November 28, 1983 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor \% Stephen Maceyak Vincent Buonanno William McBride Joseph D. Lofaro James J. Timmings Emmanuel J. Lobato, Trustees i ' Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. u f' Trustee Lobato moved, seconded by Trustee Timmings that the minutes of the meeting held on November 14, 1983 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so. Mr. John Gasko, owner of Coffin Tree Co., made several suggestions to the proposed tree law. He suggested that a permit be obtained for the removal of a tree on properties of 2 - 3 acres instead of one acre. The property owner should obtain the permit also, he said. The tree man would not have any knowledge of the laws of that particular municipalit; He also stated that tree men are competent and it is not necessary to have a commission member supervise the tree removal. >i. Mayor Zegarelli stated that Mr. Gasko's suggestions are well-taken. He stated that he has received suggestions regarding the commission's ability to collect fees that reside with the Village government, particular the Village Clerk and Treasurer. Changes can be made to streamline the proposed law, said the Mayor. He stated that something could be considered for those people who own less than 2 or 3 acres of property. V.v/ Mr. Heath stated that he would not like to see a small landowner having to obtain a permit. Following a discussion, Mayor Zegarelli suggested that Counsel, together with Mr. Heath and Mr. Gasko meet to discuss the suggested changes and report back to the board. REPORTS OF COMMITTEES PUBLIC WORKS Trustee Maceyak gave the following report: The Water department is winterizing hydrants throughout the Vilfage ,' 1 T-" I»III u.i-i,»iii •/' • . i^wpywi »wm �-2Hydrants No. 5 on Sleepy Hollow Road and No. 15 on County House Roai have been repaired. Operated air releases along entire length of gravity line. Trustee Maceyak moved that the Village of North Tarrytown impose special assessment of $80 for the supply and installation of remote reading water meters. The $80 to be paid in quarterly installments of $10 each, effective July 11, 1983, said billing to be in addition tot! regular bill for water consumed in that quarter, seconded by Trustee Buonanno. Carried. Bank balance as of November 28, 1983 is $16,900. All available men and equipment are being used to remove leaves. Trustee Maceyak proceeded to make a motion to borrow $15,000 for the replacement of the cab on the Mack sanitation truck. To replace the entire truck would be too expensive, he said. Trustee Timmings suggested that legal opinion be obtained to ascertain whether or not competitive bidding is necessary. Following a discussion, the matter was referred to Counsel for a legal opinion. Trustee Maceyak stated that the committee will hold interviews for sanitation man on December 7th at 8:30 P.M. Trustee Maceyak moved, seconded by Trustee Timmings that the job of sanitation man be posted and that the Clerk be instructed to send out letters to applicants. Carried. POLICE & LIGHT Trustee McBride stated that the suburban for the police department has been received and is now being painted. It should be in service within a week. Trustee McBride stated that we have received the Infrared Intoxily through the Westchester County STOP-D.W.I. Program Grant. The Chief ha also applied for reimbursement for the additional training of our five breath test operators which has been granted, said Trustee McBride. Trustee McBride stated that the prisoner transportation reimbursei contract with the "County of Westchester is now in effect. The Village will receive $40, including meals, per trip. FINANCE & REAL ESTATE Trustee Buonanno reported a cash balance of $498,090.56 in the Gen Fund as of November 28, 1983. TAX EXEMPT Trustee Lobato reported "progress". �/9y -3LABOR-GOVERNMENTAL RELATIONS Trustee Tinmiings stated that a negotiation session has been scheduled with I.B.T. at their union hall for Wednesday, November 30th, at 8 P.M. He stated that he prepared notes which he disbributed to the committee. Trustee Timmihgs stated that we also have a session with Perb on December 8th. We will have to select among ourselves who the Village representative will be, he said. 79 College Avenue A meeting will be held after this Board meeting. RECREATION-SENIOR CITIZENS Trustee Maceyak moved, seconded by Trustee Buonanno that the following bids be awarded for recreation equipment: Todd-Phelps - $2515.1£ Allen Sports 224.79 Kensico Sports, Inc. 206.00 ]l%l3ii^ Patchogue Surgical Co., Inc. $117.1-2 Parsson's Sports $52.10 The Athletic Reconditioning Co. - $495.42 Three teens from the Boces Walkabout Program are presently working in Douglas Park painting equipment, installing a picnic table, cleaning paths and picking up garbage. This volunteer program is co-sponsored with the Irvington Rec department. The boys will spend six days in North Tarrytown and six days in Irvington. Programs being offered in our department are hockey, mother-child playgroup, volleyball, ceramics, typing, racquetball, dog obedience, aerobics, teen gym night. Twenty children participated in our second bowling trip on Nov. 5th. Ten people attended the seminar on watercolor at the library on November 5th. 250 children attended the annual Halloween party sponsored with the Tarrytown Recreation Dept. Eight children were home on Halloween night when the North Tarrytown Great Goblin called. 110 residents of the Tarrytowns participated in the annual Pilgrim Run on November 13th. Trustee Maceyak stated that Pat Lofaro met with the architect from Urban County on a grant. A meeting will be held with the recreation commission and committee and any other member of the Board on Nov. 30th in the court room to discuss Memorial Field and handicapped parking. �-4ADMINISTRATION Trustee Buonanno stated that the telephone system in the buildi is thirty years old and in need of review and upkeep. The telephone company reviewed the system and has recommended a new system which w save the Village money and would update the equipment. Trustee Buonanno moved, seconded by Trustee Timmings that the Village Treasurer be authorized to sign a document of intent with the telephone company for the Village offices. Carried. Trustee Buonanno stated that because of holidays in December, there would be a conflict with the Board meeting and moved that only one meeting be held during the month of December, said meeting to be held on December 12, 1983, seconded by Trustee Maceyak. Carried. Mayor Zegarelli stated that this would be traditionally the anniversary night meeting which reflects the incorporation of the Village. Appropriate refreshments will be served, he said. Trustee Buonanno reported that the Board discussed the PERMA insurance which is being entered into by other municipalities. The representative explained the workings of the program. This insurance would save the Village money and is considered better than the existi company we now have. The company will set up a safety program also, said Trustee Buonanno. Trustee Buonanno moved, seconded by Trustee Lobato that the following resolution be adopted: WHEREAS, the Village of North Tarrytown seeks to provide worker compensation protection for its employees who sustain personal injuri arising out of and in the course of employment, pursuant to the provi of the Workers' Compensation Law; and WHEREAS PERMA, a corporation established by direction of the Executive Committee of the New York State Conference of Mayors and Ot Municipal Officials, has been organized to establish a program of ris management, including one or more risk management plans, loss control administration of claims and other services for workers' compensation claims against New York Public employers, and to provide management therefore; and WHEREAS PERMA has contracted with qualified service organization to provide claim services, loss control, actuarial services, legal services, investment services, and other services • in connection with the administration, evaluation, payment and disposition of workers' compensation claims; and WHEREAS it is desirable for, and in the best interest of.theVil of North Tarrytown to agree with PERMA to administer, service and pay its workers' compensation claims; and WHEREAS PERMA has agreed to provide such services and protectio �:*^^ /f? -5NOW, THEREFORE, BE IT RESOLVED that the Village of North Tarrytown join PERMA as a member organization, and hereby execute a membership agreement; and BE IT FURTHER RESOLVED that the Village of North Tarrytown join the risk management workers' compensation plan of PERMA and, pursuant thereto, PERMA shall administer,, service and pay all valid workers' compensation claims of the said public employer's employees; and ;«fi i'< . » hi BE IT FURTHER RESOLVED that Philip E. Zegarelli, Mayor of the Village of North Tarrytown be, and hereby is authorized and empowered to execute a contract with PERMA to provide for statutory workers' compensation coverage and related risk management services for the Village of North Tarrytown for such coverage and services; and such individual is further designated as the permanent representative of the Village of North Tarrytown as a member of PERMA and such individual is further authorized to designate an alternative representative from time to time. A On the question, Mayor Zegarelli stated that since he serves as a director, he would designate someone to serve on the PERMA board. Mayor Zegarelli polled the Board as follows: Trustee Maceyak Yes " Buonanno - Yes McBride - Yes Trustee Lofaro Yes " Timmings - Yes " Lobato Yes Mayor Zegarelli - abstained. Motion carried. Trustee Buonanno moved, seconded by Trustee Timmings that the Village Treasurer be authorized to notify the State Insurance Fund that we will not be renewing our policy with them on January 1, 1984 Carried. ; FIRE .: M Trustee Lofaro moved the following, seconded by Trustee Buonanno: RESOLVED that the Village of North Tarrytown reject all bids previously submitted for the Rescue Hose fire apparatus and related equipment, said right to reject all bids, having been provided for in the notice to all bidders ~... I!" Mayor Zegarelli amended the motion that all checks be returned to the bidders, seconded by Trustee Lobato. Trustee Lofaro reported that someone poured acid over the First Assistant Chief's car while it was parked. General Motors was askec if it could be repainted, but we were told that it would not be wortf it, said Trustee Lofaro. A committee meeting will be held to discus! action to be taken. MAYOR'S REPORT: Mayor Zegarelli noted communication from the Division of Equalization and Assessment regarding options that the Village may take to terminate local taxing jurisdiction and assuming jurisdiction of anotlj agency, such as the Town. Mayor Zegarelli stated that a letter was received from Con EdisoJ regarding a cut-off notice on Sylvester Williams because of non-paymej of his electricity bill. Mayor Zegarelli stated that permission was granted to Congressman Ottinger's office to use his office one day per month. The next use will be on December 6th. In connection with the Bi-Centennial closing of Washington Irvinj death, Mayor Zegarelli stated that services were held for Washington Irving on Sunday. Congratulatory messages were received from the President and Governor, said the Mayor. Mayor Zegarelli stated that a presentation was made by the Scenil Hudson, Inc. of New York regarding the scenic roads program in designi that part of route 9 in the Village of North Tarrytown. Trustee Buonanno moved, seconded by Trustee Lobato that the following resolution be adopted: WHEREAS, the Village of North Tarrytown recognizes the important of its scenic resources and cultural heritage; and WHEREAS, the New York State Department of Environmental Conservaj tion has undertaken a study of scenic roads in the Mid-Hudson Valley directed by the New York State Legislature; and WHEREAS, certain roads have been identified as eligible for Scenj Road designation under Article 49 of the Environmental Conservation Lj including Route 9 in the Corporate limits of North Tarrytown; and WHEREAS, the goals and objectives of the proposed Scenic Roads Program are as follows: 1. To strengthen the regional identity of the Hudson Valley by identifying its unique scenic qualities and their regional unity and integrity; 2. To promote a greater awareness of the aesthetic qualities of the valley on the part of its residents and visitors through an educational program which would support the enhancement of the Valley's scenic, ecological, cultural, and historic attributes; 4. To provide economic benefits to the Valley through increased tourism and through the preservation and enhancement of the landscape resulting in increased property values; v'» ill; 5. To provide a sound implementation strategy consistent with the values of each participating community through State and local cooperation; and 6. To establish a viable model for a scenic road program which can be applied throughout New York State. WHEREAS, these goals are beneficial to the community and worthy of our support; now, therefore, be it ft RESOLVED, that the Village* of North Tarrytown urge adoption of the Scenic Roads Program, and be it further RESOLVED, that designation of Route 9jas a Scenic Road under Article 49 of the New York State Environmental Conservation Law is supported by this body. Carried. Mayor Zegarelli stated that he is in receipt of a letter from Gail Schaeffer, Secretary of State, concerning the adoption of the new uniform fire prevention and building code. Trustee Timmings moved, seconded by Trustee Lofaro that the matter be referred to Fire Council for study. Carried. , i .M !"'ift Mayor Zegarelli noted communication from the Department of Planning, Division of Housing, that Rental Rehabilitation Demonstration is being offered to rental property owners in five areas of Westchester County, one of which is North Tarrytown. The program is designed to facilitate improvement of rental properties in these communities by assisting landlords who wish to upgrade their properties, said the Mayor. < l'! The matter was referred to a work session. Mayor Zegarelli stated that he wrote to the owner of 100 College Avenue for a meeting regarding problems, but has not heard from him. tu vkr Counsel was instructed to write another letter. Mayor Zegarelli stated that a letter was received from M.J. Mignogna Department of Transportation, regarding a public information meeting on December 13th at Greenburgh Town Hall to discuss New York State's recent actions to bring its laws into conformance with the requirements of the 1982 Surface Transportation Assistance Act. 'WWPIW p WP >J3j li? h �-8Mayor Zegarelli stated that in connection with the Administrate Manager position, Mr. Sal Prezioso, the outgoing manager of Yonkers would act as an adviser to the committee and Trustee Timmings so mov seconded by Trustee Maceyak that Mr. Prezioso be designated official as a special adviser. Carried. Mayor Zegarelli stated that he sent a letter to the County Executive regarding three bridges in need of care, i.e., Beekman Avenue, Palmer Avenue and the Headless Horseman Bridge. Mayor Zegarelli stated that several appointments are still outstanding. A series of discussions and proposals were held and he reiterated his appointments for confirmation as follows: Village Prosecutor-R. Pierce; Building Inspector-James Margotta; AssessorUgo Checchi; Building Board-Ugo Checchi; Recreation-Eva Piedemonte an E. Tserides; Library-Joan Levy & Tony O'Connor. Trustee Timmings so moved, seconded by Mayor Zegarelli. Mayor Zegarelli polled the>Board as follows: Trustee Maceyak - No " Buonanno - No McBride - No Mayor Zegarelli voted "Yes". Trustee Lofaro - No " Timmings - Yes " Lobato - No Motion not carried. Mayor Zegarelli then suggested that we revert back to Assessor as Joseph Jelenek and Trustee Timmings so moved, seconded by Trustee Lobato. Mayor Zegarelli polled the Board as follows: Trustee Maceyak - No Trustee Lofaro - No " Buonanno - No " Timmings - Yes " McBride - No " Lobato - Yes Mayor Zegarelli voted "Yes". •. Motion not carried. Mayor Zegarelli stated that there are several cases that are outstanding in court which will require a prosecutor. Trustee Timmings moved, seconded by Trustee Lobato that Robert Ponzini be appointed temporary Prosecutor and review outstanding cases for report *to the Board. Carried. Mayor Zegarelli stated that John Biros will continue to act as Building Inspector in the interim. Mayor Zegarelli stated that since we have no assessor, that the Board of Trustees be designated as the Board of Assessors. Any items that come before the roll should be handled by the finance committee, to which Trustee Buonanno objected. A discussion ensued. Trustee Lobato raised a point of order and moved to limit debate thirty seconds, seconded by Trustee Buonanno. �<£&3 -9.f* Trustee Timmings moved to confirm the motion that the Board act as a Board of Assessors, seconded by Mayor Zegarelli. Mayor Zegarelli quoted Section 3-301(b) of the Village Law which states that if we do not designate anyone as an assessor, the responsibility reverts back to the Board of Trustees as a whole or a group of Trustees designated by the Board as the Board of Assessors. if I k COMMUNICATIONS Communication from Mrs. Pauline Geldern requesting sidewalk repairs in front of her property at 86 Beekman Avenue was read and referred to the public works committee. Communication from W. Marmo, President of the Italian-American Independent Club, requesting permission to hold a dance at the UAW hall on December 31st from 8 - 1 2 was read and on motion of Mayor Zegarelli, seconded by Trustee Lofaro permission was granted and police department notified of same. Carried. : i UNFINISHED BUSINESS Trustee Maceyak stated that the annual Senior Citizens Christmas luncheon will be held on December 6th at 12 noon at Marymount. Ml Mayor Zegarelli stated that the week of December 5th should be designated as Senior Citizens Week and Trustee Maceyak so moved, seconded by Trustee Buonanno. Carried. \\ t h Trustee Lofaro stated that Mr. Paul Visconti will have 50 years as a fireman and Stanley Pulaski 25 years. Following a short discussion, Trustee Lofaro moved that the, matter be referred to Fire Council, seconded by Trustee Timmings. Carried. f<\ Trustee Timmings moved, seconded by Trustee Lofaro that the bills submitted on the General Fund and Water & Sewer warrants dated Nov. 28, 1983 be paid after approval by department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants* Carried.
