March 26, 1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor Fred W. Gross Vincent Buonanno William McBride Joseph D. Lofaro James J. Timmings Emmanuel J. Lobato, Trustees !'i Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Buonanno moved that paragraphs 3-4, page 5 of the minutes of March 12th be deleted, seconded by Trustee Timmings. Carried. ,J i 4 > >•: i Trustee Timmings moved, seconded by Trustee Buonanno that the minutes of the meeting of March 12, 1984, as amended, be approved. Carried Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so. No one appearing before the Board, the regular order of business resumed. REPORTS OF COMMITTEES 1 PUBLIC WORKS Trustee Gross gave the following report: The water department assisted the highway department in snow plow operations. | I Repaired leaking hydrant on Beekman Avenue. Trustee Gross moved, seconded by Trustee Buonanno that specifications be prepared for a 3/4 ton four wheel drive pickup truck and bids returnabli on April 23, 1984. Carried. W t'i Trustee Gross stated that Richard Gross, Water & Sewer Maintenance Man Gr. II has received his Grade II-B Water Treatment Plant Operator Certificate. Balance in water and sewer account as of March 26th - $60,303. Trustee Gross reported that there are eight outstanding homes to be completed for meter installation. J V li U mt Since the last meeting, a snow storm occurred on March 13th £! �-2during which salt spreaders and plows were used. General cleaning throughout the Village, with mechanical sweeperj hand brooms and rakes. Potholes were filled with cold patch. Trustee Gross stated that at the last meeting, a letter from Mr. Vallo of Anderson Avenue during which he requested the removal of a trl was referred to the -Environmental Conservation Committee. The Board in receipt of a letter from Mr. Arcate who has examined the tree and found it deteriorated and has recommended its removal, said Trustee Gross. Mr. Arcate also stated in his letter that to try to save the tree would be very expensive. Trustee Gross moved that the matter be referred to the public works committee with power to act, seconded by Trustee Timmings. On the question, Trustee Lobato inquired as to the expense involvj and that the Board should review the matter in dollars and cents. Mr. Biros stated that the tree man is hired for the day and he does as much tree work that he can. Trustee Gross stated that the Environmental Committee has looked into it and w e should go along with its recommendation. Mayor Zegarelli polled the Board as follows: Trustee Gross - Yes " Buonanno - Yes " McBride - Yes Mayor Zegarelli voted "Yes", Trustee Lofaro - Yes " Timmings - Yes " Lobato - Opposed. Motion carried. Mr. Gross stated that Mr. Cyr, owner of the Auto Parts Store on Cortlandt Street had complained about the markings of the loading zone in front of his store. He stated that he and Trustee McBride reviewed the situation and Mr. Cyr is very satisfied with the way the marking is now. He suggested that the highway department paint a white line whid would indicate the proper metered parking space. The matter was referred to public works committee. POLICE & LIGHT Trustee McBride stated that the Chief has submitted a report concerning final items needed to complete the SEAS program (formerly STOP-DWI) now called the NOW Selective Enforcement Alcohol Speed. He stated that we will be reimbursed forty hours overtime not to exceed ark $15 an hour for a five week period. We will be using a specially mar* vehicle owned by the Town of M t . Pleasant for our zone. Trustee McBrif stated that a certificate of insurance in the amount of $10,500,000 wo be necessary, as well as an execution of a waiver and indemnity agre wo| 1 �7 ? 3After discussion, Trustee McBride moved, seconded by Trustee Buonanno that contingent upon approval of the Village Attorney, tl.ft necessary certificate of insurance in the amount of $10,500,000 be provided for this program. Carried. Trustee McBride moved, seconded by Trustee Buonanno that upon approval of the Village Attorney, the Mayor be authorized to sign the waiver-indemnity agreement between the Village and Town of Mt. Pleasant. Carried. Trustee McBride stated that a request was received from the police department that the air quality control in police headquarters be investigated. He stated that Carey and Walsh inspected the system and it was necessary to change the filters and thermostat. All conditions have been met, he said. Trustee McBride stated that the new police car arrived last week and is now being painted at General Motors. This car will replace Car 504, he said. Trustee McBride stated that he is in receipt of a request for permission of Sgt. Patten to attend the Governor's Conference on Crime Prevention in Albany on April 2 - 4 . Due to the fact that one of our patrolmen will be going out on disability, two others are in Training School, Trustee McBride moved that the request be denied, seconded by Trustee Buonanno. Carried. Trustee McBride stated that several weeks' ago, a request was made by a resident of Pine Close for parking relief on his street. The matter was referred to the Chief who has recommended that two no parking zones (20 ft. each) be made at the northeast and southeast corners of Pine Close to facilitate the passing of fire trucks and other emergency vehicles. The alternative recommendation by the Chief would be to have no parking on the south side of Pine Close in the manner that no parking is allowed on the south side of Pine Street. Trustee McBride moved, seconded by Trustee Timmings that a public hearing be held on April 23, 1984 to consider restricting parking in the area where Pine Close meeting Pine Street. Carried. FINANCE Trustee Buonanno reported a balance of $179,529.71 in the General Fund as of March 26, 1984. In connection with the filing of the tentative budget, Trustee Buonanno moved, seconded by Trustee Gross that copies be distributed to department heads. Carried. Trustee Buonanno stated that many problems have to be dealt with "n connection with the 1984 assessment roll and moved that its adoption e held on April 2, 1984, seconded by Trustee Timmings. Carried. �-4Trustee Buonanno suggested that the Village Attorney review the use of Village funds rec^ .ved from parking fees. He was referring a< to whether or not the mc „es could be used for projects, such as improvements to the staLJ..m, etc. Trustee Buonanno ::.;ked for consideration for John Biros for his services as building inspector. He stated that he worked 126 hours in that capacity. A rate of $10 per hour was established, said Trust Buonanno and moved that he be paid $1260 for services rendered, second by Trustee Lobato. Carried. Trustee Buonanno stated that he had authorized $350 for additiona equipment on the new police car and Trustee Timmings so moved to confirm his action, seconded by Trustee Lobato. Carried. TAX EXEMPT Trustee Lobato - no report. LABOR RELATIONS Trustee Timmings stated that the Village had filed its list of demands with the fact finder. He stated that the teamsters also did the same, however, a copy intended for the Village was lost in the mai Councel contacted the fact finder and requested a copy of the teamster! demand and that the hearing scheduled this week be postponed. The dati of April 11th has been scheduled for a hearing in Elmsford and Trustee Timmings so moved to confirm the date for a fact finding session, seconded by Trustee Buonanno. Carried. Trustee Timmings stated that the Village was judged to be the mn in its unfair labor practice charges filed against the PBA. This redua the outstanding issues between the Village and PBA, said Trustee Timmii The Village won in both cases, said Trustee Timmings. We will attempt to establish a date to further negotiations with the police department, said Trustee Timmings. Trustee Timmings commended Counsel Ponzini for his good work. Mayor Zegarelli read part of the decision whereby it states that the PBA's submission was improper. It was a violation of Section 209A and ordered that PBA withdraw all items from arbitration and post the attached notice as communication to unit members. Mayor Zegarelli congratulated Counsel Ponzini for his help. 79 COLLEGE AVENUE A meeting will be held after this meeting. RECREATION-SENIOR CITIZENS Trustee Lofaro gave the following report: Sixteen youths attended a bowling trip to White Plains Bowl on March 24th. Approximately 35 students from the Tarrytowns are involved in a program that includes introduction to wrestling, learning basic moves and wrestling tournaments. j ' ;j j$ f Seasonal employees will begin work on April 4th. ! '3 i| ii ! 1 I' Registration is still being taken for the Girls' Softball League. Trustee Lofaro stated that a letter was received from the Scarsdale Postal employees who" are staging a musical review program in April and free to the senior citizens. The letter will be forwarded to the senior citizens. ADMINISTRATION \ i ; ji ] jj ]1 i 1 I jj Trustee Buonanno stated that the Village received new maps from C. Riley, land surveyor. Some errors were uncovered and Mr. Riley will be made aware of them for correction. . |J \>; >i j> I* J. Trustee Buonanno offered the following resolution, seconded by Trustee Timmings: •! i \f WHEREAS Almighty God has seen fit to take unto Himself the soul of the late James Weaver, and \' ' '- :' WHEREAS the said James Weaver was a former Assessor of the Village of North Tarrytown and resident of the Village for many years having been held in the highest esteem by all those who knew him, now, therefore, \ be it i RESOLVED that the Board of Trustees take official notice of James Weaver's death, and be it further J i • , RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. j j ; I I FIRE Trustee Lofaro reported Columbia Hose apparatus is back in service. Rescue Hose and Union Hose apparatus were also repaired. 1 ; I \ MAYOR'S REPORT: 1 Mayor Zegarelli stated that he was approached by other communities if we were interested in supporting legislation that would increase the drinking age from 18-21. He stated that he, personally, was in favor of it. Some communities in the area have voted for it, he said. The matter would be taken up in a work session. Mayor Zegarelli stated that he talked to Senator Flynn and Assemblymax Sullivan regarding revenue sharing proposal and we will expect a slight increase. Mayor Zegarelli stated that we verbally received word from OSHA that the grant we requested for the Village garage was awarded and in fact, we should expect to receive $79,860 which represents 75% of the �-6amount we applied for which is a revised figure from our original submission. Mayor Zegarelli stated that Ron Turnquist volunteered his servic in calculating replacement costs, etc. and a letter of thanks will be sent to him. , Mayor Zegarelli stated that he has been told by County Legislate that the County will repair the Palmer Avenue bridge and he thanked Sandy Galef and Mr. Bohlander for their work. COMMUNICATIONS Communication from Central Veterans Committee requesting permiss to hold the annual Memorial Day Parade through North Tarry town on May was read and on motion of Trustee Timmings, seconded by Trustee Lobato permission was granted and police notified of same. Communication from Thomas Curt in, President of Rescue Hose Compao requesting permission to erect signs announcing the flea market on May 12th was read and on motion of Trustee Lofaro, seconded by Trustee Gross, permission was granted. Carried. Communication from Mrs. Robbyn Fernandez, Beekman Avenue, regardi the untidiness of Beekman Avenue was read and referred to the public works committee. Communication from Gustave Sedivy, 35 Hudson Terrace, regarding parking rules on Hudson Terrace was read and referred to the police committee. The Clerk notified the Board that the Mayor filed the 1984-85 tentative budget with her on March 20, 1984. A budget hearing was scheduled for April 9th. NEW BUSINESS Trustee Timmings moved that a copy of the tentative budget be placed in the library, seconded by Trustee Buonanno. Carried. Mayor Zegarelli stated that since this is the last meeting of the outgoing Trustees, he presented certificates to Trustees Lofaro, Lobato and Gross and recognized them for their services. Trustee Gross stated that he enjoyed serving and offered his thanks to the staff for their cooperation. Trustee Lofaro thanked the Board for helping him and the people who supported him. Trustee Lobato read the following statement: W, �*r* -7"I would like to thank the people of North Tarrytown for having given me the singular opportunity to serve on the Board of Trustees of our Village. It was an honor I will always cherish and be grateful to have received. No amount of thanks can express the gratitude I owe to my wife. It was her unstiting support and understanding that made it possible for me to seek public office and participate in the affairs of the Village. To the new members of the Board, I must say that you are in for one of the most interesting, exciting and rewarding times of your life. You will have the opportunity to see first hand how the Village functions to participate in every major decision affecting our Village and to meet and work with the many good people who are employed by the Village and who voluntarily serve it through the fire department and the many Boards, Commissions and Committees that assist the Board of Trustees. I wish you good luck. There is one problem confronting the new Board that, in my mind, over-rides all others. If you will permit me a few minutes, I would like to comment on it. The problem is, how to implement professional management and continuity of management in daily Village operations. My recommendation is that the Village seek approval from the voters to hire a Manager for the Village, and if that approval is given, adopt the necessary local laws and hire a Manager as soon as possible. I have always favored hiring an Administrator or Manager for the Village, but at the time I was elected, I did not consider the matter very urgent. My experience over the past two years has convinced me that the hiring of a nVillage Manager for N. T. is essential to achieving the most that C' n be accomplished with our resources. It is the most pressing issue facing the Board. The experience of other Villages confirms that a Village Manager or Administrator is an asset to Village operations. Almost every Village in Westchester County has one, and I am aware of no case where a Village abandoned the use of an administrator or manager after one was hired. Over five years' ago, our Secession Committee, as an outgrowth of studying the feasibility of becoming a separate town, recommended a manager or administrator for N.T. Their opinion should be given special weight as being unbiased since the object of their investigation was in a different direction and their conclusion was compelled by the factsnot by a predisposition to their recommendation. The distinction between an Administrator and a Manager is crucial. I believe that the additional independence that a Manager would enjoy, and the proper delegation of the Board's authority to him or her, including the power to hire and fire all employees, is necessary if professional management is to work for N. T. Our Village politics have always been zesty and tumultuous. It is essential that this tradition not affect the institution of professional management in the Village. If one thinks that a Village Administrator could operate free of our politics, one need only look to our sister Village, Tarrytown, and the constancy of the Village Administrator as a political issue there. Does anyone seriously believe that a Village Administrator would fair better in our Village? I think that the Board had better consider a Village Manager if it would effectively change the character of how the Village is run. .» �-8- One impediment to hiring a Manager is the view held by many that N. T. is too conservative a Village, and that the people of the Villa» will never accept one. More bluntly, some of our trustees have been afraid of being voted out of office for bringing a Manager into the Village. I personally doubt that the people of the Village are unsophisticated. However, the best test as to how the people of N.T. feel about the issue is to ask them. A few months' ago, I asked my fellow Board members to put the question of whether the Village shouli be empowered to hire a Manager on the ballot this March as a referendu The Board declined to do this when the Mayor said that it would be bet to wait until the general election in November. Personally, I think this was a mistake. Although that election is seven months away, it will be so easy to let the issue slide for another year, and easier to do so than to raise the issue to finally have it decided. To the new members of the Board, I would say don't let this one get by you. It i the most important immediate problem that you face. An argument in favor of waiting to decide whether to hire a Manag or Administrator is that the citizens committee studying the issue has not yet issued their report. To that I would say, we have already had a citizens committee recommend a Manager or Administrator. If the present committee recommends to the contrary, they should present a detailed and compelling analysis to support such a negative recommenda before the Board follows it. The question of whether to hire an Administrator or Manager is for the Board of Trustees to decide, they should consider every source of advice on the issue, but not defer to one particular source of advi As one who has sat through hours of consideration of minor personnel I problems and consideration of low level daily problems, I can say thai the Board's time would be better spent on more fundamental problems al long term planning. This loss of time hurts our Village in two ways. First, valuable time is spent which should be devoted to more importan issues. Secondly, the prospect of having to spend large amounts of tii on the job discourages many people from running for the office of Trus There are many talented people who could contribute much as Board memb but they will never seek the office because of the time involved. The efficacy of a form of government which relies on substantially unpaid officers and which effectively excludes almost the entire electorate from serving in that government must be questioned. Finally, I would note that the Daily News has constantly supportei hiring a manager or administrator for years. The editorial comments 01 this subject have been right on the mark, and it is good advice that should be heeded. Again, my heartfelt thanks to the people of N. T. who elected me to a Village Office and who have given me two of the fondest years of my life." Mayor Zegarelli thanked the members who served on the Board. �•* frvf !
