May 29, 1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Vincent Buonanno William McBride Robert King Susan Galgano Steven Salman, Trustees Robert Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Buonanno moved, seconded by Trustee Galgano that the minutes of the meeting held on May 14, 1984 be approved with the following corrections: The policy for compensation for additional duties adopted refers to salaried-non-union personnel and that on page 8, paragraph 4 should read: when the next police car being replaced by the police department be considered for the auxiliary police. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so. No one appearing before the Board, the regular order of business resumed. REPORTS OF COMMITTEES ADMINISTRATION Trustee Buonanno stated that interviews were held for the position of Village Assessor last week. Mayor Zegarelli stated that the position was discussed with Counsel Ponzini if someone from outside the Village could serve and he stated that there is a provision in the law, so long as the person lives in the same county. Mayor Zegarelli appointed Caroline Prezzano, Village Assessor, at a salary of $2400 per year, effective June 1, 1984. Trustee Timmings moved to confirm the Mayor's appointment, seconded by Trustee Galgano. Carried. Trustee Buonanno stated that the door on the ambulance garage has been refitted. The firemen have requested that the grassy area in the rear of the Municipal Building be converted into a picnic area. An estimate was received in the amount of $350 for material. Labor will be performed by the firemen, said Trustee Buonanno, and moved that the amount of $350 be appropriated for material, seconded by Trustee King. Carried. �,- I -2- Q-L? f> Trustee Buonanno moved, seconded by Trustee Timmings that $3000 be appropriated for the purchase and installation of a trophy case at Union Hose Company, money to be encumbered from this year's budget. Carried. GOVERNMENTAL RELATIONS Trustee McBride stated that he is in receipt of two publications from the N.Y.S. Environmental Commission regarding fresh water wetland The booklets are in the Village. Trustee McBride stated that he received a copy of a letter that Congressman Ottinger sent to the Secretary of the Dept. of Energy in Washington regarding the shipping of radio active materials from the Department's Brookhaven National Laboratory on Long Island through New York. '• J Trustee McBride stated that Congressman Ottinger informed the department that he intends to work closely with the department, as wel as N.Y.S. officials to ensure that the planning and execution of this eff ort is done with the full understanding and involvement of responsil representatives of the people who live near the selected transportatio routes. Following a discussion, Trustee McBride moved, seconded by Truste Buonanno that a letter be sent to Feder and State representatives supporting Congressman Ottinger's position that the transportation rou be re-directed from Westchester County. Carried. Trustee McBride stated that Mayor Zegarelli will be installed as President of the N.Y.S. Conference of Mayors on June 13th. Arrange ments for bus transportation leaving from General Motors will be provii If;. MANAGEMENT-BUDGET Trustee Timmings reported a cash balance of $156,028.02 in the General Fund as of May 29, 1984. Kltl - Trustee Timmings moved, seconded by Trustee Buonanno that action! of the Treasurer in depositing $500,000 in c. d. notes with the First National Bank of North Tarrytown at 8%% interest, be confirmed. Carrie^ L' f'mi. - ' l"i,,M| Trustee Timmings stated that talks were finished with the fact finder for the teamsters and the State Fact Finder will write a report and recommendation. Trustee Timmings stated that the police binding arbitrator confin the date of June 20th at 10 A.M. in the Municipal Building. Trustee Timmings stated that a police grievance was signed seven. weeks' ago. The matter was discussed informally. An interpretation o the agreement which was made will be presented to the Board for approvi by the police PBA, he said. , ! 1 If VI fi' I* " S !• ) ?Ul • Trustee Timmings stated that we have one employee who has been out on sick leave in excess of two years. State law protects an employee for one year, he said. He may within one year of his employment's termination make out an application to the N.Y.S. Civil Service Commiss for reinstatement to his position. Civil Service will arrange a physii examination to determine his fitness for duty. �-3Trustee Timmings moved, seconded by Trustee King that Counsel send a letter to the employee terminating his employment, effective immediately. Carried. ' Trustee Timmings mvoed that the Treasurer be authorized to make the necessary transfers and adjustments for the year end closing, seconded by Trustee Buonanno. Carried. PUBLIC WORKS Trustee Salman gave the following report: The department completed the semi-annual inspection and flushing of fire hydrants. Responded to call out to College Arms for a broken water pipe in an apartment. Water was shut off to the broken area. Bank balance as of May 29, 1984 - $41,844. Replaced sidewalk slabs lifted by tree on New Broadway. Area around Margotta Courts parking lot was cleared. Planted flowers in .front of the Municipal Building, island at Beekman Avenue and Broadway and in flower boxes along the wall in front of Morse School. Cimino Contracting Company is approximately 80% completed on the renovation of catch basins and sidewalks in census tract 116. Trustee Salman moved, seconded by Trustee Buonanno that action of the committee in awarding the one-half ton 4 wheel drive dump truck with plow to Willow Motors Company in the amount of $17,100 be confirmed Funding from current budget. Carried. Based on the work session of May 24th, Trustee Salman moved that in addition to the Superintendent of Public Works and Police Department in issuing summonses for littering, Parking Enforcement Officers and all foremen in the Public Works Department shall be authorized to issue summonses also, seconded by Trustee Buonanno. Carried. Trustee Salman stated that there have been many requests for sidewalk repairs and Mr. Biros is sending each individual person a contract. Areas for the shelters will be discussed, said Trustee Salman. Trustee Salman stated that the letter received last week from a resident regarding damage due to the installation of a water meter, to the pressure valve, was answered. �-4- Trustee Salman stated that according to a report from Gus Paese he feels that since the culvert is old it would not be worth spendim the $50,000 for improvements. Basicly, it is in good shape and it has been suggested that we consider erecting "No parking" signs, alow the southbound side of Broadway on the culvert side, J^^t^^c^u. PU/<^ Trustee Salman stated that the highway department is in need of a truck with a spreader to replace the Oshkosh for an estimated amount between 90 - 95,000.00. The sanitation department is also in need of a truck to replace the Brockway at an estimated cost of $90 \ RECREATION Trustee Galgano gave the following report: The Bicycle Rodeo, co-sponsored with the Tarrytown Recreation Department was held on May 26th with twenty children participating. Trophies were given to 1, 2 and 3rd place finishers. The summer brochure is out. Men's Softball started last week. General Motors Softball League began today with seven teams competing Pool applications are available for the Mt. Pleasant Pool. PUBLIC SAFETY Trustee King stated that a bid was received for street light maintenance for one year and moved that Edward McCarthy be awarded the bid for street light maintenance commencing June 1, 1984 - May 31 1985 in the amount of $7,000, according to specifications, seconded b Trustee Timmings. Carried. Trustee King stated that the owners of College Arms was given six months to replace the incinerator with a compactor, but no action has been taken for the conversion. Mayor Zegarelli stated that a letter was sent to the owners on behalf of the Board reiterating the Village's position and that all A matters will be turned over to the Village Attorney and Prosecutor. I Trustee Timmings moved, seconded by Trustee Buonanno that the * Mayor's action be confirmed. Carried. Trustee King moved, seconded by Trustee Buonanno that a letter be sent to Fire Council as to the status of the fire inspectors. Can Trustee King stated that the Chief received a letter from the Principal of the Park Early Childhood Center in appreciation for the dog demonstration to the children and staff by Ptl. Kiggins, as well as to the police officers and their dogs and moved that the letter be placed in Ptl. Kiggins' folder, seconded by Trustee Timmings. Can Trustee King stated that the Chief received a letter from Dr. Ni Emergency Department of Phelps Memorial Hospital, commending Sgt. Hayward and Ptl. Morrison for their quick action which saved a person life and moved that the letter be placed in their folders, seconded by Trustee Timmings. Carried. �5U9 -5Trustee King stated that discussions have been held on the possibility of increasing parking meter fees and moved that a public hearing be held on June 18th on parking meter increase, seconded by Trustee Timmings. Carried. Trustee King stated that police interviews were held last Wednesday with Trustee McBride and Chief Spota. At this time, Trustee King moved, seconded by Trustee Buonanno that the Board meet in executive session to discuss a personnel matter. The Board resumed the meeting. Trustee King stated that it has been recommended that one police officer be appointed, a second one will be appointed in the near future. Trustee Salman moved, seconded by Trustee McBride that John DiCairano be appointed Patrolman, subject to twelve weeks' probationary period at a salary of $17,135 per annum, effective June 11, 1984. Mayor Zegarelli polled the Board as follows: Trustee Timmings - Yes " ' Buonanno -* Yes " McBride - Yes Mayor Zegarelli voted "Yes". Motion carried. Trustee King - Abstained " Galgano - Yes " Salman - Yes MAYOR'S REPORT: Mayor Zegarelli stated that a Parking Authority was discussed during a work session of the Board during which Mr. Gilbert Bonforte of the Mt. Kisco Parking Authority outlined procedures involved. Based on the initial meeting and discussion, Mayor Zegarelli moved that Counsel Ponzini be authorized to commence the necessary work for the establishment of a Parking Authority, seconded by Trustee Buonanno. Carried. Mayor Zegarelli stated that the matter of a pay phone be investigated. Jurors who have to appear in night court have no access to a phone to call their homes. He mentioned a possibility in the lobby of the building, however, it was suggested that one be placed in the immediate vicinity of the building. Mayor Zegarelli stated that he was talking to Mayor Barbella of Tarrytown and learned that his Village belongs to the Chamber of Commerce and asked Trustee Buonanno to look into the matter as to how much it would cost the Village to become a member. Mayor Zegarelli stated that the Board is in receipt of a request from the Cable TV for an increase in rate to subscribers and moved that a public hearing be held on June 18, 1984 on rate increase, seconded by Trustee Galgano. Carried. �-6- Mayor Zegarelli stated that a letter has been received from the Taconic State Park to deed over Gory Brook Road. He stated that he received many comments from property owners in opposition and moved? he be authorized to send a letter on behalf of the Board that we do not intend to change the status of Gory Brook Road, seconded by Trust Buonanno. Carr ied. Mayor Zegarelli reminded Board members that we will be hosting a meeting on June 7th at 7:30 P.M. in Central Fire Headquarters durii which officials from D.O.T. will review the data presented in the Route 9 summary report and discuss how to proceed with the study eff Officials from neighboring municipalities will also attend. Mayor Zegarelli stated that St. Ann's Sodality of the Immaculat Conception Church is celebrating its 50th Anniversary and moved that proclamation be presented in their honor, seconded by Trustee Buonam Carried. With regard to the sales tax proposal, Mayor Zegarelli moved tha letters be sent to our Assemblymen and Senators endorsing the Westche County Village Officials' plan regarding the increase and distributio of the County sales tax, seconded by Trustee Buonanno. Carried. COMMUNICATIONS Communications from Edward Belliveau requesting sidewalk repairs at 147-149-151 Cortlandt Street and 179 Beekman Avenue were read and referred to the public works committee. Communication from Stanley Baker, 38 Lawrence Avenue, regarding trees in front of his property creating a safety hazard was read and referred to the tree commission. Communication from Sec'y. of Fire Council Richard Green, regard! requests of Union Hose Company to take its apparatus and the Chiefs I cars to Montrose on August 11th, Columbia Hose Company to Elmsford ol August 4th was read and on motion of Trustee King, seconded by Truste Buonanno, permission was gran-ted. Carried. Communication from Sec'y. of Fire Council, Richard Green, regard changes in membership in Union, Rescue and Columbia Hose Companies wa read and on motion of Trustee King, seconded by Trustee Timmings, ac of Council was confirmed by the Board. Carried. UNFINISHED BUSINESS . « Trustee fcing stated that a proposal has bee'n drafted for the Vil automobile policy. He read the draft which will be sent to departmen heads for comments which should be made by April 18th. Mayor Zegarelli so moved, seconded by Trustee Galgano that the comments be made to either their committee chairmen or to Trustee Kin after which it will be adopted or modified as the Board sees fit. Carried. �- * * / -7NEW BUSINESS On the advice of Counsel, Trustee Timmings moved that the Village pay the dental insurance fund to the Teamsters Union at $150 per man, 20 men, for one year, seconded by Trustee Buonanno. Carried. Trustee Timmings moved that a portion of this dental insurance affecting water department employees be charged to the water department, seconded by Trustee Buonanno. Carried. Trustee Timmings moved that the Treasurer encumber appropriate funds against this year's budget for all those Village employees who have not been given increases, seconded by Trustee Buonanno. Carried. Trustee Timmings stated that this is the closing out of the budget year and moved that the Treasurer be authorized to over-time capabilities where she will document overtime hours worked and be paid accordingly, seconded by Trustee Buonanno. Carried. Trustee King stated that he, together with the Mayor, attended a meeting regarding the Rockefeller State Park on potential additional needs in servicing the Rockefeller State Park with our fire department and ambulance. There is funding available for reimbursement to the Village, he said. He stated that his committee will look into the cost of hiring a consultant for these funds. Trustee King stated that the SEAS car was placed in use on Monday and Saturday nights. Trustee Salman suggested that some sort of system be developed in order to identify house numbers at night in the event of an emergency, There is a lack of visility of addresses on homes, he said. The matter will be investigated. if''"' Trustee Buonanno moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water and Sewer warrants dated May 29, 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolutioj be attached to the warrants. Carried. 4.1 .11 There being no further business to come before the meeting, Trustee Buonanno moved, seconded by Trustee Galgano that the same be duly adjourned. Carried.
