March 12, 1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor Fred Gross Vincent Buonanno William McBride Joseph D. Lofaro James J. TiTurnings Emmanuel Lobato, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Timmings moved, seconded by Trustee Lobato that the minutes of the meeting held on February 27, 1984 be approved as written. Carried. Mayor Zegarelli read the notice of hearing to determine the advisability of rescinding the resolution of the Board dated Feb. 7, 1977 in which the Village granted a tax. abatement relief to senior citizens pursuant to Section 457 b of the Real Property Tax Law for dwelling units covered under the Emergency Tenants Protection Act of 1974 and Emergency Housing Rent Control Law of 1974 and asked if there was anyone present who would like to address the Board. No one appearing for or against the proposed resolution to rescind, Trustee Timmings moved, seconded by Trustee Buonanno that the hearing be closed. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Mr. John Lofaro, Pine Close, stated that he is experiencing a lot of difficulty getting out of his street during bad weather because of parking conditions and suggested that the Board make it one side parking. Plows are unable to go up the street during bad weather, he said. The matter was referred to the police committee. Mr. Donald Cyr, owner of Cyr's Auto Parts on Cortlandt Street, stated that there is a loading zone in.front of his store and he has heard rumors that the Village intends to install a meter in its place. He stated that he received tickets which he has paid. The lines are not marked properly, he said. Mayor Zegarelli suggested that the police and public works committees review the matter. �-2REPORTS OF COMMITTEES PUBLIC WORKS Mayor Zegarelli noted Trustee Gross1 official meeting who will serve in the interim for the remainder of the term. He asked Mr. Gross to oversee the public works committee and thanked him for sitting on the Board. Mayor Zegarelli also noted that Trustee Gross is serving at no salary. Trustee Gross gave the following report: Routine sanitary sewer cleaning with sewer jet in the Village proper. Assisted in plowing of snow (water dept.). Cleaned snow around fire hydrants. Balance as of March 12, 1984 - $53,217.50. Excavated at site of cave-in on Broadway and repaired storm sewi causing the cave-in and backfilled. Repaired damaged catch basins on corner Hemlock and Fremont Roai Since the last Board meeting, we have had one snow storm with accumulations of approximately ten inches. Plowed throughout the Village. Trustee Gross stated that the Supt., Foreman and work crews did an excellent job and streets were in good condition and moved that the departments be complimented for their work, seconded by Trustee Timmings. Carried. POLICE & LIGHT Trustee McBride gave the following police report for February: (copy in detail official minutes) Trustee McBride moved, seconded by Trustee Lobato that the bid for the 1984 four door sedan be awarded to Russell Chevrolet of Connecticut in the amount of $10,650 according to specifications. Trustee Buonanno amended the motion that payment will come out of the current budget, seconded by Trustee Timmings. Carried. Trustee McBride stated that Car 504 will be taken off the road and it will not be used in any other department. Trustee Lobato suggested that parts be salvaged from the car. Trustee McBride stated that Ptl. John Thomas will be out for an indefinite period of time. Trustee McBride stated that an application for an amusement dex machine was denied by the Chief to Petito's Pizza because it is with 200 ft. of an educational facility. Trustee McBride moved, seconded by Trustee Timmings that action of the Chief, of Police be confirmed. Carried. r" �ir ^ \\ :' -3FINANCE Trustee Buonanno reported a balance of $164,798.39 in the General Fund as of March 12, 1984. Trustee Buonanno moved, seconded by Trustee Lofaro that action of the Treasurer in depositing certificates of deposits in the First National Bank of North Tarrytown in the amounts of $400,000 and $700,000 at 8% be confirmed. Carried. ; tf Trustee Buonanno moved, seconded by Trustee Titnmings that the Tax Sale Certificate #23 in the name of American-Cable be cancelled because their payment of gross receipts is more than the amount of taxes. Amount of certificate for taxes is $2179.64. Carried. Jf'V i .1 !L' Trustee Buonanno stated that a memo will be directed to department heads that meetings will be held to discuss budgets after the tentative budget is filed. K f' M' Trustee Buonanno stated that a letter has been received from the SPCA stating that they will maintain the amount of $1980 for the new budget for dog control work. ' >! Trustee Buonanno reported the amount of approximately $14,000 in uncollected Village taxes for 1983. With regard to the hearing, Trustee Buonanno moved, seconded by Trustee Lofaro the following: The Board of Trustees of the Village of North Tarrytown at a regular meeting assembled and after published notice and public hearing do hereby ordain and enact a resolution rescinding that resolution of the Board of Trustees of the Village of North Tarrytown dated February 7, 1977 and has effectively withdrawn from the tax abatement relief program for senior citizens pursuant to Section 457-b of the Real Property Tax Law of the State of New York for dwelling units covered under the Emergency Tenants Protection Act of 1974 and the Emergency Housing Rent Control Law of 1974. This resolution is effective immediately. Carried. Trustee Buonanno stated that the resolution is not intended to hurt those people who qualify. He is asking them to apply under a different section of the law if their means of income is such that they cannot afford. Si .1! ( 1 i • i'l » \. !i J, TAX EXEMPT Trustee Lobato reported "progress". LABOR RELATIONS Trustee Timmings stated that the State appointed fact finder spent two sessions with the committee and teamsters' representatives but could not reach an agreement. He stated that the committee and Counsel met today to draft a written presentation of the Village's position. This will be proof-read and filed by next Monday. } �-4Trustee Timmings reported that a report was received from NYCOM regarding various legislative items which were recommended and upon reading same, did not feel that all were beneficial to North Tarrytoi Trustee Timmings moved, seconded by Trustee Buonanno that the NYCOM report be discussed by the Governmental Relations Committee an report back to the Board at the next meeting for action. Carried. 79 COLLEGE AVENUE - Meeting after this meeting. RECREATION Trustee Lofaro gave the following report: On Saturday, March 10th, 7 of our young residents participated in our Bowling trip to White Plains Bowl. Another trip will be held on March 24th. This week's Ski trip is to Hunter Mountain. During the spring, we will be holding an Aerobic Dance Class and an Aerobic Shape Up Cla The Dancercise class will start April 2nd in the Morse School gym fro 6:30 to 7:30 P.M. The Shape Up class starts on April 5th from 6:30 7:30. Sign up time is now for Tiny Tot baseball, Dads Club Baseball and girls softball. The Dads Club is sponsoring a Baseball Clinic for all players, coaches and parents on March 31st in the John Paulding Gym. i ADMINISTRATION I Trustee Buonanno stated that Columbia Hose Company has requested the purchase of a new stove and moved that the purchasing agent be authorized to purchase a stove, Model #CH429 in the amount of $1300, money to come out of current funds, seconded by Trustee Timmings. Car FIRE Trustee Lofaro reported that Columbia Hose is out of service for repair work. He stated that the elevator in College Arms got stuck. We are still experiencing problems in the apartments, he said. Counsel stated that the State has imposed a new for adoption by June 30th. Mayor Zegarelli noted a letter from the Legislative network of NYCOM regarding new proposals on State Revenue Sharing. i • - 1 Trustee Lobato moved, seconded by Trustee Timmings that letters be sent to our legislators in Albany. Carried. With regard to a letter received by Counsel Ponzini from Eric Paige requesting an opinion, Counsel stated that his law firm represents Mr. Paige, after which, Mayor Zegarelli moved that the Village Prosecutor, Robert Peirce, render an opinion, seconded by Trustee Lobato. Carried. COMMUNICATIONS \ \ Communication from Kathryn Fries, Town Clerk, Mt. Pleasant, requesting the use of Central Headquarters for primary on April 3rd was read. Trustee Timmings moved, seconded by Trustee Buonanno that permission be granted. Carried. Communication from Gordon Ferguson, Sec'y. of Fire Council, regarding a change in Rescue Hose Company was read and on motion of Trustee Timmings, seconded by Trustee Buonanno that action of Council be confirmed. Carried. The Clerk read notice of a' request from Mr. & Mrs. Amenta for an interpretation of Section 62-8B which will come before the Zoning Board of Appeals on March 19th. This is a formal notice to the Board in accordance with our Zoning Ordinance that property owners within a 200 ft. radius have to be notified. \ Communication from Jennaro Vallo, 15 Anderson Avenue, requesting the removal of a tree in front of his property was read and referred to the Conservation Committee. Communication from James Paolantonio, Sec'y. of Columbia Hose regarding necessary electrical wiring in their quarters was read and referred to the administration committee. I i i i I �-6UNFINISHED BUSINESS Mayor Zegarelli stated that he met with the Building Inspector regarding the Day Care Center who asked the school when they were going to correct the violations and was told that they would be done during the winter session. Sources told him that the corrections were not done, said the Mayor. Counsel stated that he discussed the matter with Mr. Peirce, thi Village Prosecutor, and instructed him to contact their Attorney. Mayor Zegarelli stated that he sent letters to the owners of College Arms regarding the incinerator and Superintendent problems for a meeting. Mayor Zegarelli moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer warrants dated March 12, 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Buonanno moved, seconded by Trustee Lofaro that the meeting be duly adjourned.
