Peter Soriano, Trustee Absent Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. fr Trustee Lofaro moved, seconded by Trustee DiFelice that the minutes of the meeting held on September 7, 1982 be approved as written Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. No one appearing before the Board, the regular order of business was taken up. REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION f Trustee Soriano - absent. Mayor Zegarelli stated that the target date for the dedication of the Village garage scheduled for October 11th may have to be postponed because of cleanup work which has to be done. .1' Mi FINANCE & REAL ESTATE Trustee Gandolfo reported a balance of $14,699.84 in the General Fund as of September 17, 1982. Trustee Gandolfo stated that the Aqua Dredge Company has submitted a bill for payment for the dredging work at Fremont Pond. She stated that the Village has retained Stanley Johnson, land surveyor, to review the specifications to ascertain whether or not the contractor has complied with them. Trustee Gandolfo moved, seconded by Trustee Lofaro that the bill from Aqua Dredge Co. be withheld for the present time. Carried. •,ilt«i f> ¥ 11' I If �-2FIRE Trustee Lofaro reported that the assistant Chief's car was involvei in an accident. A report is forthcoming. Trustee Lofaro moved, seconded by Trustee Gandolfo that twelve captain chairs be purchased, for a total of $550, for Rescue Hose Compai said money to come from the fire budget. Carried. Trustee Lofaro moved, seconded by Trustee DiFelice that a rug for the stairs leading into the basement of Rescue Hose Company be purchase in the amount of $225.00. Carried. Trustee Lofaro stated that there is a problem of water leakage ii the kitchen of Rescue Hose Company which will be taken care of, as wel[ as several other minor problems which will be corrected. Trustee Lofaro stated that the fire inspection was held on Saturda; and all quarters are in satisfactory condition. The clambake on Sunday was successful, he said. GOVERNMENTAL RELATIONS & SENIOR CITIZENS In the absence of Trustee Soriano, Trustee Gandolfo reported from the minutes of the senior citizens' meeting on September 7th that the organization celebrated its 7th anniversary with a social gathering. LABOR RELATIONS Trustee Lobato stated that a meeting has been scheduled for tomorn evening and it is hoped that we will make enough progress. POLICE & LIGHT Trustee DiFelice stated that Chief Spota has submitted a request from Ptl. Reddy to take three courses under the Criminal Justice Prograu at Community College at a total cost of $357.05. Trustee Gandolfo stated that the Board should decide whether we grant all of these or decide if it will benefit the Village. The committee should accept some criteria to see what kind of courses they going to request. The matter was referred to the police committee. Trustee DiFelice stated that he is in receipt of a memo from ChiefI Spota regarding a department awards program dinner which is in the Poliq and Procedure Manual. The matter was referred to the police committee. Trustee DiFelice stated that the K9 dog will be on duty with Ptl. Kiggins at the end of this week. Trustee Maceyak moved, seconded by Trustee Lobato that a letter bel sent to Ptl. Kiggins congratulating him on the completion of the trainii) course. Carried. �> ^ -3- In connection with Section 57-17, "Permit Required for Parking" of the General Code as discussed at the last meeting, Trustee DiFelice moved, seconded by Trustee Lobato that the Board adopt the license agreement as prepared by the Village Attorney which lists regulations in connection with their permit to park at the Village parking lot adjacent to Margotta Courts. Carried. Trustee DiFelice stated that a letter has been received from H. R. Simonsen, Dept. of Transportation, regarding our request for a signal light on Broadway and Depeyster Street. Mr. Simonsen stated in his letter that as a result of their review, they are in agreement that there is a need for a traffic light. The installation of the traffic signal will be included in the signal contract for the fiscal year 83-84 and it is estimated that installation date occur in the summer or fall of 1984. If this is not favorable to the Village, the Department would allow the Village to arrange for the installation and should the Village assume the responsibility and cost of said installation, the State would be willing to assume maintenance and pay energy costs upon completion of the installation. The matter was referred to the police committee for study. With regard to the installation of bus stop signs by the County, Trustee DiFelice stated that the committee is deciding on the spaces and locations. He stated that there would be elimination of some parking spaces in this program. Trustee DiFelice stated that a discussion was held regarding John Carroll's request for a disaster plan in the event of problems at the nuclear plant in Buchanan. He stated that Chief Spota contacted Mr. Marasco at the County Civil Defense Office and was told that we are outside the 10 mile radius. If there is any plan available, it will be sent to the Chief, said Trustee DiFelice. Trustee DiFelice stated that handicapped spaces have been repainted with blue paint and the ramp in front of the Municipal Building has been refurbished. He stated that there is a problem with the space in front of the former Strand Theater being too small. The space should either be eliminated or another space will have to be utilized, he said, and has asked members of the Board to review it visually. The matter was referred to committee. Trustee DiFelice stated that as a result of the hearing held last week regarding parking in the Manors, it was noted that some of the signs are inconsistent and it was the consensus of the Board that the signs be removed and placed at the entrances to the Manors and Trustee DiFelice so moved, seconded by Trustee Maceyak. Carried. With regard to dog control services by the Town of Mt. Pleasant to North Tarrytown, Trustee DiFelice moved the following resolution, seconded by Trustee Maceyak, and that the Mayor be authorized to sign same: �-4- ^ WHEREAS on June 1, 1978, the Village of North Tarrytown adopted Chapter 16 of its General Code entitled "Dogs", and WHEREAS the legislative intent of such local law as to prevent annoyance and danger to the person and property of others by dogs that are not properly tended, and WHEREAS section 16-3 of said local law provides for the office of a dog warden and the Village may authorize from time to time by resolut the persons authorized to enforce the provisions of that local law, and WHEREAS section 114 of the Agricultural and Markets Law of the State of New York authorizes Villages to appoint dog control officers | for enforcement of the rules and regulations promulgated for the 1 regulation of dogs, and I WHEREAS each dog control officer shall have all of the powers of a peace officer in enforcing the provisions of said local law including the power to issue appearance tickets as required, and WHEREAS section 150.20 of the Criminal Procedure Law of the State of New York permits a public servant, other than a police officer to issue appearance tickets for petty offenses, and WHEREAS the respective laws for the control of dogs in the Village of North Tarrytown and the Town of Mt. Pleasant are substantially simih and WHEREAS the Town of Mt. Pleasant has indicated it will provide the services of a dog warden to the Village of North Tarrytown upon a I schedule to be agreed upon between the municipalities, NOW, THEREFORE, be it resolved that the dog warden so designated by the Town of Mt. Pleasant to provide dog control services in the Village of North Tarrytown shall have all of the powers provided by Chapter 16 of the General Code of the Village of North Tarrytown and Chapters 150-20 of the Criminal Procedure Law and section 114 of the . Agricultural and Markets Law of the State of New York. Carried. | PUBLIC WORKS ' Trustee Maceyak reported that catch basins were repaired as well as the replacement of a driveway. Dirt was removed from Barnhart Park and dumped into the Elm Street lot. Routine cleanup of sanitary sewers. Trustee Maceyak reported a balance of $60,654.78 in the water department account as of September 20th, 1982. Trustee Maceyak moved, seconded by Trustee Lobato that action of the committee in awarding the work for the furnishing of labor and materials for the construction and repair of catch basins and drop inlet to J. C. Perri, Inc. for a sum not to exceed $95,000 be confirmed by the Board. Carried. �-5- «C* Trustee Maceyak moved, seconded by Trustee DiFelice that the Treasurer be authorized to obtain a bond resolution in the amount of $100,000 for a truck with a plow and spreader for the highway department. Carried. RECREATION & PARKS Trustee Gandolfo stated that the fall and winter brochure has been mailed to residents and among the programs offered are aerobics, ceramics beginning oils, etc. Trustee Gandolfo stated that on October 1st at 7:30 P.M., Jim Jensen and the CBS All Stars in a benefit game for Childrens' Village. Tickets can be purchased through the Recreation Department. Not listed in the brochure are calligraphy, cooking, Italian, Spanish, First Aid, etc., said Trustee Gandolfo. TAX EXEMPT & ASSESSMENT Trustee Lobato stated that the Board will meet at the Rockefeller Estate to discuss the status of their property and the tax input to the Village. MAYOR'S REPORT: Trustee Maceyak moved, seconded by Trustee Gandolfo that the following resolution be adopted: RESOLVED: Section 1. The following described area has been found to be a. sub-standard and insanitary area appropriate for urban renewal and has been duly designated as an urban renewal area within the intent of the urban renewal laws of the State: Section 16, Block 16, Lots 1,2,3,4,5,6,7,8,9,10,11,12,13,13A,15, 16,17,18,19,20,21,22,23,24,25,26,27 & 28. Section 2, The existence of said area is impairing and arresting the sound growth and development of the municipality and is inimical to the public health, safety, morals and welfare of the inhabitants thereof and of the State. Section 3. An urban renewal plan has been prepared and duly approved for said designated area. The Village of North Tarrytown has undertaken and is carrying out an urban renewal program in said area, hereinafter called the "program" as authorized by and to effectuate the purposes of the Housing Act of 1949 as amended and supplemented. Section 4. The undertaking and carrying out of the program is essential to the sound growth and development of the municipality and to the welfare of the inhabitants thereof. Section 5. It is necessary and in the public interest that the Village of North Tarrytown avail itself of the financial assistance �-6provided by virtue of the urban renewal assistance laws of the State for the purpose of carrying out the program. Section 6. The Village of North Tarrytown hereby expresses its intent and recognizes its responsibility to do whatever is necessary 01 appropriate to carry out the program. Section 7. Philip E. Zegarelli, Mayor of the Village of North Tarrytown is hereby authorized to execute an Amendatory Contract amendi Contract for State grant between the State of New York and the Village of North Tarrytown in the total amount of $145,286. which is the amount of the State Capital Grant Contract to assist in carrying out program activities, a copy of which is attached hereto. Section 8. Irene Amato, Treasurer of the Village of North Tarrytc is hereby authorized and empowered to execute and file requisitions fo funds in the total amount of $145,286. which is the amount of the State capital grant contract, as amended. Carried. Mayor Zegarelli stated that Emilie Spaulding has resigned from the North Tarrytown Housing Authority. Her resignation was sent to William Palmer, Chairman. Mayor Zegarelli appointed Margaret White a member of the N.T. Housing Authority to fill the unexpired term of Emilie Spaulding, April 1983. A letter of thanks will be sent to her. Mayor Zegarelli stated that he is in receipt of a letter from Lawrence Sally, Deputy Commissioner, Dept. of Housing, Westchester Coun stating that the County is committing $45,000 to the rehabilitation of private property in the Village. COMMUNICATIONS Communication from Gaetana Scappaticci, 59 College Avenue, request the removal of a tree in front of her property was read and referred t| the public works committee. | Communication from Lawrence Kosilla, Sec'y. of Fire Council, regarding changes in personnel in Fire Patrol and Union Hose Companies and exempt certificates for W. Gonzalez and R. Chulla of Union Hose Co. was read and on motion of Trustee Lofaro, seconded by Trustee Lobato action of Council was confirmed by the Board. Exempt certificates were awarded to the above. Carried. Communication from Nellie Sbezzi, Chairperson of the Senior Citizei informing the Board that their Council was granted funding in the amount of $1500 by the Archdiocese of New York through the Holy Cross Church was read, Mrs. Sbezzi stated that this was received through Robert Ponzini, Village Attorney, and they extended their heartfelt thanks to him for his efforts. �Vr£ -7UNFINISHED BUSINESS Trustee Maceyak suggested that a letter be sent to John Tucciarone requesting him to be present at the September 30th work session for an update on 12-14 Lawrence Avenue. Trustee Lofaro mentioned a complaint about the public address system at Tappan Motors which can be heard around his area. Counsel stated that we do have a noise ordinance. The matter was referred to the police committee. Trustee DiFelice stated that there is a problem on the west side of the railroad tracks whereby cars are being parked and causing a littering problem. The highway department will install a chain and a key will be given to the Fire Department. Trustee Maceyak inquired about the recent hearing on smoke detectors. The matter will be discussed at a work session with the Building Inspector. NEW BUSINESS Mayor Zegarelli stated that a letter was received from Mr. Dwayne Young requesting a full tax abatement for the Town and School taxes for a minimum period of three years for the purchase of 79 College Avenue. The matter will be discussed at a work session. Trustee DiFelice moved, seconded by Trustee Lobato that the bills submitted on the General Fund and Water & Sewer warrants dated Sept. 20, 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Lobato moved, seconded by Trustee DiFelice that the same be duly adjourned Carried.
