Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Timmings ma^ed^ seconded by Trustee Galgano that the minute&f of the meetings held on(fflgyL23 and 0, 1984 be approved with Carried corrections on te^-^ - Mayor Zegarelli called for bids on a 1% ton 4 wheel drive truck with plow. Treasurer Amato opened the following bids: Frank Chevrolet, No. Tarrytown, N.Y. Part I - Truck " II - plow Total $16,491.00 1,585.00 $18,076.00 A check in the amount of $903.80 was enclosed. Willow Motors Corp., Port Chester, N.Y. Part I - Truck II - plow Total $15,500.00 1,600.00 '$17,100.00 A check in the amount of $842.00 was enclosed. >"ayor Zegarelli moved, seconded by Trustee Timmings that the bids be referred to the public works committee for a report and recommendation. Carried. Mayor Zegarelli called for bids on the street light maintenance contract for one year. Treasurer Amato opened the following bid: Edward A. McCarthy, 2 Andrews Lane, N. Tarrytown, N.Y. (Check in the amount of $200 enclosed.) $7,000.00 Mr. McCarthy enclosed a note stating that there was a $30 increase of one year. He stated tha1 if the contract could be extended for two years, he would keep the sai. rate. �-2Counsel Ponzini stated that the advertisement called for a one year contract. Trustee Timmings moved, seconded by Trustee Buonanno that the bid be referred to the public safety committee and Counsel. Carried Mayor Zegarelli asked if there was anyone present who would 111 to address the Board may do so at this time. Mr. Schiavone of A & S Machine Shop, Cortlandt Street, stated1 that trees located in between his building and the Village playgroun! are pushing in his wall and he is requesting help from the Village. The matter was referred to public works committee to ascertain whether or not the trees are on Village or private property. If thei are to be taken down, the matter would be referred to the tree comnil ADMINISTRATION Trustee Buonanno stated that the committee is continuing its investigation of computer systems. Trustee Buonanno stated that estimates have been received for p wor! at the ambulance garage and moved that Raguzin Painters be authorized to do the work at a cost of $1000, seconded by Trustee Timmings. Carried. Trustee Buonanno moved that the Village garage door be motorize! at a cost of $150, seconded by Trustee King. Carried. i Trustee Buonanno stated that a policy for over-time work for I employees has been established by the committee as follows: (see attached) Trustee Timmings moved, seconded by Trustee Buonanno that actioi of th committee be confirmed. Carried. Trustee Buonanno stated that the building inspector has completi the list of multiple dwellings for the fire inspectors who will commence inspections shortly. ' rustee Buonanno stated that the Village Attorney researched unemployment compensation for part-timers and submitted the following guidelines: (in detail official minutes) Trustee Timmings moved, seconded by Trustee Buonanno that the guidelines be given to department heads and copy to Board members. Carried. GOVERNMENTAL RELATIONS Trustee McBride stated that he is in receipt of literature fro �/ « y -3- ] e County Executive's office regarding proposed H.R. bill #4103 on -.. <ble TV legislation. He urged that the Village petition our legislators* not to support the bills in the House and Senate which would restrict Jocal author•:y over cable television. Trustee McBride stated that the library committee is continuing its investigation of trust funds investments. * MANAGEMENT & BUDGET i Trustee Timmings stated that there will be a Fact Finding meeting with PERB and Teamsters on May 15th. j } t Truy.'.ee Timmings stated that he has been contacted by the Chairman * of PERB Binding Arbitration panel to set the next meeting for June 20th. The last scheduled meeting was postponed due to the PBA attorney being ill. Trustee Timmings stated that the committee interviewed three candidates for the temporary bookkeeper's job and on recommendation of the committee, moved that Rose Marie Abate be appointed at a salary of $275 per week, starting May 14, 1984 and that her pro-rated salary be paid for the training period starting May 10, 1984. As a part-time position, there are no benefits, he said. Trustee Buonanno seconded the motion. Carried. J } Trustee Timmings moved that the transfer of funds associated with the 1983-84 budget year be completed for action at the May 29th meeting, seconded by Trustee. Buonanno. Carried. Trustee Timmings stated that at last week's work session, the monitoring of the 1984-85 budget was discussed. Committees are to furnis estimates of income and expense by month to provide an input from each department head toward the fiscal management of the Village. Trustee T immings stated that at the WCVOA meeting of May 10th, representative s of eighteen Villages discussed the sales tax plans presently uncle r consideration. The majority favored the tax proposal presented by ;.' )V0A. There is a strr-::g feeling that the City County Plan has the b est chance of being approved. There was only one person in the room wh o expressed an opinion against the sales tax and the majority of th at Village supports the sales tax, and Trustee Timmings so moved, seconded by Trustee Buonanno that the Village supports the City-County Plan. Carried. Trustee Timmings reported a balance of $1,024,098.80 in the General Fund as of May 14, 1984. Trustee Timmings stated that the Treasurer is in the process of calculating anticipated bills and moved that she be authorized to deposit monies in the best source of available rates of interest, seconded by Trustee Buonanno. Carried. This Local Law shall take effect within the time by law. Carried. prescribed Trustee King stated that the committee contacted the Excelsior Garage and Machine Shop as per request of Fire Council for repair work on apparatus and is in the process of obtaining estimates for rJ work. I Trustee King stated that we received a grant of $2280 for six Alt Sensor units in connection with the Stop-DWI Program. PUBLIC WORKS Trustee Salman stated that the notice cited by the Commissioner of Labor regarding the old Village garage was posted. He stated that Miss Levy's request for sidewalk repairs has been been taken care of. The tree request from Mr. Tucci was referred to the tree commission and the 14 Lawrence Avenue sidewalk repair information was sent to the Supt. of Public Works. Trustee Salman gave the following report: 'ihe semi-annual inspection and flushing of hydrants begins tonig between the hours of 9:00 P.M. - 3:00 A.M. The Village proper and \\ubber Park will be effected the first week and Philipse Manor and Sleepy Hollow Manor the second week. Trustee Salman moved, seconded by Trustee Buonanno that action of the public works committee in awarding the contract for the purch. of a 3/4 ton pickup truck with plow for the Water & Sewer Department to Frank Chevrolet in the amount of $13,758.00 be confirmed, seconde by Trustee Buonanno. Funding will be taken from current Water & Se funds. Carried. Bai . balance in the Water & Sewer account as of May 14th is $38 �-5The street department is picking up leaves and small brush on Mondays and Thursday . Rules and regulations will be inserted in the next water bills, sai^i Trustee Salman. The department placed blacktop across the intersection of Munroe Avenue and Millard, Harwood and Kelbourne. Potholes were filled in throughout the Village. Cavein in Fremont Circle has been repaired. Repaired -«nd extended storm drain through easement across 11 Pokahoe Drive. Our contractor, Cimino, in the repair and/or reconstruction of sidewalk and catch basins is approximately 60% complete having concentrated his efforts in census tr.- . t 116 and that portion north of Beekman Ave. Trustee Salman moved, seconded by Trustee King that the previous motion to junk the old police car 504 be rescinded and transferred to the highway department and that the present station wagon being used by the highway department be junked. Carried. • Trustee Salman moved, seconded by Trustee King that a telephone poll be taken on the bids received on the 1% ton dump truck because of a time limit. Carried. Trustee Salman stated that with re^ cd to recent storms, requests for $.,6,000 were filed for aid and after inspection by a team from the Corps f Engineers and the State DOT, we were advised that $43,382 qua'ii es for aid of which $6,640 is for damage to Memorial Field. Work wil 1 commence upon notification from FEMA. Trustee Salman stated that one of our citizens has asked us to look into bus shelters for Beekman Avenue and other areas. He stated that he was in contact with the Westchester County Department of Transportation and was informed that the shelters will be erected at no cost to the Village. RECREATION Trustee Galgano gave the following report: Dad's Club baseball has begun with twelve teams participating. The games are held at Peabody Field. The North Tarrytown Girls' Softball League has started with four teams. Games are held on week nights at the SHHS field. Tiny Tot baseball has begun with 40 children involved. The Annual Bike Rodeo, co-sponsored with the Tarrytown Recreation Department, the Tarrytown and North Tarrytown Police Departments, the YMCA of V"2 Tarrytowns and the Sleepy Hollow React Club was rained out this past Saturday. It has been rescheduled for May 26th at the Morse School. The Men's Softball League will begin on May 21st. Five teams will participate in the league. �-6Ji :Lor Babe Ruth for Tarrytown and North Tarrytown boys ages 13. will h'ive try-outs at Losee Park in Tarrytown on May 19th. The Senio F-ibe l\ith baseball tryouts for North Tarrytown and Tarrytown boys age 16-18 will be held at SHHS baseball field on May 19th at 3 P.M. With regard to the rain damage, Trustee Galgano stated that Mr. Lofaro and representatives from the State reviewed the damages to } \ vries Field, as well as to the areas. We will be receiving some i:. • ?ey for the bridge to Devries Field also, said Trustee Galgano. S si. .ted that Mr. Lofaro took pictures the day after the flood which helped, she said. Without them, we might not have gotten the money MAYOR'S REPORT: Mayor Zegarelli stated that work sessions will be held on May 22 and 24th. The Manager/Administrator meeting will be held on May 23 In view of the fact that Memorial Day will be celebrated on May ?"th, Mayor Zegarelli moved, seconded by Trustee Timmings that th I'.uai meeting be held on Tuesday, May 29th instead. Carried. In view of the fact that work sessions , Conference of Mayors mee and a meeting with the Dept. of Transportation, Mayor Zegarelli moved that one meeting be held during the month of June, June 18, 1984, seconded by Trustee Galgano. Carried. Mayor Zegarelli stated that a speaker will be here to discuss a parking authority and what the pros and cons would be, after whicha report will be epared as to what we can and cannot do. An I Econo 'c Council may be established by local resolution, he said. I Mayor Zegarelli stated that an agreement was made with the First National Bank of North Tarrytown to allow taxpayers to pay their Vill taxes during their normal business hours. Taxes will also be colle at Village hall. We will be looking into the collection of water bil at the bank also, said the Mayor. Mayor Zegarelli stated that a letter was sent to Mayor Barbella calling for a joint meeting of the Boards to discuss the van for seni citizens, as well as other items of mutual interest. Mayor Zegarelli stated that a letter was received from the D.O.T regarding maintenance of State highways as to whose responsibility it rests. The matter was referred to public works. COMMUNICATIONS Communication from Mrs. Nancy Cooper, 225 Kelbourne Avenue, lodging a complaint against the Village for damage done to the water pressure control unit when the Village installed new water meters w.'l read and referred to the public works committee and to the insurance! company who installed the meter, as well as the Village's. | Communication from Murray Productions of New York requesting permission to film a Coca-cola commercial in front of police headquat was read. �o» '<f -7Trustee Timmings moved, seconded by Trustee Buonanno that permission be granted provided that the necessary insurance coverage is submitted. Carried. Communication from Martin Murphy, 219 No. Broadway, requesting sidewalk repairs was read and referred to the public works committee. Communication from Paul Amenta requesting sidewalk repairs at 239-240 North Broadway was read and referred to the public works i. ^mmittee. Communication from Mrs. G. Green, 65 New Broadway, requesting sidewalk repairs was read and referred to the public works committee. Communication from Mrs. Stephen Horecky, 25 Anderson Avenue, requesting curb repairs was read and referred to the public works committee. Communication from Mr. & Mrs. McAuley, 16 Continental Street, requesting sidewalk repairs was read and referred to the public works committee. The Clerk informed the Board that the contract with the SPCA was approved as to form and content. It was at the same rate as last year. Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor be authorized to sign the contract with the SPCA in the amount of $1980. Car Ted. UNFINISHED BUSINESS Trustee Timmings stated that the Technical Service Review Board held a meeting to discuss various * "eas of this building on space requirements. Based on various meetings with department heads and their observations, the Board will meet strictly as a committee for recommendations to department heads and Board of Trustees. Trustee Timmings stated that the Review Board would like to spend some time looking at the old Village garage and. see if it is structurally sound or capable of being restored for possible use of space for department activities. Mayor Zegarelli stated that he will be meeting with a candidate for the assessor position. This will be confirmed at the next meeting, he said. NEW BUSINESS Trustee Timmiugs stated that the Mayor will be installed as the new President of NYCOM in June. A souvenir journal will be published during which the Conference will also be celebrating its 75th Anniversary Trustee Timmings moved, seconded by Trustee Buonanno that the Village of North Tarrytown take a one page advertisement in the NYCOM journal. Carried. Noting a Con Edison bill, Trustee Timmings stated that Con Edisoi should be contacted to ascertain whether or not the bill was passed oi calendar year or summer season. Trustee Salman stated that we should look into the heating syste; of the Village. Some areas are too hot, wtd-la other areas are cold. Date MAY 9, 198U In the past full time village employees have been asked to perform duties beyond their normal duties for various and sundry reasons. To date, there has been no policy established that would outline circumstances in which a full time employee would be paid for -work performed beyond their regular job responsibilities. The Mayor and Board therefore , submit the following guidelines that will stipulate conditions in which additional pay will be awarded by the board. A. The-Board, through resolution must-appoint the person to perform a J' task that is not considered to be part of that persons normal job "responsibility or work routine. No consideration for j-ay will be given without a board resolution. B. The added job responsibility will cause that person to work additional hours ( at office or at home) to complete all the job requirements, in a- time3y manner. If the added task does not cause the person to put in additional hours over and above their normal work day, no additional ~~compensation will be granted. CV If however, the person does work added hours, they will be required to submit to -the board, the date and hours spent beyond their regular work day and a brief description.,of what was done. Ponzini, Village Attorney Part Timers/Unemployment Compensation May 2nd, 1984 You have asked your Attorney to research the minimum qualifications for an employee to claim unemployment compensation from the Village of North Tarry town. This is particularly importaz: in the hiring and retention of part timer workers. Pursuant to Section 527 of the Labor Law of the State of New York, for a valid, original claim to be filed for unemployment compensation, the claimant must meet the following qualifications: 1. Is able to work and available for work. 2. Is not subject to any disqualification or suspension under that article. 3. His previous established benefit year, if any, has expired. 4. Has had at least twenty (20) weeks of env • loyment in the fifty-two (52) week period preceding the filing of such claim. 5 Has earned remuneration averaging at least the minimum average weekly wage provided for in subdivision 5 of section 595 of the Labor Law of the State of New York for at least twenty weeks of employment in such fifty-two week period. - | | These are the guidelines that set forth the minimum requirements an employee to obtain unemployment compensation from the Village of No Tarrytown.
