Present Philip E. Zegarelli, Mayor Stephen Maceyak Janet Gandolfo Peter Soriano Joseph Lofaro Mario DiFelice Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel 18 Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Soriano moved, seconded by Trustee Lofaro that the minutes of the meeting held on December 13, 1982 be approved as written. Carried. Mayor Zegarelli read the notice of hearing to consider a proposed local law amending Section 57-18 "Parking Prohibited in designated areas to include additional bus stops in certain areas of the Village and asked if there was anyone present who would like to address the Board on the proposed amendment. Mr. Thomas Pellechi, operator of the Exxon Station on North Broadway, stated that the bus stop at Route 9 and 448 would be a serious hazard to the intersection. He stated that it is a dangerous area. Trustee DiFelice stated that back in 1980, a letter was received from the County Dept. of Transportation requesting Villages to join a uniform bus stop system whereby shelters would be provided by the County. He, together with the Supt. of Public Works, worked with the White Plains Dept. of Transportation, as well as other agencies, said Trustee DiFelice. The State feels that these bus stops should be located on Broadway, as well as on other streets. He stated that most areas are no parking zones. Agreement from the County will be forthcoming. Trustee DiFelice stated that he learned recently that the bus shelter program has been phased out in 1982. We can designate stops and the County will come in and erect signs and hopefully in the spring, we will get into the shelter program, said Trustee DiFelice. On an inquiry of Trustee Gandolfo regarding the signs, Trustee DiFelice stated that they are blue & white signs which would be erected on poles. Dr. Ippolito, speaking in behalf of the Sleepy Hollow Manor Taxpayers Association, stated that they had no objections to the bus shelter program. He stated that they would be welcomed to people waiting for buses and an asset to the community and urged that the program be adopted. 'I �-2Mr. Joseph Ruscigno, No. Washington Street, speaking in behalf of the Senior Citizens, stated that they approve the idea very hearted and that the locations be left up to the Village Board. Mr. Sinnott, 95 Beekman Ave., stated that he thought it was a wonderful idea. He stated that this is one of the communities in the County that does not have the shelters. Mr. Joseph Piedemonte, 95 Beekman Avenue, stated that we could us the shelters. Those who take the bus would appreciate them very m Mr. Joseph Schwer, 95 Beekman Avenue, stated that it was a very g idea, but at the same time, parking spaces are being moved and taken away. People in the Village are looking for spaces. Trustee Maceyak stated that only 2 - 3 parking spaces would be affected. Hopefully, by next summer, he said, the Elm Street parking lot will be completed. No other comments, Trustee Lofaro moved, seconded by Trustee Gandolfo that the hearing be closed, Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter may do so at this time. No one address the Board, the regular order of business was resumed. REPORTS OF COMMITTEES ADMINISTRATION-CONSTRUCTION I Trustee Soriano stated that the Board discussed in a work session payment of bills in connection with the new Village garage. He stated that he did not know where, in any agreement, we were to pay the archi tect for additional work. He stated that there is a deadline in the contract, as well as a penalty clause on the completion of the buildinj We passed the deadline, said Trustee Soriano. He stated that the architect should account for his action. Following a discussion, Trustee Soriano moved, seconded by Truste DiFelice that further payment be withheld to the architect until such time as all legalities are cleared. Trustee Gandolfo stated that the architect submitted a voucher for August, September and October and nothing after that. The problem is with bills from November 15-December 15th, she said, and suggested that Counsel review the original contract. The completion date is thr months late and the Village should have some redress. Trustee Maceyak moved to amend the motion that future payments to the architect and contractors" ~ be withheld pending an opinion from Counsel and discussion of the Board, seconded by Trustee Gandolfo. Motion carried on the amendment. Turnquist be confirmed. Carried. - ' ' t i i! ' ZL *••• Trustee Soriano stated that he did not think it was fair that people who are part-time employees should wait until a contract is signed. He stated that he learned that funds are available for part-time employees!j Trustee Soriano moved, seconded by Trustee Lofaro that all part-time employees be given a 25c increase, effective the first payroll period of January, ($4.25 per hour) <"• • ;. On the question, Trustee Maceyak stated that he was in disagreement until he sees facts and figures. He was not opposed to the increase. i Trustee Gandolfo stated that the amount would be a couple of thousand dollars. She stated that this could be covered in the line item without any amount being transferred from contingency to these funds. Trustee Lobato stated that he would like to have run these through labor relations. Any settlement we make or adjustments will be brought before us during the course of negotiations. The public works department has its next election in January and the police department has already asked that we start negotiations. He stated that he did not know if this proposed raise is in alignment or should be more. Trustee Soriano stated that whenever he had brought this matter up, the excuse was always given that the increase would have a reflection at bargaining time. This has no bearing whatsoever, he said. Trustee Gandolfo stated that we increase in January and this is due, usually give the part-timers an Following a discussion, Mayor Zegarelli polled the board as follows: Trustee Maceyak - No " Gandolfo - Yes " Soriano - Yes Trustee Lofaro - Yes " DiFelice - Yes " Lobato - Yes Mayor Zegarelli voted "Yes" and declared the motion carried. FINANCE & REAL ESTATE K- :< Trustee Gandolfo gave a balance of $77,688,94 in the General Fund as of December 27, 1982, Trustee Gandolfo stated that she received a letter from Dr. Ippolito stating that the S.H.M. Taxpayers' Association stating that although the Association is not completely satisfied by the performance of Mr. Pound, they feel that the job should be accepted as performed to date, (copy in detail official minutes) . Payment was sent to Aqua Dredge as per previous motion, said Trustee Gandolfo, IS' < k 8: FIRE Trustee Lofaro stated that chairs and tables for the ambulance quarters have been received. J£ �-4GOVERNMENTAL RELATIONS-SENIOR CITIZENS Trustee Soriano stated that the citizens held their annual Christmas party which was well-attended and received and enjoyed with the thanks of the citizens, LABOR RELATIONS Trustee Lobato stated that a copy of a letter was received from Joseph O'Connor, CSEA representative, and given to each member of the Board. He stated that some discussions were held with the foreman to explain to him to contract with the Village rather than through a labo organization. The contract is expired and one will not be negotiated until the question of representation is settled, said Trustee Lobato. Mr. O'Connor questions why the Village is negotiating with the foreman since under PERB he would be in the contract, Trustee Lobato stated t he has drafted an answer to Mr. O'Connor's letter subject to Counsel's approval, Trustee DiFelice proceeded to move, seconded by Trustee Soriano that according to a recent memo from Counsel, the Board should talk to no one during this time. Trustee Lobato stated that discussions were held with the foreman There are no secrets, he said, and if anyone was concerned about it, they might have raised an objection at that time. Counsel stated that it has to be determined whether or not the foreman is part of the bargaining unit. If they are members of the un we cannot talk to them. If they are/^art of the bargaining unit, we c talk to them. POLICE & LIGHT Trustee DiFelice stated that the committee met with the tenants o 1 Riverside Drive last week to discuss the parking situation in front their apartment, There are 12 cars involved, he said. The tenants wanted it to remain the way it is, he said. It was resolved that the tenants would purchase a sticker for 1 Riverside Drive with the option to purchase a sticker to park on the street proper. The signs would remain and enforced under police regulations. With regard to a recent request from Ptl. Nevelus for mileage reimbursement for his attendance at the training school, Trustee DiFel quoted resolutions adopted in 1980 that the policy be made that no reimbursement of additional mileage be granted for school attendance. Trustee DiFelice read a letter from Mrs, Rene Gagnon, Hihopac, N. commending Ptl. Caixiera and the Fire Dept. for their quick response in aiding her during a car fire. Copies will be placed in his folder and to the Fire Dept. �^2> "5" ; caJLff aetfre was r e c e i v e d from Mr. Trustee D i F e l i c e s t a t e d that -a ffLctto-ft Simonsen, D.O.T., in answer to our request to reduce the speed limit and painting the center line on Broadway. He stated that D.O.T. saw no reason to lower the speed limit, however, Mr, Simonsen would be down to talk to the Chief regarding the matter. PUBLIC WORKS Trustee Maceyak stated that the water department painted the sewage booster station on Riverside Drive and released accumulated air through air release valves at high points along gravity line to Chevrolet. The department began paitit/ the water department trucks. Bank balance as of December 27th is $37,755.72. The highway department cleaned out catch basins in the Village and Webber Park. Joints in the roadways in Webber Park have been sealed. J. C. Perri has completed approximately half of the reconstruction of catch basins in Webber Park and the Manors. Trustee Maceyak moved, seconded by Trustee Soriano that the amount of $43,890.00 be paid to J. C. Perri which represents payment for work completed less a 5% retainage on that amount. Carried. Trustee Maceyak stated that J, C. Perri will not do anymore work on this contract until spring. Trustee Maceyak stated that the department received its dump truck with sand spreader and plow on December 23rd and moved that Walter Equipment be paid the amount of $89,741 for the truck and Trius, Inc. be paid $4,741 for the leaf vacuum, seconded by Trustee Soriano. Carried. Trustee Soriano stated that the truck was a good choice and very necessary. It is an asset to the Village, he said, Trustee Maceyak reminded residents that Saturday is a legal holiday and there will be no curb pickup this week, RECREATION-PARKS !I Trustee Gandolfo reported that this week*s ski trip is to Catamount on December 30th. On January 2nd, there will be a trip to Jiminy Peak. She stated that 81% of the fall/winter programs that ended earlier this month were successful which is 10% more than last year's fall/winter programs, The winter/spring brochure will be mailed sometime in early January, she said. TAX EXEMPT & ASSESSMENT Trustee Lobato stated that at the last meeting, he raised a question about real estate taxes of 100 College Avenue which was an item in the 1980 audit. He stated that the Village Attorney provided him with background information, The assessment is now on the tax roll as per agreement and the item should not appear in the 1983 audit, he said. m~^ rrtrtV EMI fiTtT*U£:&ui If :!iff �-6MAYOR'S REPORT Mayor Zegarelli stated that the Board discussed a dance permit for New Year's eve in a work session, for the Italian-American Ind. C! and moved, seconded by Trustee Lofaro that action of the Board be confirmed. Carried, Mayor Zegarelli stated that he is in receipt of 1982 legislation which not only both chambers have signed, but the Governor as well. Among the items were reimbursing Village fire officials in the perform of their duties, snow removal expenses, zoning requirements, Boards of Assessment Review which grants to the Village the option to form a Boa of Assessment Review. He stated that the Board should think about members for this Board. UNFINISHED BUSINESS Trustee Lofaro stated that the Fire Council had approved the fire zones on Dell Street and moved, seconded by Trustee Soriano that the following Local Law #9 of 1982 be adopted: (Local Law #9 of 1982 entitled "Dell Street Circle: Fire Zone lanes established in detail official minutes) In connection with the public hearing on bus shelters, Trustee DiFelice moved, seconded by Trustee Soriano that the following Local Law #10 of 1982 be adopted: (Local Law #10 "Parking Prohibited in designated areas" in detail official minutes) I I NEW BUSINESS Trustee Maceyak stated that the building inspector has summoned the owner of 21 Beekman Avenue for violations and the time limit has passed. After a discussion, it was the consensus of the Board to meet wit the Village Prosecutor and building inspector on January 6th to discus 21 Beekman Avenue. Trustee Maceyak noted a memo from the Village Attorney regarding Riverside Drive parking. Trustee Lobato suggested that upon receipt of correspondence, the Clerk should stamp the day and time it was received. He also suggest that when a department head gives a memo to their chairman or committe a copy of same should be given to all members of the Board, particular where he would be required to sign the memo. Trustee Soriano stated that several senior citizens had a problem of a planned bus trip to Florida which did not come about and he is i endeavoring to recoup the deposits that the people have paid with the! aid of HELP, I �*rs 7 j! The fire zone or lanes hereafter described or hereby established for a certain portion of the parking area located in the Dell Street circle area; k h » (1) A fire lane located on the north side of the Dell Street circle commencing at the edge of the driveway of that premises designated as 49 Dell Street and running thence 26 ft. into the Dell Street circle, as posted. it i (2) A fire zone located on the south side of the Dell Street circle commencing at the southerly edge of said circle and running thence 26 ft, into said Dell Street circle, as posted. if i (3) Such area shall thereupon be marked with standard police signs and/or such other markings deemed necessary and proper by the Fire Chief indicating that said above-described area is a restricted fire zone or lane. B. *£he parking or remaining standing or placing thereon, at any time, of any automobile, truck, motorcycle or other vehicle or any other physical object or material within such restricted fire zone or lane is hereby expressly prohibited. C. Any person, firm or corporation violating the terms of Subsection B hereof shall be punishable by a fine of twenty ($20,00) Dollars for each and every offense; in addition, violator of any of the provisions of Subsection B hereof shall be deemed to be disorderly persons and shall be punishable as such.
