December 13, 1982 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor Stephen Maceyak Janet Gandolfo Peter Soriano Joseph D. Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J, Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Mayor Zegarelli stated that this week, the Village will be celebrating its 108th birthday and we have geared this celebration to the unveiling of the mural depicting the Headless Horseman. Trustee Soriano moved, seconded by Trustee Maceyak that the minutes of the meeting held on November 15, 1982 be approved with a minor correction. Carried. Mayor Zegarelli read the notice of hearing on a proposed Local Law amending Section 57-20J of the General Code entitled Dell Street Circle Fire Zones, adding two additional zones and asked if there was anyone present who would like to address the Board. Mr. Joseph Vandenzeren, 115 Highland Avenue, requested an explanation! as to where the zones would be created on Dell Street, after which Trustee DiFelice pointed,out the area on the north side of Dell Street circle commencing at the driveway of 49 Dell Street running 26 ft. into the Dell Street circle and on the south side commencing at the southerly edge of said circle running 26 ft. into the circle. No other comments, Trustee DiFelice moved, seconded by Trustee Gandolfo that the hearing be closed. Carried. The matter was referred to the Board as a committee. Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter. Miss Debra Lovecky, 1 Riverside Drive, stated that she was here tonight to discuss the article appearing in the Daily News regarding stickers which were issued to tenants at 1 Riverside Drive. She stated that the article was erroneous and false and said that some trustees have said that they wanted something without paying for it. She stated that the tenants pay for one space. It was agreed that the residents would receive one sticker--one per family. The agreement was made whereby the residents would buy one sticker so that no one would be discriminated against, she said. One space would be reserved for a family. <-,,_., �-2Mr. Kenneth Booth, 1 Riverside Drive, stated that he concurred with Miss Lovecky. Noting the article in the Daily News, he stated that he resents the fact that anyone would think he would become part of a deal'made in the backroom. He stated that the residents were opposed to the parking on the street, but will go along and obey the law. He stated* that he resented the statement that residents of Riverside Drive were the recipients of an underhanded deal. Mr. Thomas Cavalieri, Webber Avenue, stated that he was on the Board at the time and that the tenants were in need of relief, but he did not remember a resolution being passed. He agreed with Mr. Booth about the free sticker. Miss Priscilla Lovecky, 1 Riverside Drive, inquired as to who gav permission to install the signs and Mayor Zegarelli answered that the signs were installed when the street was abandoned. It was the Villag intention all along to provide parking for the residents just as it ha for the system of permits, when Trustee Gandolfo stated that/we had undedicated Riverside Drive, we set up a two tiered fee schedule for residents and non-residents. Then, pursuant to questions by the residents of 1 Riverside Drive abou commuters taking their parking spaces, we set off a section of the bio for them to park, Noting that the article was critical, Trustee Lobato stated that did not think any discussion or criticism was directed to residents of Riverside Drive, He stated that the Village cannot make a gift of J Village property. The people at 1 Riverside Drive would get the samel as everyone. He suggested that the matter be discussed with the polil committee and Chief, He also suggested changing the decal system. I This should be done properly and legally, he said. Miss Lovecky stated that a resolution was passed on Sept. 15, 198 that residents would pay $12 per year for parking stickers. Trustee Maceyak stated that if anyone was insulted, he would apologize for that, however, he was trying to find out if the free stickers was a resolution in the Board minutes, If the Board did not pass it the right way, we will pass it the right way now, he said. He stated that if the auditors come in, they will criticize the Board for giving away stickers. Trustee Maceyak stated that this matter stemmed from a complaint he received. He stated that he found no resolution that showed that free permits were to be issued. He was not against anyone at 1 Rivers Drive, said Trustee Maceyak, however, the issuance of tree stickers is illegal and cannot be done, Mayor Zegarelli stated that the Board has had thirteen different meetings on the subject and at the recent meeting of the Board a resoli tion was passed to the effect that no free permits will be issued to residents of 1 Riverside Drive, whether it be per family or a single person, �^Ra -3Following a discussion, Mayor Zegarelli instructed the police committee and Chief to hold a meeting with residents of 1 Riverside Drive to resolve the matter. Mr. Daniel Malone, 44 Dell Street, stated that he is the last house at the end of the circle on Dell Street and stated that the parking situation is hectic. During a discussion, Mayor Zegarelli stated that the matter will be discussed prior to any local law being adopted, Mr. Ronald Green, local Boy Scout representative, presented on behalf of the Boy Scouts, a plaque to Mayor Zegarelli, Chairman of the fund-raising drive, for his efforts in achieving the goal of $15,000 for the Boy Scouts, Mr. Michael Hyland, on behalf of the Democratic Party, presented the Board with a cake in honor of North Tarrytowns 108th Birthday. It was accepted with the thanks of the Board. Mr. Larry Kosilla, Howard St., stated that there are problems on route 9 between the north and south gates of the Manor whereby the narrowing of the road has caused several accidents. Trustee Soriano stated that the road has been widened as far as it can go, however, the matter should be brought to the State's attention. Mayor Zegarelli stated that the Board is on record on it, however, referred the matter to the governmental relations committee for a follow-up, REPORTS OF COMMITTEES ADMINISTRATION & CONSTRUCTION Trustee Soriano noted two letters from Ron Turnquist, the architect for the new Village garaget FINANCE & REAL ESTATE Trustee Gandolfo reported a balance of $86,979,87 in the General Fund as of December 13, 1982. Trustee Gandolfo moved, seconded by Trustee Lobato that action of the Treasurer in depositing a certificate of deposit in the amount of $400,000 ar/jgjo for thirty days with the First National Bank of North Tarrytown be confirmed by the Board, Carried. Trustee Gandolfo stated that work at Fremont Pond was today and moved that the final payment be approved to Aqua amount of $8900 provided that we receive approval from the Manor Taxpayers Association, seconded by Trustee Lofaro. completed Dredge in the Sleepy Hollow Carried. Trustee Gandolfo stated that Somers Contracting Co. submitted a voucher for the remaining payment for work on the new Village garage, however, as per a meeting with Ron Turnquist, the pumps in front of the building has not been installed and there is no heat in the building. �-4Following a discussion, Trustee Gandolfo moved, seconded by Trusi DiFelice that payment be withheld for both Somers and Turnquist at thi time. Carried. Trustee Gandolfo moved, seconded by Trustee Lofaro that Herlihy Donovan bill be paid totaling the amount of $9,411.00. Carried. FIRE Trustee Lofaro stated that the Ambulance Corps has requested tabl and chairs for their quarters. A part on Union Hose apparatus will be repaired, said Trustee Lofaro, LABOR RELATIONS Trustee Lobato stated that we are still waiting out some of the PERB proceedings concerning certification and decertification regardiii the union representing the blue collar workers and an attempt of the teamsters to gain the reputation. The election will be held after tto 20th, he said. Counsel Ponzini stated that the certification date is the 17th and the election will be held sometime after that; the second or thir week of January. POLICE & LIGHT - Trustee DiFelice stated that the police committee met and held I interviews with candidates for patrolman and after discussion with th! Chief, a recommendation was made. Trustee DiFelice moved, seconded by Trustee Maceyak that John Thomas be appointed patrolman in and for the Village of North Tarrytow subject to twelve weeks' probationary period, effective December 19, 1 at a salary of $17,135 per annum. Carried, Trustee DiFelice stated that the committee has been looking for a unloading zone for tractor trailers. The trailers were temporarily unloading on North Broadway, between Chestnut and College Avenue. Trustee DiFelice moved, seconded by Trustee Maceyak that a public hearing be held on January 24, 1983 to create a permanent unloading zone for tractor-trailers on the east side of North Broadway (route 9) between the hours of 8 - 5 P.M., Monday-Friday. Carried. Trustee DiFelice stated that a problem existed with the jail lock and a locksmith from White Plains repaired them. With regard to the porcelain toilets for the jail cells, Trustee DiFelice stated that we are waiting for flushometers to find leaks inl order to determine which porcelain toilets will have to be replaced. I Trustee DiFelice read a letter from Vilma Ledesma resigning from" her part-time job as a typist and moved that Karen Guardia be appoints as a Clerk-Typist at the prevailing wage, no more than 17 hours per wei seconded by Trustee Maceyak. Carried. �^ > -5Trustee DiFelice moved, seconded by Trustee Lobato that meter parking be suspended on December 24th and 31stf Carried. Trustee Soriano moved, seconded by Trustee DiFelice that Village offices be closed December 24th and 31st. Carried. Trustee DiFelice moved, seconded by Trustee Maceyak that overtime payment totaling $25,500 be paid to members of the police department. Carried, Trustee DiFelice noted the police report for the month of November. (Report in detail official minutes) Trustee DiFelice reported that Ptl, Robert Nevelus graduated from the Municipal Training School on December 10th. Trustee DiFelice stated that Ptlmen. W. Schrank and Kiggins and their dogs were certified by the North American Police work Dog Association. Records will be placed in their folders, Trustee Maceyak movedf seconded by Trustee Lofaro that a letter of congratulations be sent to the officers. Carried, Trustee DiFelice stated that Chief Spota will attend a personnel seminar in Valhalla at no cost to the Village. Trustee DiFelice read a request of Lt, Brophy to attend the Remington Model 870 (Shotgun) Seminar at the Police Armor School in Ilion, N.Y. on Sept, 8 and 9, 1983 at a cost of $56 for motel fees and so moved, seconded by Trustee Lofaro that this amount be placed in next year's budget. Carried, Trustee DiFelice read a request from Lt. Brophy to attend the Smith & Wesson Police Armor School in Springfield, Mass. on Sept. 26-30 at a cost of $110 for motel fees and so moved, seconded by Trustee Maceyak that this amount be placed in next year's budget. Carried. Trustee DiFelice read a letter from Robert Buckley, Radiological Officer, Westchester County Dept, of Public Safety, that 23 officers from the North Tarrytown Police Department have been trained in radiological emergency response courses at the Fire Training Center. Trustee DiFelice noted a voucher submitted by Ptl. Nevelus requesling payment for mileage to and from the training school and the matter was referred to the police committee, PUBLIC WORKS Trustee Maceyak reported routine flushing of sanitary sewer lines with the sewer jet. Repairing leaking hydrant on Valley Street, All fire hydrants in the Village are being winterized. Bank balance in the water account as of December 13th is $32,146.07. Remaining leaves were picked up with vacuums and effective Saturday, residents must comply with the placing of leaves in container and placed at the curb on Mondays and Thursdays, �-6Sand barrels have been placed at usual locations. Most donated. Blacktop has been placed on Clinton, Depeyster Streets and Belbo Avenue. .. Woo During the first snowfall, sanding-salting began approximately 1 P.M. Friday night. During the second storm on Sunday morning, sandin began at 7:00 A.M, Trustee Maceyak complimented Mike Apollonio and his men for their work in keeping the roads clear. The highway vehicle paint work has been completed and work will commence on water department equipment. Job interviews will be held on Saturday, Trustee Maceyak reminded residents that they must shovel their sidewalks after a snowstorm. Trustee Maceyak complimented John Biros for his efforts to obtaii a grant for 3/4 of the money spent on the new Village garage. Trustee Maceyak read a letter from Henry Ludwig, III, submitting his retirement date of December 2, 1982 and moved that his retirement be accepted, seconded by Trustee Lofaro and a letter of thanks be sent to him. Progress is being made on the interfait housing program, he said. * Trustee Gandolfo stated that when salaries were given to non-unio personnel, the increase was not included for the CDA Director and move that William Doorley's salary be increased from $6000 to $6600 per yef the amount to come from CDA funds, seconded by Trustee Soriano. Carried. RECREATION & PARKS Trustee Gandolfo gave the following report: �<^y -7The fall/winter programs will be concluding next week. Included in the program brochure are badminton, youth basketball, box lacrosse, floor hockey, jogging, aerobics, horticulture, karate,racquetball and many more. Ski trip to Belleayre Mountain on Saturday will cost $27. Ski trip on Sunday to Jiminy Peak will cost $31. Tarrytown Lakes will open up for ice-skating. is $2 for the entire season. Cost for residents The Christmas tree in the lobby was decorated by Gary Thomas, said Trustee Gandolfo. TAX EXEMPT PROPERTY & ASSESSMENT Trustee Lobato stated that about three years * ago, an audit report picked up the taxable status of 100 College Avenue and moved that Counsel be directed to thoroughly investigate the problem for a difinitiv answer in a memo, seconded by Trustee Maceyak. Carried. MAYOR'S REPORT Mayor Zegarelli acknowledged receipt of various documents and letters from Counsel concerning Arnell Construction Co., Attorney John Pasquini regarding the Richard Dunn matter, Lehrman and Krotnick, Attorneys for #12 & 14 Lawrence Avenue, Mayor Zegarelli stated that a letter was sent by Judith Conway of the Warner Library to him that the present contract between Tarrytown and North Tarrytown states that the library budget must be presented to the Villages by December 15th and that the library board would like permission to extend the deadline to January 15th because pertinent information is not available at the present time, etc. Trustee Soriano moved, seconded by Trustee Gandolfo that the deadline be extended to January 15th. Carried. COMMUNICATIONS Communication from Gwenn Sussman, 203 Harwood Avenue, requesting sidewalk repairs was read and referred to the public works committee. Communication from Sec'y. of Fire Council, Lawrence Kosilla, regarding changes in personnel in Fire Patrol, Pocantico and Union Hose Companies was read and on motion of Trustee DiFelice, seconded by Trustee Soriano, action of Council be confirmed by the Board. Carried. Communication from Curtis Heath, Chairman of the Conservation Council, recommending that the tree, which was requested to be removed by Mrs, G. Scappaticci of 59 College Ave., be retained was read. Mr. Heath stated that the tree appeared to be healthy. The party involved is to be notified, i �-8The Clerk stated that a dance permit was issued to the Cuban Clul for the date of December 4th and Trustee Soriano moved, seconded by Trustee Lobato that action of the Clerk be confirmed by the Board. Carried. The Clerk noted a letter on each Trustees desk from Howard Lamp who is requesting a balance of $265.70 in consultant fees for the St Paving Grant a couple of years' ago. The matter was referred to the Board. UNFINISHED BUSINESS A discussion was held regarding the hearing on Dell Street Fire Zones, after which Trustee Lofaro had moved to adopt the local law which was seconded by Trustee DiFelice, however, noting the remarks from several residents, Trustee Lofaro moved to rescind his motion as did Trustee DiFelice his second, Carried. The consensus of the Board was to wait until a recommendation is received from the Fire Chiefs. Trustee Lobato inquired about the latest action by Mr. Tucciarone regarding the Day Care Center, He stated that the Prosecutor should keep working at it, Trustee Maceyak stated that the only step now is to close the Day Care Center in accordance with the Code inspections. The Board should keep its hands off, he said, and leave the matter in the hand| of the Village inspector and Village Prosecutor, NEW BUSINESS I Trustee Soriano stated that at a meeting of the senior citizens additional programs were discussed for active citizens and suggested that they be considered as budgetary items. Trustee Soriano moved, seconded by Trustee Gandolfo that the bill submitted on the General Fund and Water & Sewer warrants dated Dec. 13 1982 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attach to the warrants.
