NORTH TARRYTOWN, N.Y.

A special meeting was held before the Board of Trustees of
the Village of North Tarrytown on the above date.

Mayor Zegarelli called the meeting to order at 10:00 P.M. and
stated that the purpose of the meeting was to discuss American Cable's
request for a rate increase. Hearing was held on June 18th.
Following a discussion, Trustee Buonanno moved, seconded by
Trustee Galgano that the following resolution be adopted:
WHEREAS: The Village of North Tarrytown awarded a cable television
franchise to McLean Cable TV, Associates in August 12, 1977 and
WHEREAS the Village approved the transfer of said franchise to
ACNY on June 13, 1983, and
WHEREAS the franchise was assumed by ACNY on September 13, 1983,
and
WHEREAS ACNY has applied to the Village for an amendment of
Section 12 of said franchise, and
WHEREAS Section 12.2 of said franchise prescribes a procedure
for amendments relating to rate changes, and
WHEREAS pursuant to Section 12.2 of said franchise and Part 592
of the rules of the New York State Commission on Cable Television,
a public hearing to consider the proposed amendment was held, upon
due notice to the public, on June 18, 1984, and
WHEREAS the Village Board has considered the proposal of ACNY
and the comments of the public as expressed at the public hearing,
NOW, THEREFORE, BE IT RESOLVED that:
Section 12 of the Cable Television franchise for the Village of
North Tarrytown is amended to read as follows:

�Section 12.1;
Rates: Grantee may charge subscribers for or in connection with
basic CATV service hereunder only those rates which are specified
in Schedule B, attached hereto and made a part hereof, unless
changed as provided in Section 12.2 hereof.
Section 12.2s
Rate Changes; Grantee may, from time' to time during the term
hereof, request, in writing. Municipality approval of a change in
rates. The Chifrf Administrative Officer shall set a date for a
public hearing before Board thereon and shall cause a notice of
such hearing to b« published, in a newspaper of general circulation
within Municipality at least 10 days prior to the date specified
for the hearing* At the time set for the hearing. Board shall
proceed to hear the matter. Followini such hearing Board shall
decide whether any such requested rate change shall be approved in
whole or in part.
If Board approves any such requested change in whole or in part,
Grantee shall then request approval from Commission in accordance
with the Commission's procedures.
Following approval by Board and Commission, if such events occur,
Grantee may institute the new rate Is) effective on such date not
earlier .than 60 days from the date of Grantee's request for rate
change as. Grantee may elect.
