Novr-nber 1, 1982 ' A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee Lofaro that the minutes of the meeting held on October 18, 1982 be approved as written. Carried. Mayor Zegarelli called for bids on a new dump truck with snow plow and spreader. Treasurer Amato opened the following bids: Cambria, Secaucus, N . J . IV - $89,741. �Trustee Lofaro moved, seconded by Trustee Soriano that the bids be referred to Counsel and public works committee for review and report to the Board. Carried. Mayor Zegarelli stated that prior to tonight's calling of the meet to order, he checked downstairs to see if anyone had requested to hold the meeting on the main floor of the Municipal Building. There was no one. Mayor Zegarelli read the notice of hearing to consider a proposed law to amend Section 57-79, subdivision B of the General Code which won increase the fine for parking in a handicapped space to not less than $25 and asked if there was anyone present who would like to address tfa Board. No one appearing for or against the proposed law, Trustee Lobato moved, seconded by Trustee Maceyak that the hearing be closed. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. No one appearing before the Board, the regular order of business was resumed, REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION Trustee Soriano stated that with regard to the Mayor's memo on security of Village buildings, suggested that a directive be sent to the police department instructing them to check all buildings. After a short discussion, Trustee Maceyak moved that former Truste be requested to return their keys, seconded by Trustee Soriano. Carried 1 Trustee Soriano read the second opinion which was obtained regard] the floor in our Central Fire headquarters and Rescue Hose companies whereby Mr. Sadler stated that the structure in the apparatus room can support the apparatus without over-stressing the steel beams and recoi^i that the concrete on the floor should be shored up not,the steel. I Mayor Zegarelli suggested a meeting with the consultant, however, he was told that the consultant would have to charge a fee, after which the matter was referred to the building inspector to contact the consul! to ascertain his fees. Trustee Soriano stated that a meeting was held with the architect on the new garage facility. The Board agreed to go along with new windi instead of repairing the existing windows. Mayor Zegarelli stated that a request for payment forthe construct! of the garage was received by the Treasurer at 5:00 P.M. this evening, however, it is not included on the warrant in tonight's meeting. Trustee DiFelice inquired if the Attorney will look into the mattei of penalties against the contractor for not completing the job within tl time specified in the contract. Trustee Gandolfo questioned as to whether or not notice should ha.i been given to the contractor. �Following a short discussion, the matter was refer rod to Con .r,el tb take the proper procedure. Trustee Soriano reported that the Board is contemplating on building a new parking lot on Hudson Street and in the meantime fill is being dumped. The fill is not being pushed back far enough and has caused a problem whereby trucks backing into the lot have pulled down wires. He was told that one of the trucks who has dumped fill damaged the fire alarm wires. We are now in receipt of a bill in the amount of $176 for repair. A discussion arose whereby Trustee DiFelice stated that he stated in the past, that department heads must go through their committee chairman for any action. Following a short discussion, Trustee DiFelice moved, that since it has been the policy of government to work through committees, department heads must work through their respective committees and committee chairmen prior to any course of action taken by the department heads and that department heads be notified of same, Carried. FINANCE & REAL ESTATE Trustee Gandolfo reported a balance of $231,430.07 in the General Fund as of November 1, 1982. Trustee Gandolfo moved, seconded by Trustee Lobato that action of the Treasurer in depositing a certificate of deposit in the amount of $500,000 in the First National Bank of North Tarrytown at 8%% interest be confirmed. Carried. Trustee Gandolfo stated that several weeks' ago, a public hearing was held on a proposed resolution to exempt from Village taxes to the extent of 50% of the assessed value properties owned by one or more persons 65 years of age or over who comply with the provisions of Section 467 of the Real Property Tax Law, The committee met to discuss the income of the owners. Last year, the combined income was fixed at $8000. The committee recommends that it be fixed at $9000 this y • r, she said, Trustee Gandolfo moved, seconded by Trustee Lobato that the following resolution be adopted: RESOLVED: 1. Any real property located in the Village of North Tarrytov.n I be exempt from taxation by the Village to the extent of fifty (50%) ; -c cent of the assessed valuation thereof, pursuant to Section 467 of t/e Real Property Tax Law, provided that: a. In the case of joint ownership of said real property, either the husband or the wife must be sixty-five (65) years of age or over. b. The income of the owner or the combined income of all the owners of the property does not exceed the sum of nine thousand ($9,000.00) dollars for the twelve (12) consecutive months immediately preceding the date of the application for excrpi. i on. Where title to the property is vested in either the husband or the wife, their combined income may not «r-ceed such sum. Such income shall include Social Security and retirement �-4- benefits, interest, dividends, rental income, salary or earnings and income from self -employment, but shall not include gifts or inheritance In connection with any application for exemption, applicant shall furni the Board of Assessors such evidence of the income or combined income ; the Board of Assessors may require. c. The title to the property shall have been vested in the owner or all of the owners of the property for at least twenty-four (24) consecutive months prior to the date of making application for exemptio d. The property is used exclusively for residential purposes. e. The real property is the legal residence of and is occupied iii whole or in part by the owner or by all of the owners of said propertJ 2. Application of such exemption must be made by the owner, or all I of the owners of the property on forms to be furnished by the Board of Assessors of the Village. Said application shall furnish all the information and shall be executed in the manner required or described i| such forms, and shall be filed each year with the Board of Assessors no! later than December 31st. This resolution shall apply only to Village real estate taxes for the fiscal year commencing June 1st, 1983. Carried. Trustee Gandolfo called for a meeting for November 18th with the finance committee and department heads to discuss four months spending to date. Trustee Gandolfo reported that she, together with Trustee Soriano, Mr. Pound, Dr. Ippolito, and a representative from the Sleepy Hollow Manor Taxpayers Association to discuss the results of the dredging of Fremont Pond. All agreed to meet again with the surveyor which will be within the next two weeks. FIRE Trustee Lofaro stated that a parking situation exists on Dell Strl which is creating a problem for fire apparatus and the department has I suggested that a fire zone be created on the street, * Trustee Lofaro moved, seconded by Trustee DiFelice that a public hearing be held on December 13th on a proposed local law to establish a fire zone on the cul-de-sac on Dell Street. GOVERNMENTAL RELATIONS-SENIOR CITIZENS Trustee Soriano stated that his committee, finance and labor relations committees met to discuss raises for non-union employees and moved that a 5% increase in salary be granted to the following employ retroactive to June 1, 1982, seconded by Trustee Lofaro: F. Fallacaro, I. Amato, S. Canfield, P. Lofaro, G. Thomas, E, Moten, T. Maroney, V. M. Apollonio, J. Biros, A, Everett. The Police Chief has already been given his raise. Carried. �Trustee Soriano moved, seconded by Trustee Lofaro that actftn of the governmental relations committee in purchasing a gestetner machine which will be used basicly by the senior citizens under the supervision of the recreation department in the amount of $2021 be confirmed and that the cost of the machine be taken from CDA funds. Carried. In connection with the forthcoming Village election in March, 1982, Trustee Soriano movedf seconded by Trustee Lobato that the following be adopted: WHEREAS the next general Village Election for officers will be held on March 15, 1983, and WHEREAS the Board of Trustees must designate by resolution and publish the offices which are to be filled in such Election and the terms thereof, NOW, THEREFORE, BE IT RESOLVED: Section 1. That the Board of Trustees designates the following offices as vacant at the end of the current official year, to be filled at the Village Election to be held on March 15, 1982 for the following terms: Mayor - two years; Trustee - two years, Trustee - two years, Trustee - two years. Section 2. The Village Clerk is hereby directed to publish the resolution in full in the Daily News, a newspaper of general circulation within the Village. Section 3. This resolution shall take effect immediately. Carried. Trustee Soriano stated that a public hearing had been scheduled for November 15th regarding the heat temperature to be maintained in apartments. However, since the meeting, the Village Attorney received a memo from the building inspector that the minimum standards for heat noted by the County are incorrect. The inspector will notify the Board of the specifics of this error. Trustee Soriano moved, seconded by Trustee Lobato that the scheduled public hearing for November 15th be rescinded at this time. Carried. Trustee Soriano stated that we are in receipt of a letter of resignation from Miss Josephine Chessari from the Senior Citizens Commission and moved that Mrs. Fannie D'Alessandro be appointed to fill the unexpired term of Miss Chessari, seconded by Trustee Gandolfo. Cair'.-.i (April, 1985) The Commission will hold a meeting on Monday, Nov. 8th at 7:30 P.M. in the water department to vote on a new chair person, said Trustee Soriano. Trustee Soriano stated that his committee and the finance committee will determine the feasibility as to whether or not we should file ah application for funds for a bus for the senior citizens which will be sponsored by the F.O.E. One of the factors to be considered will be the maintenance of the bus and cost involved. �,ABOR RELATIONS ,. , Trustee Lobato reported that the decertification procedure will go on according to the first scheduled date. A meeting has been schedii for VTednesday. POLICE & LIGHT Trustee DiFelice stated that with regard to the recent action brought against the Village by Ptlmen. Hayes and Patten, the Village received a decision from the Supreme Court dismissing the action of the respondents on the grounds that the petitioners have not exhausted thei administrative remedies. Trustee Lobato congratulated Counsel for his good work. Trustee DiFelice gave the following report for the month of Octotf (copy in detail official minutes) Trustee DiFelice stated that Sgt. Kostelny will be retired on December 1st and a replacement will have to be made to fill the vacancy Trustee DiFelice moved, seconded by Trustee Lobato that on the recommendation of the Chief of Police that two additional Sergeants be appointed to the force on or about December 1st when Sgt. Kostelny will be retired. On the question, Trustee Maceyak stated that he has no objection to replace Kostelny, but was opposed to the creation of another slot fo a Sergeant. Trustee Gandolfo stated that financially, we did not anticipate it in this year's budget and we do not have the money for it. We are top heavy in the department, she said. If we make a new Sergeant, we wouli have a total of eight officers in the department and 14 patrolmen--more than a two - one ratio of officers and patrolmen. I Trustee Lobato stated that the difference of Kostelny's salary .;rl the new Sergeant should even out so that the financial impact will not! be severe. ' Mayor Zegarelli stated that the court case does not order this Boai of Trustees to create a new Sergeant's slot. He stated that he thought they were all in agreement. When the Chief was asked, not ordered, to consider a six month test in utilizing the Lieutenants to a greater de-i we were not given an affirmative answer that it would be tried. He stated that he will not go for an additional Sergeant's slot. He statei that he did not think the financial needs of the community, as a whole, warrants the creation of an additional Sergeant's slot. He also stated! that the second shift has been eliminated at General Motors; in fact, t entire plant is shut down for at least a week. ' Trustee DiFelice stated that if anything happens in General Motors or Mallory's, jobs are going to be cut as in other communities. Trustee Soriano stated that when the budget was prepared last year he had suggested that two Sergeants positions be allocated, however, si>< they were not, we should abide by the present budget. i *» �^ .7. Mayor Zegarelli polled the Board as follows on Trustee DiFelice's motion: Trustee Maceyak - Yes " Gandolfo - No " Soriano - No Mayor Zegarelli voted "No". Trustee Lofaro - Yes " DiFelice - Yes " Lobato - Yes Motion carried. Trustee DiFelice moved that Patrolmen William Patten and Gabriel Hayes be appointed Sergeants in the North Tarrytown Police Department subject to twelve weeks' probationary period, effective December Jp, ffilt 1982, at a base salary of $27,428 per annum, plus longevity. This ii in keeping with four patrol sergeants, he said, Carried. Trustee DiFelice stated that the Chief is requesting a full time youth officer. Trustee Gandolfo stated that when we were putting the budget together, $10,000 was allocated in the Chief's budget for the three men to work as part-time youth officers. Trustee Lobato stated that this is up to the Chief --as long as he gets the job done. The staff is not being changed, he said. Trustee Soriano stated that once you take the man and use him as a youth officer, you lose him as a patrolman. The money has not been utilized, he said. Trustee Gandolfo stated that if we were to get a youth officer, we would have to replace him with another patrolman, The men were told that there was money in the budget for three part-timers. Mayor Zegarelli inquired that if money was allocated and not utilized, where is the need for a full-time appointed person as a youth officer, Trustee DiFelice stated that the reason why the Chief wants a fulltime youth officer is because the money will go towards the detective's salary which will be his official title. Trustee Maceyak moved that a memo be sent to the Chief to attend the work session on November 10th at 7:30 P.M. to discuss with the Board the re-organization of the police department, sergeants, youth bureauf etc., seconded by Trustee Gandolfo. Carried. Trustee DiFelice moved, seconded by Trustee Soriano that 14 bulletproof vests be purchased at $160 each for the police department. Carried Trustee DiFelice stated that the Chief will replace two beds in the women's cell, as well as the replacement of toilets on the east side of the cell block. A discussion arose regarding the porcelain toilets, after which the matter was referred back to committee. �-8Trustee DiFelice moved, seconded by Trustee Gandolfo that meter and alternate side parking be suspended on November 2, 11th and 2 5th. Carried. Trustee DiFelice moved, seconded by Trustee Lofaro that during the month of November, parking ticket fines may be paid at their origii amount without penalty. However, this does not include those cases whei motor vehicle registrations are being held. Carried. With regard to the bus stop shelter program, Trustee DiFelice stated that areas were checked throughout the Village to establish bus stop locations. He stated that the County will come in and post th bus stops and advertising companies will erect the shelters. | Trustee DiFelice moved, seconded by Trustee Maceyak that a public hearing be held on December 27,1982 to establish bus stop areas on Cortlandt Street, Beekman Avenue, Route 9, North Washington Street and Valley Street. Carried. Trustee DiFelice stated that when he was chairman of buildings and grounds, he was endeavoring to get a mural painted in the Board room. He has located a company who would paint the mural. Following a short discussion, Trustee DiFelice moved, seconded by Trustee Soriano that the contract be awarded to Wallgraphics in the amount of $1805, cost to come from the administration funds of CDA. Car Trustee Gandolfo moved, seconded by Trustee DiFelice that Sally Is Dog Control Officer, be granted an increase to $1.50 per mile for the use of her vehicle, not more than 20 hrs. per week, effective Nov. 1, 1 Carried. At this time, Trustee Maceyak moved that a five minute recess, seconded by Trustee Lobato. Carried. PUBLIC WORKS Trustee Maceyak gave the following report: I The water department is repairing defective hydrants. N.Y.C.shutP down the Catskill Aqueduct for one day with no problems to us. A one week shutdown of the Croton Aqueduct is scheduled for November 15th. No problems are anticipated. Trustee Maceyak moved, seconded by Trustee Lofaro that John Vydare be granted permission to ^ttend a factory instrument school of BIF, Pro Rhode Island on November 16-18 with expenses. Carried. Bank balance in the water account as of Nov, 1, 1982 is $20,913.80 Trustee Maceyak read a letter he has sent to the Board (in detail official minutes) regarding the effect the proposed Rockefeller Park wi have on the water supply in North Tarrytown. Permanent blapktop was placed over the excavation for the new drai line on Kendall Ayenue extension and on Clinton Street. r *» �^<W _9- The catch basin at the corrier of Riverside Drive and Hunter* Avenue has been reconstructed, J. C. Perri Company has completed catch basin work in the Manors and Webber Park. Village property on Hudson Street has been cleaned. Part-timers from BOCES are sandblasting and painting plows and sanders. RECREATION Trustee Gandolfo stated that 150 youngsters attended the Halloween Party. Mrs. Linda Perlmutter will give a talk on water colors at the Library. Registrations are still being taken for the Pilgrim Run. -TAX EXEMPT PROPERTY & ASSESSMENT Trustee Lobato stated that his committee is in the process of. developing a model which will show the future effect-of the tax revenue being taken away by the Rockefeller pronosal. He stated that what is extremely important is in connection with any payments that the Village is going to receive. MAYOR'S REPORT: Mayor Zegarelli read a letter from the American Water Works Assoc, informing him that John Biros was selected for an award for his service and contributions in the water works field. Mayor Zegarelli informed the Board that a letter was sent to the D.O.T. requesting parking be returned to Route 9, St. Paul's hill and that the center line also be returned. Mayor Zegarelli stated that he is in receipt of a letter from HUD in regard to points raised by us regarding the closeout of CD.A. Mayor Zegarelli stated that he is in receipt of a letter from the Power Authority regarding increase in electricity rates. COMMUNICATIONS Communication from Lawrence Kosilla, Sec'y. of Fire Council, regardi changes in personnel in Fire Patrol and Columbia Hose Companies and requesting exempt certificates for Joseph Pulsoni and Wilson Brown of Fire Patrol Company was read. Trustee DiFelice moved, seconded by Trustee Gandolfo that action of Council be confirmed and exempt certificates granted. Carried. Communication from David Levine, 516 Bellwood Avenue, requesting sidewalk repairs was read and referred to public works committee. •• �Communication from Josephine Chessari resigning from the Senior Citizens Commission due to health reasons was read, Mayor Zegarelli moved, seconded by Trustee Soriano that Miss Chessari*s resignation be accepted with regret. Carried. Communication from Curtis Heath, Chairman of the Conservation Coun regarding a tree on property of Barkley Rice, Hunter Avenue, was referr to public works. Communication from Larry Rodrigues requesting permission to instal three amusement devices on his premises was referred to Chief Spota, Trustee Soriano moved, seconded by Trustee LqJaatA. that the Mayor be authorized to sign the agreement between the ^ufeite^tt and Village for snow removal on State roads under protest. Carried. Counsel asked the Board's pleasure regarding a letter from Transit Casualty who have claimed the Village as contributory negligence in th car accident by the Assistant Fire Chief and a bus company. The corapa is willing to send the Village a check for 507o of the Village's loss. Our insurance carrier has informed us to accept this award. Trustee Gandolfo moved, seconded by Trustee Soriano that the Villa accept the award of 50% of the loss in damages to the second assistant Fire Chief's car. Carried. UNFINISHED BUSINESS Trustee DiFelice noted a recent article in the newspaper regarding clemency for J. McGiven who was involved in the death of Sheriff Williai Fitzgerald of North Tarrytown and moved that a strong letter be sent to the Honorable Mario Cuomo to protest this clemency, seconded by Trustee Maceyak. Trustee Maceyak stated that the sign on the Strand Roller Skating rink was struck by a vehicle and suggested that it be investigated to ascertain whether or not it was over-extended, Trustee Gandolfo stated that the Village Prosecutor, John Tucciar attended the work session of the Board. Court was not held last Thurso; so matters were put over to this week. She stated that Mr. Tucciarone was informed of another matter of a building that was burned out on Cortlandt Street and that he was told to meet with the bailding inspect! to take the necessary action. The Board will cooperate with the build: inspector, she said. Trustee Maceyak inquired about condemnation proceedings on the vacani lot on Pocantico Street. Counsel stated that formal procedure would have to be taken, howevi he will review the matter in detail and report back to the Board. With regard to the hearing on an increase in handicapped parking penalties, Trustee Maceyak moved seconded by Trustee Gandolfo that following Local Law be adopted; The Board of Trustees of the Village of North Tarrytown at a regular meeting assembled and after published notice and public hearing do hereby ordain and enact Local Law #7 of 1982 which amends Local Law #3 of 1981, section 57-79, subdivision B of the General Code of the Village of North Tarrytown entitled "Parking for the Handicapped" as follows: All vehicles parked in violation of the statute herein or those vehicles that fail to display the necessary handicapped permit shall be punishable by a fine of not less than twenty-five ($25.00) dollars for each and every offense. law. CHAIRMAN PUBLIC INCORPORATED 1B74 WORKS November 1, 1982 Mayor & Board of Trustees Municipal Building North Tarrytown, New York Gentlemen: 10591 The water supply and distribution basic system of the Village begins with a supply intake at the northeast corner of the Village with a single 16" transmission main, (constructed in 1925) , carrying water to the Village proper and then to the residential areas of Philipse and Sleepy Hollow Manor reducing in size to a 6" supplying the Phelps Memorial Hospital in the Northwest corner. The hospital being a major water user, constructed a storage tank on their property in order to maintain adequate pressures during periods of peak demand and to maintain continuity of supply. This tank has substantially exceeded its design life and a major reconstruction will be necessary in the not too distant future. A 20" water main along the northern boundry of the Village (Northern Loop) would remedy the problem by "looping" the distribution system and thus being able to feed the grid from either the north of the south. A more economical construction would occur if we moved the "loop" somewhat further north to emerge in the vicinity of the hospital entrance. Some time ago IBM built a facility adjacent to and just north of the hospital. This facility is presently being served by a private water company and has had a number of interruptions in water service. From the foregoing it appears that a number of beneficiaries exist in* the construction of the "northern loop". In summary then: 1. The Village gains by providing continuity of service in the event of a failure of the single existing transmission main. 2. The hospital will have the continuity of service without reliance on a storage tank on their property, a tank which will need reconstruction in the forseeable future. 3. IBM will be able to avail themself of an emergency connection. [ 4. The state will have adequate water supply to provide fire protection to the area to be acquired. !
