August 9, 1982 ' ^ A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Philip E. Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee Lofaro that the minutes of the July 12, 1982 meeting be approved as written. On the question, Trustee Lobato stated that he voted "no" on the resolution adopting Local Law #3-Recreational Vehicles, and it was not recorded. Trustee Soriano moved that the minutes be corrected with the inclusion of Trustee'Lobato's "no" vote, seconded by Trustee Gandolfo. Motidfcf" carried"'. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Dr. Elio Ippolito, President of the S.H.M. Taxpayers Association stated that it was the 'consensus of the Association that the present contractor is not performing the work in accordance to specifications on the dredging of Fremont Pond. The Sleepy Hollow Manor Association members are not satisfied with the job, said Dr. Ippolito and they would like the work completed before next year. Mayor Zegarelli acknowledged two letters Dr. Ippolito sent to him • in this connection. Trustee Gandolfo stated that she met with Mr. Pound and inspected the area and Mr. Pound has promised t6 remove the debris floating around in the pond, however, he stated tha't he did not feel under the contract that the eastern and southern tip of the pond should be cleared by him. * r Trustee Gandolfo suggested that a meeting be held on Wednesday with the Board to discuss the matter further, after which a meeting will be held with Mr. Pound. �f'7 Mr. Eugene Buonanno, representing the Neighborhood Association, stated that he has never received a call or notice regdrding his inquir about the parking lot owned by McCall-Frandsen on Katrina Avenue. He stated that the lot is supposed to park ten cars. Mayor Zegarelli stated that the Board met with Mr. Tucciarone, Village Prosecutor, to go over the aspects and asked Mr. Maceyak to review the matter. Trustee Maceyak stated tffat he was called by Mr. Buonanno and he investigated the property in question. He stated that the three trees are uprooted and the Village curb is damaged. fl The Board met with the Zoning Board on the subject matter, said • Trustee Maceya'k. The variance which was granted is vague to some peopB and has been interpreted in another way. In 1956, Mr. Margotta submit! a request for a variance, together with a set of plans (which Mr. Macey found in the building department office) which shows ten parking spaces There is a 50 ft. frontage from the retaining wall to the sidewalk, sail Mr. Maceyak. Mr. Maceyak also produced a survey map taken in October, 1956. He stated that Village property has been damaged and suggested that the Village erect a guardrail along Village property line to prevent vehicles from going put over the curb. The curb cut is 34 fi wide, he said. The Village co.de reads 25 ft., said Trustee Maceyak. Mayor Zegarelli-stated that this was agreed to between the Associat and-the Board. Trustee Lobato inquired of Counsel if the matter could be settled by declaratory judgment. • Counsel stated that if you decide to go to the Supreme Court for a declaratory judgment, a bond might have to be posted. Trustee Maceyak stated that a discrepancy exists. He stated that by installing the guardrail and fence the driveway the way it should be as well as patrolling the area, the matter would be resolved. rr Trustee DiFelice read a memo, dated May 9, 1979, from the buildir; inspector to the Board that Mr. Margotta obtained all necessary buildiiij permits for the work done on 334 No. Broadway and that the highway department issued the curb cut permit. Mr. Page also stated in the mem * iV^-^-hat the fence around,..the parking lot was damaged by motorists and had t be removed to prevent children from being hurt and as yet, no permit has been applied for to erect a new fence. Trustee DiFelice stated that it is up to Mr. Frandsen to obtain a permit for the fence. Trustee Gandolfo stated that a determination will have to be made J to how many parking spaces are allowed. She stated that this is the fit she has known of the plans "which Mr. Maceyak produced. Mayor Zegarelli stated that this is the first he knew of the plans also. �y/r -3- Trustee Soriano stated that we have had several meetings with Mr. Tucciarone and Mr. Arcate. Mr. Frandsen has been cooperative, said Trustee Soriano, and he should have a representative here also. This is a personal harrassment against Mr.* Frandsen and he should be allowed to have his day in court, "said Trustee Soriano. Mayor Zegarelli suggested tfiat we seek a compromise. not brought to the Board s attention in 1979, he said. The maps were Trustee Gandolfo stated that as far as the amount of parking spaces being indifinitive, she does not agree with it. Trustee Lobato suggested that between now and the next Board meeting, the Board should decide whether it is ten cars or not. Following a discussion, Trustee Gandolfo moved, seconded by Trustee Lobato, that the Village erect a railing on Village property from the street corner of property to curb cuts on Katrina Avenue, after the area in question is specifically staked out according to the maps and plans on file, by a licensed surveyor. Motion carried. Mr. Thomas Square, 95 Beekman Avenue, complained to the Board regarding the dangerous conditions of the catch basins on route 9. He. stated that some of them are hazardous. Trustee Maceyak stated that a letter is being drafted to the State regarding them. REPORTS OF COMMITTEES BUILDINGS & GROUNDS Trustee Soriano moved the expenditure of $900 for the refinishing of the kitchen in Union Hose Company, money to be taken from the fire budget, seconded by Trustee Lofaro. Carried, •<•*• Trustee Soriano stated that the committee will meet on Thursday to discuss Pocantico H & L request for a trophy case. Trustee Soriano moved, seconded by Trustee Maceyak that Enrico Solari be awarded the contract to regrout the marble slates in the foyer and stairwell of the municipal building in the amount of $2400, seconded by Trustee Maceyak, to be paid for by a capital note. Carried. Trustee Soriano stated that a problem exists in front of the building whereby a separation exists in the wall. Estimates will be obtained and recommendation will be made, said Trustee Soriano. In connection with the opinion received regarding the floor in Rescue Hose Company, Trustee Soriano stated that a second opinion should be obtained. He stated that it was his opinion that the cost for this work will run over $100,000. He also suggested that $1500 be allocated for engineering fees. Mayor Zegarelli read a memo from the -buijLding inspector that a member of the Technical Service Advisory Board would be willing to arrange to have a structural engineer to look at Rescue and Central Fire Headquarters. �-4Trustee Maceyak suggested that an engineer be obtained from out-of-town for a second opinion. Following a discussion,. Trustee Soriano moved that the Mayor be authorized to contact the member of the Technical Service Advisory Boan to propose a second engineer-. . This engineer preferably from out-of-towi is to provide a second opinion on the structural soundness of Central headquarters and Rescue Hose with a total amount of expenditure not to exceed $1500 for both written opinions, seconded by Tru*t*ee Gandolfo. Mayor Zegarelli polled the Board as follows: Trustee Maceyak - No Gandolfo - Yes 11 Soriano - Yes Mayor Zegarelli voted "Yes". Trustee Lofaro - Yes " DiFelice - Yes " Lobatp - Yes •? Trustee Soriano stated that he reviewed the energy ^report and certain recommendations were made. Money will have to/expended, he said. The windows in Union Hose Company will be sealed, he said. « FINANCE & REAL ESTATE Trustee Gandolfo reported a cash balance of $226,967.53 in the Gen Fund as of August 9, 1982. Trustee Gandolfo moved, seconded by Trustee Lofaro that action of the Treasurer in depositing certificate of deposit notes with the -First National Bank as follows be confirmed by the Board: $100,000 for 30 days at 11%, $400,000 for 30 days at 11% and $500,000 at 10%. Carried. Trustee Gandolfo reported that the auditors tjave completed the yearly audit of Village books, copies of which will be distributed. Trustee Gandolfo stated that a meeting will be held with Mr. Moultc to go over our insurance policies, as well as to (JjLscuss other insurant available. '' i Trustee Gandolfo stated that Gary Shatsky was going to be author i'J to make a financial study of Village finances, but Joseph Singler, the local auditor, will review same and make a preliminary study. Trustee Gandolfo moved, seconded by Trustee Soriano that the amount not exceeding $500 be allocated for this study. garried. GOVERNMENTAL RELATIONS Noting two cases which have been settled in f#vor of the Village, Trustee Soriano congratulated Counsel Ponzini for '^fifts efforts. The firs case was a discriminatory grievance against the Village by Thomas Brown which was dismissed and closed and the other case was Frank Chevrolet withdrawing tax petitions which resulted in a saving of $6048.50 to the Village. Trustee Soriano noted NYCOM's request for suggestions of proposals to be included in its legislative program for 1983. He stated that he will contact department heads for suggestions. �-5- fa0 ^ LABOR RELATIONS Trustee Lobato reported that the committee met with-the negotiators of the CSEA a»nd exchanged a respective set of proposals for the new contract. He stated that the committee will meet this Wednesday at which time we will prepare a" set- of counter proposals, after which the Board will be notified as to where we stand. Referring to legal action pending against the Village concerning the practice of using patrolmen as acting sergeant, Trustee Lobato stated that not only the Village officials are named in the proceeding, but the Chief of Police. The committee recommends that the Chief obtain separate Counsel, of his choice, at Village expense. There have been different opinions from this Board and the Chief as to the extent of the Board's responsibility. He stated that Counsel Ponzini would be retained to represent the Mayor and Board and the Chief would obtain his own Counsel. Counsel Ponzini stated that when the notice of petition was received, he had addressed the Chief on two separate occasions, one in person and the other by telephone and it was pointed out to him that there might be some diversion in the defense action, however, he was informed by the Chi el that he did not want an attorney. If there is a direction by the Board, he will so inform the Chief, said Counsel. Mayor Zegarelli stated that he had mentioned the court case to Village Counsel and asked him to contact the specific people named in the papers. The papers were received by the Clerk said the Mayor, and directed to Counsel to provide us with an opinion and a proposed response. Following a discussion, Trustee Lobato moved, seconded by Trustee Soriano that: Be it resolved by the Board of Trustees that a conflict of interest exists and pursuant to our Indemnification & Defense Local Law, the Chief of Police is directed to retain his own Counsel in the matter of Patten & Hayes vs the Village of North Tarrytown and that his Counsel will be comDensated pursuant to the Indemnification & Defense of Village Officers and Employees Local Law. Carried. Trustee Lobato stated that during discussions on grievances, many have never been resolved and moved that any Supervisor or Village employee who receives a grievance and charged with answering it, that a copy be forwarded to the Labor Relations Committee and when he answers it, that a copy be also forwarded to the Labor Relations Committee, seconded by Trustee Gandolfo, Carried. POLICE & LIGHT Trustee DiFelice gave the following police report for July. (in detail official minutes) Trustee DiFelice stated that the hearing before the ABC Board regarding complaints against the La Terrazza Club has been postponed until September. A call box was installed at the First Reformed Church on North Broadway, reported Trustee DiFelice. �tf*L 1 -6- Trustee DiFelice stated that a report was received from the K-9 unit instructor regarding the progress being made by the police dogs. Trustee DiFelice read a,letter from a Mrs. R. Doran of Middletown commending Sgt. Lee Hayward for his help during a car accident and moved that a copy be placed in his fold er, seconded by Trustee Soriano. Carrietl Trustee DiFelice noted a claim from L. Wolverton regarding damages to her car while it was impounded and he has asked the Chief to give him a report. Trustee Maceyak stated that the Chief has in his possession a lettgr granting permission to use the Mallory lot to impound cars. Trustee DiFelice noted a communication from the personnel office if we would like to participate in the Chief and Lieutenants exam and so moved, seconded by Trustee Soriano. On the question, Trustee Maceyak stated that he did not feel it necessary to call for a Chief or Lieutenant's exam. Following a short iiscussion, Mayor Zegarelli polled the Board as follows: Trustee Maceyak Gandolfo " Soriano - No - Yes - Yes Mayor Zegarelli voted "Yes". Trustee Lofaro - Yes DiFelice - Yes " Lobato - Yes Motion carried. Trustee DiFelice .stated that we are in the process of investigating the purchasing/o?"" a^^cfaphone machine for the po^ce department telephon and radios for taping of incoming calls. The cost Is approximately $149 per month for 35 payments after which it will belong to the Village, he s Counsel stated that there might be some connection in the law whereby a municipality might not be able to lease equipment. I Following a discussion, Trustee Soriano moved, seconded by Trustee! Lofaro that the Village enter into an agreement which would provide for the installation of the police department telephone and radio taping device, subject to Village Counsel's favorable opinion as to the validity of a municipality entering into an agreement such as a lease. Carried. Trustee DiFelice stated that four porcelain lavatories in the jail cells do not work. The Chief has asked plumbers IJprlihy & Donovan for an estimate which was given as approximately $2800 /to repair them, he sai * Trustee DiFelice questioned as to whether or not the Board would like to reactivate the porcelain lavatories or purchase the stainless steel lavatories such as the ones purchased several years' ago which woul cost about $10,000 and 26 weeks for delivery when the order is placed Following a short discussion, the matter was referred to the finance committee. �-7- ^>^ Trustee Lofaro stated that Pocantico H & L Company will be celebrating its anniversary in September and they have requested a trophy case. He stated that he received an estimate in the amount of $1210 from Mr. S. Zambelletti. Following a discussion, Trustee Lofaro moved, seconded by Trustee Gandolfo that Mr. Zambelletti be awarded the estimate of $1210 for a trophy case for Pocantico H & L if acceptable by the company, funds to be taken from the Fire Department budget. Carried. Trustee DiFelice moved, seconded by Trustee Lobato that the month of September be proclaimed Pocantico H & L month. Carried. Mayor Zegarelli moved, seconded by Trustee Soriano that August 22nd be proclaimed VFW Day. Carried. PUBLIC WORKS Trustee Maceyak gave the following report: Excavated and repaired water leak on New Broadway and placed permanent blacktop on Beekman Avenue, County Iftnise Road and New Broadway. Quarterly meter reading is in progress. Bank balance as of August 9th is $51,117.00. Replaced deteriorated sidewalks on Washington, Howard, Depeyster Francis Streets and Kendall Avenue and Gesner Place. Drop curbs at Washington and College Avenue. Blacktopped areas of Hudson Street and Kendall Avenue extension. Leveled disposal areas at Elm Street and hospital. Approximately 100 tons of blacktop was placed on Sleepy Hollow Road to eliminate pot holes, Trustee Maceyak reported that as per a request of the VFW in connection with their parade on August 22nd, an agreement has been made whereby North Tarrytown will clean the General Motors parking lot and Tarrytown will clean up after the parade in North Tarrytown also. RECREATION & PARKS Trustee Gandolfo gave the following report; Four concerts were held and well-attended. Rollerskating to music was held at Morse School on August 5th and 100 skaters attended. A Battle of the Bands will be held at Morse School playground on August 12th. The Homerun Derby sponsored with Tarrytown Recreation was a success with $80 going to Rosary Hill. The Women's Softball Tournament sponsored by Michaels Tavern II was very successful. The Day & Tot Camp is in its final-week with 220 children registered. Men's playoffs are'under way. �The North Tarrytown vs Tarrytown Village Officials game is set for August 15th at Memorial Field. There was vandalism at the Clinton Street playground, Barnhart and Margotta Courts playgrounds. TAX EXEMPT & ASSESSMENT Trustee.. Loba to reported "progress", MAYOR'S REPORT: Mayor Zegarelli stated that Robert Costello, Management Supervisoj of the Van Tassel Apartments has agreed to represent the landlords on the Rent Guidelines Board and the County has been notified of same. Mayor Zegarelli reminded Trustees that the Village Officials meeting will be held in Croton on September 9th. Mayor Zegarelli stated that the building inspector has submitted a request to attend the Assessors Conference at Liberty, N.Y. Sept. 19-22. Trustee Soriano moved, seconded by Trustee Maceyak that permission be granted, with expenses. Carried. COMMUNICATIONS Communication from D. Pulsoni requesting a loading zone in front of his store on Chestnut Street was read and referred to the police committee for recommendation. Communication from Judith Steiner, 129 Farrington Avenue, requesting sidewalk repairs was read and referred to the public works committee. Communication from John Singer, Sr., Kendall Avenue, requesting sidewalk repairs was read and referred to the public works committee. Communication from Richard & Shirley Kelly, 39 Kendall Avenue, requesting sidewalk repairs was read and referred to the public works committee. Communication from Fermin Esteban, 1 Pleasant Street, requesting that trees be trimmed or topped in front of his property was read and referred to the public works committee. Communication from Clyde Tart, 157 No. Washington Street, requestinj sidewalk repairs was read and referred to the public works committee. Communication from Dr. Blumenfeld, 11 Highland Avenue, requesting investigation of a dead tree in front of his property was read and referred to the public works committee. Communication from Rose Maffucci, 134 Cortlandt Street, requesting sidewalk repairs was read and referred to the public works committee. Communication from Wayne Crosby, Tarry Restorations, requesting sidewalk repairs at 260 No. Washington Street was read and referred to the public works committee. �-9- *v Communication from Mrs. Stephen Horecky, Anderson Avenue, regard i nr, the condition of her driveway as a result of work done by the highway department to the curb across the street from her was read and referred to the public works committee. Communication from Chief Bozelli regarding changes in personnel in Pocantico H & L Company was rea'd and -on-motion of Trustee DiFelice, seconded by Trustee Maceyak action was approved by the Board. Chief Bozelli stated that the action was approved by Fire Council. Communication from K. Fries, Town Clerk of -Mt, Pleasant, requesting permission to use Central Fire Headquarters for Registration Days on October 14th and October 16th was read. Mayor Zegarelli moved, seconded by Trustee Maceyak that permission be granted. Carried. The Clerk notified the Board of a notice of claim of Richard Dunn against the Village claiming that the Village has interfered with his ability to operate his peddler's business as a disabled veteran at his chosen location and the same was reported to the insurance carrier and Counsel. The Clerk notified the Board of a notice of claim from the Arnell Construction Corp. against the Village for claims resulting from the construction of the Catskill Aqueduct Project and the same was reported to the insurance carrier and Counsel. *• Communication from DeCarvalho Landscaping Service withdrawing his bid for the furnishing- of labor and materials for catch basins because of the fact that his partner is ill in Portugal was read. Trustee Soriano moved that all bids for the catch basin projects be rejected, seconded by Trustee Maceyak. Carried. Trustee Maceyak moved, seconded by Trustee Gandolfo that specifications be prepared and bids returned on September 7th for catch basins. Specifications should reflect a limitation on the cost, including fees not to exceed $100,000. Carried. UNFINISHED BUSINESS Mayor Zegarelli suggested that: the public works committee should restudy the fees for street openings and make a report to the Board. Mayor Zegarelli stated that he is in receipt of a letter from Charles Riley, land surveyor, who submitted a proposal to perform an "as built" survey of the Village garage and appurtenances for a cost of $550. Following a short discussion, it was the consensus of the Board that this offer is not needed at this time and the Mayor was directed to notify him of same. Mayor Zegarelli stated that Thun Associates have completed their work in connection with the structural evaluation report in Rescue Hose quarters and moved that their bill in the amount of $650 be paid, seconded by Trustee Lofaro. Carried. �^9J*T 10Trustee Maceyak stated that he would like an up-to-date report on 12-14 Lawrence Avenue for the next work session. Trustee Maceyak moved that a letter be sent to the Attorney General's office regarding residency status of the Judge, seconded by Trustee DiFelice. Trustee Lobato stated that motions were made for the appointment of a sergeant and were tabled. He stated that he would like to talk about this in a work session. Now that we have a legal proceeding, it might be wise to see some action on the motion, he said, or it should be properly made to postpone indefinitely. A motion to table is not debatable, he said. Mayor Zegarelli stated that there can be a motion to untable. NEW BUSINESS Trustee Maceyak suggested to the Board that the phone booth in front of the former Strand Theater be removed. He stated that many complaints have been received about it. Following a discussion, the matter was referred to the police committee. Trustee Maceyak discussed the unloading of trailers on the bridge and brought to the attention of the Board an ordinance prohibiting this. Trustee DiFelice stated that it had been agreed that trailer would unload there at a time. : only one Following a discussion, the matter was referred to a work session. Trustee Maceyak stated that he was in receipt of complaints from residents that the recent arrests of 13 people from Port Chester for the purpose of commencing .a riot in North Tarry town were held without ~ bail was not in the best/judgment and proceeded to move that a letter II be sent to the Judge regarding same. There was no second to his motioilj Mayor Zegarelli, after discussion, stated that each Trustee could tell the Judge his or her own opinion of the matter and that the Village Board should not interfere. Trustee Gandolfo stated that several meetings' ago, a resolution was adopted that purchases of $25 or less would not need a purchase order and moved that the resolution be amended that no purchase order is necessary for anything $100 or less, excluding any purchases that are made locally, i.e., Tarrytown and North Tarrytown, where it remains at $25 or less, seconded by Trustee DiFelice, Carried. Trustee Soriano moved, seconded by Trustee Lofaro that the Fire Department be allowed to improve the dispatcher room in the basement and all purchases be made under the supervision of John Biros. Carried. �<^£ -11- Trustee DiFelice noted an ordinance that the Town of Mt. Pleasant had adopted concerning converting single family homes into two family homes which is explained in the most recent issue in the Town of Mt. Pleasant news letter. * * The matter was referred to Counsel. •* Trustee Maceyak moved that the .previous motions adopted on December 21, 1981 regarding the policy of paying employees injured on the job be rescinded effective August 9, 1982 and that the Treasurer be authorized to revert back to the policy previously followed in this connection, seconded by Trustee Lobato. Carried. I Trustee Gandolfo offered a resolution in sympathy for Marguerite Timmings, Mother of former Trustee James Timmings, seconded by Trustee Lofaro. Carried. Trustee Soriano moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated August 9, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee DiFelice moved, seconded by Trustee Lofaro that the same beduly adjourned. Carried.
