NORTH TARRYTOWN, N.Y April 2, 1984 The Organization Meeting of the Village of North Tarrytown, N.Y. was held on the above date. Present Philip E. Zegarelli, Mayor 1j James J. Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Tax Collector, Registrar - Mayor Zegarelli stated that Filomena Fallacaro continues in office for a term of two years. Village Treasurer, Tax Collector, Depty. Clerk - Mayor Zegarelli stated that Irene Amato continues in office for a term of two years. Village Attorney - Mayor Zegarelli stated that Robert J. Ponzini continues as Village Attorney for one year. Village Prosecutor - Robert Peirce continues as Village Prosecutor for one year. Village Auditor - Mayor Zegarelli appointed Landry & Singlar for a term of one year. y Village Assessor - Mayor Zegarelli stated that there is a question as to whether or not the person has to be a resident which is being reviewed. In the meantime, the Management and Budget committee will act as a Village Assessment group. Board of Assessment Review - Mayor Zegarelli stated that a full membership will be appointed as soon as an assessor is appointed. Recreation Commission - Mayor Zegarelli appointed John Kraft a member of the Recreation Commission for a term of five years. Trustee Timmings moved to confirm the Mayor's appointment, seconded by Trustee Galgano. Carried. if * to? I At this time, Mayor Zegarelli read a letter of resignation of Steven Salman from the Planning Board due to his election as Trustee. Trustee Timmings moved to accept his resignation, seconded by Trustee Buonanno. Carried. Mayor Zegarelli appointed Raymond Dool to fill the unexpired term of Steven Salman on the Planning Board. Trustee Timmings moved to confirm the appointment, seconded by Trustee Galgano. Carried. Zoning Board of Appeals - Mayor Zegarelli stated that Martin Ruane and Edward Swaby will continue as members of the Zoning Board of Appeals for a term of three years each. Fire Inspector -ft&yorZegarelli stated that this will be vacant until such tin as Fire Council decide as to how they are going to service or provide for the Fire Inspectors Corrmittee. Member of N.T. Housing Authority - Mayor Zegarelli stated that he isi waiting for a reply from Edward Beck if he would like to serve on thl board. In the meantime, Trustee Timmings will remain on the board I until the next meeting. Building Inspector - Mayor Zegarelli appointed James Margotta Builditi Inspector, Grade III, part-time basis at $10 per hour. Trustee Timmings moved to confirm the Mayor's appointment, secon by Trustee Galgano. Carried. Electrical Board - Mayor Zegarelli stated that Joseph Schwer continue as Electrical Contractor for a term of two years; James Margotta as Building Inspector for a term of one year; Edward McCarthy as Con Ed's representative for a term of one year? William Craft, Board of Fire Underwriter's representative for a term of one year and Walter Ceconi, Journeyman, for a term of three years. Trustee Timmings moved to confirm appointments of the Mayor, seconded by Trustee Buonanno. Carried. Police Surgeon - Mayor Zegarelli stated that Dr. Elio J. Ippolito continues as police surgeon for a term of one year. Police Matron - Mayor Zegarelli stated that Josephine Moore continue! as police matron for a term of one year. I Acting Village Justice - Mayor Zegarelli re-appointed Dennis Fitzgerald Acting Village Justice for a term of one year. Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor's appointment be confirmed. Carried. �S^^ Village Historian - Mayor Zegarelli stated that Joseph Finnegan continues as Village Historian for a term of one year. Senior Citizens Commission - Mayor Zegarelli appointed Joseph Ruscigno a member of the Senior Citizens Commission for a term of eight years. Trustee Timmings.moved, seconded by Trustee Galgano that action of the Mayor be confirmed. Carried. Environmental Conservation Council - Mayor Zegarelli stated that the following members continue to serve on the Council for a term of two years: Ralph Cellante, Gordon Cannoles, Anna DeLuca, Curtis Heath, John Arcate, Jr. and Alice Croke. Trustee Timmings moved to confirm the Mayor*s action, seconded by Trustee King. Carried. Tree Commission - Mayor Zegarelli stated that Janet Landow continues as a member of the Tree Commission for a term of three years. Drug Guidance Council - Mayor Zegarelli stated that Frank Mangieri and Karen Savage continue to serve on the Council for a term of three years' each. Handicapped committee - Mayor Zegarelli stated that Eva Piedimonte, Gwendolyn Carter and Aretha Allen continue to serve on the committee. Technical Service Review Board - Mayor Zegarelli stated that Robert Cavanagh continues to serve on this Board. Traffic & Transportation Committee - Mayor Zegarelli stated that a public hearing will be held on May 14th to create an Economic Council and Parking Authority. Therefore, the terms will lapse. Mayor Zegarelli appointed Trustee Timmings Deputy Mayor for a term of one year. Mayor Zegarelli stated that the First National Bank of North Tarrytown will continue as depository of Village funds. Mayor Zegarelli stated that the Daily News continues as the official newspaper of the Village. Mayor Zegarelli stated that the second and fourth Mondays continue as meeting dates of the Board. Mayor Zegarelli designated Trustee King, Chairman of the Police Committee, a member of the Police Pension Fund Committee. The Mayor and Chief of Police are automatically Trustees of such fund. Mayor Zegarelli stated that Roberts Rules of Order continues as the official Parliamentary Procedure of the Board. Carried. Mayor Zegarelli appointed the entire Board as a committee for study and consideration of the budget. He stated that the budget hearing will be held on April 9, 1984. Mayor Zegarelli stated that Counsel prepared memos in connection with grievances which were filed on Grievance Day and in connection with them, Trustee Buonanno moved, seconded by Trustee Timmings that the following grievances be denied and that the memo be submitted as part of the minutes: . Tonight's Board meeting is the! formal and annual reorganization session of the North Tarrytown Vill* government. Tonight, we will set committees, make appointments and| particular, set an agenda for the future..a series of topics, plans • and ideas that need to be addressed on behalf of the people of NortB Tarrytown. The items I would like to discuss include the following: j In the very near future, we will hold a series of public hearing! to formally establish an Economic Council and a North Tarrytown ParkiB Authority. Both topics are of vital importance to the continued well being of this village. The economic council will be advisory in natfl and is envisioned to include the addressing of problem areas that are unique to this village. The continued well-being of General Motors, existing problems of Duracell, and the concerns of the local N. T. shop owner all have a common threat. Keeping North Tarrytown viable, this will be one of our major concerns. The Parking Authority under the provisions of New York State Law be mandated to address and solve the parking needs of this village not only to search for solutions, but to provide answers with long over-due action. Citizens will be called upon to serve on these non-partisan committees. We know that the response will be overwhelming. We will seek to establish new points of reference-guideposts-on behalf of this village. We will revitalize our Trustee Committees by consolidating responsibility and dwelling more on police, Village neeF and decision making than was probably ever done before. Certainly, ul will have all department heads responsible for their respective depafl ments and we must avoid undue interference with the timely execution] and delivery of services but we will continue to participate. In kefl with the desire to move our village ahead, we will continue to search] out for various county, state and federal grants that are in keeping I with the needs of our village. Our award of the OSHA grant for our Village garage and seeking a resolution on the rehabilitation of the Palmer Avenue bridge reflects this village's ability to identify and respond to the needs of the village. Because a grant takes time or effort does not mean it should be awarded. We will try for a boat basin. On a budgetary level, we will seek to convert our budget to a zero based format, wherein every expenditure, every year will be reviewed on a case by case basis, not just rolled over and institutioij alized or bred into the budget. We will seek to computerize as many areas and functions as possible. We will create a task force to identify duplications and repetitions hand work that can be converted to a computerized format. This can include the assessment roll, tick* fees, fines and billings of the village as well as the maintenance of historical records of the village to mention only a few. Communications at all levels will be a central theme this year. We will initiate a monthly meeting of all department heads with the Board and shall continue this format so that intra-government concern! and controversies are avoided. We will meet with citizens' groups tli will help in identifying village concerns and provide proposals. We J will seek to create an agenda for each board meeting that will outlij the business of the village to be undertaken. We will reinstitute ti village news letter as a tested means of communications for the citizenry replying to developments and proposals within our village. �-V-*- If. Additional areas that we will address include the creation of a youth court, expanded services for our senior citizens, revitalization of the code enforcement needs of the Village. We shall seek adequate compensation from the state for the services that will be ultimately required for the servicing of the Rockefeller State Park, as well as a host of items that can be identified as areas of mutual concern among the local villages, as well as our own citizens. We look forward to the special committee studying the administrator and/or manager form of government and will actively respond to all items or suggestions that they propose and outline. We will always keep the village first in our minds. Last year's debacle will not be repeated. Harmony and a restoration of basic values is paramount. Last year saw a sizable loss for the image of Village government and the confidence that people have in their elected officials. We will not be unanimous in our decisions nor should we, but we will seek one goal and that is the best possible government for the lowest possible price always with the good and welfare of the people of North Tarrytown highest in our minds. I look forward of working together with the entire Board in solving the problems that confront this village starting today and throughout this next year. I ask the Board to join me in taking this pledge." Mayor Zegarelli stated that problems facing North Tarrytown are the G.M. Ponzini, Village Attorney Tax Grievances - 1984 April 2nd, 1984 FROM: RE: DATE: This memo is a brief report on the grievances which were file requesting tax reductions for the tax year 1984/85 in the Village ii North Tarrytown. HI Refunds for this year are estimated with a tax rate of approximately $77 per thousand. 1. Raymond Avellino, Section 16, Block 10, Lot ^ 15A, 148 Cortlandt Street, North Tarrytown: New York. Assessed value $18,200. Requested reduction to $1,800. A total reduction requested of $16,400 in assessed value. This would result in a refund by the Village, if granted, of $1,262.80. A letter was forwarded to the taxpayer and his attorney on February 24th, 1984 requesting materials to be used in evaluating his claim. None of these materials were returned. Based upon his-failure to properly disclose, it would be recommended, subject to the decision of the Tax Assessor, that this claim be denied. 2. Alfred Benzenberg, 266 Palmer Avenue, North / / ~ ^~?-/< Tarrytown, New York, Section, Block and Lot not provided. Mr. Benzenberg requested a reduction from $16,600 to $4,000 in assessed valuation. This represents a reduction of $12,600 at an estimated cost to the Village, if granted, of $970.20. Mr. Benzenberg was sent a letter on February 23rd, 1984, requesting necessary details to adequately review his claim. None of these materials were returned or provided to the Village of North Tarrytown. Therefore, it is suggested that Mr. Benzenberg's claim be denied, subject to the approval of the Village Assessor. ,'l^ >s • •v �t North Tarrytown Land Corporation/Platzner Management Company, 14 Lawrence Avenue; 255 Broadway, Section 15, Block 14, Lots IB and 1C; Section 16, Block 7 y Lot 2: North Tarrytown Land Corporation filed a grievance for the above captioned parcels which are presently assessed in toto in the amount of $40,100. They are requesting a reduction to a total assessment on all three parcels of $4,028. If this assessment were granted in all respects, the cost to the Village would be $2,772. On February 23rd, 1984, requests were sent to the attorney and to the taxpayer requesting various items for review. On March 12th, 1984, your attorney received certain documents for the review of this claim. The items were not complete in all respects and to the extent that they were received do not justify the requests submitted. Therefore, it is submitted that the grievances should be denied in all respects, subject to the review of the Tax Assessor. Van Tassel/Tarrytown Company, Section 15, Block 11, Lot 20, 95 Beekman Avenue, North Tarrytown: The taxpayer submitted to the Village grievances on property presently assessed in the Village in the total amount of $440,100. Reductions are requested reducing the assessment to a total amount of $30,569. On February 24th, 1984, a letter was sent to the taxpayer and its attorneys requesting certain items for review in determining whether their grievance should be granted or not. These items were never returned to the Village; therefore, it is impossible for the Village to make an informed decision with respect to this grievance. As a result, this grievance should be denied in all respects, subject to the approval of the Tax Assessor. It is worth noting, this is the third year grievances have been filed by this taxpayer and we should be expecting a Note of Issue placing this on the trial calendar in the near future. As the Board is well aware, we have hired an expert who is working on this matter who should be advising us in the near future. �5- General Motors; This taxpayer is presently assessed by the Village on various properties in the total amount of $19,845,835. They have requested a reduction of their assessement to $5,100,020. This would represent a refund for the 1984/85 tax year in the amount of $1,135,442. This is the second year that a grievance has been filed against the Village. The grievance for 1983/84 in now pending on the trial calendar in Supreme Court, Westchester County. On February 22nd, 1984, a letter was forwarded to General Motors and their attorneys requesting various information to review their complaint. Most, if not all of that information, was provided to your attorney for his review. After reviewing that documentation, and the records maintained by the Village, it is recommended that this grievance be denied subject to the review of our Assessor. Additionally, your attorney will be meeting in the near future with the attorney for the School Board, and hopefully, 1 the attorney for the Town, to plan litigation I strategy. I will keep you advised of further | developments. It is recommended, therefore, that all the aforementioned grievances be denied by the Board of Trustees. If that resolution i adopted, your attorney will forward a letter on behalf of the Board to all tax grievants.
