February 14, 1984 t] m A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Philip E. Ponzini, Counsel r Stephen Maceyak Emmanuel Lobato, Trustees Absent r Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. \. Trustee Buonanno moved, seconded by Trustee Timmings that the minutes of the meeting held on January 23, 1984 be approved as written. Carried. Mayor Zegarelli called for bids on a 1984 four door sedan. No bids were received. ''! Following a short discussion, Trustee McBride moved, seconded by Trustee Lofaro that we re-advertise for bids for a 1984 four door sedan, returnable on February 27, 1984. Carried. iJi Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. I* 1< No one appearing, the regular order of business was resumed. REPORTS OF COMMITTEES PUBLIC WORKS i> Mayor Zegarelli stated that he acknowledges the fact that Trustee McBride informed him before the meeting that Trustees Maceyak and Lobato would not be here tonight. He stated that he was "fed up", especially with Mr. Maceyak who showed up for one meeting in . December and absent from at least nine work sessions, interviews, etc. since. He stated that he was receiving his pay checks from the Village. He is calling upon the Board to do something about the matter. Mr. Maceyak is no longer a working Trustee and Chairman and moved that he should resign as a Trustee, seconded by Trustee Timmings. ; li "'< * i ; ir If m j A' •w x a.! t 4* *fa* *"**%* *rtgtf** 1 M �-2Trustee Buonanno requested a brief meeting after which Mayor Zegarelli called for a five minute recess. After the recess, Mayor Zegarelli stated that there was a motioi on the floor and polled the Board on his motion that Trustee Maceyak I should resign as follows: Trustee Buonanno " McBride - No - No Mayor Zegarelli" voted "Yes". Trustee Lofaro - No ' " Timmings - Yes Motion not carried. Mayor Zegarelli stated that by power of the State law pertaining to Villages, he is removing Trustee Maceyak as Chairman of the Public Works and Recreation Committees. He asked Board members if they wouli be interested in serving as Chairman of either committee. No one volunteered for Public Works Chairman after which the Mayor stated tha he will act as temporary Chairman. Mayor Zegarelli stated that Trust Lofaro will act as Chairman of the Recreation Committee in the interim Trustee Timmings moved, seconded by Trustee Lofaro that the Mayor's action be confirmed. Mayor Zegarelli polled the Board as follows: Trustee Buonanno " McBride - Yes - Yes Mayor Zegarelli voted "Yes". ' Trustee Lofaro - Yes " Timmings - Yes Motion carried. PUBLIC WORKS I I Since the last Board meeting, we have had an ice and snow storm. The department sanded and salted. Sand barrels were refilled after every storm. Bids were received at the last Board meeting for the reconstruct! of catch basins and sidewalks in census tract 116, which is part of th Urban County program. Upon review of the bids, Mayor Zegarelli moved, seconded by Trustee Buonanno that the bid for catch basins, sidewalks, etc. be awarded to Cimino Contractors in the amount of $89,246.50, according to specifications. Carried. The department has cleaned up around fire hydrants after each snow fall. Routine sanitary sewer flushing with the sewer jet has also been performed. Mayor Zegarelli moved, seconded by Trustee Timmings that Angela Everett be terminated as Int. Account Clerk-Typist, effective Feb. 14 1984. Carried. Trustee Tinmings moved, seconded by Trustee Buonanno that Angela Everett be appointed Int. Account Clerk effective immediately, to continue at her present salary. Carried. �Arb -3Trustee Timmings moved, seconded by Trustee Buonanno that John Biros be granted permission to attend the N.Y. Section American Water Works Assoc, from April 22-24 with expenses. Carried. U Bank balance in Water & Sewer account as of Feb. 14th, $44,698.00. Mayor Zegarelli stated that Trustee Lobato, J. Biros and himself held interviews for sanitation man. The matter will be held over until the next Board meeting, he said. ..' r POLICE & LIGHT Trustee McBride gave the following report for January: *.ii (In detail official minutes) Trustee McBride stated that departmental awards will be held on March 1st in Holy Cross Hall and the Board is invited to attend. %/ Trustee McBride stated that several weeks' ago, the Salvation Army requested a loading zone in front of their Thrift Store on Beekman Avenue. On recommendation of the Chief of Police, Trustee McBride moved, seconded by Trustee Timmings that a "No Parking" sign be placed at the first meter in front of the Thrift Store for a trial period of thirty days. Carried. IJ FINANCE Trustee Buonanno reported a balance of $53,035.20 in the General \ Fund as of February 14, 1984. He stated that the Village received in ] Municipal Aid the amount of $47,191.00. This is a supplement to State ! Aid, he said. j Trustee Buonanno moved, seconded by Trustee Lofaro that action of the Treasurer in depositing c.d. notes in the amounts of $400,000, $200,000 and $700,000 in the First National Bank of North Tarrytown at 8% be confirmed. Carried. Trustee Buonanno stated that the Village has no policy on employees who are on Military leave and compensated. He stated that employees should not receive pay from the Village and from the Military. He stated that the Village should pay the difference on what they make, he said. Trustee Buonanno moved,seconded by Trustee Timmings that Counsel review the matter for a report. Carried. Trustee Buonanno moved, seconded by Trustee Timmings that action that the Board took at a recent work session increasing the library budget 10% be confirmed. On the question, Trustee Timmings stated that the increase has more than doubled the inflation rate in this area for the library. «t* :, :v#w \, I �-4Trustee Buonanno amended the motion that the increase be from $130,414 to $143,455, our share or 10% increase. Carried. Trustee Buonanno moved, seconded by Trustee Timmings that North Tarrytown pay one half of the purchase price of the van for senior citizens which amounts to $10,000. Carried. Trustee Buonanno stated that in 1977, the Board passed a resoluti concerning a section of the ETPA law for senior citizens which allowed a landlord to receive back more money than he paid in taxes to the Village. Based on research, that particular section can be rescinde after a public hearing, he said. Following a short discussion, Trustee Buonanno moved, seconded by Trustee Lofaro that a public hearing be held on March 12, 1984 to rescind the resolution under Section 457B of the Real Property Tax Law. Carried. TAX EXEMPT - Trustee Lobato absent. LABOR-GOVT'L. RELATIONS Trustee Timmings stated that a mediation session with the Teamstei and State appointed mediator was held but we did not have any success. The fact finder appointed Ken Woodlock who has suggested meeting nights said Trustee Timmings, and he would like to meet with the labor relatic committee and Counsel to discuss a convenient date. Trustee Timmings stated that we were notified by the administratl law Judge of her decision regarding the unfair labor practice charge | filed by the police bargaining unit and the decision is that the Villag won its case. Trustee Timmings stated that he is in receipt of a grievance from a member of the teamsters union which the committee does not think is ligitimate and moved that the matter be referred to Counsel, seconded by Trustee Buonanno. Carried. 79 COLLEGE AVE. - A meeting will be held of the Board of Directors following the regular meeting. ADMINISTRATION Trustee Buonanno stated that the Attorney forwarded a proposed agreement to Frederick Clark Associates authorizing them to commence work on the Cluster Planning Services for the Village. Trustee Buonanno stated that the Village has used the services of the Municipal Law Resource Center which has provided valuable benefit to the Village and moved that the Mayor be authorized to sign the subscription pledge card for another year, seconded by Trustee Timmin in the amount of $500. Carried. Trustee Buonanno stated that an opinion was received from the Attorney regarding payment to Trustees who have worked on the assessm roll. Trustee Timmings moved, seconded by Trustee Buonanno that the �-5opinion "be made part of the record. Carried. (In detail official minutes) Trustee Buonanno reported that storm windows were repaired in the ambulance building. In order to keep our maps updated, Trustee Buonanno moved that the Clerk be authorized to send to Mr. Charles Riley, deeds received on a monthly basis, seconded by Trustee Lofaro. Carried. FIRE Trustee Lofaro stated that the contract for Pierce-Tyler was sent to Tyler and signed. We are in receipt of a notice from the Mack Company that they are no longer making Mack trucks, only chassis, said Trustee Lofaro. Trustee Lofaro stated that he is in receipt of a bid memo from General Motors regarding a 1979 suburban, four wheel drive automobile which can be bid upon. He stated that the department will look at the automobile. Mayor Zegarelli asked Trustee Lofaro to have the ambulance reviewed as per the Board's request. MAYOR'S REPORT: Mayor Zegarelli stated that a letter was received from Joseph Petrocelli-Faust Programs, State and County, regarding funds which will be used for paving of Sleepy Hollow Road. Mayor Zegarelli stated that a letter was received from County Legislator Sandy Galef regarding a meeting which will be held by the D.O.T. on additional funds for bridges. John Biros will attend, he said. In accordance with the Tree Law adopted at the last meeting, Mayor Zegarelli appointed John Arcate for a term of three years and Gordon Cannoles for a term of two years. A member from the Planning Board and public will be appointed later, said the Mayor. Trustee Timmings moved to confirm the Mayor's appointments, seconded by Trustee Buonanno. Carried. Mayor Zegarelli stated that with regard to Revenue Sharing regulations, a notice must be published that the Village of North Tarrytown does not discriminate on the basis of handicapped status in admission or access to, or treatment or employment in, its programs and activities, and moved that this notice be published, seconded by Trustee Timmings. Carried. RECREATION Trustee Lofaro gave the following report: �-6r On Saturday February 4th, Pat Lofaro attended a mini conference sponsored by the New York State and Westchester Recreation and Park Society. The general theme of the conference was "Solutions For Success". Keynote speaker Mr. Doyle Allen, Director of the Department fo Parks and Recreation fo Camdon/Kershaw County in South Carolina, spoke on computer applications in a recreation environment. A total of some 160 Recreation & Parks officials from New York State attended the Conference that was held at the Marriott Hotel from 9 AM to 5 PM. IJ U', 2) This week's ski trips will be to Butternut on Saturday February 18 for $33 and Wednesday, February 22 to Jiminy Peak for $34. Last week's trips were to Belleayre on the 11th for $29 and Jiminy Peak on the 12th for $34. 3) The Winter/Spring Programs are off to a successful start. The successful programs have beenAerobic Shape Up, Karate, MotherChild Playgroup, Advanced Typing, Adult Co-Ed Racquetball,and all of our gym activities. The gym activities include: Youth Basketball, Box Lacrosse, Indoor Soccer, Adult open Gym, Teen Open Gym, and Vacation Teen Gym. We will also be having our Kid's Wrestling Program, Kiddy Playtime Program, and Tiny Tot Baseball for the younger children. The programs which were not held because of lack of registration were: Stain Glass Design, Calligraphy, and Aerobic Dancercise. 4) The Ice Skating Olympics have been cancelled for the past two weeks because of inclement weather. They have been rescheduled for next Sunday, February 19 at 2:00 PM. 5) There will be an Urban County meeting on Thursday, February 16 at 8:00 PM in the Court Room. fc-ftl k" 1- 4 ii ; ! • > > • ' : �<^r^ -7COMMUNICATIONS The Clerk informed the Board that the 1984 Assessment Roll has been completed and that the tentative figure is $38,301,642. In connection with the Assessment Roll, Mayor Zegarelli informed the Board that Grievance Day will be held on February 21, 1984 between the hours of four and eight in the afternoon. The Clerk informed the Board that Village Treasurer Irene Amato had filed her report of unpaid taxes for the year 1983 as of January 31, 1984, totaling $40,644.07 and in connection therewith, the following resolution was offered by Trustee Buonanno , seconded by Trustee Tinntings and was adopted: RESOLVED that the Board of Trustees sell all unpaid taxes for the year 1984 on March 15, 1984, pursuant to Section 1436, 1450, 1452 and 1454 of the real property tax law and amendments thereto the same terms and conditions as the sale held on March 17, 1983 at the Village Hall, 28 Beekman Avenue and the Treasurer be and she hereby is directed to publish the proper legal notice for three consecutive weeks beginning February 25th, March 3rd and March 10th, and be it further RESOLVED that a copy of this resolution be given to the Treasurer with the return of unpaid taxes as certified to by the Board. Carried. Trustee Buonanno moved, seconded by submitted on the General Fund and Water & 1984 be paid after approval by department be authorized to pay same and that a copy to the warrants. Carried. Ponzini, Village Attorney Compensation for services performed by Village Trustee as Assistant to Village Assessor DATE: February 14, 1984 i You have asked for a memo with respect to compensation to a Villagj Trustee for services provided in connection with assisting the Village Assessor. General Municipal Law Section 801 provides as follows: j "No municipal officer or employee shall have an interest in any contract with the municipality of which he is an officer or employee whi such officer or employee, individually or as a member of a board, has tj power or duty to pay, negotiate, prepare, authorize or approve a contra or authorize or approve payment thereunder." ! Section 802 of the General Muncipal Law also provides for certain exceptions to Section 801. However, in the instant matter, section 80| specifically prohibits a member of a Board of Trustees of a Village to serve as an assessor or assistant for compensation (1973, Opinions, Attorney General, May 14, informal) . A Village Trustee may not contrac or authorize the payment for services for the Village of which he is a member of the Board when said Trustee has the power to negotiate, authorize, and approve the contract and payment thereunder.
