December 12, 1983 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor Stephen Maceyak Vincent Buonanno William McBride Joseph D. Lofaro James J. Timmings Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flagf. Mayor Zegarelli stated that North Tarrytown will be celebrating its 109th birthday on December 17th and, as in the past, refreshments will be served after the meeting and invited the audience to join in the festivities. Trustee Timmings moved, seconded by Trustee Lofaro that the minutes of the meeting held on November 28, 1983 be approved as read. Carried. Mayor Zegarelli called for bids on a five man canopy cab fire apparatus and equipment. Treasurer Amato opened the following bids: A.A.A. Emergency Supply Co. White Plains, N.Y. Pt. II $21,075 Certified check in the amount of $2107.50 enclosed. Pierce-Tyler Elmira, New York Pt. I (apparatus) $162,566 Credit for 1960 apparatus 6,000 Total $156,566 Bid bond enclosed. Pt. II (Equipment) $20,463 Trustee Lofaro moved to refer the bids to the Fire Committee and Counsel for report back to the Board, seconded by Trustee Lobato. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. �-2Mr. Robert Carpenter, 106 Pocantico Street, inquired as to the status of the structure which was erected by Exxon in their rear of its property on Pocantico Street and North Broadway for which no permit was obtained. Trustee Buonanno stated that he talked to Mr. Biros and was tolt that the individual who rents the property has applied for a permit through Exxon and Exxon will render its decision. We hopefully will have a report within a week, he said. He stated that Exxon would hav to comply with the Village law and if necessary, apply for a variance \ Mr. Ray Dool,M65 Webber Avenue, stated that the lights on the flag poles have been out for sometime. \ Mayor Zegarell^ stated that he did report this in the light book Trustee Maceyak stated that he spoke to Mr. McCarthy and was informed that he was having a problem with the fixture and is checkinj into it. Trustee Timmings stated that flag etiquette states that if there are no lights on the flag, it should be taken down. Mayor Zegarelli stated that flags will be flown at full staff since the mourning period is over. Mr. Tony Vitetta, 134 Cortlandt Street, stated that he has been trying to have cable TV installed in his apartment and is having problems with the neighboring property owner who refuses to allow the cable company to install the wires on his property. He stated that there are 25-30 residents of Cortlandt Street who cannot get cable TV Counsel Ponzini stated that he talked to Rep. Ottinger's office as well as Rep. Gilman's office to intercede for him. There is a change of ownership and new personnel, said Counsel, and hopes that the situation will be remedied. Counsel stated that he will contact the new manager about the problem. On a question of Trustee McBride as to what happens when the abutting property owner refuses to allow cable on his property, Counsel stated that the franchise places a certain responsibility on the company to get those wires in there. Mr. Sylvester Williams, Cortlandt Street, inquired about garbage rules. He stated that he left garbage out on the sidewalk and the men would not remove it. Mayor Zegarelli stated that there is no reason why they should not pick up the garbage and referred the matter to Mr. Biros. Mayor Zegarelli stated that there has been a lot of discussion regarding appointments of individuals and as a result of same, a compromise has been agreed to. �-3Mayor Zegarelli proposed the following names for six positions as a partial compromise: Village Prosecutor - Robert Peirce Village Assessor - Antonio Soares Recreation Commission - Eva Piedimonte, E. Tsekerides Library - Joan Levy Planning Board - James Galgano Trustee Buonanno moved to confirm the appointments, seconded by Trustee Lobato. Trustee Maceyak moved to amend the motion that each individual be voted upon individually, seconded by Trustee Buonanno. Mayor Zegarelli polled the Board on James Galgano, a member of the Planning Board for a term of five years: Trustee Maceyak - Yes Buonanno - Yes McBride - No Mayor Zegarelli voted "Yes". Trustee Lofaro - Yes " Timmings - Yes » Lobato - Yes Carried. Mayor Zegarelli stated that the position of building inspector is still open. Trustee Timmings moved that the salary of Assessor be establish at a rate equivalent to the annual salary in the budget, seconded by Trustee Lobato. Carried. Mayor Zegarelli stated that we may need to adjust it. In connection with the position of Assessor, Mayor Zegarelli read a letter from the N.Y. Telephone Company, Legal Department, informing the Assessor that the N.Y. Telephone Company's 1983 statio equipment assessment of $123,900 for the Village should be reduced t none for 1984 and future tax years. The letter cited various judici and regulatory determinations, including the court-mandated divestit of A.T. & T which have resulted in a reconfiguration of the Bell Sysl network, including the N.Y. Telephone Co. portion of the network. REPORTS OF COMMITTEES Before going into committee reports, Mayor Zegarelli, addressing his remarks to Trustee Maceyak, stated that he could not, at previous times, attend Board meetings and work sessions. He stated that what concerns him and fellow members of the Board that he has not been as attentive to the committees, work sessions and other meetings and tha is why he sent out a memo to the recreation and public works commits that the department heads report to him, as Mayor, until the matter resolved. He inquired of Trustee Maceyak as to where he stands. Trustee Maceyak explained that he apologized at the last meeting for his absences which were due for personal reasons and illness. Wi regard to the interviews which were scheduled, he had called the Village Clerk and told her that because of the bad weather, he would have to work and that she call the other members of the committee to see if they would be here to interview. He stated that he had late talked to Trustee Lobato and he would do the interviews. At 8:30 P.I the Mayor had cancelled the interviews. He stated that he should ha �Ae> f> -5- ! I i. Messrs. Lofaro and Biros to find out if he was abusing his committees. J He stated that he has kept abreast of all activities in his departments.! Trustee Titnmings stated that the Mayor is an ex-officio member of r all committees and should be able to direct any department head to keep ; him apprised of anything. j, Hi f..r Mayor Zegarelli stated that he does not have the authority to remove a Trustee from a committee and stated that it was up to the Trustees to have him removed from his commitees if they so desired. N Trustee Lobato stated that he will remain on his committees. Mayor Zegarelli then asked Trustee Maceyak to give his report. PUBLIC WORKS Trustee Maceyak gave the following report: Repaired hydrants on Washington Street at College Avenue, County House Road and River Street. Balance as of December 12, 1983 in the Water Account is $16,161. Repaired deteriorated sidewalk on Clinton Street. Removed dead and/or diseased trees on New Broadway, Barnhart Avenue, Bellwood Avenue and Riverside Drive. Concentrated all efforts on picking up the remainder of leaves under the no bagging policy which has been in effect since Oct. 17th. As of this date, all streets have received attention at least three times. Effective December 15th, all leaves, grass clippings, etc. will again have to be placed in containers and at the curb and only on Mondays and Thursdays. M I I'M In connection with the replacement of the cab on the Mack sanitation truck, Trustee Maceyak moved, seconded by Trustee Buonanno that the Village Treasurer use her discretion, after discussion with the finance committee, as to whether or not a capital note is necessary for the payment of the cab replacement. Carried. In accordance with the Public Works contract, the public works departments will close on December 26th and January 2nd, said Trustee Maceyak. POLICE & LIGHT Trustee McBride gave the following police report for the month of November: (In detail official minutes) Trustee McBride stated that car 506 was totaled in an accident and will not be replaced. SI; �-6After discussion, Trustee McBride moved, seconded by Trustee Timmings that the police committee investigate whether or not parts of the car can be salvaged and report back to the Board. Carried. Trustee McBride moved, seconded by Trustee Lofaro that Ptl. Michael Ulacco be granted permission to attend the Firearms Instrucl School in Massachusetts, from June 18-22 at a cost of $116.25. Car! Trustee McBride stated that North Tarrytown will be funded in the 1985-86 County budget for our M.R.D. Program. FINANCE & REAL ESTATE Trustee Buonanno reported a cash balance of $102,303.89 in the General Fund as of December 12, 1983. Trustee Buonanno moved, seconded by Trustee Timmings that actio! of the Treasurer in depositing $400,000 due Dec. 29, 1983 and $200,0 due Jan. 4, 1984 with the First National Bank of North Tarrytown at 8% be confirmed, seconded by Trustee Timmings. Carried. With regard to the final payment in connection with the new Village garage, Trustee Buonanno stated that Mr. Lamberti is riolding| up County Asphalt who is requesting payment from him. There is a question of a swail which has to be corrected and we will not make payment to Lamberti until the condition is corrected. Following a discussion, the matter was referred to Counsel. Trustee Buonanno moved, seconded by Trustee Timmings that the Clerk be instructed to inform department heads to submit their budget requests for 1984-85 to the finance committee by January 15, 1984. Carried. Trustee Buonanno made the Board aware that part-time employees hired in public works and recreation and work twenty weeks or more will be eligible for unemployment insurance. The matter will be discussed in a work session. TAX EXEMPT Trustee Lobato stated that Pace University is sponsoring a cour on Tax Assessment Administration from February 1, 1984 - May 16, 198 application charge of $30 and moved, seconded by Trustee Maceyak thai the new assessor be authorized to attend the course one day per week Carried. LABOR RELATIONS Trustee Timmings stated that two bargairing sessions were held w the Teamsters. He stated that he attented, with Counsel, the unfai labor session with Perb in N.Y.C. The Village filed a claim agams the PBA. He stated that the Judge has not rendered a decision in tt unfair labor practice against the Village by the PBA. When some of the other matters have been settled, we will be looking into these grievances for a solution, he said. 79 COLLEGE AVENUE Trustee Timmings moved, seconded by Trustee Lofaro that a meeting of the Directors be held after the Board meeting. Carried. RECREATION Trustee Maceyak gave the following report: >.. Mayor Zegarelli stated that two North Tarrytown vacancies exist on the Mt. Pleasant Senior Citizens Council and appointed Mrs. Fannie D'Alessandro and Mrs. Julia Vydareny as our representatives. ADMINISTRATION Trustee Buonanno stated that Village offices will be closed on December 26th and January 2nd. Trustee Buonanno moved, seconded by Trustee Maceyak that action of the Administration Committee in sending a letter to Tom Pellechi for repairs to the door in the Municipal Building be confirmed. Final drawn down will be made. After the audit is accepted by HUD, closing documents will be filed, said the Mayor. Trustee Maceyak moved, seconded by Trustee Buonanno that actioi of the Treasurer be confirmed. Carried. COMMUNICATIONS Communication from Bessie7 Levy regarding a tree uprooting the sidewalk in front of 19 Depeyster Street was read and referred to the public works committee. UNFINISHED BUSINESS A short discussion was held regarding the Day Care Center. May Zegarelli stated that the school was going to correct the violations Counsel stated that if the repairs are made, the violations wl be lifted. He stated that he will contact their Attorney. With regard to Search for Change, Trustee Maceyak moved, second by Trustee Lofaro authorizing Counsel to write them to the effect that the Village's position has not changed and there is no agreemen Carried. Trustee Maceyak moved authorizing the continuing of negotiation with the County pertaining to the Modified Section 8 Housing Rehabilitation Program, seconded by Trustee Lobato. Carried. Mayor Zegarelli stated for purposes of notice, there would be a special meeting on Monday, December 19th, after the meeting with Mr. Prezioso to decide various items still outstanding such as the fire truck bid/ the catch basin contract and other administrative items that may be necessary to handle before the end of 1983. Trustee Lofaro so moved, seconded by Trustee Lobato. Carried. Trustee Timmings stated that the Technical Service Review Board has now completed its meeting with all of the department heads of tl Village.
