July 12, 1982 Yul A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present: Philip E. Zegarelli,Mayor Stephen J. Maceyak Janet Gandolfo Peter Soriano Joseph D. Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Deputy Mayor Gandolfo called the meeting to order at 8:00 P.M. with a salute to the flag. She stated that the Board would meet in the Court Room so that the meeting would be available to the handicapped. The Board then recessed and moved downstairs to the Courtroom. Deputy Mayor Gandolfo called for bids for a 1982 Police Car. Treasurer Amato opened the following bids: Russell Chevrolet of Fairfield, Conn, bid on a 1982 4-door Impala Chevrolet in the amount of $9,365.00. Carigliano Motors of Boonton, New Jersey bid on a 1982 Dodge Diplomat in the amount of $9,186.00. Trustee DiFelice moved, seconded by Trustee Lofaro that the bids be referred to the Police Committee. Carried. Deputy Mayor Gandolfo called for bids for the reconstruction and repair of catch basin and drop inlets in Sleepy Hollow Manor, Philipse Manor, and Webber Park. Treasurer Amato opened the following bids: J.C. Perri, Inc. of Tarrytown, New York-Total Bid $2,000.00 Certified check enclosed. County Asphalt, Inc. - Tarrytown, N. Trustee Maceyak moved, seconded by Trustee Soriano that the bids be referred to the Public Works Committee. Carried. Deputy Mayor Gandolfo called for bids for the improvement of Douglas Park. Treasurer Amato opened the following bids: J.C. Perri, Inc. - Tarrytown, N.Y. $10,000.00 Certified Check enclosed. Bid - $ 29,500. �- 2 DeCaryalho Landscaping Services , N. Tarrytown - Bid 51,000.00 Certified checTT~eri closed. y'O ^ $19,025. Trustee Maceyak moved, seconded by Trustee Soriano that the bids be referred to the Recreation Committee. Carried. Deputy Mayor Gandolfo stated that the meeting was being held in the Courtroom on the first floor at the request of a handicapped person. Apparently they were not among the spectators and she asked if there were any objections to the Board meeting upstairs. There being no objections she declared a 10 minute recess and the Board proceeded to move upstairs. At this time Mayor Zegarelli who had been detained appeared and took over the meeting. The Board recessed and met in Executive Session to discuss the bids opened earlier. Mayor Zegarelli called for the approval of minutes of May 29th, June 2nd, and June 14th. Trustee Gandolfo moved, seconded by Trustee Soriano that the minutes of May 29th and June 14th be approved as written. Carried. Trustee Gandolfo moved, seconded by Trustee Soriano that the minutes of June 2nd be approved as written. Trustee DiFelice stated that he objected to the minutes of the meeting held on June 2nd as the meeting was to be a Special Meeting called for a specific purpose. He stated that the minutes were incomplete and did not adequately state his position and he moved to void the minutes of the meeting of June 2nd, 1982. No one offered a second to the motion. Mayor Zegarelli stated that he had looked over the minutes and felt they had covered the meeting adequately. He also stated that minutes were not meant to be word for word. He stated that they be referred to the Board and corrected. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Janet Wright, 1 Kelborne Avenue stated that she had received a parking ticket for parking in front of her residence. She had called the Police Department, had spoken to Judge Maroney and stated that the whole situation regarding parking on the streets in the Manor had erupted into a full scale problem because of a huge mobile van being parked continuously on Pierson Avenue. The van was offensive and detracting to the area and because of the many complaints had been ticketed. The owner apparently had demanded that the police ticket all cars illegally parking on streets in the Manors. Mayor Zegarelli stated that there is an ordinance adopted in 1932 that no vehicles be parked on the streets in Philipse Manor or Sleepy Hollow Manor. He stated that conditions have changed since that time but the Philipse Manor Improvement Assoc, and the Sleepy Hollow Manor Assoc, were in favor of leaving the ordinance as adopted. He stated �- 3 - ' ^ that there is a problem of mobile homes and recreation vans being parked on the streets throughout the Village. He suggested that a public hearing be held regarding street parking in the Manors in order that the Board could be aware of the feelings of the residents. He stated that an ordinance was to be adopted under "old business" regarding the parking and storing of recreation vehicles on the streets and on property in the Village. Trustee DiFelice moved, seconded by Trustee Lobato that the regular order of business be suspended so that a discussion could be held on the proposed ordinance. Trustee Gandolfo moved, seconded by Trustee DiFelice that the following Local Law #3 of 1982 be adopted as follows: (copy in detail in Official Minutes) . 7 ^ ^ ^ &+AsC<^t>L ^ ^ C J J ^ 1 ^ ^ ^ ^ Edna Fernandez of 525 Riverside Drive stated that parking of mobile homes on property is unsightly; they do not pay taxes and stated that some are parked on the street for weeks at a time. Trustee Maceyak stated there shouldbe flexibility as some homes, especially in Webber Park do not have access to their rear yards. Mr John Garibaldi, 138 Harwood Avenue spoke in favor of the ordinance and also stated that some people have been known to park mobile homes or campers on their property and live in them. Mayor Zegarelli stated that the ordinance prohibits living in the campers. He also stated that Mr. Poor had asked for an extension in removing the trailer from his property as he was going on vacation. Mayor Zegarelli read a letter from Irene Ravina of 115 Harwood Avenue voicing her objection to Mr. Poor's trailer and stated that she was in favor of a ban to such recreational vehicles in residential areas of the village. James Margotta of Merlin Avenue commented on the parking of autos in Philipse Manor and that he was in favor of parking on the streets in the Manors and that cars should not be ticketed, but should have been given warning tickets. Trustee Maceyak moved, seconded by Trustee DiFelice that a Public Hearing be held on September 13th, 1982 to hear resident views whether to repeal or amend the statute regarding "no parking" in Sleepy Hollow Manor and Philipse Manor. Carried. Mayor Zegarelli stated, tickets that were issued must be paid or brought before the Judge, as they were legally issued tickets. Raymond Avellino, Gory Brook Road spoke on 79 College Avenue. He asked questions regarding back rents owed, evictions, and various other problems with tenants of 79 College Avenue. Mayor Zegarelli stated that the Board of Directors of 79 College Avenue Housing Devolopment Fund Co. would meet after the Board meeting. �REPORTS OF COMMIT I'KES ADMINISTRATION ft CONSTRUCTION Trustee Soriano notified the Board Members that they would meet on July 14th at 7:30 P.M. with the Structural Engineer to inspect the various firehouses owned by the village, and members of the Board were welcome to attend. Trustee Soriano stated that the village offices are on summer schedule for the months of July and August and the hours will be 9:00 A.M. to 4:00 P.M. Trustee Soriano reported that the caretaker, William Haggerty will be on two weeks vacation from July 19th to August 2nd, 1982. He reported "progress" on the construction of the Village Garage. FINANCE & REAL ESTATE Trustee Gandolfo reported a cash balance in the General Fund as of July 12th, 1982 of $237,039.64. Trustee Gandolfo reported that the Treasurer has obtained Certifi of Deposits in the amounts of $100,000 maturing 7/14/82 at 11%, $100,000 maturing 7/18/82 at 11%, $400,000 maturing 7/29/82 at 11% and $700,000 maturing 8/2/82 at 11 % with the First National Bank of North Tarrytown, and moved to confirm her action. Seconded by Trustee DiFelice. Motion carried. �y*v — Trustee Gandolfo reported that members of the Board had met with Gary Statsky regarding a financial managment study. She would have a' report for the next meeting. An inventory of all village insurance policies is being compiled showing coverage and cost of same and will be presented at the next board meeting. FIRE Trustee Lofaro reported that a public hearing had been held on June 14th, 1982 to consider a proposed amendment to the Fire Prevention Code. That a memo had been received from the Building Inspector regarding the adoption of the N.Y.S. Fire Code and the National Fire Prevention Code and suggested before the amendment was adopted that further information be obtained from Mr. Page at the next work session. GOVERNMENTAL RELATIONS & SENIOR CITIZENS After a discussion Trustee Soriano moved, seconded by Trustee Maceyak that the following resolution be adopted: WHEREAS, THE VILLAGE OF NORTH TARRYTOWN contracted with the Arnel Construction for work on the Catskill Aqueduct Joint Project, and WHEREAS, the project was audited and closed-out on August 1st, 1979, and WHEREAS, Arnell Construction was requested a final bill on March 27th, 1980 and by numerous phone calls prior and subsequent to that date, and WHEREAS, said claim was not submitted for review by the Mayor and Board of Trustees until March 1st, 1982 in the amount of $323,584.53 and WHEREAS, after review of the entire record, the transactions between the parties and the constructions contract, and upon the recommendation of the Director of Public Works and the consulting engineer, NOW, THEREFORE, it is RESOLVED that the claim submitted by Arnel Construction, dated March 1st, 1982, in the amount of $323,584.53 is denied and a claim, if properly submitted by Arnell Construction in full satisfaction of any indebtedness of the Catskill Aqueduct Joint Project, in the amount of $23,759.66 is approved, and It be further RESOLVED that the Village of North Tarrytown reserves any and all rights to examine and audit this claim at a future date pursuant to the Village Law of the State of New York. Trustee Soriano reported that in a memo had been received from Mr. Doorley regarding the following transfers within community development �- 6 - ~r'-' f block grant funds and moved that the following funds be allocated: Senior Citizens $25,000., Day Care $10,000 and C.O.C. $10,000, based on a letter from the Department of Planning Div. of Housing and Community Development dated May 7th, 1982 seconded by Trustee Gandolfo. Carried. Trustee Soriano stated that the foregoing was based on the recommendation of the Citizens Advisory Committee and Mr. Doorley. Trustee Soriano reported that the Senior Citizens next meeting would be held in September. LABOR RELATIONS Trustee Lobato reported that he is attempting to set a date with members of the C.S.E.A. local unit for August 4th and August 11th to begin negotiations. He stated that he would suggest that only three members represent the union at the present time. POLICE & LIGHT Trustee DiFelice moved that Nick Morabito be authorized to install three spot-lights at the Winfield L. Morse playgroung at an entimated cost of $400.00 for the purchase and installation of same. Trustee Maceyak seconded the motion which was carried. He stated that the school would be notified. Trustee DiFelice reported that a report had been received from Department of Agriculture and Markets regarding local dog ordinance and various state mandates in.connection with dogs. The State representative had conferred with the Dog Control Officer, the Village Clerk and the Village Treasurer regarding various items to be corrected. Trustee DiFelice asked Counsel if a public hearing would have to be held to change sections of the ordinance. Counsel stated that he would check with Albany to see if changes had to be made. Trustee DiFelice reported that the First Reformed Church had requested that a Police call box be installed on Route 9 in front of their church. It was stated that various organizations use the church and there is no telephone available to them and in case of an emergency they would have no way to contact the police for assistance. The cost of said box would be $223.00 for installation and a monthly charge of $31.00 Trustee DiFelice moved, seconded by Trustee Gandolfo that the Police Committee investigate and be granted power to act, if they felt the situation warranted a call box in this area. Carried Trustee DiFelice reported that he had received the monthly Police reports for the month of June (copy in official minutes). Trustee DiFelice moved, seconded by Trustee Lofaro that the award for the police car be awarded to Russell Chevrolet, Fairfiled, Conn. in the amount of $9,365.00, stating that it was the desire of the Board to maintain vehicle inventory in keeping with present G.M. stock of parts. Carried. *» �7 ~ 7 f Trustee DiFelice reported that he had received a memo from Chief Spota commending Ptl. James Whalen for his part in recent investigations and moved that a copy be placed in the officer's file. Trustee DiFelice reported that he had received a memo from Chief Spota reporting that a hearing will be held on August 3rd, 1982 at the, State Liquor Authority, New York concerning charges filed against the LaTerraza Bar, 128 Cortlandt Street by the local police department. Trustee DiFelice moved, seconded by Trustee Soriano that the Mayor be authorized to write a letter to the S.L.A. on behalf of the local police department. PUBLIC WORKS Trustee Maceyak Fire hydrants within the sewage treatment near Collea Avenue, gave the following public works reports: the village proper have been painted, weeds behind plant have been cut, hydrant on Washington St. damaged by police car has been repaired. Cash Balance in the general fund of the Water and as of July 12th, 1982 is $45,509.71 Sewer Dept. Trustee Maceyak reported that sidewalks on Elm Street, North Washington Street, Cedar and Depeyster Street and the crosswalk on the southeast corner of Cortlandt and Depeyster Street. Blacktopping on Depeyster near Broadway, Valley near Depeyster, Andrews Lane, Kendall Avenue, Holland Avenue and Hemlock Drive. Excavated for the planting of 18 trees on Elm Street, Depeyster, Beekman, Washington, Cortlandt, Anderson and Gordon Avenue, was completed. After a discussion Trustee Maceyak moved, seconded by Trustee Soriano that all future new employees be required to have a physical examination at the expense of the Village by a physician of the Village's chosing. Carried. Dr. Burton Miller, 12 Greenridge Avenue, White Plains, N.Y. will make such a physical examination at a cost to the Village of $50.00 per patient. Trustee Maceyak moved, seconded by Trustee Soriano that all new employees for Public Works Department must have their Class 3 license before the end of their Probationary period of six months. Carried Trustee Maceyak moved, seconded by Trustee Soriano that Richard Gross of Maple Street, North Tarrytown be appointed as a Laborer in the Water and Sewer Department at an annual rate of $15,581. less $500.00 for the probationary period effective July 16th, 1982. Said laborer's starting salary to be subject to finalizing C.S.E.A. contract effective June 1st, 1982.Carried. Trustee Maceyak moved, seconded by Trustee Soriano that James Townsend, Sanitation Laborer be required to be examined by Dr. Burton Miller to determine if he is "fit for duty". Carried. Mr. Townsend has been on "disability" from a non-employment injury. Trustee Maceyak moved, seconded by Trustee Soriano that Douglas DiCairano be appointed Sanitation Man at an annual rate of $15,581.00 less $500.00 for the probationary period effective July 16th, 1982. *» �Said laborer's starting salary to be subject to the finalizing of the C.S.E.A. contract effective June 1st, 1982. Carried. RECREATION & PARKS I Trustee Gandolfo reported that the Day Camp and Tot Camp started on Tuesday, July 6th for 180 children. Tennis lessons have started on' July 12th, "Big Band" concert was held, basketball, running and wrestling programs started. Various concerts will be he»ld on July 15th, July 22nd, and the last concert on July 29th. Barnhart Park Dedication and Olympics took place on July 10th with some fifty children and adults in attendance. Trustee Gandolfo moved, seconded by Trustee Soriano that the bid for the improvements at Douglas Park be awarded to Albert DeCarvalho Landscaping Service in the amount of $19,025. subject to the signing of contracts and posting of bond. Carried. Trustee Gandolfo moved, seconded by Trustee Soriano that the following resolution be adopted;. WHEREAS Almighty God in His divine wisdon has seen fit to take unto Himself the soul of the late Rosaria Malandrino; and WHEREAS the said Rosarfa Malandrino was a resident of the Village for many years, and mother of Former Trustee John Malandrino having been held in the highest esteem by all those who knew her; Now Therefore, BE IT RESOLVED, that this Board of Trustees take official notice of Rosaria Malandrino's death; and BE IT FURTHER RESOLVED that his resolution be made a part of the official minutes of this meeting and a copy sent to the fanily of the deceased. ( Trustee Gandolfo moved, seconded by Trustee Soriano that the following resolution be adopted'* WHEREAS Almighty God in His divine wisdom has seen fit to take unto Himself the soul of the late Theodore "Skip" Muldoon; and WHEREAS the said Theodore VSkip" Muldoon was a resident of the Village for many years, and ^#e^S^f^of our Recreation Commission, and haying been held in the highest esteem by all those who knew him; Now, Therefore, BE IT RESOLVED, that this Board of Trustees take official notice of Theodore "Skip" Muldoon's death; and BE IT FURTHER RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. TAX EXEMPT & ASSESSMENT Trustee Lobato reported "progress". i N �- 9- JfU f MAYOR'S REPORT: Mayor Zegarelli stated that the Immaculate Conception Church has requested permission to hold their Annual Bazaar on August 12, 13,14, 15,16, 19, 20, 21, 22 with a set-up and cleanup on Aug. 11th and 23rd and request that Depeyster Street be closed to traffic. Trustee Lofaro moved, seconded by Trustee DiFelice that permission be granted and that the Police Department and Fire Departments be notified. Carried. Mayor Zegarelli reminded the Board that the V.F.W. parade will be held on August 22nd and that they would assemble at 1:30 P.M. Mayor Zegarelli reported that he was in receipt of a Progress Report from Trunquist Architects and referred it to the Board for study. Mayor Zegarelli reported be had received a letter from the N.Y.S. Office for the Aging approving state aid in the amount of $2,000.00 for the period July 1, 1982 to June 30, 1983. Mayor Zegarelli reported that Mr. Benjamin Edmonds had submitted his resignation from the North Tarrytown Housing Authority and he appointed Mr. James Timmings to fill the unexpired term. Mayor Zegarelli reported that a letter had been received from the N.Y.S. Division of Housing and Communite<iRenewal regarding the provisions of S. 8a of the Emergency Tenant Protection Act whereas the Commissioner has determined.the village's proportionate share to be $6,030.00 for the period July 1st, 1982 to June 30th, 1983, computed at the rate of $9.00 per housing unit for the 670 units inculded in the Village letter dated June 24th and which excludes 80 units owned by the Housing Authority which are not subject to E.T.P.A. Trustee Gandolfo moved, seconded by Trustee Lofaro that each building owner be assessed a fee of $15.00 per unit to cover the cost of administration of E.T.P.A., $9.00 to be paid to N.Y.S. Division of Housing and $6.00 to be the village's fee to cover the cost of administration. Carried. Mayor Zegarelli reported that representatives of the State will be available to the village to help in the organization and institution of E.T.P.A. COMMUNICATIONS Communications from Michael D. Schrader, 138 Merlin Avenue requesting new sidewalk was read and referred to the Public Works Committee. This would incude replacing of wire on Route 9 from Beekman Avenue t o Phelps Memorial Hospital. NEW BUSINESS After a discussion Trustee Soriano moved, seconded by Trustee lofaro t h a t the bid for the reconstruction and r e p a i r of catch basins and drop i n l e t s i n Sleepy Hollow Manor, Philipse Manor and Webber Park be awarded t o DeCarvalho landscaping Service in the t o t a l amount of $102,220.00 with a u n i t p r i c e bid of $610.00 per u n i t , said u n i t s t o be reconstructed t o be determined by Consultant Engineer and Director of Public Works so t h a t t o t a l cost of complete project did not exceed amount of bond authorized. Carried. Trustee Gandolfo reported a b i l l in Albany allowing J u s t i c e Courts t o impose a condition of sentence t h a t youths/adults work for the community with no compens s t i o n , with insurance problems taken under consideration i n the wording of the b i l l . Trustee Gandolfo moved, seconded by Trustee Maceyak t h a t the Board go on record t h a t we support t h i s b i l l and t h a t l e t t e r s be sent t o both our Assemblyman and our Senator in Albany. Carried *» �- 11 - 7 'I Trustee Gandolfo moved, seconded by Trustee DiFelice that a Public Hearing be held on August 16th, for the purpose of amending the Aruscsnent Ordinance regulating the number of machines per establishment at three and raising the cost for owners to $250.00 per machine and to $200.00 per machine by operator and an application fee of $25.00 per device, by owner. Carried. Trustee Lofaro - yes Trustee DiFelice - yes Trustee lobato - yes Trustee Soriano moved, seconded by Trustee Maceyak that the bills submitted on the General Fund and Water & Sewer warrants dated July 12th, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried Trustee Jerry Blood of the Village of Tarrytown appeared before the Board and a discussion followed regarding "Friendship Park". There being no further business to come before the meeting. Trustee DiFelice moved, seconded by Trustee Lobato that the same be duly adjourned. It shall be unlawful for any person to park any of the following defined recreational vehicles on any residential property or street within the Village of North Tarrytown, except in accordanci with the provisions of this chapter. B. As used in this Chapter, the folowing terms shall have the meaning indicated: Camper - A separate vehicle designed for human habitation and which can be attached or detached from a pickup truck. Camper-Trailer - k vehicular, portable dwelling structure designee to be used for recreational purposes. This includes a travel trailer, so identified by the manufacturer, a pickup camper; a folding tent trailer, and a motorized canper where the camping portion is an integral part of the self-propelled vehicle. Motor Home - A self-contained vehicle designated for human habitation, with its own motive power and with a passageway from the body of the home to the driver's and front passenger's seat. Trailer - A vehicle without motive power designed for carrying persons or property on its own and to be drawn by a vehicle with motive power. The term "trailer" shall include, but shall not be limited to horse trailers, boat trailers and skimobile trailers Section 2 - Parking in Residential Areas Prohibited. No person, firm or corporation shall park or store a boat, trailer, motor home, camper-trailer, camper or recreational vehicle upon any rcadwe street or highway in any residential area within the Village of North Tarrytown. Section 3 - Occupation of Vehicles. It shall be unlawful to occupy any car.per-trailer or motor home for living or sleeping purposes or to cause any such vehicle to be connected to electric, water, gas or sanitary sewer facilities anywhere within the Village, except in a duly established trailer park maintained in accordanc with the ordinances of the Village of North Tarrytown. �Y/3 Section A. Storage. A. No boat, camper, cimper-trai1er, motor home, trailer or recreational vehicle shall be stored in any front yard or in «*ny side yard of any premises within any residential zone within the Village of North Tarrytown extending beyond the front building line of the premises; provided, however, that said vehicles may also be stored within that area, within the rear yard of premises formed by the extension of the side building line to the rear lot line so long as the vehicle does not protrude into the side yard requirements as set forth in any applicable ordinance within the Village. B. In of of of of be the event that an individual is unable to meet the requirementJ Subsection A of this section, he may apply to the Zoning Board Appeals for permission to store said vehicle in the side yard the premises. Upon a showing of such inability and the approvs a majority of all present members of the Board, permission may granted to store said vehicle in the side yard of the premises. Section 5 - Violations and Penalties. Any person, firm or corporation violating any provision of this chapter shall be fined not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. Section 6. - Effective date. This Local Law shall take effect within the time prescribed by law.
