Present Philip E. Zegarelli, Mayor James J. Timmings William McBride Robert King Susan Galgano Steven Salman, Trustees Robert J. Ponzini, Counsel Absent Vincent J. Buonanno, Trustee Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee King moved, seconded by Trustee Galgano that the minutes of the meeting held on May 29, 1984 be accepted with two minor corrections Carried. Mayor Zegarelli read the notice of hearing on a proposed increase in rates by American Cable TV and asked if there was anyone present who would like to address the Board. Mr. Robert Bartlett, General Manager of American Cable, cited several reasons for their request for an increase, i.e. the addition of nine services, the rise in cost for electricity, gasoline, etc. He stated that the company was asking for a 9.95 increase. ' Mrs. Emilie Spaulding, Gov't. Community Director of Cable, stated that the company has made a tremendous effort to improve customer service.] She stated that it takes awhile to resolve problems, but there is an on-going effort to correct them. * Mr. Angel Fernandez, also representing the company, stated that next year, they will be increasing the channel capacity to 52 channels. Ms. Lisa Kuhn, Program Director, stated that they are making facilities a lot better. No other comments, Mayor Zegarelli moved that the hearing be closed, seconded by Trustee Salman. Carried. Mayor Zegarelli read the notice of hearing to consider a proposed Local Law #3 to amend Section 57-32 which would increase the parking meter fee to one dime for one-half hour and to amend Chapter 19A-1 which would increase the meter fine to $7 and asked if there was anyone present who would like to address the Board. w u 1 v • �-2Mr. John Carroll, 140 Hunter Avenue, suggested that the revenue from the parking meters be used to set up a library branch, as well as using the extra revenue for the hiring of additional police officers. On a question as to why the increase in the meter increase, Mayoi Zegarelli stated that the Board is considering a parking authority. ] money will be used towards the purchasing of property for parking are; We are the lowest in parking meter fees, said the Mayor. No other comments, Trustee Galgano moved, seconded by Trustee Sale that the hearing be closed. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter. Mr. Robert Carpenter, Pocantico Street, inquired about the status of the Aruj Service Station. He stated that the first complaint was made about a year ago and nothing has really been done about the situat Mr. Margotta, Building Inspector, stated that he has a ligitimate problem. Mr. Carpenter is living in an area allowing gas stations, he said. He talked to Mr. Aruj and was told that several cars in the lot belong to his employees and the other cars he claims that are abandoned were bought by Mr. Aruj. Following a discussion, Counsel Ponzini suggested that Mr. Carpent meet with Mr. Margotta and the Village Prosecutor to go over each item and if an item warrants prosecution, Mr. Peirce will handle the matter. REPORTS OF COMMITTEES ADMINISTRATION ADMINISTRATION A r^r . /&v^. / 0 J ,s J / J In tho ^bocnee of Truatce Buonanno/ Trustee King stated that an estimate was received from Mr. Zambelletti for a trophy case in Union Hose Company and moved that Mr. Zambelletti be authorized to install the case in the amount of $3240, of which $3000 will be taken from the 82-83 budget and $240 from the 84-85 budget, seconded by Trustee Galgano. Carried. Trustee King stated that painting has begun in the ambulance garaj Trustee King reported that eleven building permits were issued by the building inspector during the month of May totaling $260. GOVERNMENTAL RELATIONS Trustee McBride stated that the Warner Library issued a summer news bulletin. He noted activities which will be held. Mayor Zegarelli stated that Trustee Salman has requested that be be removed from the Library Board. Mayor Zegarelli appointed Trustee Galgano to serve as North Tarrytown's representative. �33f Trustee King moved to confirm the Mayor's action, seconded by Trustee Salman. Carried. MANAGEMENT AND BUDGET Trustee Timmings stated that through the efforts of independent contacts, the committee believes that they have an understanding with the Teamsters that could be beneficial to the Village. Trustee Timmings moved that John Vincek, Floyd Rhein and Joseph Bozelli be appointed Heavy Motor Equipment Operator, retroactive to June 1, 1984, seconded by Trustee McBride. Carried. Trustee Timmings stated that at the last meeting, he reported that through a handshake method, a grievance was settled, however, a formal hearing has been requested. He stated that a letter was written to the President of the Police Bargaining Unit for an available date so that we can proceed with this matter. With regard to the summer schedule, Mayor Zegarelli moved, seconded by Trustee King that the meetings be held on the following dates: July 16 and August 13th. Work session be held on June 27th. Carried. Trustee Timmings noted that at the close of the 82-83 budget, it was indicated that one of our problems was that we had in excess the total salary and benefit package. Until we find other sources of revenue, we will continue to be close to the constitutional tax limit, he said. Any community that is taxing in excess of 90% of its tax limit is considered to be a bad financial risk. Imposition of the county sales tax would improve the position of the Village, said Trustee Timmings. PUBLIC SAFETY Trustee King moved that the following police report- for the month of May be made part of the minutes, seconded by Trustee Galgano: (copy in detail official minutes) Trustee King stated that he met with the Chief regarding the scofflaw program which will be resumed. Two patrolmen were assigned to this program and the amount of $1500 was collected in outstanding fines. Trustee King moved, seconded by Trustee Timmings that the Chief of Police be granted permission to attend the Association of Chiefs Conference in Albany, from August 26-30, with expenses, seconded by Trustee Timmings. Carried. Trustee King stated that he is in receipt of a list of signs to be painted, as well as replacing and 25 meters which are in need of repair. Trustee King moved, seconded by Trustee Salman that the Fire Chief's car which was damaged be painted and money to come from the existing Fire Department budget. Carried. We received $1500 from the insurance company for.the paint job, said Trustee King. �-4• Trustee King stated that the police committee has recommended that we temporarily increase the police force from 25-26 men. Ptl. John Thomas has been out on disability and quite probably will not return. If we hire a new police officer now, he will not become atr -^hAiuHfi-**~2& officer until November or December, said Trustee King. He stated ^ ^ that the Village is paying a lot of overtime. In order to try to alleviate this, Trustee King moved that the police force be temporar increased from 25-26 men, seconded by Trustee McBride. On the question, Trustee Timmings stated that it was agreed and compromised in the current Village budget that we would replace Ulac There is no funding in the budget for the individual's benefit. The proposal to add another man puts an unbudgeted salary and benefit loa on the taxpayers of the Village. We have some very distinct financia problems, said Trustee Timmings. To put some financial burden in the budget is the sort of thing to make the situation worse. Trustee McBride stated that there is a man on disability and inquired as to how much the Village is paying. l - Mayor Zegarelli answered that compensation is paying 2/3rds and the Village 1/3. Trustee McBride stated that we need the manpower. measure everything by the dollar, he said. You cannot Trustee Timmings stated that before we were going to appoint j another person, we were going- to evaluate the impact of overtime. Trustee Salman stated that we had gotten definite information. I He stated that he had spent some time with the Chief looking at over| time and schedules. There were over 1300 hours of overtime and men working double shifts. They were working eight days with one day off, he said. , ; | : Trustee Timmings stated that for some period of time, the police department had a limited or concentrated vacation schedule, bu as a result of collective bargaining, the present vacation schedule i spread over the entire year. If we're not spreading the vacations ou we have a management problem. Trustee Galgano stated that when we had the budget meeting, it was agreed to 24 working people at the time and consider the 25th when Thomas was off. She stated that she does not see^how the situation changed. Mayor Zegarelli polled the Board on the motion to temporarily increase the police force: Trustee Timmings " McBride - No - Yes Mayor Zegarelli voted "Yes". Trustee King - Yes " Galgano - No " Salman - Yes Motion carried. �^34, -5On the reconimeridatiori of the police committee, Trustee King moved, seconded by Trustee McBride that Jimmy Warren, Jr. be appointed police officer, effective July 2, 1984 at a salary of $17,135 per annum, subject to twelve weeks' probationary period. Mayor Zegarelli polled the Board as follows: Trustee Timmings McBride - Yes - Yes Mayor Zegarelli voted "Yes". Trustee King - Yes " Galgano - Yes " Salman - Yes Carried. Mayor Zegarelli moved to transfer money from Contingency Fund to the police account to cover Mr. Warren's salary, seconded by Trustee McBride. Trustee Timmings questioned the money for Ptl. DiCairano's salary. Mayor Zegarelli stated that it would be funded out of "PoliceOther. Trustee Timmings stated that we did not agree to find the position. He stated that he had nothing against the appointee. The money is not there, he said. The Board acted in totally irresponsible fashion, he said. The money will come out of Chief Spota's budget and replenish other sources of area. Trustee King moved to confirm, seconded by Trustee McBride. Carried PUBLIC WORKS Trustee Salman gave the following report: The department excavated, repaired and backfilled sanitary sewer on Kelbourne Avenue, as well as repairing the service line damaged by Con Ed on upper Hemlock Drive. Water service line was replaced and the sanitary sewer damaged by the contractor who is building a home on Farrington Avenue was repaired. Defects in hydrants were repaired. Bank balance as of June 15th is $20,288.94. The department excavated and repaired the storm sewer manhole on Depeyster Street, near Valley. Defective sidewalks on New Broadway, Maple Street, Broadway, Depeyster and Elm Streets were repaired. Responded to chemical spill at Duracel. Chemical was absorbed with sand after which it was swept up. Duracel completed the cleanup that afternoon and the next morning. Catch basin on Washington Street was repaired. Cimino Contracting is now finished his basic catch basin, sidewalk rehabilitation contract. Since this is a unit price contract and our grant is for $95,000, the contract was extended for an additional 1200 sq. ft. of sidewalk. �-6- I Trustee Salman moved, seconded by Trustee McBride that the I Village pay for a cat scan for one of our highway employees. Carrie* Trustee Salman suggested that we retain an architect for an m evaluation of the old greenhouse for storage of salt. The name of I Ronald Turnquist was suggested, since he had done previous work for I the Village. m The payloader developed a crack in the engine due to overheating since the radiator was found to engine was replaced by a reconditioned one by Karl expert who has his shop around the corner from our blockhead, probaM be clogged. The I Sterling, a dieselB garage. I The controls for the salt spreader and plow on the Walters have! been giving us some problems this past winter. Karl Sterling is now! in the process of making these controls more positive. I The steering and front end of the backhoe has failed. We are I presently replacing the working parts of this unit in our shop. RECREATION Trustee Galgano gave the following report: Dad's Club baseball concludes its season this Saturday with the Minor and Major All Star Game at Memorial Field. An award ceremony will be held between games. The Girls' Softball League concluded its season with the Rockets winning the league title. Babe Ruth baseball and Teen Girls Softball will start early in July with games held at SHHS. There are still openings for Teen Girls Softball for 8, 9 and 10th grade girls from the Tarrytowns. The Tiny Tot Baseball program will be extended one week because o several rainouts, the World Series game against the Tarrytown Pee Wees will be played on June 30th at the Pennybridge School field. Tennis lessons for all age groups are available for North Tarryto residents. The registration deadline will be extended until Friday. We have had some 250 inquiries for the Mt. Pleasant pool off Route 117. Anyone interested in obtaining an application should conta the recreation department. The Men's Softball League will start playing teams from Irvington Recreation department league beginning tonight and will continue for three weeks. Trustee Galgano stated that a letter of thanks was received from Gerald Barbelet thanking Patrick Lofaro for co-sponsoring the Tarryto1 entry into the Harvey School Spring High School Hockey League. The team comprising of thirteen students from the Tarrytowns tied for thi in the six team league. �33i -7With regard to the summer help at the Day Camp Center, Mayor Zegarelli designated the following people and Trustee Galgano moved to ponfirm the same, seconded by Trustee King: (in detail official minutes) Trustee Galgano stated that the Recreation Commission interviewed candidates for Park Foreman. The person selected cannot take the position until December, however, he will work part-time and so moved that R. Volpacchio be appointed part-time at $5.50 per hour, seconded by Trustee Timmings. Carried. Trustee Galgano stated that the Village officials of Tarrytown will be challenged to a softball game, the date being scheduled for September 8th. MAYOR'S REPORT: Mayor Zegarelli stated that a meeting was held with representatives from DOT regarding work to be done on Route 9 and another meeting will be scheduled with representatives from the Manor Associations, Restoratiot etc. Mayor Zegarelli moved that based on additional work demands on the new Village Assessor, her salary be increased from $2400 - $3600, effective retro-active to June 1, 1984, seconded by Trustee King. Carried Mayor Zegarelli stated that the Town of Mt. Pleasant had sent through the mail, notices to residents in Philipse and Sleepy Hollow Manors that their land values were increased. The Town Office was deluged with phone calls. He stated that he talked to Mr. Rovello and was informed that the Town Board would rescind the increases in the land assessment. The Village had no part or involvement in the increase of individuals' land assessments, said the Mayor. Mayor Zegarelli stated that he is in receipt of a letter from D.O.T. regarding CHIPS money which has been funded in the State budget. \y> Mayor Zegarelli stated that the sales tax proposal is dead. The Mayor of White Plains sent him a suggested replacement proposal. M' Trustee Timmings stated that he was willing to go with the Village Officials plan more so than with the County plan. Mayor Zegarelli stated that he sent Duracell a bill of expenses incurred at their plant during which our fire department and highway department had responded to a spillage. In answer to our letter regarding Gory Brook Road, the State Office of Parks, etc. have asked us to reconsider their request to purchase part of the road, said the Mayor, however, he did not see how we could reconsider it at all. Mayor Zegarelli noted that Lyndhurst will be open to the public on June 24th from 10 A.M. - 5 P.M. free of charge. " F': �-8COMMUNICATIONS * Communication from E. Mulcahy, 15 Depeyster Street, requesting that the tree in front of her property be inspected was read and j referred to the public works committee and tree commission. Communication from A. Lynch, 24 Pine Street, requesting investigation of a tree trunk in front of her residence was read and referrei to the public works committee and commission. Communication from Josephine Moore, 167 Beekman Avenue, requestii that a tree be planted in front of her residence was read and referret to the public works committee. Communication from John White, 296 No. Washington Street, request sidewalk replacements was read and referred to the public works commit Communication from Salvatore Baglieri, 35 Elm Street, requesting the removal of a dead tree was read and referred to the public works and tree commission. Mayor Zegaralli acknowledged receipt of a letter in answer to his from the North Tarrytown Realty Associates (100 College Avenue) regard his incinerator. Mayor Zegarelli acknowledged receipt of the Senate/Assembly Bill concerning the amendment of the General Municipal Law which increases fees paid for court costs. Mayor Zegarelli acknowledged receipt of a letter from Con Edison that they are going to turn off the electricity on property owned by Mr. Pichardo, Cortlandt Street. Mayor Zegarelli thanked everyone who attended the N.Y.S. Conferenc of Mayors Banquet at Grossinger's during which he was installed as President. He stated that the Presidency brings honor and distinction to the* Village, as well as himself. We will have a good year, he said. UNFINISHED BUSINESS Trustee Timmings reported a cash balance in the General Fund as of June 18, 1984 of $219,637. Trustee Salman stated that a vacation schedule time table was discussed during a work session for public works employees. Trustee Timmings stated that there are terms in it that are not in agreement with the contract and requested that the matter of adoptii it be postponed. Trustee Salman gave the following recommendations from the tree foreman•(John Arcate, Jr.) regarding property owners* tree requests: �3Yo -9• 15 Depeyster St.(l) - Tree is in need of pruning. 65 New Broadway (1) Tree is young and healthy, could be thinned by pruning. 21 Pine Street (1) - Tree is in need of remedial pruning, but not hazardous or old and decayed. 38 Lawrence Avenue (2) - One tree is dead and the other is showing minimal signs of life. Could be a disease affecting the trees. Feels they are following their natural end. Trustee Salman discussed the letter received from Mrs. Cooper regarding her water meter with Mr. Biros who contacted her plumber. The plumber denies the situation occurred, said Trustee Salman. He will write her another letter, said Trustee Salman. Trustee King stated that he has received comments from different department heads regarding the use of Village vehicles policy. Following a short discussion, Trustee King moved, seconded by Trustee Salman that the following policy be adopted;effective June 18, 1984: 1. Village vehicles are not to be considered personal vehicles. All Village vehicles assigned to specific department heads or employees are to be utilized in the execution of your respective responsibilities for the Village. This includes those normal and routine situations which require your presence during various days and times outside normal business hours. 2. It is the policy of the Mayor and Board of Trustees that the use of a Village vehicle for official use within Westchester County does not require permission of the respective chairman of your Trustee committee. Any use of the vehicle outside the County of Westchester requires the minimum of notification and approval by your respective Trustee Chairman, 3. Village vehicles are not to be utilized for personal use such as travel to and from work, vacations, shopping and family use with the exception of: A) Police Chief within Westchester County as he would be able to respond to an emergency when notified by radio. B) Fire Chiefs within Westchester County if and only if they would be able to respond to an emergency when notified by radio or other means. The Fire Chiefs should notify the Police Officer on the desk as to his whereabouts, should he need to be notified. 4. In order to protect the Village from possible insurance claims, it shall be the policy that non-Village personnel shall not operate, nor be a passenger in a Village vehicle. The exception being when such persons are accompanying a Village official to a Village-related event, such as a firemen's dinner. 5. While there will be cases where exceptions may be necessary, this policy is to take effect immediately. Violations of the policy will be handled by the Mayor and Board of Trustees as a whole and can include suspended use of the vehicle, monetary penalty and/or the elimination of the vehicle from your responsibility. Consideration of this situation should be considered also in the personal context. This includes the possible suspension of the Village's insurance coverage, not only for the vehicle, but for the person utilizing the vehicle where an accident �-10or other liability may occur. party of last resort. Carriec Mayor- Zegarelli stated that a letter was received from HUD regard Section 8 Housing and will invite Mr. Hordell to discuss some of the items in the letter. Trustee King moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated June 18 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attach* to the warrants. Carried. There being no further business to come before the meeting, Trustee Galgano moved, seconded by Trustee King that the same be duly adjourned. Carried.
