Mark Weingarten stated that he is a partner with the law firm DelBello Donnellan Weingarten
Wise &amp; Wiederkehr, LLP, representing the applicant to request two area variances for the
proposed three-story medical office building and related parking structure on Block A of the
Edge-on-Hudson project. Mr. Weingarten stated that the Board requested additional information
at the November 20, 2024 meeting. Materials submitted on January 9, 2025, included a letter and
exhibits providing information regarding the parking supply, similar medical office buildings
owned or developed by the applicant, and a memo from DTS Provident Design Engineering,

�LLP that incorporated usage data supplied by our prospective tenant. Mr. Weingarten stated that
he is now allowed to say publicly that Northwell Health will be the tenant. Northwell Health’s
usage data for expected uses within the building was incorporated into the traffic study and the
shared parking analysis originally provided to the Planning Board, and now provided as
supplemental information. The support letter from John DeCicco states that the original proposed
378 parking spaces was an adequate supply for the supermarket to share with the medical office
building. Mr. Weingarten described the reasoning for the creation of the 300 foot reduced height
and why it should be eliminated. He provided examples of similar height variances granted by
the Zoning Board within the restricted height zone. Mr. Weingarten stated that the benefits to the
applicant outweigh any detrimental impact to the community in granting the requested height
variance. The Board is required by law to take a balancing test in determining whether or not to
issue a variance. Mr. Weingarten stated that the top of the parking structure is proposed at the
same height of the medical office building, would sit well below Beekman Avenue, and preserve
the viewshed. Commerical development was a critical component of the Edge-on-Hudson
Riverfront Development master plan. The parking analysis prepared by DTS Provident Design
Engineering, LLP provided expert evidence that the original 378 parking spaces and now
proposed 426 were sufficient to satisfy the peak hour parking demands. Mr. Weingarten stated
that the Simone Development letter provided examples of six medical office facilities that
provide less parking per square foot and less on-street parking is available to the public. The
letter details that the requested variances are necessary for the project to provide enough square
footage and be economically feasible for the developer and the prospective tenant to proceed.

Mr. Weingarten solicited comments from the Board.
Dennis Xenos asked for the floor-to-floor heights, details regarding circulation, and
handicapped-accessible parking in the parking structure.
Gorette Crowe asked how many handicapped spots are provided in the garage.
Brooks Slocum is the project architect from G3 Architecture Interiors Planning. Mr. Slocum
stated that one lane would be provided each way for entering and exiting the parking structure.
Handicapped accessible parking spaces are proposed on the surface lot and parking structure, but
is unsure of the count.
Thomas Chang asked if the garage parking spaces will have time limits.

�Mr. Weingarten stated that time limitations are not proposed in the garage structure. They are
discussing with DeCiccos about limiting the time on the surface lot to ensure that the spaces are
utilized by the supermarket and not by employees staying longer in the medical facility.
Ms. Crowe asked how the medical office building site will accommodate ambulette vehicles and
what treatment services will be offered.
Umberto Annunziata is the Development Manager for Simone Development Companies. Mr.
Annunziata stated that the medical office building will offer primary care, orthopedics,
neurosciences, and muscular and skeletal outpatient surgery.
Mr. Slocum stated the intention is to have ambulette vehicles utilize the drop-off area, where five
vehicles could park. There will also be space in the loading area. The ground floor of the parking
garage could accommodate vans if needed.
Ms. Crowe asked if an urgent care service would be offered in the building and if the garage
structure would have a sprinkler system.
Mr. Annunziata stated that urgent care services will not be offered in the medical office building,
and the parking structure will not have ventilation or sprinkler systems.
Mr. Weingarten stated that the medical office building would be utilized for scheduled
procedures, not urgent care.
Sean McCarthy stated that the parking structure will require a sprinkler system.
Mr. Xenos asked the applicant to explain the circulation plan for DeCicco’s loading dock.
Mark Gratz is the engineer from DTS Provident Design Engineering. Mr. Gratz explained how
the delivery trucks would access the loading docks for DeCicco’s supermarket.
The Board requested that the applicant submit section plans for the garage structure.
