Zegarelli, Mayor Stephen Maceyak Janet Gandolfo Peter Soriano Joseph D. Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. and stated that the purpose of the hearing was to consider a proposed Local Law amending Chapter 4 of the General Code "Amusement Devices" which would increase the cost of the devices by the owner to $250 per device, as well as a $25 application fee per each device by the owner, and an increase to $200 per device for the operator of the machine. The amendment also increases the penalty for offenses. He then asked if there was anyone present who would li&e to address the Board may do so at this time. Mr. Thomas Laverne, Attorney, 36 Main St. W, Rochester, N.Y., representing the Westchester Operators Guild and Attorney to the N.Y.S. Coin Machine Association. s^at-jQ-d that his firm has very carefully worked out problems with cities,''such as Rotterdam and Troy, that will make it possible for the operators to exist without being a nuisance to the community and for the community to make it under constitutional law. Mr. Laverne inquired as to why the total opposition to eliminating centers. Trustee DiFelice stated .that the Village had an amusement center which caused a lot df-trouble with individuals inside and outside the center. Fights occurred, riots, drug use, etc. whereby the police department had to shut it down, he said. Mayor Zegarelli stated that there really are no major changes, only the fees have been increased and the center aspect has been eliminated. A vote will not be taken this evening, said the Mayor. Mr. Laverne stated that the increase will hurt the operators economically and is placing a burden on them without justification. He stated that the Village has a right to limit centers. Trustee Soriano stated that he is on the Board of Directors for the COC and the people in the area were up in arms when machines were brought into the center. Mr. William Crossett, co-owner of Michael's II on Beekman Avenue, stated that the Board should'*not under-estimate the economic impact. He is two sales tax periods behind in payments, he said. He stated that taverns and restaurants are too well-regulated for any problems with the machines. He stated that the fees are excessive. Mr. Laverne was informed by the Mayor that the Village does not set a tax; we can only set a fee. Mr. Laverne Stated that license fees have to be justified and you cannot justify the fees„as proposed. He stated that if this was opened up to delicatessens, clothing stores, etc. as in other cities, we will really have trouble. Mr. .Laverne stated that restrictions could be placed during schoo^ hours, 'htttofcver, restriction of age has some merit, but is unconstitutil Referring to the age limit of 18 in the proposed amendment, Mr. ™ Laverne stated that the Board is dealing with the constitutional rights of a "kid". Age limitations .are difficult, he said. Rodney Rodriguez, owner of R & R, 31 Beekman Avenue, stated that proof of age has to be shown before they can be served. However, he stated that he could not place someone at the door to ask for proof of age because it would be costly to him. Alex Kriss, owner of the Cortlandt Amusement Machines in Elmsford, stated that it was not the jdb of the council to regulate the age limit. He suggested that centers be regulated under the zoning ordinances and that the proposed fee schedule was too high. Seymour Pollak, owner of machines, read a part of the contract with local operators that any fees shall be deducted from cash receipts. Mayor Zegarelli thanked Mr. Laverne and associates for his remarks and suggestions. The legislation in effect from cities which he presented this evening will be submitted to the Board for review, said the Mayor. Mayor Zegarelli stated that prior to any ^decision, he will be .notified. He stated that individual operators or owners will be invited to come to the work session on this item.
