMUNICATIONS • Communication from Sylvia Freyler requesting, on behalf of the North Tarrytown Business Association, permission to hold a sidewalk sale on June 25th and 26th from 10 A.M. - 5 P.M. on Beekman Avenue and also requesting that the Village ask permission of the school board to allow people to park in the Morse School playground area was read. Trustee Lofaro moved, seconded by Trustee DiFelice that permission be granted. Carried. Communication from Mrs. Lucy Tumino, 162 Beekman Avenue, requesting a new sidewalk was read and referred to the public works committee,. Communication from T. 01adipo? tenant at 74 Beekman Avenue, requesting the repair of holes was read and referred to the public works committee. Communication from V. Chebetar, on behalf of the Class of '41, requesting permission to use Douglas Park for a picnic on July 18th was read. i *» �-li- 3?0 ^% » Trustee Gandolfo moved, seconded by Trustee Maceyak that permission be granted. Carried. * Communication from Joseph Marasco, Recording Sec'y. of Pocantico H & L Co., requesting two cabinets for the display of trophies and awards was read and referred to the buildings and grounds and fire committees for study. Communication from Mrs. G. Adamovic, 42 Hudson Street, requesting the trimmings of a tree in front of her property was read and referred to the public works committee. Communications from Sec'y. of Fire Council, R. DeCarlo, regarding changes in personnel in Fire Patrol, Rescue Hose, Columbia Hose and Union Hose Companies, as well as permission of Union Hose to take its apparatus to Thornwood on July 14th was read and on motion of Trustee DiFelice, seconded by Trustee Lofaro, action of Fire Council be confirmed by the Board. Carried. Communication from John Garibaldi, 138 Harwood Avenue, inquiring about the proposed local law on recreation vehicles, as well as objecting to a trailer that has been parked across the street from his home was read. Trustee Maceyak moved, seconded by Trustee Lofaro that a recommendation be made at the next meeting in July, after the appropriate committees review the matter again. Communication from Mrs. Paul Miethker, 265 No. Washington Street, requesting the removal of a tree stump at the corner of Washington Lane and North Washington Street was read and referred to the public works committee. Communication from Mrs. Thomas Malone, 21 Tappan Avenue, requesting the trimming of a tree in front of her home and curb repairs was read and referred to the public works committee, Communication from Willis Moon, Sec'y. of the North Tarrytown Democratic Party, requesting permission to use Douglas Park for a picnic on August 8th was read. Trustee Soriano moved, seconded by Trustee Lofaro that permission be granted. Carried. Communication from Armando Alvarez, owner of property at 175 Valley Street, requesting sidewalk repairs in front of his property was read and referred to the public works committee. Communication from J. Popodopolus, owner of 49% Elm Street, requesting sidewalk replacement was read and referred to the public works committee, * Communication from Mrs, M. Marshall & Mrs, A. Rice of 247 and 265 Hunter Avenue, requesting permission to close Hunter Avenue from Munroe Avenue to Riverside Drive on June 26th from 5:30 to 9:30 P,M. for a supper party for a neighbor moving away was read. �Ax >jf\\ Mayor Zegarelli moved, seconded by Trustee Lobato that permission Carried j be granted and that the police and fire chiefs be notified of same. f UNFINISHED BUSINESS Trustee Soriano stated that he is in receipt of a notice that in accordance with Section 46 of the Highway Law, the Village is responsibl for the drainage problem on Route 9, near the fountain. The catch basin in this particular area where the drainage problem exists will be included in our program for catch basin work, said Trustee Soriano Referring back to the position of Water & Sewer Main. Man, Truste Soriano stated that it was never agreed that the position would not be filled. He stated that he feels that the job should not be abolishe ii In connection with the dredging of Fremont Pond, Trustee Gandolfo moved, seconded by Trustee Lobato that the following partial payment schedule of Aqua Dredge Company be approved .• Total contract price; $61,000.00 Construction of dredged spoil area: Mobilization of dredging plant and installation of pipeline Dredging approx. 12,000 yds, Seeding of spoil area $15,000.00 5,000.00 37,500.00 3,500.00 $61,000.00 Trustee Gandolfo moved, seconded by Trustee Soriano that the amount of $20,000 be paid to Aqua Dredge to which the contractor is entitled at this point. Carried. Trustee Lobato stated that at a previous meeting, a motion was made to appoint William Patten Sergeant in the Police Department, and which said motion was tabled. Trustee Lobato moved to remove the motion from the table to appoii Ptl. Patten Sergeant, seconded by Trustee Maceyak. Mayor Zegarelli polled the Board on Trustee Lobato's motion to untable as follows: Trustee Maceyak " Gandolfo " Soriano - Yes - No - No Mayor Zegarelli voted "No". Trustee Lofaro - Yes " DiFelice - No n Lobato - Yes Motion not carried. Mayor Zegarelli stated that we should not deal with individual persons deciding the issue. Until we obtain a difinitive response from the Chief of Police concerning our request to institute different scheduling for Lieutenants as we had outlined, I feel that further discussion of any appointment should be held in abeyance. i �-13Trustee Lobato questioned the Mayor as to why he would couple the appointment of a Sergeant to the issue of the Police Chief's flexibility. Mayor Zegarelli stated that the idea was to remedy a problem of personnel and supervisory matters and coverage and the request to the Chief was to test the schedule for six months. As elected officials, we are entitled to an answer to our request, regardless of what other people may feel is the proper line of command, said the Mayor. Mayor Zegarelli stated that Counsel Ponzini has received a letter from Mr. Haroldls office, attorney for the police bargaining committee, that the situation with regard to the regular use of patrolman on desk duty has not been corrected which violates the Civil Service law and if the situation is not immediately corrected, the association has directed him to institute litigation. Trustee Gandolfo stated that it was her understanding that the Chief was requested to try a certain schedule out before we appointed another Sergeant to see if, indeed the Village needs another Sergeant. She stated that she thought this was a test case for six months. We had to do one thing before we decide that the other is appropriate. Mayor Zegarelli stated that there was no acknowledgment on the part of the Chief. Trustee Lobato stated that the feeling was that we authorize a Sergeant, but not fill it until the Chief answers our request. Mayor Zegarelli stated that he would like to meet with the Chief again. Counsel Ponzini stated that he will answer Mr. Harold's letter. NEW BUSINESS Mayor Zegarelli noted a petition received calling for support in eliminating nuclear war threat and on motion of Trustee Lobato, seconded by Trustee Maceyak, the following resolution was adopted: WHEREAS the greatest challenge facing the earth is to prevent the occurrence of nuclear war by accident or design: WHEREAS the nuclear arms race is dangerously increasing the occurrence of nuclear war, now, therefore, be it RESOLVED, that it is the sense of the North Tarrytown Village Board that the President should propose t hat the United States and the Soviet Union immediately reduce, subject to rigid inspection, their nuclear arsenals by a specified percentage and that the President simultaneously propose a conference, under the auspices of the United States, the Soviet Union, the People's Republic of China, Great Britain and France, of all nations having nuclear arms to devise a comprehensive program calling for a percentage annual reduction in nuclear weapons until all nuclear weapons arms are eliminated from every country. Carried. �-14* * * Trustee Lobato moved, seconded by Trustee Maceyak that Thome Berg be appointed special attorney to review the matter of the residency requirements of the Village Justice at $50 per hour, not to exceed five hours ($250). Carried. • Mayor Zegarelli stated that the Board should see a copy of the report before it is released. Trustee DiFelice moved, seconded by Trustee Soriano that Mrs. Sophie Dwyer be commended for 40 years of service in the Red Cross and that a certificate be forwarded to her. Carried. Trustee Maceyak suggested that John Tucciarone, Village Prosecut be invited to attend the work session of the Board on July 1st to dis Lawrence Avenue properties and Gordon Avenue. i Trustee Soriano moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated June 14, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attachet to the warrants. BE IT RESOLVED by the Board of Trustees of the Village of North Tarrytown, as follows: Section 1. The Village of North Tarrytown shall issue its Serial Bonds of the aggregate principal amount of $100,000 pursuant to the Local Finance Law of New York, in order to finance the specific object or purpose hereinafter described. r Section 2. The specific object or purpose (here- inafter referred to as "purpose") to be financed by the issuance of said obligations is the reconstruction and replace ment of storm drains in Sleepy Hollow Manor, Philipse Manor, and Webber Park, three residential areas in the Village at an estimated maximum cost of $100,000 and appropriating the proceeds to such purpose. Section 3. The Board of Trustees has ascertained and hereby states that (a) the estimated maximum cost of said purpose is $100,000, (b) no money has heretofore been �' 3 f authorized by the Board of Trustees of said Village for such purposes, (c) the Board of Trustees plans to finance such purpose entirely from funds raised by the issuance of obligations herein authorized, (d) the proposed maturity of the obligations authorized by this resolution will not be in excess of five (5) years, and (e) said purpose is for a nonassessable improvement. Section 4. It is hereby determined that said pur- pose is an object or purpose described in Subdivision 4 of paragraph a of Section 11.00 of said Local Finance Law and that the period of probable usefulness of said purpose is ten (10) years. Section 5. Subject to the terms and conditions of this resolution and the Local Finance Law, and pursuant to the provisions of Sections 30.00, 50.00 and 60.00, inclusive, of said Law, the power to authorize bond anticipation notes in anticipation of the issuance of Serial Bonds authorized by this resolution and the renewal of said notes and the power to prescribe the terms, form and contents of said Serial Bonds and said Bond Anticipation Notes, and the power to sell and deliver said Serial Bonds and any Bond Anticipation Notes issued in anticipation of the issuance of such bonds is hereby delegated to the Village Treasurer of said Village. The Village Treasurer is hereby authorized to sign any Bond Anticipation Notes issued in anticipation of the •* �issuance of said Serial Bonds, and the Village Clerk is hereby authorized to affix the corporate seal of said Village to any of said Serial Bonds or any Bond Anticipation Notes and'to attest such seal. Each interest coupon representing interest payable on such Serial Bonds shall be authenticated by the facsimile signature of the Village Treasurer. Section 6. This resolution shall be published in full by the Village Clerk of said Village, together with a notice in substantially the form prescribed by Section 81.00 of said Local Finance Law, and such publication shall be in "The Daily News", a newspaper having a general circulation in said Village and published in the Village of Tarrytown. The validity of said Serial Bonds and of any Bond Anticipation Notes issued in anticipation of the sale of said Serial Bonds may be contested only if such obligations are authorized for an object or purpose for which the said Village is not authorized to expend money, or the provisions of law which should be complied with at the date of the publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or if said obligations are authorized in violation of the provisions of the Constitution of New York. �S e c t i o n 7.
