April 23, 1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Vincent Buonanno William McBride Susan Galgano Steven Salman, Trustees Absent Robert King, Trustee Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Buonanno moved, seconded by Trustee Timmings that the minutes of the meetings held on March 26, April 2, and April 10, 1984 be approved as written. Carried. Mayor Zegarelli called for bids on a four wheel drive pickup truck. Treasurer Amato opened the following bid: Frank Chevrolet Corp., No. Tarrytown, N.Y. Part I (Truck) " II (Snow plow) Total Check in the amount of $687.90 enclosed. $12,245.00 1,513.00 $13,758.00 Trustee Buonanno moved, seconded by Trustee Timmings that the bid be referred to public works for a recommendation. Carried. Mayor Zegarelli read the notice of hearing to consider a proposed local law to amend Section 57-7A-9 prohibiting parking on certain portions of Pine Street and asked if there was anyone present who would like to address the Board. Mayor Zegarelli stated that Mr. John Lofaro of Pine Street had come before the Board requesting this because of the parking situation. Following a short discussion, Trustee Buonanno moved, seconded by Trustee Timmings tht the matter be referred to the public safety committee for recommendation and report at the next meeting. Carried. Mayor Zegarelli moved that a meeting be held on April 30th to adopt the 1983-84 budget, seconded by Trustee Timmings. Carried. �-2Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. No one appearing, the regular order of business resumed. REPORTS OF COMMITTEES ADMINISTRATION Trustee Buonanno stated that during the work session last week, a discussion was held regarding computerizing the asssessment roll tax bills, water bills, etc. The Treasurer and he will be contacting ADP Services for specifications. Trustee Buonanno stated that the ambulance garage is in need of repairs and moved that estimates be obtained, seconded by Trustee Timmings. He stated that the cost would amount to less than $1,000. Carried. Trustee Buonanno stated that when the assessor was unavailable, Village employees performed the function and moved that the Village Clerk be paid $500 and the Treasurer $600, amount to be taken out of the current budget (assessor), seconded by Trustee Timmings. Carried. Trustee Buonanno stated that he talked to the building inspector regarding information required by the Fire Inspectors in order to make inspections of multiple dwellings and moved that Mr. Margotta be authorized to hire a part-time secretary at the prevailing rate to compile the necessary information, seconded by Trustee Galgano. | Carried. I GOVERNMENTAL RELATIONS Trustee McBride stated that Judy Conway, Warner Library, asked for a leave of absence and will be replaced by Pat Hannan. The Board of Directors are looking to increase funds, he said. Trustee McBride stated that the New York State Conference of Mayc will be held at Grossinger's from June 10-14th. Trustee McBride stated that a memo was received from the Office of the County Executive regarding proposed legislation before the Senate which would take away powers from local government in Cable TV, Trustee McBride moved, seconded by Trustee Timmings that a lettei be sent to our legislators urging them to vote against the pending legislation. Carried. Mayor ZegarekLi abated that the N.Y.S. Conference of Mayors have taken a similarfSISSS^a^ainst this. MANAGEMENT & BUDGET - Trustee Timmings moved, seconded by Trustee Buonanno that the I rate per mile for the use of personal cars for business be increased| to 20.5% per mile, effective June 1, 1984. Carried. Trustee Timmings reported a balance of $68,585.88 in the General Fund as of April 23, 1984. i �2>&y I -3Trustee Buonanno stated that the Int. Account Clerk is applying for an illness (maternity) leave of absence. Trustee Timmings so moved that Shirley Canfield be granted a leave of absence within the requirements of the law, seconded by Trustee Galgano. (According to her request from 5/14/84-9/30/84. Trustee Buonanno stated that he interviewed her this afternoon and if there is a need to address the Board we will follow it up. Carried! Trustee Timmings stated that the Board decided that we would try to get a college student on summer vacation to fill this position. He stated that he wrote to several colleges and this will also be advertised! through the local newspaper. Trustee Timmings reported that a fact finding session was held this week. A letter was received from the Chairman of PERB and a meeting will be held on May 2nd, at 10:00 A.M. to commence binding arbitration. Trustee Buonanno commended Trustee Timmings for his efforts on behalf of the Village. He stated that he has taken his vacation time off and spent 4 - 5 hours during the evenings to work on negotiations. Trustee Buonanno stated that meetings were held with department heads to discuss their budgets. An analysis of independent audits and two years of budgets were broken down by percentage increase over the total period, he said. He hopes this will place the Board in a position in an attempt to finalize the budget. PUBLIC SAFETY In the absence of Trustee King, Trustee Salman gave the following report: Police report for the month of March - in official minutes. North Tarrytown will receive $64,500 for the installation of a new police radio system which will include a new base station, mobile radios for every police vehicle and new portable radios for the entire department. The program will be funded 100% by the State at no cost to the Village Trustee Timmings moved, seconded by Trustee Buonanno that the Treasurer be designated as the chief Fiscal Officer and Chief Spota as Project Director and the Building Inspector to assist. Carried. Trustee Timmings movedUthat Chief Spota be thanked and that the action of Senator Flynn t>e thanked for his efforts also. Carried. General Motors sent a letter to Chief Spota commending Sgt. Booth and Ptlmen. Whalen and Cappello for their assistance to them during the flood on April 5th, and Trustee Timmings moved, seconded by Trustee Buonanno that letters be placed in their folders. Carried. �A letter was sent to Chief Spot a from the Sleepy Hollow Manor Taxpayers Association commending the police department for their efficiency and professionalism during recent events. Trustee Salman stated that a request has been made by Det. Ferguson to attend the International Juvenile Officers Association Training Conference in Washington, D.C. from June 25-28 at a cost of $332.00. Trustee Timmings moved, seconded by Trustee Buonanno that the matter be tabled for further discussion. Carried. A letter was received by Chief Spota from James McGowan, Chains of the Legislative Committee of the N.Y.S. Automobile Association urg support of the legislation raising the drinking age to 21. Mayor Zegarelli stated that the matter will be discussed in a work session. Trustee Buonanno stated that the street light maintenance contr expires June 1st and moved that specifications be prepared and bids returned on May 14, 1984 for a new contract for the year 1984-85. Car PUBLIC WORKS Trustee Salman gave the following report: Located leak on water main on River Street which was repaired. Replaced broken manhole frame and cover on Valley Street, malfanctio vacuum pump at the Catskill meter station, damaged hydrant on Colleg Ave. Bank balance as of April 23rd $52,035. Continuing with general cleanup and "pot hole" repairs. Replac broken ground water pipe directing water into storm drain, Catch basin repaired on Amos Street. Devries Ave. was repaired. Storm water manhole on Cimino Contracting of Yonkers commenced work on catch basins and sidewalk repair project (funded by the Urban County Program) and has completed the sidewalks on College Avenue and in front of our parking lot on Elm Street. He is presently rebuilding catch basins in the Elm Street, Howard Street and Kendall Ave. extension area. Trustee Salman stated that in order for the OSHA Abatement Board to release a check in the amount of $79,800 which was awarded to the Village for repairs to the old garage, it was necessary to adopt the necessary resolution for same. Trustee Salman moved, seconded by Trustee Buonanno that the premises cited by the Commissioner of Labor on May 15,1981 known as the Village Public Works Garage, shall not be occupied or otherwise utilized in its present condition by the Village or any other public employee and that public employees shall not have, or be permitted to have access to such premises and that notices have been posted and shall remain posted at all points of entry to such premises �3*6 * -5warning that entry by any public employee is prohibited. Carried. Trustee Salman moved, seconded by Trustee Buonanno that specifications be prepared and bids be received on May 14, 1984, for a 1% ton, 4 wheel drive pump truck with snow plow, funding to come from the current budget. Carried. RECREATION Trustee Galgano gave the following report: On Saturday, April 14th, the North Tarrytown Recreation cosponsored with the Tarrytown Recreation, an Easter Egg Hunt. A raffle was held for adults for a dinner for two at the Marriott. The summer brochure will be out in early May. has ended. The ski program The Annual Bike Rodeo has been scheduled for May 12th at the Morse School. Rain date is May 26th. During the recent rainstorms damages estimated in the amount of $20,000 were incurred irJpur parks. Trustee Galgano stated that at one time, the Village had an agreement %l£]^j£esghool i^arc* regarding the Morse School playground/ We do not llawfy th'isagrkn^nt anymore and Mr. Lofaro and the Commission have recommended that this agreement be cancelled. All that is necessary is a three day cancellation notice. Trustee Galgano moved, seconded by Trustee Timmings that this agreement be cancelled, effective June 1, 1984 and that Patrick Lofaro notify the school board of same. Carried. Trustee Galgano stated that at the last Board meeting, the Village of Tarrytown informed us that the van being purchased for senior citizens for both Villages would amount to $20,000, one-half to be paid for by each Village. The bid that was awarded came in higher and that North Tarrytown's share would be $11,409, instead of $10,000, and so moved that this amount be paid to the Village for our share of the van, seconded by Trustee Buonanno. Carried. MAYOR'S REPORT: Mayor Zegarelli stated that he is in receipt of a request from George Bollanbacher to change the Bicycle race in Philipse Manor from June 24th to June 30th and so moved, seconded by Trustee Buonanno. Permission was granted at a previous meeting. Carried. Mayor Zegarelli stated that he is in receipt of a letter from the Taconic Region Office of the N.Y.S. Dept. of Parks Preservation concerning their request for the abandonment of Gory Brook Road in those areas pertaining to the new Rockefeller State Park. ;f '* �-6Mayor Zegarelli stated that the^^axc. meeting of the Board will be held on May 29th and Trustee Timmings moved to confirm, second by Trustee Buonanno. Carried. Mayor Zegarelli stated that the next meeting of the Administrat Manager Committee will be held on May 2nd. Mayor Zegarelli stated that he is in receipt of a letter from Congressman Ottinger designating parts of Westchester County for Fedei assistance. $18,000 has been submitted by the Village as a preliminai estimate for flood damage of which $10,000 is for private homes and $8,000 for Village damages. We have included some of the recreation areas still to be added up. At the organization meeting, a member of the Fire Board of Appej was inadvertently omitted, said the Mayor and that Emil Imhof will continue to serve on this Board for a term of five years. Mayor Zegarelli stated that John Gasko, Coffin Tree Company, has asked permission to park his trucks in the Village lot at night. He has to vacate his present parking spaces. The matter was referred to public works. Mayor Zegarelli stated that he sent letters to the Supervisor of Mt. Pleasant, School Board and Tarry town Board for meetings to disc recurring questions. COMMUNICATIONS I Communication from Alice Hayes, President of the Elders, Inc. inviting, the Board to attend a turkey luncheon at the COC on May 12th at 1:30 was read. The Clerk informed the Board that a dance permit was given to the Italian-American Ind. Club for April 28th from 9 - 12 at the Immaculate Conception Church. Trustee Timmings moved to confirm action of the Clerk, seconded by Trustee Buonanno. Carried. Communication from Bessie Levy, No. Broadway, regarding her communications of 1982 for repairs to sidewalks on her property at North Broadway and for tree removal at 19 Depeyster Street was read and referred to the public works committee. Communication from Michelle Landings, Inc., 335 No. Broadway, requesting sidewalk repairs at the Amoco Service Station was read and referred to the public works committee. Acknowledgement of sympathy from the Weaver Family was read. �' • \ lot -7« Communication from Giovanni Tucci, 21 Pine Street, regarding a tree which is causing damage and expense for plumber and roto-rooter service was read. Trustee Salman moved, seconded by Trustee Galgano that the letter be referred to the Tree Commission for study. Carried. Communication from Wayne Righter, Chairman, Tarrytowns Post #1939 requesting permission of the Veterans of Foreign Wars to conduct its annual Poppy Sale Drive during the month of May was read. Trustee Timmings moved, seconded by Trustee Buonanno that permission be granted. Carried. Communication from Gordon Ferguson, Sec'y. of Fire Council • regarding status of Fire Inspectors was read. Matter was referred to the Building Inspector for a list of property owners with homes of three families or more. Communication from Gordon Ferguson, Sec'y. of Fire Council requesting permission of Fire Patrol to take its apparatus to Mt. Kisco on July 13th and Croton on August 22nd, as well as Chief's car was read. Change in personnel in Pocantico H & L Company was also read. Trustee Timmings moved, seconded by Trustee Galgano that permission be granted to Fire Patrol and that action of Council regarding the change be confirmed. Carried. Communication from Gordon Ferguson, Sec'y. Fire Council, requesting a maintenance program with Excelsior Garage & Machine Works for repair work on fire apparatus was read and referred to the Public Safety Committee. Communication from Richard Green, Sec'y. of Fire Council, regarding changes in personnel in Union Hose and Columbia Hose Companies was read. Trustee Timmings moved, seconded by Trustee Buonanno that action of Council be confirmed. Carried. i:l • Communication from Richard Green, Sec'y. of Fire Council, regarding< request of Rescue Hose Company to take its apparatus to parades in Cwwutut inn Ballston Spa on June 23rd, Mamaroneck on July 2nd, Ossining on August 7th and WCVFA Convention on September 22nd, as well as the Chief's car was read. Trustee Timmings moved, seconded by Trustee Buonanno that permission be granted. Carried. Communication from Richard Green, Sec'y. of Fire Council, requesting permission to take Fire Patrol and Chiefs car to the Croton Railroad station on April 28th and Pocantico H & L on April 26th to the County Training Center for drills was read and on motion of Trustee Buonanno, seconded by Trustee Timmings, permission was granted. Carried �-8Communication from Richard Green, Sec'y. of Fire Council, requa that the N.T.F.D. Inspection Team act as the N.Y.S. Fire Prevention Co Enforcement Officers for the Village was read and referred to Counsel for study. Communication from Richard Green, Sec'y. Fire Council, inviting the Board to attend the annual Fire Department Inspection and clam ba on June 2nd and June 3rd respectively was read. The Clerk informed the Board that a Mr. George Boumis, 14 Lawren Avenue, North Tarrytown, N.Y., fell in front of 43 Lawrence Avenue on April 18, 1984 due to a sidewalk opening which was not replaced and that our insurance carrier was notified of same. The Clerk informed the Board that she is in receipt of the watei delinquent accounts for 1983 amounting $11,428.55. Trustee Timmings moved, seconded by Trustee- Buonanno that they be entered on the 1984 tax assessment roll. Carried. The matter of bus shelters was brought before the Board by Mr. Sinnott and was referred to Public Works Committee. Trustee Buonanno moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer warrants dated April 23, 1984 be paid after approval by department heads and that tfo Treasurer be authorized to pay same and that a copy of this resolutioi be attached to the warrants. Carried. There being no other business to come before the meeting, Trustee Buonanno moved, seconded by Trustee Galgano that the same be duly adjourned. Carried.
