Caxci£d.~ �-2" Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter. Mr. Stanley Biloon, 52 College Avenue, stated that he is having problems with garbage removal from his apartments at 52 College Avenue, He stated that garbage is accumulating because Village trucks are not allowed to drive into private properties. He stated that the men take some of the garbage and leave the rest. Trustee Maceyak stated that some of our employees have been injure and adjacent properties were damaged because of the fact that the trucli had entered on to the property as well as trying to push the hopper un. his driveway. He stated that he has met with Mr. Biloon and gave"his several alternatives as a solution. Following a discussion, the matter was referred to ther public works committee for a solution. Mr. Richard Sweet called the Board's attention to a recent meeting of the Westchester County Taxpayers Council whereby questions "were rais as to where money would come from when the new garbage disposal- plant is built. He stated that one community was selected and was offered a million dollar inducement when the Gra sslands site was turned down. He questioned why Mt. Pleasant was not offered the same inducement. Trustee Soriano stated that there was an inducement to Peekskill Mayor Zegarelli stated that there was opposition from the people of the Town of Mt. Pleasant against the plant being built in their area! REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION Trustee Soriano stated that the Board met with the architect for a tour of the new Village garage. Everyone is well-pleased with its progress, said Trustee Soriano. | Trustee Soriano inquired if the Board came to any agreement (durift his absence) with regard to a recent request for a tax abatement from a Mr. D. Young if he purchased 79 College Avenue. Trustee DiFelice reiterated his previous remarks that the matter b placed on the ballot in the next Village Election and let the people decide whether or not they would go for a loss on this project. Trustee Soriano stated that we cannot maintain the property any longer and believed in compromising with the purchaser. The matter was referred back to committee. FINANCE & REAL ESTATE Trustee Gandolfo reported a balance of $144,212.53 in the General Fund as of October 4, 1982. r �vac -3- Trustee Gandolfo moved, seconded by Trustee DiFelice that action of the Treasurer in investing a certificate of deposit in the amount of $750,000 for thirty days with the First National Bank of North Tarrytown at 8%70 be confirmed. Carried. Trustee Gandolfo offered the following resolution, seconded by Trustee Soriano: BOND RESOLUTION, DATED OCTOBER 4, 1982, AUTHORIZING THE ISSUANCE OF $100,000 SERIAL BONDS OF THE VILLAGE OF NORTH TARRYTOWN, PURSUANT TO THE LOCAL FINANCE LAW, TO FINANCE THE ACQUISITION OF A MOTOR VEHICLE FOR THE VILLAGE. (In detail official minutes) Trustee Gandolfo stated that the office of Code Enforcement terminated on September 30, 1982, Allowances were made in the budget for a part-time code enforcement officer, Trustee Gandolfo moved, seconded by Trustee Soriano that the Treasurer be authorized to pay Mr, Page from General Fund for part-time Code Enforcement Officer at the rate of $711 per month for the period October 1, 1982-May 31, 1983. Carried. Trustee Gandolfo stated that the committee hired Karen McCarthy part-time secretary for the Assessor, Mr. Page, at the rate of $3.50 per hour and moved that action of the committee be confirmed by the Board, seconded by Trustee Lofaro. Carried. In connection with the Community Development Office, Trustee Gandolfo moved, seconded by Trustee Soriano that the amount of $2585. be debited from #1630 Buildings-Other and Credit Community Development FundPublic Works, Carried. Trustee Gandolfo moved, seconded by Trustee Soriano that the amount of $524.90 be debited from #1010-Board of Trustees and Credit Community Development Fund-Planning and Management, Carried. Trustee Gandolfo stated that she received a call from Mr. Johnson that he made an inspection of the work by the contractor who dredged Fremont Pond and is compiling his report. She stated that she received a call from Mr. Pound requesting a copy of the site plans and as per approval of Mr. Gorman, Attorney for the project, Mr. Johnson was instructed to send him a copy of the site plans for cross section and moved, seconded by Trustee Maceyak that her action be confirmed. Carried. Trustee Gandolfo stated that the surveyor would like to meet with the Board when he completes his report and a date was scheduled for October 16th. FIRE Trustee Lofaro stated that at a previous meeting, a resolution was adopted authorizing the expenditure of a trophy case for Pocantico H & L in the amount of $1210. Because of the increase in materials, the bill submitted this evening is for $1500 or $290 over the amount adopted. T t �-4Following a short discussion, Trustee Lofaro moved,' seconded by Trustee Soriano that the bill in the amount of $1500, which includes the additional amount of $290, be paid for the trophy case. Carried. Trustee Lofaro stated that in connection with the hearing held several months' ago on smoke and heat detectors, Victor Page had recommended that the following sentence be included in Section #22-6A of the code - (Single Family and Two Family Dwellings Section: "Where the N.Y.S. Fire Prevention Code does not provide a specific regulation, the National Fire Prevention Code, current edition, as amended, will govern." Trustee Lofaro so moved, seconded by Trustee DiFelice that the above amendment be included in the Fire Prevention Code. Carried. Trustee Maceyak moved, seconded by Trustee DiFelice that the following Local Law #6 of 1982- Smoke and Heat Detectors be adopted: (Copy in detail official minutes) GOVERNMENTAL RELATIONS-SENIOR CITIZENS Trustee Soriano stated that we are in receipt of a letter from the Federal Savings Bank requesting that the Village support A6388B and S4756 which would require the State and local governments to deposii reserve funds in interest-bearing accounts and would authorize thrift institutions to accept these deposits. Trustee Soriano moved, seconded by Trustee Lobato that we support the bills. Carried, Trustee Soriano reported that a determination order from the N.Y.S Division of Human Rights with respect to a complaint filed by Kim Berry was received. The complaint was dismissed in all respects and the Village was cleared of any wrong doing or the issue of racial discrimins tion, The Senior Citizens met today and 75 people were in attendance. He stated that Mrs. Sbezzi has resigned as chairperson and a meeting has been recommended by Mr. Porcano to fill the vacancy. Trustee Soriano stated that he has been attending the Town of Mt. Pleasant Senior Citizens Council in Hawthorne, He stated that document! havec been prepared for interfaith housing for senior citizens and there are two churches holding up progress. LABOR RELATIONS Trustee Lobato stated that the blue collar workers have filed a petition to decertify the CSEA bargaining unit who represents them in the Village and will hold an election to certify the teamsters union as their bargaining representatives. The Village is required to be servec with a petition and has the opportunity and right to be heard in conjunction to this, said Trustee Lobato, Several meetings were held with negotiatiors, he said. r r r �-5- *r Trustee Lobato stated that the committee is reviewing various outstanding grievances and is looking to settle them. He stated that the public works department has been looking into minor re-organization which will have some labor relations impact, he said. The committee is coordinating with them. POLICE & LIGHT Trustee DiFelice stated that he is in receipt of a request from Chief Spota for permission of Lt. Brophy to attend the Rugers Armours firearms training program in Newport, New Hampshire from Nov. 8-12, at a cost of $150 for motel fees. Lt. Brophy will pay for mileage and meals, said Trustee DiFelice, Trustee Lofaro moved, seconded by Trustee DiFelice that Lt. Brophy be granted permission to attend the training program in New Hampshire at a cost of $150 for motel fees. Carried. Trustee DiFelice stated that Chief Spota has requested permission to attend the Lesley College Graduate School seminar on Management Supervision to be held in White Pla ins on October 14th at a cost of $150. Trustee Lofaro moved, seconded by Trustee Soriano that the Chief be granted permission to attend the school on October 14th with exDenses of $150. Carried. Trustee DiFelice reported that all No Parking signs have been removed from streets in Philipse Manor and installed at each entrance into the two manors, he said. Trustee DiFelice stated that a couple of years' ago, the Village received a grant for pavement markings in the amount of $12,254. Mr. Lampert, who sought out funds for the Village, received a fee of 20?o of the grant. Last year, we paid him $1866.54 and there is a balance of $586,26. Trustee DiFelice gave the following police report for September: (In detail official minutes) Trustee DiFelice stated that a program on Child Restraint Program sponsored by the Westchester County Traffic Safety Board will be presented on Friday morning, October 15th, at 10:00 A.M. in Village Hall. This new law is mandatory, said Trustee DiFelice, Trustee DiFelice discussed the handicapped parking space in front of the former Strand Theater after which the matter was referred to a work session. Trustee DiFelice stated that at a recent meeting of the Board, a member of the handicapped committee suggested that the fine for parking in a handicapped space be increased to $25 and moved that a public hearing be held on November 1, 1982 to increase the fine for parking in a handicapped space to $25, seconded by Trustee Lofaro. Carried. PUBLIC WORKS Trustee Maceyak gave the following report: �w -6The semi-annual inspection and flushing of hydrants will begin on October 13 for two weeks. First week will be the Village proper and Webber Park and the second week, Phil ipse Manor and Sleepy Hollow Manor Bank balance as of October 4th is $45,188.28, New catch basins were built and a drain pipe relaid on Kendall Avenue extension. Replaced deteriorated sidewalks at College Avenue and Cortlandt Street. Twenty barrels to be Edison. used as sand barrels were donated by Con Trustee Soriano moved, seconded by Trustee Maceyak that a letter of thanks be sent to Con Edison, Carried, Trustee Maceyak moved, seconded by Trustee Soriano that specifica tions be prepared and bids returned on November 1, 1982 on a heavy duty dump truck with plow and spreader, Carried. Trustee Maceyak reported that equipment is being readied for snow. Dead trees have been removed throughout the Village, RECREATION & PARKS Trustee Gandolfo moved, seconded by Trustee Maceyak that the Mayor be authorized to sign an application for State aid in the amount of $3459.60 to the Division of Youth, Carried. Trustee Gandolfo moved, seconded by Trustee Soriano that specifications be prepared and bids received on October 18th for recreational equipment, Carried. Registration deadline for the fall/winter programs close on Oct. 7t The next special event will be held on November 6th at the Warnerfj Library. Artist Linda Perlmutter will talk on Water Color Techniquesl] and Tools at a demonstration called "Being Creative with Water Colors"! at 10:30 A.M. Jim Jensen's CBS All Stars game will be held on October 1st at Memorial Field. Trustee Gandolfo reported that on September 23rd, the Westchester County Volunteer Firemen's Association presented Pat Lofaro an award for saving the life of a teenager several months' ago and moved that the letter be placed in his folder, seconded by Trustee Lofaro. TAX EXEMPT PROPERTY & ASSESSMENT Trustee Lobato reported "progress11, MAYOR'S REPORT Mayor Zegarelli stated that he is in receipt of a city ordinance regarding licensing of private vehicles for rental from Mt. Vernon and referred it to Counsel. t A �Mayor Zegarelli stated that he is in receipt of a letter from Seymour Pollak concerning the recent local law adopted by the Village regarding amusement devices and he acknowledged same. Mayor Zegarelli stated that he is in receipt of a letter from the County concerning the Urban County consortium community development advisory group which states that the Board can appoint a person to this group. The first meeting will be held on October 12th, It was suggested that the name of Ida Mae Smith be appointed to this group. COMMUNICATIONS Communication from Leonard Galante, President of the Central Veterans Committee, requesting permission to hold the Annual Veterans Day services at Patriots Park on November 11th at 10:30 A.M. and invited the Mayor and Trustees was read and on motion made and seconded, permissioi was granted and the invitation accepted. Communication from L Rodrigues, President of Rodrigues Enterprises, requesting permission to hold a parade and inviting the Mayor, Trustees and other Village officials to the opening of the Strand Roller Skating rink on October 15th at 7 P.M, was read. Trustee Lofaro moved, seconded by Trustee Lobato that permission be granted and the invitation accepted. The Chief was ordered notified of same. Carried, Communication from William Palmer, Chairman of the Housing Authority, submitting salary schedules for 1983 for review and approval for the Superintendent, Maintenance Laborer and Administration Assistant was read. Trustee Lofaro moved, seconded by Trustee Gandolfo that the letter be acknowledged by the Board. Carried. Communication from Mr. & Mrs. B, Czyz, 37 Bedford Road, requesting tree trimming was read and referred to the public works committee. Communication from Dorothy Fox, 15 Elm Street, requesting sidewalk repairs was read and referred to the public works committee. Communication from Nellie Sbezzi resigning as chairperson on the Senior Citizens Commission because of ill health was read, Trustee Soriano moved, seconded by Trustee Lobato that her resignatioi as chairperson be accepted and that a letter of thanks be sent to her for her services. UNFINISHED BUSINESS Trustee Maceyak requested that a meeting be held with the Zoning Board to discuss McCall-Frandsen lot, With regard to the hearing on the local law to amend the loading zone chapter, Trustee Soriano moved, seconded by Trustee Lofaro that Local Law #5 of 1982-amending Section 57-18 Loading Zone be adopted as follows: (In detail official minutes) N } t �n -8With regard to the hearing on exemptions for citizens over the age of 65 years, Trustee Gandolfo stated that she would like the mattei discussed in finance committee. Following a discussion, the matter was referred to the Tax Exempt Property and Finance Committees for study. Trustee Gandolfo stated that Mr. Gorman, Attorney for Fremont Pom has recommended that the bill submitted by Mr. Charles Pound for dredgn work at Fremont Pond be withheld on the basis that we do not know what if any, extra monies have been incurred by the Village and moved that payment be withheld until we have had an opportunity to speak to the Attorney, surveyor and Mr, Pound, seconded by Trustee Lobato. Carrie A discussion was held regarding the subdivision of the Rockefell< property, after which Trustee Gandolfo moved that an informational hearing be held on October 25th informing residents as to their plans, etc. as well as obtaining public input, seconded by Trustee DiFelice Carried. On the question, Trustee Lobato stated that if we do not have any maps available, the hearing would be of no use. He suggested more fact| be made available as to the impact of the tax laws as well as other final information before setting up a hearing. Following a discussion, motion carried. Mayor Zegarelli moved, seconded by Trustee Soriano that the follov resolution be adopted: WHEREAS the Rockefeller family and landowners of large parcels of land located in the Village of North Tarrytown, and WHEREAS said property have been the subject of public notice for a two-stage gift of park land to the State of New York, and WHEREAS certain additional parcels of Rockefeller land will be gifted to Sleepy Hollow Restorations and WHEREAS the gifts of these respective parcels of land will remove those properties from the tax assessment roll of the Village of North Tarrytown, and WHEREAS the loss of these taxable properties from the rolls of the Village of North Tarrytown will cause a severe financial hardship on its residents and taxpayers, and WHEREAS the Village of North Tarrytown presently has within its boundaries a disproportionate share of tax exempt properties in relatioij to other municipalities wit Jiin the County and the State of New York, WHEREAS the Town of Mt, Pleasant is requesting relief from the State of New York for these tax inequities and have forwarded resolutioij to its representatives in Albany, and �-9- ^ ^ ? W WHEREAS there has been precedent for requesting relief from a tax inequity caused by an inordinate amount of tax exempt property within a municipality, NOW, THEREFORE, BE IT RESOLVED that a copy of this resolution be forwarded to our State Assemblyman and Senator to introduce legislation in the N.Y.S. Senate and Assembly for a ten year payment by the State of New York in lieu of taxes for the property to be deeded to the State of New York by the Rockefeller family. That said payment be equal to the taxable status of the gifted property on the date of its gift to the State of New York and reduced in an amount of 107o per year for a period of ten years and that by this resolution, the Village of North Tarrytown join in a similar resolution forwarded by the Town of Mt. Pleasant seeking similar relief. Carried. With regard to the letter received from the D.O.T. regarding the traffic light at Broadway and Depeyster Street, Trustee DiFelice moved, seconded by Trustee Maceyak that the Village formally request that the State place the traffic signal installation on its calendar for the fiscal year 1983-84. Trustee Lobato inquired about the status of Chief Spota's request to send a patrolman to Westchester Community College for a Criminal Justice course. Trustee DiFelice stated that Chief Spota was told to obtain a letter from the individual stating the purpose for attending the course and of what benefit it would be to the residents of North Tarrytown. He stated that he has not received the letter, as yet. Trustee Maceyak stated that summonses were issued to the owners of 12-14 Lawrence Avenue for violations, however, something went wrong and new summonses were issued. NEW BUSINESS Trustee Gandolfo stated that she is in receipt of complaints about an accessory apartment at 150 Merlin Avenue. She stated that she is working with the Village Prosecutor on this matter. A notice of violation will be served on the owner, A discussion ensued, after which Trustee Gandolfo moved, seconded by Trustee DiFelice that the complaints received regarding 150 Merlin Avenue be referred to the Building Inspector and Village Prosecutor. Carried. With regard to the salary of Judy Conway, Librarian, Trustee Lobato stated that the salary was not raised to the satisfaction of the Library Board. Tarrytown had raised some objection as to who had responsibility and who had the power, he said. North Tarrytown's representatives felt that this Board adopted a budget and Miss Conway's salary was in the budget; however, it was not raised to that amount. He stated that Mayor Pilla was surprised at the figure in the agreement budget, however, he is going back to his Board and if there is a basis for the figure, she would get the amount, said Trustee Lobato. t �412> -10- Trustee Soriano moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated October 4, 1982 be paid after approval by department heads and that thi Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Definitions and Minimum Requirements: 1. Smoke Detector: The minimal permissible smoke detector shall be of single station type, approved by Underwriters Laboratorj (U.L.) and/or Factory Mutual, and shall be powered by a battery ha\\ a usable life of at least twelve (12) months duration. 2. Heat Derector: The minimal permissible heat detector sfo' be of single station type, approved by Underwriters Laboratories (]}' and/or Factory 15utual, and shall be either mechanically, electrical! or gas powered. 3. Smoke Area: An area totally enclosed which contains at ii 50 square feet of floor area but not more than 600 square feet of fli area. Section B. Installation Requirements: 1. All buildings other than those used as dwellings, and v do not contain approved sprinkler systems, shall contain (except in areas where heat detection devices are separately required) one smoki detector for each smoke area, and in the case of enclosed hallways, corridors, and vestibules, one smoke detector for each 50 linear feet 2. All buildings other than these used as dwellings and vfmc do not contain approved sprinkler systems, shall contain in each rooi •with cooking facilities, boilers,furnaces or other heat producing units, one heat detection device for each smoke area. 3. All nmltifamily dwellings shall have smoke detectors ir. following locations : (i) At the top of any stairwell if such stairwell is open to common hallways or corridors. (ii) One (1) smoke detector for each 50 linear feet in C O M hallways and/or corridors. (iii) Storage Areas; In areas exceeding 50 square feet, a mini™ of one (1) smoke detector for each smoke area or portion thereof. A. K All smoke and heat detection devices required hereunder must, at all times, be in good working order. Section E. Compliance requirements: 1. All owners of buildings described in Section 2 above shall, on January 1st of each calendar year, file with the Chief of the Fire Department of the Village of North Tarrytown, an affidavit in the form required by the Chief. The affidavit shall set forth the number and location of all smoke and heat detection devices in any building owned by the person signing the affidavit and shall certify that such devices have been examined and found to be in proper working condition on a date no more than sixty days prior to the signing of the affidavit. 2. Failure to file any affidavit as provided in subsection (a) above shall be a misdemeanor which is punishable by a fine not to exceed One Hundred Dollars (100.00) for each day beyond January 1st of any calendar year in which the owners of the building described in Section 2 above fails to provide the required affidavit. 3. The making of any false statement in an affidavit filed pursuant to subsection (a) above shall be a misdemeanor and, in addition to any other civil or criminal penalty imposed by any other law, such false statement shall be punishable by a fine not to exceed Five Hundred Dollars ($500.00) and/or imprisonment of up to six months. Section F. Effective Date. 1. This local law shall take effect upon adoption for all new construction in the Village of North Tarrytown. 2. This local law shall take effect in all existing buildings within the Village of North Tarrytown in the following manner: (i) 50% of the total smoke and heat detectors required in a building shall be installed- within 12 months of the effective date of the Law. (ii) The remaining 50% of the smoke and heat detectors shall be installed within 24 months of the effective date of this Law. Page 2 �y%0 BOND RESOLUTION, DATED OCTOBER 4, 1982, AUTHORIZING THE ISSUANCE OF $100,000 SERIAL BONDS OF THE VILLAGE OF NORTH TARRYTOWN, PURSUANT TO THE LOCAL FINANCE LAW, TO FINANCE THE ACQUISITION OF A MOTOR VEHICLE FOR THE VILLAGE. BE IT RESOLVED by the Board o;£ Trustees of the Village of North Tarrytown, New York as follows: * Section 1. The Board of Trustees shall issue its Serial Bonds of the aggregate principal amount of $100,000 pursuant to the Local Finance Law of New York, in order to finance the specific object or purpose hereinafter described. Section 2. The specific object or purpose (hereinafter referred to as "purpose") to be financed by the issuance of said bonds is the acquisition of a ££bO0cfcft!bdb£tn truck with a plow and spreader for use by the Village. Section 3. The Board of Trustees has ascertained and hereby states that (a) the estimated maximum cost of the sansbfaattixxx truck is $100,000; (b) no money has heretofore been authorized to be applied to the payment of the cost of the purposes; (c) the Board of Trustees plans to finance the purposes entirely from funds raised by the issuance of obligations herein authorized. �Section 4. It is hereby determined that the purposes are objects or purposes described in Subdivision 29 of Paragraph a of Section 11.00 of said Local Finance Law and that the period of probable usefulness of the purposes is five years. Section 5. Subject to the terms and conditions of this resolution and the Local Finance Law, and pursant to the provisions of Sections 30.00, 50.00 to 60.00, inclusive of said Law, the power to authorize bond anticipation notes in anticipation of the issuance of the Serial Bonds authorized by this resolution and the renewal of said notes and the power to prescribe the terms, form and contents of said Serial Bonds and said Bond Anticipation Notes, and the power to sell and deliver said Serial Bonds and any Bond Anticipation Notes issued in anticipation of the issuance of such bonds is hereby delegated to the Village Treasurer of said Village. The Village Treasurer is hereby authorized to sign any Serial Bonds issued pursuant to this resolution and any Bond Anticipation Notes issued in anticipation of the issuance of said Serial Bonds, and the Village Clerk is hereby authorized to affix the corporate seal of said Village to any of said Serial Bonds or any Bond Anticipation Notes and to attest such seal.
