Trustee DiFelice stated that he has always been in contact with Mr. Buonanno and has made available to him any information he had received regarding this matter. Trustee Soriano moved that the minutes of August 9, 1982 be «ppiovr-d as corrected, seconded by Trustee DiFelice. Carried, Trustee Soriano moved, seconded by Trustee DiFelice that the minutes of the August 16, 1982 meeting be approved as written. Carried. Miss Eva Piedemonte, 304 Gordon Avenue, stated that the sign for the handicapped space in front of the former Strand Theater was moved and that people have been parking in the space. Trustee DiFelice stated that the sign was never moved. appears in front of M. Fisher's store. It still Miss Piedemonte auggested that the curb be painted blue and that the sign be placed in the proper place. She also requested that the vh( be cut in front of the V.T. for wheelchairs and that fines be incrua- i-d for violation of these spaces. The matters were referred to the police committee. Miss Piedemonte complained about the parking of new cars on the bridge and being left for several hours blocking Gordon Avenue by traile drivers. She stated that there was a fire on Gordon Avenue recently and if they were parked at the time, the apparatus would not have been able to get through. She stated that she was almost involved in a serious accident there also and inquired as to why the cars are allowed to be parked on the bridge. f Mr. Frank Mangieri,- North Broadway, inquired as to why the cars M allowed back on the bridge. There is a safety hazard involved, he sMd There could have been a disaster had they been there during the rrcent fire. He inquired as to who made the agreement and on what basis are the trailers allowed to unload there, Trustee DiFelice stated that when he was on the force, there was a policy whereby tractor-trailers were allowed to make deliveries as soon as possible. He stated that this matter was brought to his attention oi August 13th for the first time. He had informed both Lieutenants that if there are violations on Old Broadway, that summonses are to be issuec A meeting was held with representatives of the three car dealers at the work session of August 26th, said Trustee DiFelice, and Tappan Motors agreed to unload on the bridge one at a time and McCall-Frandsen agreed to unload infront of his showroom. Frank Chevrolet agreed to unload on Valley Street or at McDonald's parking lot. Trustee Maceyak stated that McCall-Frandsen is still unloading on the bridge. Mr. Ray Avellino, 2 Ridge Street, stated that in connection with t.1 e adoption of ETPA, he is listed as having 12 tenants and none of them speak English and he is having difficulty explaining the $15 charges. Me stated that the Village should send someone down to explain to his te-\ ^ s Trustee Soriano read a letter that was sent to landlords assessing them $15 for each apartment. The owner is to collect from the tenant. Following a discussion, Trustee Gandolfo suggested that he submit the names of the tenants and she will get someone from ETPA to explain the program to his tenants. Mayor Zegarelli stated that the Board held a public hearing recently to consider amending the amusement device ordinance. He no ed that the Board met and after discussion, agreed to several changes : he proposed amendment, lowering of owner's fee and operators' fee. Mr. Charles Kriss, attorney, representing Thomas Laverne who is Counsel to the State Association of Amusement Game & Operators Guild, stated that after the hearing they had hoped that they would be involved in the process of revising the initial proposal into a more reasonable proposal. He expressed disappointment as to how the matter was handled. It was handled with a real lack of fairness to the operators, himself and Mr. Laverne. Trustee DiFelice stated that the provision for minors has been, in the ordinance since 1956. • * Trustee Lobato stated that this is a conservative community. The spirit of the ocmmunity is that they do not want children congregating 1oget her. r-f * Mayor Zegaielli stated that we do know the feelings of the communit and-we are modifying the legislation. Mr. Frank Cisca, Attorney for the \>si;chester Operators Guild, stated that the guild is concu- ned with the Village's attempts to reguh amusement devicesThe ordinance has to be fair to both sides in oi A to operate. They are not opposed to the banning of arcades, but are concerned with the language of the ordinance. He stated that parts of ' ordinance are unconstitutional. He stated that they were not here to oppose the Village, but to work out something. He asked the Board to defer any action until they have time to work something out. Mr. Cisca pointed out some of the issues that he said are wrong. He stated that this ordinance as compared to other communities is une of the strongest and restrictive ordinance and deemed it unconstitutional. g Trustee Gandolfo stated that some good points about changing the I language in the statute, as far as juke boxes and definitions paragraph which would exclude shuffle board and the pool table, but she stated th-: she did not think his arguments restricting the games to minors has m»:n Counsel suggested to the attorneys for the amusement device owners that they forward any proposals that they may wish to be incorporated ii the local law to him. TrusteesMaceyak and DiFelice stated that they stand firm on -.the age limit and fees. Trustee Lobato moved that a work session be held on September 16th to discuss the ordinance regulating amusement devices, seconded by Trustee Lofaro. Carried. REPORTS 0F_COMMITTEES Trustee Soriano stated that the conmittee approved the expenditure o*f $900 for refurbishing the kitchen cabinets in Union Hose Company, fhe Village garage will be dedicated soon. Trustee Maceyak stated that he would like to make sure that all Trustees and the Mayor are invited to the dedication. He stated that in the past, all Trustees were not invited to a function, one of which was at the delivery of the van to the C.O.C. Several members of the Board indicated that they were not invited. Trustee Soriano stated that he, together with Trustee Lofaro, met with Trustees Blood and Galella of Tarrytown to discuss Friendship Park. FINANCE &__RE AL_ ESTATE Trustee Gandolfo reported a cash balance of $103,399.74 in the General Fund as of September 7, 1982. Trustee Gandolfo moved seconded by Trustee Soriano that action of the Treasurer in investing $100,000 in c.d, notes in the First N/B of North Tarrytown at 8%70 be confirmed by the Board. Carried. Trustee Gandolfo moved, seconded by Trustee Lobato that action of the Treasurer in investing $850,000 at 8%7e in the First N/B of Norjih Tarrytown be confirmed by"the Board. Carried. Trustee Gandolfo moved, seconded by Trustee Maceyak that Stanley Johnson be authorized to do survey work to determine whether or not the contractor who dredged Fremont Pond performed the work in accordance with the specifications, for an amount not to exceed $2,000. The amount is to come out of the existing bond allocation for this work. GOVERNMENTAL RELATIONS & SENIOR CITIZENS Trustee Soriano moved, seconded by Trustee Maceyak that the Village Clerk and Treasurer be authorized to attend the 27th Annual Training School for Clerks and Fiscal Officers on Sept. 2S-29 at Grossinger's, with expenses. Another date will be scheduled by the end of this week, he said. POLICE & LIGHT Trustee DiFelice stated that the new spotlights are in operation at the Morse School to prevent vandalism. He stated that many complaints have been received regarding the actions of the patrons leaving Michael's tavern on Beekman Avenue at night. Trustee DiFelice stated that Ptl. Robert Nevelus will have complete his three month probationary period on September 13th. Pleasant and North Tarrytown concerning school taxes. The motion to dismiss was denied by Judge Leggett. Their time to answer is today, said Trustee Lobato. We should have an answer soon. Mayor Zegarelli stated that a letter was received regarding the General Revenue sharing allocations for Period 14, which is Oct. 1, 1981 Sept. 30, 1983. The Village's allocation is estimated at $64,361. $2,702 was deducted from allocation 14 to North Tarrytown. We will re« $61,659. Mayor Zegarelli stated that he signed the statement of assurances certificate form. Mayor Zegarelli stated that the Planning Board discussed in commits the resolution of the Board of Trustees of December 5, 1981 and have recommended that the east side of Clinton Street be reclassified from its present R5 District to C2, General Commercial. The talk was about points and questions General Motors had, as well as planned expansion, said the Mayor. He stated that further discussions will be held and representation from the Board of Trustees will be provided * for. The Mayor noted that a briefing session will be held prior to our meeting with Greenrock Corp. concerning Rockefeller property and the General Motors matter.
