January 9, 1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor Vincent Buonanno William KcBride Joseph D. Lofaro James J. Timmings Emmanuel J. Lobato, Trustees Robert J. Ponzini, Counsel Absent Stephen Maceyak, Trustee Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Buonanno moved, seconded by Trustee Lobato that the minutes of the meeting held on December 12th and 19th, 1984 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. Mario Belanich, No. Washington Street, stated that he received a letter from the water department that he will be charged $10 for eight quarters for the installation of the meter. He had been charged prior to the installation of the meter and questioned its legality. He also stated that he had been told that the Village owns the meter. If this is so, why should he pay for it, said Mr. Belanich. He had nothing in writing to this effect, he said. The person who installed the meter is not a licensed plumber, said Mr. Belanich. If the meter is vandalized, who will pay for it,, asked Mr. Belanich. Mr. Belanich stated that he spoke to Mr. Biros concerning the matter, but did not get a satisfactory response from him. Mayor Zegarelli stated that he received a phone call from someone in another part of the Village who was billed and did not get the meter yet. Trustee Buonanno stated that Mr. Belanich refused to have the meter installed in his home. The Village will still charge him because the meter will still be installed. Mr. Belanich stated that he did not refuse to have the meter installed. He stated that he was away and that when he came back from his vacation, he would have the meter installed. When he returned, he had the meter installed, however, it was not placed in the area where he (Mr. Belanich) told the contractor to install it. �-2Mr. Biros stated that the installation of a water meter is not plumbing. Instructions were given to the contractor that the installati must be agreeable to the owner and accessible to the department. Mr, Biros stated that the owner is not paying for the meter, he is paying for the service on the meter. The $80 includes the install tion cost of $30. Mayor Zegarelli stated that there is a constant flow of problems ai that it might have been wise to raise the water rate to cover the expem of the new meter and the installation than to charge the homeowner the $80 and that the Mayor requested that Mr. Biros prepare an estimate of what charge the new water rate would have to be to cover the new meter. Trustee McBride stated that it was his understanding that the $80 includes installation, plus the cost of purchase of the meter. Following a discussion, Mayor Zegarelli stated that the Board will obtain clarification from John Biros and Counsel. Mr. Belanich stated that there is a Village ordinance requiring property owners to clean their property. He stated that he spoke to John Biros and was told that he should put his complaint in writing. He stated that he did not see where he should complete a form. He stat that the property owner at 171 No. Washington Street has not cleaned hi property and there is an accumulation of leaves which is hazardous, especially for the elderly. Counsel Ponzini stated that when complaints were received over I the telephone and the person was the only witness, he would not appear! in court and the case would be thrown out. All complaints are treated' same, said Counsel. A form should be completed by the person making the complaint, after which it will be processed, said Counsel. REPORTS OF COMMITTEES PUBLIC WORKS Trustee Lobato stated that Trustee Maceyak was ill and asked him to give his report which follows: Repaired damaged hydrant on County House Road and leaking hydrant at corner of Valley and Depeyster Streets. Repaired and replaced valves on suction side of 2000 gallon per minute diesel drive emergency pump. N.Y. City shut down the Catskill Aqueduct January 3-5 to make repairs to gates in conjunction with the power generating project at Kensico Dam. Power failure yesterday effecting both Croton and Catskill statio from 10:30 A.M. to 3:00 P.M. Pumping continued during this period usin the diesel at the Catskill Station. Bank balance as of January 9, 1984 is $63,213. �«=5y y -3- l ,\i Permanently installed sump pump in hoist pit at the Central garage. Sand barrels were refilled throughout the Village. Christmas trees were erected and removed on Broadway, Beekman Avenue, Valley and Cortlandt Streets to celebrate the holiday season. Trees were trimmed with the use of our bucket in Sleepy Hollow Manor. Removed discarded Christmas trees through the Village and chipper was used to reduce the volume of the waste. • iiU Joints were sealed in pavement in Sleepy Hollow Manor. Snow and/or ice storms have developed since our last meeting. A combined accumulation of 5" of snow occurred which was able to be controlled with approximately 85 yards of sand and 150 tons of salt. |: j) I POLICE & LIGHT Trustee McBride gave the following report for December: • (copy in detail official minutes) Trustee McBride stated that Chief Spota received a letter of resignation from Ptl. Michael Ulacco, effective January 4, 1984. He stated that the letter should have been addressed to the Mayor. The Chief received it on Jan. 3, 1984. \m * Trustee McBride moved, seconded by Trustee Lobato that Ptl. Ulacco's resignation from the Police force be accepted, effective January 4, 1984. * Trustee McBride stated that Trustee Buonanno and himself interviewed two candidates as a possible transfer. He stated that a patrolman list has been called for from the County Personnel Office. | ; j Trustee McBride stated that the probationary period of a patrolman normally is for twelve weeks with a possibility of extending it forty weeks. In the case of Gregory Camp, his probationary term was completed today. Since there is a time limit of notifying the patrolman and County Personnel Office for an extension of his probationary term, (10 days Ptl. Camp is automatically placed on permanent basis. Ptl. Donald Pellegrino's probationary term will be completed on January 23rd, said Trustee McBride, and moved that his probationary term ' be extended forty weeks and that Ptl. Pellegrino and County Personnel • be notified of same, seconded by Trustee Timmings. Carried. FINANCE W | !!: 11 i• !•4 JM": I: •: f Trustee Buonanno reported a balance of $391,645.00 in the General Fund as of January 9, 1984. Trustee Buonanno moved, seconded by Trustee Timmings that action of the Treasurer in depositing c.d. notes in the amounts of $400,000, $200,000 and $700,000 in the First National Bank of North Tarrytown, at 8%, for thirty days, be confirmed. Carried. Trustee Buonanno acknowledged receipt of budget requests for 1984-85 from Senior Citizens, Library and Recreation and Parks. ] *• �-4Trustee Buonanno noted a recent ruling that the Village Counsel made the Board aware of concerning a higher penalty rate for delinquen taxes. In accordance with Section 10, Chapter 541 of the Real Property Law, Trustee Buonanno moved, seconded by Trustee Timmings that the following penalty rate be instituted for the next Village tax bill: Month Delinquent Carried. He stated that the committee would like to talk withche Town Supervisor. I'i'l! Trustee Timmings stated that a letter has been received from PERB that an arbitrator has been appointed for determining a contract with the Teamsters. The man hired had contacted him at work, he said. The committee is working on another case now, said Trustee Timmings, and a hearing has been scheduled for January 26th or any Thursday after that date (whichever is convenient). A confirmation will be made before the next meeting, said Trustee Timmings. Trustee Timmings stated that he received a letter from Edward Lavin, State member of the binding arbitration panel for police negotiations. He is calling for a meeting for February 17th, at 10 A.M., said Trustee Timmings. *P i :. Counsel stated that a letter was received from the hearing officer who is waiting for either side to send her briefs, after which a decision will be made. Trustee Timmings moved that Counsel be authorized to send her responses on the Village's position for the February 17th hearing, seconded by Trustee Buonanno. Carried. t t Trustee Timmings stated that a grievance was filed by a member of the police department who submitted a voucher for clothing recently and is trying to bill it for the preceding year. We probably would lose the case, said Trustee Timmings, but he would like to bring the matter before the committee. He stated that members are notified months in advance regarding their uniform allowance. %\ Trustee McBride stated that this is not the fault of the person making the purchase. He stated that it was in the billing which was not submitted in time. The purchase order is not getting to the Treasurer, he said. Mrfi, The grievance procedure does call for three steps, said Trustee Timmings, and he would like to hear his side of the story. 79 COLLEGE AVENUE A meeting will be held after this meeting, said Trustee Timmings. �-6RECREATIQN & SENIOR CITIZENS In the absence of Trustee Maceyak, Trustee Lobato reported that the Winter-Spring brochure is out and listed all available programs. Ice skating at the Tarrytown Lakes started on December 27th. A 1300 residents of the Tarrytowns have signed up. The annual ice skating Olympics will be held sometime in late January or early Februj The date and time will be announced. Ski trips scheduled: January 7th - Hunter Mountain; Jan. 8 Butternut; Jan. 14th - Belleayre; Jan. 15th - Jiminy Peak. During the week of December 26th, approximately between Dec. 27ti at 5 P.M. and Dec. 29th at 9 A.M., tools were stolen from the Recreati truck. The department is checking inventory to ascertain what exactly is missing. The Commission and Recreation Supervisor have requested the hirit of a candidate for Park Foreman, said Trustee Lobato, and moved that the Village Clerk advertise for that position on the basis that salary to be negotiated, seconded by Trustee Lofaro. Carried. ADMINISTRATION Trustee Buonanno moved, seconded by Trustee Lofaro that Counsel be authorized to enter into a contract with Clark Associates subject* to Board approval. Carried. I Trustee Buonanno moved, seconded by Trustee Lofaro that Counsel" represent the Village on pending litigation. Carried. Trustee Buonanno stated that a letter has been received from the Public Schools of the Tarrytowns soliciting for an ad in their yearboc and moved that an ad be taken in the amount of $75, seconded by Trustc Timmings. Carried. Trustee Buonanno acknowledged receipt of a letter from Union Hose Company regarding various situations which have arisen in the Company. Corrections are being made, he said. FIRE Trustee Lofaro seated that with regard to Rescue Hose new apparal the matter of warrantJWEwill be looked into by Counsel. Trustee Lofaro stated that a special meeting might have to be called to finalize awarding the fire apparatus. Trustee Lofaro moved that A.A.A. bid for fire equipment be accep seconded by Mayor Zegarelli. On the question, Trustee Lobato suggested that we hold off until we purchase the truck. Following a discussion, Trustee Lofaro withdrew his motion and Mayor Zegarelli withdrew his second. Carried. �a ^ -7MAYOR'S REPORT Mayor Zegarelli stated that he is in receipt of a letter from Joseph Ruscigno resigning as Chairman of the Senior Citizens Commission, effective January 15, 1984. He wants to remain as a regular member, said the Mayor. An appointment will be made at a future date, said the Mayor, and asked for suggestions. Trustee Timmings moved, seconded by Trustee Buonanno that Joseph Ruscigno's resignation as Chairman be accepted with regret. Carried. Mayor Zegarelli stated that he is in receipt of a letter requesting membership in the Westchester Municipal Planning Federation and moved that the Village join, seconded by Trustee Lobato. Carried. Mayor Zegarelli noted a memo from the Supt. of Public Works, John Biros, regarding the public information meeting on Surface Transport Assistance Act which will be distributed to Board members. Mayor Zegarelli noted a letter from County Executive, Andrew O'Rourke, quoting Chapter 200 of the N.Y.S. Laws of 1983 which authorizes municipalities and school districts to adopt local laws or resolutions providing that improvements to real property used solely for residential purposes as a one, two or three family residence may be partially exempt from taxation. The exemption applies to the extent of any increase in value attributable to an improvement which is used to facilitate and accommodate the use and accessibility of the property by the handicapped. Mayor Zegarelli noted a thank you letter from Mary L. Lutters, Community Liaison, thanking the Board for its support of the Scenic Hudson Roads Program. Mayor Zegarelli noted a letter from Barbara Long, Planner of the Westchester County Division of Housing & Community Development, that North Tarrytown does not now have an active member on the Community Development Advisory Group. He stated that he is seeking a Village citizen who would like to attend the meeting and report back to the Board. Mayor Zegarelli noted a request from Mr. Spagnoli for a tax refund in connection with the ETPA whereby landlords may receive from the Village, a Village tax refund for subsidizing tenants with a limited income. Trustee Buonanno moved, seconded by Trustee Timmings that the Mayor send a letter to the County taking issue with the calculations concerning the refund to Mr. Spagnoli. Carried. COMMUNICATIONS Communication from the Italian-American Independent Club requesting permission to hold a dance at 95 Beekman Avenue, from 9 - 1 2 was read. Trustee Timmings moved, seconded by Trustee Lobato that permission be granted and that the police be notified of same. Carried. �-8UNFINISHED BUSINESS Counsel Ponzini noted that members received a copy of the Tree local law which was amended as per suggestions. The Board may adopt the local law after review. NEW BUSINESS Trustee Lobato* inquired about the position of Village Manager and asked about the final date that the referendum could be placed on the ballot. Counsel stated that the resolution must contain the duties, etc. in order to go on the ballot. The Board has not discussed this matter in detail. Trustee Timmings suggested a bi-partisan support. The electorat should be well-informed, he said. Counsel Ponzini stated that one of the options available for the Village is to bring someone in as an Administrator by local law and a a later date, the Village, if they wanted to, can convert the manager form by referendum. Counsel was instructed to issue a memo with respect to placing the matter on the ballot. Mayor Zegarelli stated that he discussed with Trustee Buonanno part-time employees collecting unemployment. He stated that a letter was sent to the part-time employees who have requested unemployment payment, that work is available in other departments and that they contact the Supt. of Public Works. Trustee Timmings moved to confirm the action, seconded by Trustee Lobato. Carried. Trustee Timmings noted that/inrecent bulletin received from the State Comptroller, anyone using up more than 90% of tax capability is considered a bad financial risk and that fact should be considered in the new budget. Trustee Timmings moved, seconded by Trustee Lobato that the bills submitted on the General Fund and Water & Sewer warrants dated January 9, 1984 be paid after approval by department heads and that the Treasu be authorized to pay same and that a copy of this resolution be attach to the warrants. Carried. There being no further business to come before the meeting, Trustee Buonanno moved, seconded by Trustee Lobato that the same be duly adjourned. Carried.
